1 The 212 th meeting of the State Expert Appraisal Committee (SEAC) was held on 7 th August, 2015 under the Chairmanship of Shri K.P. Nyati for discussion on the query responses submitted by the PP and the projects / issues received from SEIAA. The following members attended the meeting- 1. Dr. Manoj Pradhan 2. Shri A.A. Mishra, Secretary The Chairman welcomed all the members of the Committee and thereafter agenda items were taken up for deliberations. In view of the Directions passed by the Hon, able NGT in the Review Application No. 18 of 2015 dated 24/07/2015, followed by the directions of SEIAA, the meetings of State Expert Appraisal Committee were scheduled from 7 th to 11 th August 2015 exclusively for the sand mining projects of M.P. State Mining Corporation. Initial scrutiny of the applications revealed that most of these applications are incomplete in respect of mandatory documents. The same was intimated to the concerned OICs by SEIAA as well as SEAC. After fixing the dates for SEAC meetings the project proponents were requested to furnish the requisite documents during meeting. In meeting it was informed by the representatives of the Mining Corporation that mandatory documents required for appraisal of various projects is available only for a very few projects and procurement of necessary documents / certificates for most of the projects shall still require some time. Committee decided to appraise those projects where needed information was available, hence the 05 days meetings were re-scheduled only for two days. Accordingly, the 212 th meeting was conducted on 07/08/2015 and the 213 th meeting on 08/08/ Case No. 2720/2015 Shri Raj Kumar Nema, OIC, Sub Off., M.P. State Mining (MP) Neelkanth River Sand Quarry Lease Area ha., Capacity -, Capacity - 1,00,000 cum/year, at Village-Neelkanth, Tehsil-Nasrullaganj, District-Sehore (MP) This is a river sand quarry. PP has submitted certificated issued from DFO, Tehsildar and Mining Officer. Mining Officer has reported vide letter no dated 16/07/2015 that no mine is operating / proposed in 1000 m from the periphery of the said mine. Tehsildar has reported that the confluence point of two rivers from the project boundary is 300 meter. Scrutiny of the Mining plan submitted reveals following deficiencies specific method of extraction is not proposed. capacity, infra-structure /machinery to be deployed/ man-power required, number of working days excluding monsoon season. Similarly, the EMP furnished is replication of general activities whereas the same is expected to be site-specific. The EMP does not include likely adverse impact of the mining activity on the followings and measures proposed to mitigate the impacts: 1. Land degradation, bank erosion, flood plains etc 2. Stability of structure like bridge/embankment etc if any in the close vicinity 3. Riparian and in stream habitant Page1
2 4. Ground water quality and level 5. Health and safety of the nearby habitation expected to be exposed to the impacts from sand mining / transportation. 6. Approach road proposed to be used for transportation of the sand. 7. The protection / restoration plan for river banks based on their conditions. Owing to the above discrepancies PP was asked to submit the revised Mining Plan and sitespecific EMP through SEIAA. Accordingly it was decided to return the case to SEIAA. 2. Case No. 2722/2015 Shri Raj Kumar Nema, OIC, Sub Off., M.P. State Hoshangabad - Babri River Sand Quarry Lease Area ha., Capacity -, Capacity - 1,10,000 cum/year, at Khasra No. 137/1, Village-Babri, Tehsil-Seoni Malwa, District- Hoshangabad (M.P.). This is a river sand quarry. PP has submitted certificated issued from DFO, Tehsildar and Mining Officer. Mining Officer has reported vide letter no dated 30/07/2015 that 01 more mine is operating / proposed in 1000 m from the periphery of the said mine and the cumulative lease area is 32 Ha. By virtue of the total lease area within 1000 meter the case falls under category B-1 hence PP is required to prepare EIA. During discussion it was observed that are some more mines within 1000 meter from the periphery of this cluster hence over all extent of the cluster is still not clear. PP was asked to submit the clarification in this context. It was decided to consider the case for scoping after receipt of the details of cluster in terms of number of operating / proposed projects in the cluster and the cumulative lease area of the cluster. Beside above PP was also directed to revise the Mine Plan in light of following comments of SEAC: capacity, infra-structure /machinery to be deployed/ man-power required, number of working days excluding monsoon season. Owing to the above discrepancies PP was asked to submit the revised application stating details of cluster, revised Mining Plan and EIA based site-specific EMP through SEIAA. Accordingly it was decided to return the case to SEIAA. 3. Case No. 2723/2015 Shri Raj Kumar Nema, OIC, Sub Off., M.P. State Hoshangabad (MP) Kesla River Sand Quarry Lease Area ha., Capacity -, Capacity - 1,18,800 cum/year, at Khasra No. 432/1, Village-Kesla, Tehsil-Itarsi, District-Hoshangabad (M.P.) This is a river sand quarry. PP has submitted certificated issued from DFO, Tehsildar and Mining Officer. Mining Officer has reported vide letter no dated 21/07/2015 that no mine is operating / proposed in 1000 m from the periphery of the said mine. A bridge has been reported at 300 meters from the project boundary. Scrutiny of the Mining plan submitted reveals following deficiencies Page2

Similarly, the EMP furnished is replication of general activities whereas the same is expected to be site-specific. State Hoshangabad (MP) Dimawar River Sand Quarry Lease Area ha., Capacity -, Capacity - 58,000 cum/year, at Khasra No. 107, Village-Dimawar, Tehsil-Seoni Malwa, District-Hoshangabad (MP)- TOR This is a river sand quarry. PP has submitted certificated issued from DFO, Tehsildar and Mining Officer. Mining Officer has reported vide letter no dated 30/07/2015 that 01 more mine is operating / proposed in 1000 m from the periphery of the said mine and the cumulative lease area is 27 Ha. By virtue of the total lease area within 1000 meter the case falls under category B-1 hence PP is required to prepare EIA. After deliberations committee suggested for addressing following TORs in addition to the standard TORs prescribed by MoEF & CC: 1. The study area shall be delineated considering all the mines operating or proposed in the cluster. 2. Land use of the study area should be described delineating forest area, agricultural land, grazing land, wildlife sanctuary and national park, migratory routes of fauna, water bodies, human settlements and other ecological features should be indicated. Land use plan of the mine lease area should be prepared to encompass preoperational, operational and post operational phases and submitted. Impact, if, any, of change of land use should be given 3. Details of replenishment studies. 4. A study shall be got done to ascertain the impact of the Mining Projects (cumulative effect of all the projects of the cluster) on the aquatic life and Page3
4 accordingly detailed mitigation measures required, should be worked out with cost implications. 5. A hydro-geolgical study shall be got done to ascertain the impact of the Mining on the ground water level and quality and accordingly detailed mitigation measures required, should be worked out with cost implications. 6. A study shall be got done to ascertain the impact of mining (cumulative effect of all the projects of the cluster) on the stability of structure ( bridge, railway bridge, dam etc) if any lies within 5 km from the periphery 7. An inventory of all the features such as bridges, dams and other similar structures in the study area shall be prepared & presented. 8. Inventory of all the sensitive receptors such as human settlements, forest areas, protected areas, water bodies, etc, in the study area and the transportation route shall be prepared & presented. 9. Detailed evacuation plan including road net-work, infra-structure and manpower requirement. 10. Details and the seasonal behavior of the water body (river) from where sand is proposed to be evacuated. 11. Details of the potential up-stream and downstream users of water from the proposed water body to be dealt. 12. EIA study shall be carried out by an QCI accredited EIA Consultant only. Beside above PP was also directed to revise the Mine Plan in light of following comments of SEAC: capacity, infra-structure /machinery to be deployed/ man-power required, number of working days excluding monsoon season. The EMP shall be prepared based on the recommendations of EIA report and on the points suggested by the committee. 5. Case No. 2731/2015 Shri Raj Kumar Nema, OIC, Sub Off., M.P. State Hoshangabad (MP) Dolriya River Sand Quarry Lease Area ha., Capacity -, Capacity-75,000 cum/year, at Khasra No. 218, 267, Village-Dolriya, Tehsil- Dolriya, District-Hoshangabad (M.P.) This is a river sand quarry. Scrutiny of the Mining plan submitted for reveals following deficiencies capacity, infra-structure /machinery to be deployed/ man-power required, number of working days excluding monsoon season. State Hoshangabad (MP) Gwadikala River Sand Quarry Lease Area ha., Capacity -,, Capacity - 1,15,000 cum/year,) at Khasra No. 108, Village-Gwadikala, Tehsil-Itarsi, District-Hoshangabad (M.P.) - TOR This is a river sand quarry. PP has submitted certificated issued from DFO, Tehsildar and Mining Officer. Mining Officer has reported vide letter no dated 21/07/2015 that 02 more mines are operating / proposed in 1000 m from the periphery of the said mine and the cumulative lease area is Ha. By virtue of the total lease area within 1000 meter the case falls under category B-1 hence PP is required to prepare EIA. Scrutiny of the project reveals that Railway tract are in close proximity from the project boundary. It was observed that there is no scope for leaving safety zone in the project, hence committee decided to recommend rejection of the project. The case may be forwarded to SEIAA for necessary action in the matter. 8. Case No. 2761/2015 Shri Raj Kumar Nema, OIC, Sub Off., M.P. State Hoshangabad (MP) Kasda Rajyatwadi River Sand Quarry Lease Area ha., Capacity -, Capacity - 1,18,800 cum/year, at Khasra No. -18, Village- Kasda Rajyatwadi, Tehsil-Itarsi, District-Hoshangabad (M.P.)
