1 UNICEF Turkey TERMS OF REFERENCE (ToR) SHORT TERM NATIONAL INDIVIDUAL CONSULTANCY TECHNICAL SUPPORT for the IMPLEMENTATION and PILOTING of DENGE JUVENILE PROBATION PROGRAMME () Links with the Country Programme Priorities: Outcome 1: By 2020, the education, child and social protection and health systems, NGOs, communities and families provide vulnerable children with increasingly inclusive opportunities to realize their rights to protection, education, development and participation. Output 1.E - Justice for Children: Community-based alternatives are developed for children in conflict with the law. Activity 1 - Community-based alternatives for children in conflict with the law - Development of an Effective Risk Evaluation System for Children in Turkish Probation Services Project I. BACKGROUND and JUSTIFICATION The United Nations Committee on the Rights of the Child frequently expresses its concern that international standards on youth justice have not been fully implemented throughout the world. Research shows that it is more beneficial to rehabilitate a child in the community than in detention. Interventions delivered in the community are more effective at reducing reoffending than those delivered in custodial or institutional settings 1. In Turkey, the number of children in conflict with the law is around 180,000 every year. Approximately 165,000 children have gone through the probation system since probation services for children were introduced in 2005, and children are currently under probation as of December The Ministry of Justice (MoJ) has been following a gradual strategy of improving its standards to ensure that children in the juvenile justice system are treated in a manner that is consistent with their rights and needs. The strategy is being implemented in accordance with Article 37 of the United Nations Convention on the Rights of the Child as well as the priorities set out in the Strategic Plan of Ministry of Justice ( ). Work carried out in the above context has revealed a need to strengthen the community-based services for children engaged in crime to be able to put into practice the principle that detention should only be used as a measure of last resort. The Development of an Effective Risk Evaluation System for Children in Turkish Probation Services Project (also known as the DENGE Juvenile Probation Programme) has been developed to improve the probation services for children in Turkey. The Project is co-funded by the European Union, the Government of Turkey and UNICEF, and is being implemented by the Ministry of Justice Directorate General for Prisons and Detention Houses Probation Department with UNICEF technical support. The overall objective is to increase the efficiency and effectiveness of the juvenile justice system in Turkey through the development of a more effective, preventive and rehabilitative probation system. Improved services are to be developed for the reintegration of juveniles under probation in Turkey which take their individual risks and needs into account and are effective, measurable and compliant with EU standards. The final beneficiaries of the project are the children in contact with the justice system and their families. The Project is ultimately expected to ensure their successful reintegration in society as well as supervision and follow-up in the community. In this regard, various national and international consultancy teams are currently working on 1 IJJO White Paper:
2 the development of the risks and needs assessment tool, which, as an integral component, includes various supportive intervention programmes tailored for those identified risks and needs. Following the development of the tools and the programmes, a series of training for relevant professionals will be conducted. Prior to the nation-wide implementation, the tools will be piloted in 21 provinces 2 which will be regularly visited to for monitoring purposes in the course of An intensive calendar of milestone events (including trainings, workshops and regional meetings) as well as field visits to monitor the pilot implementation is planned for 2018, which requires additional technical support for timely, efficient and successful implementation of those activities (with a special focus on pilot implementation). Thus, UNICEF Turkey is seeking a short term national individual consultant to provide technical support on the implementation and piloting of the DENGE Juvenile Probation Programme. II. SCOPE of WORK As per the results and activities stipulated in the logical framework of the Project, and in close collaboration with the Project team (composed of MoJ and UNICEF staff as well as the Project consultants) the consultant is expected to complete the following tasks throughout the consultancy process and to submit the relevant deliverables in line with the agreed upon work calendar (see Table 1): 1. TECHNICAL SUPPORT to the DEVELOPMENT, TESTING and MONITORING of the TOOLS and PROGRAMMES The consultant is expected to provide concrete technical support on the development, testing and monitoring of the tools and programmes to be developed under the framework of the Project. This will include sub-tasks such as: - Providing timely and regular feedback on the assessment tools and programmes to be developed, - Consolidating the received feedback from the field workers and provide inputs to the revision of the tools, - In close collaboration with the relevant consultancy teams, developing a plan and tools for the field visits including standard checklists and field visit reporting formats, - Participating the field monitoring visits and ensure timely reporting, - Documenting good practices in the field, - Coordinating the finalization process of the developed tools, - Providing inputs to UYAP integration process. 2. TECHNICAL SUPPORT to THE MILESTONE EVENTS of the PROJECT In close collaboration with the relevant staff, the consultant is also expected to provide sound support to the content, planning, organization and documentation of the milestone events to be conducted. These events include but not limited to the following: Trainings on supportive intervention programmes (April 2018), Trainings of probation officers/professionals from 21 provinces (May June 2018), 7 local seminars for 1750 participants in total (July-September 2018), 3 regional meetings for 240 participants from 21 provinces (September October 2018), 2 Adana, Amasya, Ankara, Antalya, Bursa, Denizli, Diyarbakır, Elazığ, Erzurum, Eskişehir, Gaziantep, İstanbul, İzmir, Kayseri, Kocaeli, Konya, Manisa, Mersin, Rize, Sakarya, Şanlıurfa. 2
3 A workshop for 60 participants (September 2018), and Closing Ceremony (December 2018). 3. TECHNICAL SUPPORT to the SOUND IMPLEMENTATION of the OVERALL PROJECT ACTIVITIES In addition to the above mentioned primary tasks, the consultant is also expected to support and monitor the overall implementation of the project activities in line with the revised timeframe for These are included but not limited to the following: Tracking overall activity progress, Sustaining relations with other project consultants and regularly updating the supervisor, Supporting urgent translation requirements and proofreading, Taking the minutes of various meetings and record keeping, Providing inputs to production and distribution of visibility materials as well as the communication activities. For the timeframe of the tasks, please see the tentative work calendar (Table-1) below. III. WORKING METHODOLOGY and TENTATIVE WORK CALENDAR The consultant will work under the supervision of the Justice for Children and Child Rights Monitoring Specialist in accordance with the standards, rules and procedures of UNICEF. The consultant is expected to maintain constant contact with UNICEF JFC & CRM team, Directorate General for Prisons and Detention Houses, Probation Department officials and other relevant partners. For all the tasks conducted throughout the consultancy period, the consultant is expected to submit a monthly report describing the monthly progress s/he contributed along with attached supporting documents (such as minutes of meetings, revised reports, participant lists, produced tools etc.). Inputs provided for the visibility and communication materials ENG April December 2018 Translated documents Monthly reports on the progress of the abovementioned activities *As the payments will be made on monthly basis, the consultant is expected to submit his/her monthly report at least 5 days before the last working day of each month to secure timely finalization of the deliverable and transaction of the monthly payment. Please note that, report of December should be submitted on 10 th of December. IV. DUTY STATION The consultant will be based in the UNICEF Ankara Office with frequent travels within Turkey. V. TRAVEL REQUIREMENTS FOR THE ASSIGNMENT The consultant will be required to travel within Turkey especially to 21 cities where pilot implementation will be conducted. UNICEF will cover the accommodation and travel expenses of the official approved trips within Turkey. 4
5 VI. SUPERVISOR Child Protection Specialist (Justice for Children and Child Rights Monitoring) VII. DURATION & COST of ASSIGNMENT Duration: Assignment will cover a 9-month period (01 April - 15 December 2018) and payments will be effected upon the delivery of monthly reports. Estimated Cost of Consultancy: UNICEF will issue an individual contract in Turkish Liras. UNICEF will cover travel and accommodation costs arising from event organizations. Travel and accommodation expenses may only cover those items identified by UNICEF and shall not exceed the pre-determined limits of the daily allowances rate of UNICEF. Other costs related to administrative tools, communications, etc. shall be covered by the consultant. Payment schedule: The contract for the consultancy will be issued in Turkish Liras. Payments will be done monthly upon the approval of the monthly reports. Reservations: UNICEF reserves the right to terminate the contract and/or withhold all or a portion of payment if the rules and the regulations regarding confidentiality, ethics and procedures of UNICEF and the partners are not followed, the performance is unsatisfactory, or work/deliverables are incomplete, not delivered or fail to meet the deadlines. In addition, UNICEF reserves the right to work with multiple consultants for the same assignment, if necessary. Where this is the case, all consultants are expected to work in cooperation and coordination. VII. QUALIFICATIONS AND SPECIALIZATION REQUIRED FOR THE ASSIGNMENT: The consultant who will be recruited to complete the assignments is expected to have the following qualifications: Technical requirements: - At least bachelor degree in social sciences (law, social work, psychology etc.) - At least 3 years of experience in juvenile law (criminal law, child protection law and civil law) and juvenile justice system. - Experience in managing EU funded projects is a major asset. - Working experience with local or central government agencies (e.g., Ministry of Justice), public institutions, international organizations (e.g., United Nations agencies) and/or civil society organizations is an asset. Skills and personal traits: - Organizational skills to arrange meetings, trainings, workshops, conferences, study visits, missions, etc. - Respecting different cultures, accepted local norms, religious beliefs and practices, personal interaction and gender roles, disability, age and ethnic identity. 5
6 - Excellent communication and interpersonal skills. - Ability to work closely with national and international actors and working group within a tight schedule to facilitate the coordination of the process. - Computer literacy. Language: - Proficiency in oral and written English. VIII. APPLICATIONS Applicants are expected to submit to UNICEF their technical and financial proposals in compliance with the format attached to this ToR. Technical proposals are expected to explain the method to perform the work in detail and should include a concrete work plan. Applicants are expected to prepare their technical proposals by duly considering this Terms of Reference. For the details of financial proposal, please refer to the attached template. Please note that, the candidates are required to specify their daily rates, and total cost per month by considering that each month has 21 working days.
