1 The Further Education and Training Awards Council (FETAC) was set up as a statutory body on 11 June 001 by the Minister for Education and Science. Under the Qualifications (Education & Training) Act, 1999, FETAC now has responsibility for making awards previously made by NCVA. Module Descriptor Industrial Relations Level 5 N744

Where relevant, it lists what certification will be awarded by other certification agencies. Recommends the level of previous achievement or experience of the learner. Usually none but in some cases detail is provided here of specific learner or course provider requirements. There may also be reference to the minimum safety or skill requirements that learners must achieve prior to assessment. Describe in 3-5 statements the broad skills and knowledge learners will have achieved on successful completion of the module. Structure the learning outcomes; there may be no units. 3 1 Module Title Industrial Relations Module Code N744 3 Level 5 4 Credit Value 1 credit 5 Purpose This module is a statement of the standards to be achieved to gain a credit in Industrial Relations at Level 5. It is designed to be taken across a wide range of FETAC certificates and is also intended to prepare the learner for further study in related areas. The module is designed to designed to provide the learner with a general understanding of the main elements of Industrial Relations that impact on organisations. The focus of the module is on both the theoretical basis for Industrial Relations and its application in the business environment. Preferred Entry Level 7 Special Requirements Level 4, Leaving Certificate or equivalent qualifications and/or relevant life and work experiences. None. 8 General Aims Learners who successfully complete this module will: 8.1 develop an understanding of industrial relations concepts and terms 8. understand the impact of industrial relations on the business environment 8.3 appreciate the role of individual and collective law in the industrial relations arena 8.4 be familiar with the institutions and role players within the industrial relations system 8.5 understand the nature of conflict and negotiation as it pertains to industrial relations within the organisation 8. appreciate the role of collective bargaining and partnership in Ireland s economic success 1

Unit 1 Unit Unit 3 Unit 4 Unit 5 Fundamentals of Industrial Relations Role of Individual and Collective Law Conflict and Industrial Action Collective Bargaining Strategic Human Resource Management and Industrial Relations 10 Specific Learning Outcomes Unit 1 Fundamentals of Industrial Relations Learners should be able to: Explain the concept of industrial relations Distinguish between employee relations and industrial relations Outline the roles of the key parties involved in the industrial relations process Discuss the function, operation and outcomes of the Labour Court, Labour Relations Commission, Rights Commissioners, Equality Authority and Equality Tribunal Describe the Labour Court referral process Outline the role and function of key industrial relations institutions (e.g. trade unions, third parties and employer organisations) Discuss the development, types, objectives and structure of trade unions Discuss the development, types, objectives and structure of employer associations Outline the role of the European Commission within the industrial relations framework
5 Unit Role of Individual and Collective Law Learners should be able to: Explain the role of individual and collective law within the industrial relations framework 10.. Outline the main pieces of employment legislation Unfair Dismissals Acts 1977, 1993 Safety, Health and Welfare at Work Act 005 Employment Equality Act, 1998 Equality Act, 004 Protection of Employees (Part-Time Work) Act, 001 Protection of Employees (Fixed Term Work) Act, 003 National Minimum Wage Act, Outline the procedure involved in taking claims under the following legislation Unfair Dismissals Acts 1977, 1993 Employment Equality Act, Critically evaluate the main pieces of collective industrial relations legislation Trade Disputes Act 190, 198 Trade Union Acts 1935, 194, 1971, 197 Industrial Relations Acts 194, 199, 1990, 001 Unit 3 Conflict and Industrial Action Learners should be able to: Outline the types and functions of conflict Discuss the types of grievance and disciplinary issues frequently encountered within business organisations Outline sample grievance and disciplinary procedures Explain the roles of natural justice and record keeping in disciplinary procedures Discuss the nature and forms of industrial action, both individual and collective Outline the critical factors that impact on the level and pattern of strike activity Discuss the key trends and pattern of strike activity in Ireland 3
6 Outline the two dominant forms of bargaining Explain the phases in a negotiations process Unit 4 Collective Bargaining Learners should be able to: Distinguish between individual and collective bargaining Outline the structure, levels and alternatives to collective bargaining Discuss the history of centralised agreements Critically evaluate the perspectives of trade unions, employers and government with respect to centralised agreements Discuss the contribution of centralised agreements to Ireland s economic success Outline the role of social partnership at national and local levels Explain the components of partnership-based industrial relations agreements Unit 5 Strategic Human Resource Management and Industrial Relations Learners should be able to: Define Strategic Human Resource Management Distinguish between personnel management and human resource management Outline the key models of human resource management Discuss the role of trade unions within the human resource management framework 4
7 Outline the dynamics and forms of employee involvement and participation in the business environment Discuss the trade union and employer perspectives on employee involvement and participation in Ireland 11 Portfolio of Assessment Please refer to the glossary of assessment techniques and the note on assessment principles at the end of this module descriptor. All assessment is carried out in accordance with FETAC regulations. Assessment is devised by the internal assessor, with external moderation by FETAC. Summary Assignments () 0% Examination (Theory-Based) 40% 11.1 Assignment The internal assessor will devise two briefs that require candidates to produce evidence that demonstrates an understanding and application of a range of specific learning outcomes. Assignment 1: The brief for the first assignment will require candidates to investigate and analyse topics appropriate to industrial relations in the context of the role of individual and collective law within the candidates vocational area e.g. Safety, Health and Welfare at Work, Unfair Dismissals, Industrial Relations Acts, 1990, 001. Evidence will include reference to appropriate industrial relations concepts and theories. Assignment : The brief for the second assignment will require candidates to investigate and analyse topics appropriate to industrial relations in the context of collective bargaining e.g. perspectives of stakeholders with respect to centralised agreements, the contribution of partnership agreements to Ireland s economy. Evidence will include reference to appropriate industrial relations concepts and theories. The assignments may be presented in a variety of media, for example written, audio, video, graphic, visual or any combination of these. Any audio or video evidence must be provided on tape. All assignments carry equal marks. 5

Examination The internal assessor will devise a theory-based examination that assesses candidates ability to recall and apply theory and understanding, requiring responses to a range of structured questions. These questions may be answered in different media such as in writing or orally. The examination will be based on a range of specific learning outcomes and will be hours in duration. The format of the examination will be as follows: Section A 1 short answer questions Candidates are required to answer 10 ( marks each). Section B 3 structured questions Candidates are required to answer (10 marks each). 1 Grading Pass 50-4% Merit 5-79% Distinction %
