CETMO h THE COMMUNITY POLICIES TO ENSURE A MORE EFFICIENT MULTIMODAL TRANSPORT The European transport policies pay special attention to the improvement of the conditions for multimodal transport. This intervention will allow for a brief recall of the initiatives promoted within the European Union and which takes a particular interest for the Euro-Mediterranean region. Anna Panagopoulou. The first session of the workshop aims to examine the aspects of road transport that limit the fluidity of international transport in the Mediterranean and to identify the priority initiatives to be encouraged to improve its efficiency. The session will reflect on: - the interest of certain international conventions on road transport and for harmonising the national regulatory framework to that of the Community for the facilitation of international transport of goods in the region; - the efficiency of the bilateral and multilateral agreements set for international road transport to facilitate transport in the Mediterranean; - the problems associated with the realisation of road transport, in the context of international transport chains, including those found for passage through borders. SNCFT (Tunisia) h The interoperability of the national rail networks: The technical fragmentation of the European rail network greatly harms the quality and punctuality of the international freight transport services. The historical division of the European network is the cause. This fragmentation brings about delays on trans-border journeys, as the locomotive or driver must be changed. Some technical disparities (for example, signal or gauge systems) equally cause barriers. The objective of this Page 2

3 intervention will be to present the European case as an element of reflection for the Mediterranean Partner Countries. Angel Aparicio. Universidad Politécnica de Madrid (Spain) h The separation of the management role of the rail infrastructure from that of the rail services operators: The Community policy favouring the creation of an integrated European rail area also comprises of the opening of freight rail services to the competition, primarily those related to international freight. In this context, the EU required the Member Countries to separate the management of infrastructures from transport operations so that the public companies become independent from the State. The EU also approved a set of directives establishing the division of the rail infrastructure capacities, the collection of taxes for the use of these infrastructures and the granting of licences to rail companies. After an intervention on the actual policy in Morocco in this respect, a discussion will be proposed to the workshop experts on the interest of this approach for the Mediterranean Partner Countries. The aim of this session will be to revise, using several examples, the aspects that are normally susceptible to limiting the efficiency of multimodal transport between the two shores of the Mediterranean. FORTH SESSION : The priorities to improve the efficiency of multimodal transport in the Mediterranean. The interventions during the forth session will serve to look, in more detail, at several issues that effect the efficiency of multimodal transport in the Mediterranean. The topics proposed for discussion will be the regulation of the responsibility in multimodal transport, the harmonisation of loading units, the development of logistical platforms within the countries, and the development of the profession of multimodal transport entrepreneur. Professeur de droit maritime et international (Tunisia) h The regulations on the responsibility in multimodal transport: There are no existing international standard rules applied to the responsibility in the case of loss, damage or delay linked to multimodal transport. The actual juridical framework only brings together international conventions to regulate only one mode of transport, national laws and types of contracts. This makes the degree of responsibility vary greatly depending on the case and unpredictable. The aim of the two forecasted interventions and the subsequent discussion will be to revise the juridical framework applied in the Mediterranean and to weigh-up the consequences for the facilitation of transport in the region. To what measure does the actual diversity of these loading units truly constitute an obstacle for the efficiency of multimodal transport in the Mediterranean? What would be the consequences for the region of the approval of the Community directive proposal regarding the harmonisation and standardisation of the intermodal loading units? Joao Soares. 5 12.45 h Discussion h Lunch h The development of the profession of multimodal transport entrepreneur : strategies and challenges: Even if the shipper and the consignees often prefer dealing with only one party, who make the arrangements to dispatch the goods from door-to-door and who is contractually responsible throughout the whole journey, there is a delay in the Mediterranean Partner Countries with regard to the development of this type of operators. Several interventions will allow us to reflect on the consequences of this delay on the facilitation of transport in the region and the priority actions to support to overcome this situation.
