Final Evaluation and award of contract shall be based on L1 method wherein the bidder with lowest commercial quote among technically qualified bidders shall be considered for award of this project. The project contract period shall be for a period of 3 years, which may be further extendable for a period of 2 more years subjected to terms & conditions and post PIC committee approval. Bidders are requested to deposit the EMD through online payment gateway available on e-tendering portal three days prior to submission date to avoid any banking transfer delays No SLA will be provided on wireless connectivity and will not bet efforts. No penalty will be applicable. 1:4 or 1:8 are shared bandwidth options with no guarantee on bandwidth availability. The agency shall provide 3 year Accidental damage warranty on all the hardware devices. g The agency shall install, configure and test all the hardware & devices at the respective location mentioned in this RFP. 26 Page 15 ; Section 1 1. Payment Terms The payment terms should be revised in such case. The hardware payment should be done by Dept upong delivery at individual locations Kindly confirm that acceptance shall be provided upon delivery & installation of internet services at each site. Accidental damage cannot be covered in warranty. It should be covered by Insurance. If this is required, then Dept should seek separate quote for the same. Kindly clarify the types of hardware expected to be provided by the bidder. Penalty for delay in Project execution For any delay in successful installation of hardware and provisioning of required bandwidth at locations beyond 45 days of signing the contract, the department will charge 0.5% of the total project cost per week subjected to 10% of the total project value. The downtime for Broadband Internet Connection at Offices will be defined as Non-working of the internet service at the office In case of physical damage/accidental damage to the device & insurance is not opted for by customer, in such cases replacement can be done on a chargeable basis. For other cases where device stopped working due to issues with hardware/software, replacement/repair/re-installation shall be done free of cost. The delivery timeline is very less considering project size of 801 locations. The timeline should be minimum of 16 weeks. Also penalty for delay in delivery shall be calculated 0.5% of the respective link annual cost per week subjected to 10% of the respective link annual cost. The down time should exclude any outage caused by issues within the internal LAN/PC/Computer For any physical damage happened because of department will be chargeable. For technical issues, successful bidder has to resolve or replace the device free of cost. Yes. The downtime will be considered caused by the internet services

Taxes and Duties The Agency shall fully familiarize themselves about the applicable Domestic taxes (such as GST, VAT, Sales Tax, Service Tax, Income Tax, duties, fees, levies, etc.) on amount payable by the department under the contract. The Agency shall pay such domestic tax, duties, fees and other impositions (wherever applicable) levied under the applicable law. The penalty suggested are very high and not sustainable as per industry standards. The SLA should be revised as follows. Uptime for internet services per link % per quarter Penalty for uptime less than 98.50% - prorata basis service extension The commercial bid should be changed to reflect prices inclusive of taxes. Also in case of any change in taxe rates, the difference shall be borne by Dept. in case of downward revision, benefits shall be passed on to Dept. The commercial annexure includes the separate section for taxes, hence the project cost will be the inclusive of applicable taxes. Also, the difference amount due to revision in taxes will be borne by the department

Deviations We hereby declare that all terms and conditions mentioned in RFP including the corrigendum are acceptable to us without any deviation and all the services shall be performed strictly in accordance with the bid documents. Kindly remove this clause, bidders may need to have clarification and deviations and having this clause makes the RFP completely one sided. 34 Page 36 ; Section 5 35 Page 37 ; Section 7 (5) Work Completion Timelines and Payment Terms Project Delivery / Work Completion milestones given below are from the date of Work Order. (7) Warranty Services The Selected Agency is required to provide a comprehensive accidental damage warranty for all the supplied hardware & devices supplied for a period of 36 months. The accidental damage warranty shall remain valid for 36 months after final delivery sign-off as per Section 3.1. In case of theft of the hardware or devices, the department will procure the hardware & devices from the agency at the same cost provided in the financial bid. In case the department negotiates with the vendor to extend the project period to another 2 years post expiry of 3 year period, the vendor shall provide extended 2 year accidental damage warranty to the department. Annexure 6: Geographical distribution of Hardware / Connections Dept should be cognizant of the fact that hardware is procured from the OEM and OEMs have manufacturing setups outside of india. Hence keeping the price same for the contract period shall not be possible for Hardware component. There are multiple factors affecting this such as OEM price itslef, currency exchange rate, duties and levies etc.. Hence requesting modification of this clause as follows " in case of theft, new device shall be procured as per price submitted by bidder at the time of such an instance" Kindly share the excel sheet/word document for the location addresses. Also, please indicate the bandwidth required at each of the locations Does 1:4 or 1:8 under Section I on page 5 means that we can bid with wireless data card broadband connections? If we can bid with data card broadband connections, then what will be the monthly data usage for each location? Is it compulsory to bid for all 801 locations or we can bid for less than 801 locations also? We request you to allow consortium of bidders to match criteria The hardware will be leased out to department by the selected vendor and only leased amount can be charged The list of offices are already available in RFP, however the location wise bandwidth bifurcation will be shared with successful bidder if the Wireless data card will suffice the departments requirement as per the scope of work mentioned in the RFP Unlimited data usage Yes

10 In the payment terms- payment should come quarterly in advance or end of the quarter. Please remove tier 1 ISP clause, because even large service provider may not have presence at all 801 locations so that partners like us can deliver the project in association with various ISPs as per feasibility in particular area. It s difficult to cover accidental damage of equipments so we request you to remove the same Minimum days required to cover 801 locations For any physical damage happened because of department will be chargeable.
