1 CITY COMMISSION BRIEFING For Meeting Scheduled for October 18, 2012 Authorize Contract 520 Corridor Sector Plan Development Regular Agenda Old Business TO: FROM: THRU: Mayor Leon Skip Beeler and Members of the City Commission Anthony Caravella, AICP, Director of Development Services Robert Majka, City Manager RE: Authorize award of contract to Zyscovich Architects for development of 520 Corridor Sector Plan Development DATE: October 8, 2012 NOTE: This item is continued (old business) from the City Commission meeting on September 20 th. It will also be the subject of a Commission workshop on October 16, 2012, discussion scheduled to include: Review and discuss scope of work and consultant selection for planning study known as the S.R. 520 Area/Sector Plan: - Possible boundaries of the study area - Scope of services for the study and expectations of final work product - Consultant selection - Anticipated cost and budget allocation for the study A. Background/General Information and Introduction: In 2004, the City Commission adopted Comprehensive Plan Objective I.15, enabling the development of sector/area plans in certain parts of the City. This enabling objective is presented as Attachment A. The Development Services Department budgeted, and the Commission approved, professional service fees for the purpose of developing this sector plan. The attached scope of services for this product is presented as Attachment B. Staff is recommending Zyscovich Architects, given their work record with, and product produced for, the City. Zyscovich was chosen through a Request for Proposal process in 2008 and K:\userdata\SHARED\Building Department\COMPLAN\Sector-Area Plans\Beach Gateway Area\CCxfer - Award contract ( ).docx

For example, the City has only approximately $100,000 budgeted for this planning work. This requested action would authorize the contract per our purchasing procedures and have the City Manager contract the final terms of the agreement and contract. The City may be able to partner with private property owners in the area, but participation by these owners may require formal City Commission approval and agreement as determined by the City Attorney. B. City Commission Review September 20, 2012 The Commission reviewed the attached scope of services at the September, 2012 meeting, at which time the Commission scheduled a workshop for October 16, Key Facts/Issues Requiring Discussion None. Commission approval required per purchasing procedures. The scope of work, limits of study area, and fees all need to be further negotiated. Planning studies greater than $35,000 fall under Florida Statute (Consultant s Competitive Negotiation Act CCNA). Zyscovich Architects were selected under the provisions of the CCNA back in Implement any discussion from the October 16 th workshop. 2. Costs $160,000 Fixed fee for Scope of Services, per Pages Development Services Department general fund budget. 3. Savings Not applicable. 4. Source of Funds General Fund Development Services professional services budget; however, only approximately $100,000 has been budgeted for this service. 5. Communications Not applicable. 6. Environmental Impact None.

Recommended Motion: Authorize award of contract to the firm of Zyscovich Architects for the development of a 520 Corridor Area/Sector Plan, and have the City Manager negotiate the final terms of any agreement and/or contract. 4 CITY OF COCOA BEACH, FLORIDA COMPREHENSIVE PLAN 2010 Objective I.15: By December 31, 2006, the City Commission will work towards adoption of one or more Sector Plans, regarding the need and support for area revitalization efforts in certain areas of the City. Policy I.15.1: The City will seek to adopt a Sector Plan for each of the areas below, in the order of priority as listed (i.e., (a) first, (b) second, and (c) third): a) The Downtown Area, generally located between North 4 th Street to South 2 nd Street, and between Woodland Avenue and the Atlantic Ocean. b) The Beach Gateway Area, around the SR 520 and SR A1A node intersection. c) The North Cocoa Beach Area, generally north of California Avenue. Policy I.15.2: When developing Sector Plans, the City must seek public participation and input, using techniques including, but not limited to, neighborhood meetings, charettes and advertised public hearings. Significant categories for focus of these public discussions will include: a) Land use. b) Protecting existing residential development. c) Transportation/traffic. d) Historic preservation and development patterns. e) Accommodating tourists. Policy I.15.3: In a Sector Plan, the emphasis will be placed on using innovative planning techniques, such as special zoning districts, overlay zoning or mixed-use zoning to encourage pedestrian traffic, traffic control, and reinvestment in older structures. Encouraged methods of design should: a) Include parking standards, incorporating public on-street parking when available, for the purpose of confirming existing land use patterns. b) Lessen visual impacts that would require the placement of parking facilities behind the primary structure for new commercial development. c) Include a mixed use zoning classification that permits both residential and non-residential uses to occupy the same structure, subject to complying with applicable health and safety code standards. d) Limit and discourage strip-type, highway oriented commercial development. e) Require accesses for new development to connect to the street or highway of lowest classification, and to construct driveway access to adjacent commercial properties. f) Prohibit driveway access to major roads, or streets of higher functional classification whenever possible. g) Promote conversion of existing conforming and nonconforming structures in a manner that maintains the visual character and scale of existing development in the area. h) Place the highest priority upon preventing commercial encroachment on existing single-family residential development.
