Z of 31st May GENERAL CONDITIONS 1 General building regulation approval proves the usability or applicability of the item approved under national building regulations. 2 The general building regulation approval does not replace statuary authorisation, approval and certification applicable to the implementation of construction projects. 3 The general building regulation approval is issued irrespective of the rights of third parties, especially private industrial property rights. 4 Manufacturer and distributor of the item approved must, irrespective of further applicable regulations under "Special conditions", provide the user of the item approved with copies of the general building regulation approval and must point out that the general building regulation approval must be made available at the location of use. Copies of the general building regulation approval must be made available to any participating authorities on their request. 5 The general building regulation approval may only be copied in full. Publication in part requires agreement of the German Institute of Structural Engineering. Texts and drawings contained in advertising material may not contradict the general building regulation approval. Translations of the general building regulation approval must contain information to the effect that the text is a "translation of the German original text not checked by the German Institute of Structural Engineering". 6 The general building regulation approval is issued revocably. The information contained in the general building regulation approval can be supplemented or changed at a later date, especially if new technological knowledge requires this. P

3 II. SPECIAL CONDITIONS Page 3 of general building regulation approval no. Z of 31st May Item approved and scope of application (1) The subject of this general building regulation approval is a module container Type B MC (see Appendix 1) compost of steel frame construction, wall and roof elements, together with steel interception troughs with storage levels made of steel grating. The module container is suitable for the storage of barrels, tank containers and small drums which comply with traffic regulations for the transport of hazardous goods. (2) The module container may be used outdoors, on the works premises or in rooms which are only used by warehouse personnel or are used only temporarily by other persons, depending on its version, and may only be made accessible to authorised persons. (3) The module container may be used for the storage of water-polluting liquids with a flashpoint above 55 C and, depending on its fittings, also for the storage of waterpolluting liquids with a flashpoint up to 55 C in the above-mentioned barrels, tank containers and small drums. (4) The materials used for the module container interception trough must be resistant to the water-polluting liquids to be stored there. (5) The water rights determination of suitability and building regulation approval in accordance with 19 h from WHG are superseded by this general building regulation approval. (6) The general building regulation approval has been issued irrespective of the inspection or approval reservations of other legal fields (e.g. 1st regulation for the equipment safety laws - low voltage regulations -, laws regarding electromagnetic compatibility of devices - EMVG -, the 11th regulation for the equipment safety laws - explosion protection regulations - and regulations in accordance with 18 of the Safety at Work Act - operational safety regulations, toxic chemical regulations). 2 Provisions for construction products 2.1 Properties and composition Components and materials (1) The steel structures each comprise of main components welded together: underbody, internal frame, and external frame and roof (2) The steel frame profiles consist of steels S235JR (Material No ) in accordance with DIN EN and/or S250GD (Material No ) in accordance with DIN EN (3) The underbody is always formed as an interception trough with a wall thickness of at least 3 mm. It is manufactured in S235JR steel (Material No ). (4) The steel frame structures consisting of S235JR steel and the interception troughs have been provided with a suitable corrosion protection system in accordance with DIN WHG:19th August 2002; Water Resources Law 2 DIN EN : ; hot-rolled products in structural steel, technical terms of delivery for nonalloyed structural steels 3 DIN EN 10326: ; continuously hot-dip refined band and plate in structural steel - technical terms of delivery 4 DIN : ; Corrosion protection of steel construction through coatings and plating; Part 8: Corrosion protection of structural thin-walled structural components P

Z of 31st May 2007 (5) Wall or roof elements corresponding to the component list 5 included in this general building regulation approvals have been fitted between internal and external frames, and in the roof. (6) The wall opening must be closed off using a fire-resistant or fire-retirement, selfclosing fire protection closure (steel door T 90, T30 if necessary, each in accordance with DIN , see Section 2.1.4) corresponding to the component list 5. Steel doors must be fitted in compliance with Appendices 1.4 to 1.8. The regulations contained in the general building regulation approval issued for the fire protection closure are otherwise valid. The fire closure must be fitted with a suitable locking device whose usability is also proven through the issue of a general building regulation approval. (7) Locking devices (Fire protection flaps) to K90 corresponding to the component list 5 (fitting in accordance with Appendix 1.10) or, if necessary, construction products for the closure of overflow openings corresponding to the component list 5 (fitting in accordance with Appendix 1.9) must be fitted to openings for aeration and venting. The regulations contained in the general building regulation approval issued for these building products are otherwise valid. (8) Cables and piping may be routed through the container walls and roof as follows: - in connection with cable bulkheads of at least fire resistance class S 90 in accordance with DIN and pipe bulkheads of at least fire resistance class R 90 in accordance with DIN (installation in accordance with 1.11). The provisions contained in the general building authority test certification or approvals for bulkheads apply in these cases. - individual cables and ducts in accordance with MLAR Construction details (1) The module container construction details must correspond to the provisions, drawings and static calculations contained in Appendices 1 and 1.1 to 1.3, in addition to Appendices 1.4 to 1.12 submitted to the DIBt and also those contained in the inspection report (see Section 2.1.3). (2) The fire protection closure hinge connections must be completely filled out with mortar in Group III or with fire protection compound in accordance with the component list 5. (3) The spacing between the mounting parts (see Section Para. (7) to (8)) and the module container frames may be max. 100 mm. Spacing between mounting parts themselves or between wall and roof element butt joints must be at least 100 mm. (4) When the module container is located outside, fire protection closures and any locking devices used must be protected against the effects of inclement weather. Weather protection must be agreed with the door manufacturer. Z of 31st May 2007 (3) When the module container is located outside, openings for aeration and venting must be provided with weather protection (see Appendices 1.9 and 1.10). When the module container is located in buildings, the air extraction opening must be connected to an extraction pipe leading outside. In this case, the necessary extraction performance (see Section 3 (9)) must be ensured Stability The module containers are considered stable for the scope of application listed in Section 1 in accordance with inspection report No /06, static prototype test carried out by the Thuringia state administrative office, building inspection/structural engineering of Fire behaviour The module container, when completely fitted out, closed off with a fire-resistant fire protection closure (steel door T 90) and ready for operation, shows a fire resistance capability of 90 minutes in accordance with the inspection report named in Section when subject to fire loading from one side, either from inside or from outside. 2.2 Manufacturing and certification Manufacturing (1) Manufacturing of the module container in accordance with the provisions and construction drawings listed in the testing confirmation (see Section 2.1.4), and the provisions contained in this general building regulation approval may only take place in the premises owned by Denios AG in Bad Oeynhausen. (2) Manufacture of the interception troughs with a collection volume of up to 1000 l must take place in accordance with technical regulations published in the Building Regulation List A Part 1 under cons. No (3) DIN and the following regulations apply to the manufacture of the steel frame construction and interception troughs with a collection volume greater than 1000 l: - During manufacturing, procedures which are proven to be within the manufacturer's expertise must be applied, and which ensure that the interception troughs comply with the requirements of this general building regulation approval. Proof must be provided either - in accordance with AD Codes of Practice in series HP or - in accordance with manufacturer's qualification to DIN , Class B for the module container steel construction and in Class C - Combination of interception of individual parts must take place by welding carried out using an acknowledged welding instruction (WPS). Bolted connections below the maximum possible liquid level in the interception trough are not permitted. - If interception trough individual parts are manufactured using cold forming, it must be ensured that no changes to the material which may be damaging to the manufacture and use of the interception trough take place. When forming edge borders on interception trough components, the bending radius must be the same as or larger than the wall thickness. - Welded seams in the interception troughs must be carried out using suitable working material and filler materials, and must be manufactured after careful preparation of individual parts so that perfect welding work is guaranteed, and so that internal stresses are reduced to a minimum. 6 Page 6 of general building regulation approval no. Z of 31st May Welding seams must have been welded over the entire cross-section. They may not show any cracks or bonding errors or slag inclusion. Welded seams on the interception troughs must be carried out as double-sided welded butt seams without major edge misalignment. Corner joints must be carried out as double-sided welded fillet welds. Single-sided butt-welded corner joints and double-sided welded corner joints are also permissible. Double-tee joints are to be avoided. - Mechanised welding processes, for example for prefabricated parts, are permissible if their parity with double-sided manual welding has been proven through the issue of procedure auditing by the responsible inspection centre Certification The module container must be labelled by the applicant with conformity marks in accordance with conformity mark regulations issued by the relevant state. This marking may only take place when all requirements in accordance with Section 2.3 have been fulfilled. In addition, the applicant must label the module container visibly and permanently with the following information: - module container type, - manufacturing number, - year of manufacture, - interception trough material, - collection volume of interception trough, whereby the collection volume may only be measured to the bottom of the gratings, or a freeboard of 2 cm must be taken into account for the interception trough, - admissible loading of storage levels (grating floors) - additionally if a fire-retardant fire protection closure is used: "T 30 steel doors In acc. w. DIN ". With regard to labelling of the module container by the operator, please see Section (1). 2.3 Compliance certificate General (1) The properties of the preliminary products, semifinished products and components used, if they are listed in construction regulation list A Part 1 or if they are building authority-approved, must be demonstrated by the German Ü mark, otherwise through the use of test report 2.2 in accordance with DIN EN (2) Confirmation of the module container compliance with the test report (see Section 2.1.3) and the general building regulation approval must take place for the manufacturing works with a conformity declaration made by the manufacturer based on the first inspection by the manufacturer and an in-works production inspection. (3) Confirmation of conformity for interception troughs with a collection volume of up to with the technical regulations stated in construction regulation list A Part 1 under consecutive number must take place with a conformity declaration provided by the manufacturer based on an in-works production inspection and an initial test for the interception troughs by an acknowledge the test centre for this purpose. 12 DIN EN 10204: ; Metallic products, types of test certificate P

Z of 31st May 2007 (4) Confirmation of conformity for interception troughs with an interception volume greater than 1000 l with the provisions contained in this general building regulation approval must take place for the manufacturing works with a conformity certificate based on an in-works production inspection and regular third-party supervision including initial tests of the interception troughs based on the requirements of the following provisions. - In order to be issued a conformity certificate and third-party supervision including the product inspections to be carried out in these cases, the manufacturer must authorise an acknowledged certification body and an acknowledged supervision centre to carry out this work. - The German Institute of Structural Engineering is to be given a copy of the conformity certificate in addition to a copy of the initial test report by the certification body In-works production inspections (1) An in-works production inspection must be set up and carried out in the manufacturing works. The term in-works production inspection is taken to be continuous supervision of production to be carried out by the manufacturer, with which the manufacturer can ensure that the construction products manufactured by himself comply with the provisions of this general building regulation approval. (2) The results of the in-works production inspections must be recorded and evaluated. These records must contain at least the following information: - date of manufacture and inspection, - designation of source materials, - type of inspection or test, - results of inspections and tests, - signature of person responsible for the in-works production inspection. (3) The records must be maintained for at least five years and must be handed over to the supervision centre authorised to carry out third-party supervision. They must also be handed over to the German Institute of Structural Engineering and the main building authority responsible on request. (4) If the test results are insufficient, the manufacturer must carry out any measures necessary to rectify defects immediately. Construction products which do not comply with requirements must be dealt with so that they cannot be mistaken for products complying with requirements. Once the defect has been rectified the relevant inspection must be repeated immediately, as far as is technically possible and as far as is necessary to prove rectification of the defect In-works production inspection of the completely assembled module container and initial test The in-works production inspection of the module container must contain at least the following measures: 1. Inspection of certification for all preliminary products, semifinished products and components used in accordance with Section (1). 2. Inspection of completeness of the necessary general building regulation approvals and general building authority certification required for components used such as wall and roof elements, fire protection closures and fittings. 3. Check for existence of necessary substantiation and test certificates for any fitting parts built in at the works. 4. Inspection of dimensions and connections for the module container steel frame construction in accordance with static calculations. P

Inspection of assembly in accordance with provisions stated in the general building regulation approval and general building authority test certification of the components used. The initial test must be carried out in accordance with the in-works production inspection In-works production inspection of interception troughs with collection volumes greater than 1000 l (5) The in-works production inspection must take place based on DIN Every interception trough must be subject to the following inspections during the course of the in-works production inspection. 1. Dimensions. 2. Welded seam inspections in accordance with DIN , 3. Leaktesting Leaktesting takes place using non-destructive material testing, for example using a vacuum process, ink penetration process in accordance with DIN EN or an equivalent process Third-party supervision of interception troughs with a collection volume greater than (1) The in-works production inspection for interception troughs by third-party supervision based on DIN 6600 must be monitored regularly by a third-party supervision body. Third-party supervision must be carried out at least twice annually in deviation from DIN (2) An initial test of the interception troughs must be carried out in accordance with Section during the course of third-party supervision. (3) The results of certification and third-party supervision must be retained for at least five years. They must also be handed over to the German Institute of Structural Engineering and be responsible main construction authorities by the certification body or supervision centre on request. 3 Provisions for design and dimensioning (1) Conditions necessary for the erection of the module container must be taken from water, safety at work and construction regulations. (2) The direction of the module container must be included in the fire protection concept operated by the owner/warehouse. Attention is drawn to additional measures for fulfilling fire protection requirements for any module container which is only closed off using a fire-retardant fire protection closure (T 30 steel door). (3) The module containers fulfil the requirements on storage rooms in accordance with TRbF 20 15, and (4) The module container must be erected on and anchored to concrete foundations in accordance with the inspection report contained in Section (5) Module containers may not be stacked on top of each other. 9 Page 9 of general building regulation approval no. Z of 31st May 2007 (7) The module container must be sufficiently protected against possible damage from outside. This protection can be provided by, for example: - protected erection location outside in-works transport routes, - impact protection. (8) Any gratings used as storage shelving must be designed for double the permissible area loading and be demonstrably chemical resistant to the stored media. (9) If storing liquids with a flashpoint < 55 C, module containers must be fitted with a ventilation system whose performance guarantees at least 5-fold air changes per hour and which is effective dance floor level. In cases of exclusively passive storage in transport containers approved for the transport of hazardous goods with a capacity of up to 1000 l, 0.4 or 2 air changes per hour are sufficient under observance of TRbF 20, Section 5.4.2, Para. (10) and Section No ventilators made of plastic may be used. (10) Module containers must be erected, or the ventilation system must be so designed, so that any air-gas mixtures occurring during leakage, or any cold smoke occurring during fire, cannot penetrate any surrounding buildings. (11) Module containers in accordance with TRbF 20 Section 12.1 must be provided with a lightning protection device. 4 Provisions for implementation (1) Only companies considered to be specialist companies in the sense of 19 1 WHG may be authorised to erect the module container, unless such activities are exempt from specialist company obligations according to national or local regulations. (2) The company erecting the module container must also have knowledge of fire and explosion protection regulations at its disposal. (3) Measures for the rectification of damage to interception troughs may only be carried out in agreement with an assessor in accordance with water laws. 5 Provisions for use, maintenance, servicing and testing 5.1 Use Module container fittings Conditions necessary for fitting out of the module container must be taken from water, safety at work and construction regulations Stored liquids (1) The resistance required in the corresponding section 1(4) is considered proven if the stored media are contained in DIN and the ancillary conditions listed there have been observed or suitability in accordance with Section 3 of DIN 6601 is proven, whereby liquid-material combinations can be considered as suitable if the wall erosion due to surface corrosion is a maximum of 0.5 mm/year. Resistance is considered to be proven, - if the stored media are contained in the "BAM List, requirements on tanks for the transport of hazardous goods" (published by the German Federal Agency for Material Research and Testing (BAM), Unter den Eichen 87, Berlin) or 16 DIN 6601: ; resistance of materials in tanks made of steel against liquids (positive liquid list)16 P

Z of 31st May through road traffic approval or building regulations conformity for the container if the interception trough is made of the same material as the container. (2) When storing liquids with a flashpoint < 55 C the requirements of the fire and explosion protection laws, especially those of TRbF 20, must be observed. (3) In the case of media which fall under the hazardous materials regulations, TRGS and TRGS must be observed Leakage detection The container must be set up on the grating above the interception trough so that the interception trough can be seen into from at least one location for the purposes of leakage detection Documentation The user of the module container must be provided with the following documentation: - copy of this general building regulation approval, - construction parts list 5 confirmed by the DIBt for components listed in Section 2.1.1, information about module container fittings Operation (1) Before initial startup of the module container, the operator must label it correctly for the intended use. Labelling in accordance with other legal areas is unaffected. (2) Before using the module container, and every time the stored media is changed, a check must be made that the media is permitted to be stored in accordance with Section (3) The module container interception trough must be able to collect the contents of the largest container, or a minimum of 10% of the total volume of stored containers. The interception trough must be able to collect the total contents of all stored containers insofar as storage of water-polluting liquids is permissible in water protection zone protection areas. (4) The operator is responsible for the observance of the maximum permissible storage capacity or container size described in (3) taking the collection volume of the interception trough stated on the module container into account. (5) The max. load-bearing capacity of the gratings must not be exceeded. (6) Larger drums and barrels may only be placed in the container or removed from it with suitable devices. (7) Small drums and barrels may only be stacked in accordance with road traffic approval and safety at work regulations. They must always be secured against falling. (8) Containers containing water-polluting liquids of varying composition and constitution may only be placed in an interception trough if it has been determined or can be proven that these materials cannot cause dangerous reactions with one another if caused to leak. 11 Page 11 of general building regulation approval no. Z of 31st May 2007 (10) The module container doors may only be kept open for storing and retrieving and for working inside the module container. For this purpose, suitable locking devices with general building regulation approval must be used together with fire alarms located in the inside of the storage area. Triggering of locking devices using a gas warning device is not necessary. It must be ensured that the module container doors can be opened immediately in any situation from inside. (11) Any relevant accident prevention regulations must be observed to avoid hazards to employees and third parties. 5.2 Maintenance, servicing (1) The module container interception troughs must be kept free of soiling. (2) Any damage to the interception trough surface protection must be rectified immediately. (3) If a grating is replaced, only a grating of at least the same load-bearing capacity may be used. (4) If the interception trough is repaired after any form of damage which has considerably influenced its correct functioning, it must be subject to a renewed leakage tested. Overhauls and leak tests must either be carried out by the manufacturer or by a specialist company in accordance with 19 1 WHG who is able to meet the requirements stated in Section 2.2.1(3). 5.3 Inspections (1) The module container operator must determine through the use of visual checks at regular intervals, at least once per week, whether liquid has run out of the containers into the interception trough. Any leaked liquid must be removed immediately without damage to the surroundings. (2) Normally, suitability of the blocking devices built into the ventilation openings is not proven for ventilation systems in which heavy soiling, extreme moisture or chemical contamination can be assumed (compare application area of general building regulations approval issued for the blocking device). For this reason, the blockage device function must be tested if major leakages of gas-producing liquids has occurred. (3) Use of "PX-G" construction products for the closure of overflow openings has not yet been proven in the context of the general building regulations approval issued for this purpose for the effects of gaseous chemicals such as vapours produced by concentrated sulphuric acid or the gases produced by concentrated ammonium hydroxide solution or by liquid chemicals such as caustic soda solution or sulphuric acid or salt spray. For this reason, any "PX-G" construction products must be replaced by new ones if any relevant leakage has occurred. (4) The condition of interception trough and gratings must be checked annually by visual inspection. The results are to be recorded and are to be made available to the water authority responsible on demand. (5) The condition of steel doors, especially that of corrosion protection, must be checked at least annually. 5.4 Provisions for mounting parts With regard to fire protection closures and any locking devices and cable and pipe bulkheads, the regulations contained in the general building authority test certification or approvals issued for these construction products and construction types apply to their usage, maintenance, service and inspection.
