3 1. INTRODUCTION It is proposed to rezone land in Papakura from the current rural/residential zoning to industrial. The area under consideration is bounded by Takanini School Road to the west, Porchester Road to the east and Manukau City to the north. To the south, the site extends to the residentially zoned land immediately to the north of Manuroa Road. The site is shown on Rgure 1 below. It identifies planning methods for controlling these effects and proposes noise rules that are considered appropriate for the development.

4 2. EXISINTING AND PROPOSED ZONING Figure 1 above is an excerpt from the zoning maps of the Papakura District Plan and show the site zoned as Rural/Residential. The zoning of the surrounding land and the appropriate noise rules of the District Plan are described below: - To the north: This land is on the far side of Papakura Stream and is within Manukau City, where it is zoned as Residential; - To the south: Residential zone; - To the west: Predominately with some Residential to the south; - To the east: Rural/Residential The proposal is to rezone the existing Rural /Residential land to mainly with some Industrial 1 zoning.

5 3. LANDUSE PLANNING While the noise rules proposed below can be used to control the effects of noise from the proposal to the surrounding activities, there are a number of practicable features that could be considered for the proposal that will improve the amenity of the local environment such as: - Buffer Zones To control the effects of noise from one zone to another, it is recommended that the noise sensitive zones, such as Residential and Rural/Residential, be separated from the high noise zones, such as Industrial 1 and in particular. Appropriate buffer zones include open space. - Staged Zoning The noise rules proposed later in this report provide higher noise levels for than for Industrial 1. It is therefore recommended that the less intensive Industrial 1 zoning be used as a buffer zone between the noisier and the noise sensitive Residential and Rural/Residential zones. - Screening Placing a physical screen between the Industrial 1 and 3 sites and the Residential and Rural/Residential sites will help to control noise. While the screen could be a fence or earth bund (situated on an open space zone), the buildings proposed for the Industrial sites themselves could also be used as screens. For instance, assuming that each industrial site consists of a building and a yard, placing the building adjacent to the residential boundary will provide screening from activities within the yard.

6 4. EXISINTING DISTRICT PLAN NOISE RULES The relevant noise rules of the Papakura and the Manukau District Plans are important as it is proposed to base the noise rules for the proposal in then. The current noise rules are shown below: Zone Residential Rule 4 Criteria The noise level (L 10 ) as measured at or within the boundary of any residentially zoned site (other than the site from which the noise is emanating) shall not exceed the following limits: Monday - Friday Saturday At all other times including Sundays and public holidays 45dBA 45dBA 40dBA Noise control between units - An acoustic design Part 4 ii certificate shall demonstrate that the unit has been designed in such a manner as to comply with the following internal noise levels (L 10 ) Bedrooms Habitable Rooms 35dBA 45dBA

Rule 8.5(1) applies to home occupations but is included as it provides an understanding as to the level of protection that Council consider suitable from Rural areas. 9 5. PROPOSED NOISE RULES The noise rules that are proposed for the project are shown in Table 2 below. The proposed rules have been based on the current rules in the District Plan but have been modified in some cases, the reason for which is discussed in the table.

10 Noise Rule Residential Zones The noise level as measured at or within the boundary of any residentially zoned site (other than the site from which the noise is emanating) shall not exceed the following limits: Comments This rule is a direct copy of the existing rule for residential zones with a provision for the control of the maximum noise level (Lmax). 11 * The notional boundary is defined as a line 20m from the fa<;ade of any rural dwelling or the legal boundary where this is closer to the dwelling. TABLE B The noise level as measured at or within the boundary of a site zoned for an industrial purpose shall not exceed the following limits: Industrial 1 j50dba J65dBA A building that is located in an industry 1 or Industry 3 zone and which is to be used for Residential purposes shall be designed and constructed such that: The noise level inside any bedroom resulting from noise generated by permitted activities within the surrounding Industrial 1 or zone shall not exceed 35dBA L 10 in any bedroom. - The upper noise level from the zone at 'all other times including public holidays' has been reduced from 50dBA to 45dBA as 45dBA is the upper level recommended by NZS6802 for residential properties at night time. - The layout of this rule mimics the current rule. Given the additions proposed to the rule, there may be benefits in reviewing the layout. The level received by an zone has been increased from the current 55dBA to 65dBA. This is because under the current rule, 55dBA is considered restrictive for industry and compliance results in the requirement for expensive mitigation. The increased level is considered to be more appropriate. This rule has been added to allow for residential in industrial areas, if this is intended, to protect the industrial activities from reverse sensitivity. 13 6. CONCLUSIONS The noise rules for the proposed Takanini Area 6 development have been based on the existing noise rules of the Papakura District Plan but updated where appropriate. As the development boarders a residential zone in Manukau City, the criteria of the District Plan for Manukau District Council have been included in the proposed noise rule. Rhys Hegley August 2007
