The due date for questions has passed and the due date for bids remains the same. I. Changes, Additions, and Modifications to the ITB A. Changes 1. Part III Special Provisions Delete all references to APP in the page numbers of the section and replace with III. B. Additions 1. Part III, Section Scope of Work (Page III-6) Add the following bold, italicized text under the existing text: A Super Silt Fence shall be placed at the outfall of the pond as shown in Attachment A. In addition, a filter bag shall be installed prior to pumping water from the pond and shall be installed per Detail F-4 Filter Bag Straw shown in Attachment B. The water shall be pumped to the outfall rip rap so it can flow through the super silt fence. 2. Part III, Section Bid Item A-1: SWM Pond Conversion (Page III-6) Add the following bold, italicized text under the existing text: The Contractor shall assume up to six (6) inches of sediment shall be removed from the bottom of Forebay # and bottom of SWM pond. In addition, the rip rap in the forebay shall be removed and replaced/reestablished as shown in Attachment A.

Part III, Section Bid Item A-3: Gabion Basket Repair (Page III-7) Add the following bold, italicized text under the existing text: The gabion baskets shall be removed and reconstructed as shown on Attachment D (Revisions to Asbuilt.) 4. Part III, Section Bid Item A-4: Fencing (Page III-7) Add the following bold, italicized text under the existing text: Add twelve (12) foot chain link gate to the four (4) foot chain link fence as shown on Attachment A. In addition, No Trespassing signs shall be placed every 50 feet around the perimeter of the pond attached to the fencing. The signs shall be 14 by 10 in size. C. Attachments 1. Attachment E - Pre Bid Meeting Sign In Sheet II. Pre-Bid Meeting Notes Introduction Good morning, and welcome to the pre-bid meeting for ITB 14-02, NPDES Acton Lane. My name is Shanna Reese, and I am the Assistant Chief of Purchasing for Charles County Government. Also with us today is Mr. Arthur Swann, and Mr. Mike Snyder, of the Department of Planning & Growth Management, Capital Services Division. The primary purpose of this project is to convert the current sediment basin into a stormwater management facility. This project is in support of the County s efforts to fulfill the NPDES permit requirements. Work includes converting the pond from its current condition as a sediment basin and repairing all the existing gabion baskets at the forebay. The meeting will be conducted in 2 parts. o I will first review selected portions of the Instructions to Bidders within the ITB. Items not reviewed should not be construed as being less important than those reviewed. No information will be presented that is not already contained within the ITB. I will then ask for any questions pertaining to the Instructions to Bidders. o The meeting will then be turned over to Mr. Swann who will discuss technical aspects of the project, and entertain any technical questions. o As a group, we will then proceed to the site visit locations. If you have not already done so, please sign-in on the attendance roster. Procurement Discussion / Questions All solicitation documents may be found on the County Bid Board. Ensure all required forms and any other information required is complete and in your bid package. o Bidder s Experience Form on page I-18. o Bid Form on page I-13 & I-14. o Addendum Certifications on page I-17 (there will be at least one addendum). Submit two (2) unbound original and two (2) copies of your bid. 2

3 Questions concerning the procurement process should be directed to me via the contact information provided in the ITB. In accordance with the ITB, all technical questions should be directed to Mr. Swann, in writing only, via the contact information provided. No information obtained from any source other than the Solicitation documents found on the County Bid Board, or from myself or Mr. Swann, may be considered to be accurate. Important Dates are identified in Part I, Section 1.4 of the solicitation. Bids must state that they are valid for 120 days from the due date. There is an aspirational 25% MBE goal for this solicitation. We encourage you to meet that goal. This procurement is subject to the County s Small, Local Business Enterprise (SLBE) Program. Please contact Lucinia Mundy in the Purchasing Office for additional information. Insurance requirements are located on page I-7 of the ITB. The protest policy may be found on page I-5. The County may reject any and all bids for any reason it deems necessary, and may waive any irregularities and/or informalities, and make award in any manner that is in the best interest of the County. Award will be to the lowest responsive, responsible bidder, provided it is in the County's best interest to do so. Project Term: The project is to be completed within 270 consecutive calendar days, from the Notice to Proceed date issued by the County. A 5% Bid Bond, certified check, or bank Cashier s/treasurer s Check shall accompany the bid or the bid will not be considered. A Performance Bond and Labor & Material Payment Bond in the amount of 100% of the contract price will be required for this project and contract. By submitting a bid in response to this solicitation, the bidder certifies that their firm is not debarred, suspended, or otherwise ineligible for participation in government procurement by the federal government, the State of Maryland, or any other state, county, or municipal government. Are there any questions pertaining to the procurement process? I will now turn the meeting over to the Mr. Swann, who will discuss technical aspects of the project, and answer any technical questions. Technical Discussion Art Swann This project has already been built to the configuration of the sediment basin as shown on the as built drawings. It was built for the roadway project (Acton Lane Phase 3) to handle the sediment and stormwater runoff. However, the County canceled the project during construction and the roadway construction never started nor the storm conveyance system from the roadway to the stowmwater facility. However, this facility is designed to treat the stormwater runoff from the existing neighborhoods as well as the new roadway (that was not constructed). Our goal here is to convert it to a storm water management facility and gan final acceptance. For access to the site, there is one access at the end of Tred Avon Court where the forebay is. There is also access for heavy hauling off via a private gravel driveway off of Acton Lane northwest of Tred Avon Ct, towards Prince George s County. A Right of Entry has been established to use this driveway and it was used during the heavy hauling of the construction of the sediment basin. The entrance at the other end of Tred Avon Court has a sewer pipe and a manhole which is probably not a good access point for any heavy equipment, but would be safe for smaller vehicles or for loading/unloading some equipment. The as-builts for the current sediment basin is on the bid board so you can see what configuration the pond is in. The storm drain pipe designed to convey the stormwater from Acton Lane was only built from the forebay to manhole 20. In the red (on the as built plans) are the actual elevations, you shouldn t have to do any work at the inflow of the pipe run but uncover the rip rap. 3

4 Quite a bit of landscaping will need to be done also. There is a plant list on the drawings set that must be followed. The weir wall has a wall opening that has been bricked shut per plan with a dewatering pipe through it. The brick and the pipe shall be removed. In addition, the rip rap and profile shown (Section B-B) on page SWM01 must be installed per plan. The whole entire bottom of the pond, must be mucked out, all the sediment removed, the clay core installed, and the finish grade reestablished. For this contract, assume that six (6) inches of sediment must be removed from the pond. The contractor shall muck out the bottom of the pond, put it back on grade and put the 6 clay liner in at the bottom of the pond but not the forebays. There is a forebay at the end of Tred Avon Ct. that also must be mucked out (assume 6 of sediment), regraded, rip rap reestablished, and stabilized. The rip rap must be removed and reinstalled in the forebay as well (coming off of Tred Avon Ct.). Also, as part of this contract as detailed in Appendix 1 of the solicitation, the Gabion baskets previously installed during construction of the sediment basin failed during the storms of September The Gabion Baskets need removed, then the subgrade reestablished and tested by geotechnical engineer, and installed per plan (Revisions to As Builts). This contract includes all the fencing shown in Appendix 1 of this solicitation. Please include the fencing shown in the diagram/drawing of the contract documents. It includes a split rail fence around the forebay at the end of Tred Avon Ct., and a 4 chain link fence around the remainder of the pond. The existing split rail fencing around the forebay shall be removed and discarded. Another twelve (12) foot double gate will be added per addendum to be installed at the forebay of the pond. So, there shall be two (2) each twelve (12) gates in the chain link fencing, and one eight (8) gate for the split rail fence. The contractor shall include in their bids installing No Trespassing signs all around the facility every 50 feet. You will have to pay attention to the landscape requirements as they are very specific in range and location. I also imagine you are going to have to pump this pond down to complete this work. Pre-Bid Meeting Questions Question 1 Question: When will the Notice to Proceed be issued? Response: Once contracts are executed, the County will schedule a Notice to Proceed start date, which is estimated at late winter/early spring at this time. Question 2 Question: You said the bids subject to a payment performance does that mean there s a possibility that it s not required? Response: No, that will be required. Question 3 Question: You said the bid must state its good for 120 days, is that on the bid form or should we write that on the bid? Response: No, this should be specified in the cover letter to be submitted with your bid as per Part I of the solicitation. Question 4 Question: So it probably has some overgrowth on it (pipe run from Acton Lane, rip rap area)? Response: No, it has like a filter cloth over it covering it so there isn t any overgrowth. Question 5 Question: Do we reinstall existing or replace it with new gabion baskets? Response: If you can reuse it then that s fine otherwise new. 4

5 Question 6 Question: Is that going to come out in the Addendum? Adding the gates there (end of Tred Avon Ct) because it is not showing a gate on corner? Response: Yes, locations of the gates will be in the addendum. See Attachment A. Question 7 Question: Is it showing a fence across that rear wall? You guys don t want it across there? Response: No, the current diagram does not show a fence here. We do not want a fence on top of the weir wall. Question 8 Question: Will you provide a spec on the sign or can we just go to a hardware store and buy some? Response: See Item I.B.5 above. Question 9 Question: Are bids due December 18? Response: Yes. Question 10 Question: When do you expect to start, I know there is a normal process for everything? Response: Actually, as soon as the contracts come back through our Purchasing procurement and everything is in order with them then we will contact the contractor and we ll schedule a Notice to Proceed. We would hope to start by the end of February or early March. Question 11 Question: So you think it will be probably generally six weeks to start? With landscaping, it d be best to install this in the spring. Response: We are looking at late winter early spring. Hopefully we can start late winter. Conclusion Thank you for attending, and good luck. Copies of the attendance roster will be posted on the County Bid Board. An addendum will be posted containing all of the questions from this meeting, as well as any others received. Please ensure you sign the attendance roster before you leave, if you have not already done so. III. Questions and Responses The following are responses to written questions submitted to the County. Question 12 Question: I would like to get the cost estimate of the Acton Lane National Pollutant Discharge Elimination System. Response: Cost information is not available for this project. Question 13 Question: Please clarify extent and thickness of the clay liner. Response: See Sheet SWM01 of the Contract Drawings. Sheet SWM01 specifies a 6 clay liner. Question 14 Question: Please verify the soil classification required for the clay liner. Response: See Sheet SWM01 of the Contract Drawings. Sheet SWM01 specifies a CL or CH material with a 95% compaction per MD 378 specifications. 5

6 Question 15 Question: Is there assumed thickness for the existing sediment to be mucked out? Response: See Section I.A.3 Changes. Question 16 Question: In the invitation to bid section 2.7 Sediment & erosion Control reads as follows: The Contractor must install erosion and sediment (E&S) control measures as shown on the project drawings or otherwise required by the regulation. Is there an erosion control plan for this project? Response: The approved sediment and erosion plans for the project is included in this addendum as Attachment C. Since this project is at the end stage of the Sequence of Construction of the approved drawings and all stabilization has been achieved, you must start at the appropriate sequence of construction. Consequently, the silt fence has previously been removed when the sediment basin achieved final acceptance by the County and after adequate stabilization. However, super silt fence shall be installed at the outfall of the pond if the pond will be pumped out as shown on Attachment A. Question 17 Question: Will as-built drawings be required for the conversion work that has been performed? Response: Yes, however, only the changes made to the pond during this contract work shall be shown on the as built drawings. * * * * * * END OF ADDENDUM * * * * * * 6
