6 1.0 Introduction CIDCO India's Premiere Town Planning Agency. When it says, We make Cities, does not solely attribute this claim on the creation of eminent housing infrastructure rather various urban development projects, which are unique, justifying CIDCO's vision in the city planning and development. The CIDCO planned city, Navi Mumbai is witnessing rapid development in the construction activities. As a part of the transparency and reforms initiatives, CIDCO is implementing COPAS for sanction of building plan to make it simple, transparent and stakeholder friendly leveraging information and communication technology. It's an initiative in making Navi Mumbai a smart city using high-end technology solution like GIS and online building plan approval system, SAP etc. An unique and innovative software solution COPAS enables online plan submission, automatic scrutiny of building proposal by reading CAD (Computer Aided Design) drawings submitted by architect/applicant, assessment of charges to be paid online and issue Commencement, Occupancy and other certificates online. What is COPAS? COPAS is the automation of Building Permission Planning Dept. the approval process, followed for approval of architectural plans. It is an application customized for efficient management and approval of the drawings. It helps in attaining standardization and hence transparency in the total process of building permission. The complete building Online Document Sharing approval management system will be a web based system where Architects submit the plans and required documents on line. The customized software available for approval is based on the GDCR and rules of GDCR. The submitted proposals will be scrutinized automatically and will be accepted or rejected based on the scrutiny sheet generated by the system. Advantages of COPAS COPAS is a system for online submission of proposals for Development permission. It is a system driven Scrutiny of Building Plans and Approval Management System. An unique software to Scan CAD drawings and map them to Development Control Regulation /rules for approval by CIDCO. Seamlessly integrated to online approval workflow to monitor the approval process with associated document scrutiny. SMS and Personal Digital Assistants are used for creating alerts and notifications at every stage of approval process to the architect/owner. 2

7 2.0 CIDCO s Online Plan Approval System (COPAS): Permission Process Building Permission section of Planning Department is the office concerned for grant of development permission of buildings (commercial, industrial and residential etc) based on GDCRs and stipulated set of rules and policies. As per the relevant provisions of the Act, any person desirous of undertaking a construction activity (New as well as modifications), is required to be obtained prior to clearances from the CIDCO (dealt in Building Permission section) before embarking on the same. The licensed architect shall also prepare and shall indicate his name, address, qualifications and license number as allotted by the Council of Architecture. The plans shall also be duly signed by the Licensee indicating his address and submit the same on proposal site. The Building Permission section performs scrutiny and processing of building plans and issues Development Permissions (CC). No person shall carry out development or building construction activity without obtaining permission from the corporation. In case the Owner (Licensee) of authorized & legal plot wishes to carry out construction, he shall apply to the Building Permission section, CIDCO in the prescribed format with plan and building drawing prepared by using AutoCAD (both architectural & structural) in a particular format along with the requisite scrutiny fees and mandatory documents. Compliance with the provisions of General Development Control Regulations (GDCR), MR & TP (Maharashtra Regional and Town Planning) Act & Rules to GDCRs is must for any building plans. Both architectural and structural drawings submitted by the architect would be scrutinized using COPAS and scrutiny reports are generated. All construction or work for which permission is required shall be subject to inspection /scrutiny of Document, Site, and Drawing by the Corporation. Inspection, where required, shall be made within the stipulated time period following the receipt of application. Plan may be approved or refused after scrutiny. Once plan is approved and Commencement Certificate (CC) is issued after which owner shall be free to carry out the construction according to the sanctioned plan. Architects should submit site photographs with latitude and longitude from all sides (as plot shapes may be zigzag and not geometrical). Site inspection authority should also take site photographs with latitude and longitude from all sides during site inspection and system would match the coordinates (latitude & longitude) of submitted site photographs for correctness and further processing. System provides verification checkboxes and space to write comments for site photographs provided by the architect and option to attach site photographs with latitude and longitude taken by site inspection authority during site inspection. 3

8 Proposal for development permission may be refused after scrutiny (Scrutiny of Documents, Site, and Drawing) by Building Permission section. In case of refusal after scrutiny subsequent resubmission can be made by the architect. System generates building as well as fire scrutiny reports using COPAS based on building bye laws (GDCRs), fire norms and NBC norms Architect (License) should submit hard copies of the documents (ownership documents & NOCs) within 8 working days of proposal submission. Application system displays a message for this on architect s dashboard. Inward clerk has option to refuse the proposal if hard copies are not received within 8 working days. Scrutiny (Document, Site and Drawing Scrutiny) should be completed within 8 working days. At the first inspection, the Authority shall determine to the best of its ability that the building has been located in accordance with the approved site plans. Building Permission section of planning department provides details of various fees such as scrutiny fees, security deposits, developmental charges, infrastructure development charges, premium charges for free of FSI components, drainage connection charges, PSIDC etc. Accounts section takes care about collection of the fees / charges and maintenance of appropriate records. Accounts Section (Account Clerk) will receive the payment in form of DD (Demand Draft) only and issues payment receipt. Architect /Owner submit the payment receipt at the counter of Inward Clerk (Building Permission Section) for updating the payment details (Payment amount, mode of payment, date of payment, DD/Online payment reference number) into the system. Challan payments can be made either online using application s interface or offline at Accounts Section s counter. Cash / Cheque payments are not accepted at CIDCO. In case of offline payments, credit verification is obtained from Account Section. Architect (Owner) is required to pay scrutiny fees on proposal submission. Proposal acceptance acknowledgement and permanent file number is generated by the system after payment of scrutiny fees. System provides interface to both Architect and Owner (licensee) to view and pay scrutiny and other fees (challans) online. Application system has provision of reassignment of proposal for scrutiny to the competent authority by the higher level authority to deal with unforeseen situations arrived due to sickness, leaves etc. Resubmission (Revision) of drawing due to deviations as per building bye laws (GDCR) is allowed for maximum 5 times. Architect / Owner is liable to be penalized by taking the scrutiny fees again by the corporation after 5th Resubmission (Revision) attempt. Application system has provisions to black list cancel the registration of Architects based on malpractices such as submission of false documents, more number of attempts for submission of false documents, submission of drawings with failed entities >3 times etc. 4

9 Once the submitted the plans are in accordance with the GDCR rules at the compliances are made the development permission shall be granted online including parameters. The architects / owner shall be communicated through SMS / alerts. It is expected that through the system a maximum 15 working days would be required for seeking permission subject to all required compliances to be made by the applicant. In case any compliance not made, the permission can not be proceed further till the same is complied. Only registered architects with valid license should be allowed for proposal submission. Architects with invalid / expired licenses will not be allowed to submit / resubmit proposals. Such architects would have view only rights of earlier submitted proposals. CIDCO issues LETTER OF INTENT (LOI) for proposals with gross built up area greater than square meter for obtaining Environmental Clearance from authorities concerned and issues CC after receiving Environmental Clearance Certificate. The permission once accorded shall remain valid up to one year. The permission shall be got revalidated before the expiry of this period. Such revalidation may be permitted for three consecutive terms of one year each (i.e ), after which proposals shall have to be submitted afresh. No drawing scrutiny is done at the time of CC renewal, only documents are validated. Renewal fees (Premium for extension of time period) is taken. CC extension /Revalidation letter is issues by the corporation after renewal. Renewal of Development Permission (CC) will not be required if plinth completion certificate is already granted within one year from C.C. The Authority may either sanction or refuse the plans and specification or may sanction them with such modifications or directions as it may deem necessary and there upon shall communicate its decisions to the person giving the application. Application system has provision of verification of approved cases by immediate next higher level approval authority. Out of 10 approved cases, at least 1 approved case must be verified by the next higher level approval authority. Application system, after approval of 10 cases should display an alert to send 1 case to next higher level approval authority for verification. In the case of refusal the Authority shall give the reasons and relevant provisions of the rule which the plans contravene. The Authority shall as far as possible advise all the objections to the plans and specifications in the first instance itself and ensure that no new objections are raised when they are resubmitted (revised) after compliance of earlier objections. The Authority may revoke any permission issued under the provisions of these rules wherever there has been any false statement or any misrepresentation of any material fact in the application on which the permission was based. Once Development Permission (Commencement Certificate) is issued /granted, Owner (Licensee) will start building construction work strictly as per approved plan and complete up to plinth level. 5

10 After giving Development Permission, CIDCO would upload Commencement Certificate (CC), approved drawing and building floor details on its website that should be viewable / downloadable to the Architects / Owners / Citizens. Temporary Development Permissions are given on plots where land is notified but not acquired yet. The temporary permission is given for one year period and, it requires renewal (revalidation) every year. Temporary permission is one time permission and no plinth completion / 1st habitable floor completion or occupancy certificate is issued for constructions on such notified plots. Temporary Development is only in terms of time and not for type of construction. Development Permissions for installation of Mobile Tower are given on plots / buildings where structure and mobile towers installation is proposed as per the Government Notification. Different ownership documents and NOCs from concerned departments are required to process Development Permissions application for Mobile Tower. Development Permissions for installation of Hoardings are given on plots /buildings where structure and installation of hoardings is proposed as per the guidelines of GR. Different ownership documents and NOCs from concerned departments are required to process Development Permissions application for Hoardings. Development Permissions for construction of compound walls on plots are issued by the Building Permission section, CIDCO as per GDCR. As the CC is valid till plinth, on completion of the construction of the plinth the owner of the building shall obtain from the Corporation a certificate to the effect that the plinth has been constructed strictly in accordance with the permissible covered area. The owner shall give an application to the Corporation, which shall either issue the Plinth Completion Certificate (PCC) or order suitable changes to be made as per the approved plan. The owner shall carry out such instructions as are given, failing which the authority will be competent to demolish such part of the plinth as in under objection. The granting of a certificate or the issue of instructions (Refusal) regarding necessary changes will be done within 7 days of the application, failing which it will be deemed that the certificate has been issued. Every owner on completion of 1st habitable floor and before completion of building shall obtain from the Corporation, a 1st Habitable Floor Completion Certificate (1stHFCC) to the effect that the building up to 1st floor has been completed as per the sanctioned plan. If during the construction of a building any deviation from the sanctioned plan is made, the authority may refuse issuing 1st habitable floor completion certificate. The inspection of 1st habitable floor completion of the work will be made within 7 days following the receipt of application. After completion of the building and on application of the licensee, the corporation will scrutinize and validate as built drawing for deviations if any at occupancy stage and issue occupancy certificate or refusal of the building occupancy within 30 days from the receipt of such request. System identifies gaps in CC and OC stage drawings. In case of major deviations, amended CC will be required. 6

11 At the request of the owner, Part Occupancy may be granted as per Rules to the GDCRs for one or more buildings in a layout of multiple buildings. In case of multi-dwelling units, part of the building where more than 50% construction is completed and safe occupation of completed structure is not obstructed due to ongoing activities. In case of Residential-cum-Commercial Plots, either residential or commercial part provided that the portion, for which Part OC is applied, shall be completed in all respects. Provided further that the owner/supervisor of the project shall take responsibility of public safety and health of the occupants in such part Occupancy issued buildings and indemnify the corporation in the prescribed format. As per the direction given by Honorable MD, Part OC in a single building may be permitted. If any construction is initiated without permission / work is commenced beyond plinth without obtaining PCC / possession is given without OC, suitable action will be taken by the corporation and If the construction is strictly in accordance to law and regulations the same may be regularized after paying the condonation charges as approved by the CIDCO Board. In case of plots falling in CRZ (Coastal Regulation Zone), prior approval of MCZMA is to be obtained. As per the High Court order (2005), no construction activity is allowed within 50 meters buffer area of mangroves. System generates MIS reports, displays status on GIS map, displays site photographs, plan drawing in PDF, permission certificates, online payment interface, SMS notifications and proposal status on citizen search interface. The license will not be required to obtain the NOCs being issued by various CIDCO departments. The said NOCs will be obtained by Building permission Section online from concerned departments within 10 days after receipt of requisite documents from the licensee. However, in case of special cases of additional FSI requesting exemptions, extension of time limits, the Estate NOC may require time upto one month. The licensee can obtain the temporary water supply and lectric connection without Estate NOC as required earlier, after the grant of CC. No separate NOC from horticulture section will be required, the same will be granted by building permission section only (except for the cases were tree cutting is involved). Water supply NOC required for OC has been scrapped. Health NOC required for OC will be granted by Engineering Section. PSIDC NOC will be required at the time of CC only except for cases involving increase in built-up area. For speedy clearances of OC proposals and to bring out transparency, the licensee shall be required to attached video footage of site showing main features. 7

13 3.2 Architect Registration Every Architect who intends to submit the proposals online at CIDCO can do so by one time registration at CIDCO. Architect needs to provide his personal information such as name, firm name, registration no. validity, contact information, login name etc for online registration. In this system architect is registered not his firm as per Council of Architecture Registration no. Architect will receive an SMS containing application login credentials on successful verification of identity and license documents. 3.3 Dashboard for Architect/ Engineer Architect can access the application system by providing the login name and password.after login, dashboard is displayed as default page. This complete dashboard will show the In Process, Approved and Refused proposals. View Details 9

14 link provided on dashboard redirects the userto the proposals list page. Individual proposals can be viewed by clicking on file number link from proposals list page. 3.4 Proposals The left panel provides an option New for submitting new proposals. The architects need to submit the proposal information along with documents scanned copies and architectural, structural & fire drawings. 21 3.4.8 Revision of Proposals If proposal gets rejected based on 1. Document scrutiny 2. Site visit scrutiny 3. Technical Scrutiny Architect need to revision the proposal. For resubmitting file, architect will have to follow following step like. A consolidated list of Refusal proposal is available on the Proposal section. Architect/ Engineer needs to enter the file number of the proposal to comply the objection. Below screen shows the process of resubmission. Based on the objection type compliance screen will be displayed. Compliance can be one of the following : 1. Drawing Objection 2. Document objection 3. Site visit objection 4. All the above or any combination. 17

22 3.4.9 Approved Proposals Architect can see the list of Approved proposals. By clicking on the file number he/she can view the all details of the respective file. Architects can see the Scrutiny Reports, Proposal Receipt and Commencement Certificate by clicking on them. Scrutiny Reports:- 18

24 By clicking on the file number he/she can view the all details of the respective file. Refusal Letter: Submission Of Earlier Proposal For Further Permission :- For the Cases, which were already granted development permission manually (i.e. C.C./PCC), a separate link is provided as APPLY FOR PAST PROPOSAL. Proposal seeking Plinth Completion Certificate (PCC), Habitable Floor Completion, Amended Commencement Certificate, Occupancy Certificate (OC) may be submitted through the COPAS through this link. 20

25 The Following procedure should be followed. 1. After login, press the link APPLY FOR PAST PROPOSAL in proposal tab. 2. Fill up the information a. File No. (Only digits) b. Basic Plot Details e.g. Plot No,. Node, Area etc c. CC date d. CC Outward No. 3. Click on save button after filling all information 21

27 4.0 GUIDELINES FOR NOC FOR CC (COMMENCEMENT CERTIFICATE) (To be read in conjunction with chapter 7.0) 4.1 POWER SUPPLY INFRASTRUCTURE DEVELOPMENT CHARGES (PSIDC) NOC (applicable for Kharghar & Ulwe Nodes only) Kharghar Node A. Document required for NOC of Commencement Certificate i) Undertaking on stamp paper of Rs. 200/- for load not exceeding 300 KW for residential & 600 KW for commercial use in case plot BUA is below 400 square meters. (Annexure-I) ii) Load calculation certified by Electrical Consultant. iii) Details of D.D. in favor of CIDCO for the amount of PSIDC as per norms. iv) Attested copy of receipt for PSIDC paid (Original copy for verification) B. Guidelines (please refer 7.2) 1. The documents will be verified at Single Window, after verification, if the, plot owner has made the PSIDC payment in the marketing, estate & land sanction as per payment norms, then the PSID charges will not be recovered at Single Window, Kharghar, if not PSIDC payment challan will be issued to the plot owner for making the payment. (refer Annexure-II) 4.2 Provisional Fire NOC 2. After the payment made by the plot owner the copy of the challan alongwith the receipts will be submitted by plot owner to Single window (Kharghar), thereafter the PSID NOC for C.C. will be issued to ATPO. 3. If there is no change in Built up area (BUA), NOC at the time of O.C. will not be required. But if there is change in Use, FSI or BUA, then it will be mandatory to obtain NOC for O.C. Submit online all architectural drawings in metric system which should include Block Plan, Typical Floor Plan, Section & Elevation Plan etc. and floor wise area calculation certificate duly signed by Architect/ Civil Engineer. (Including free of FSI areas like basement, underground tanks, underground solvent storage areas etc.) After approved by Town Planning department plans will be forwarded to the Fire Department. 14. Block Plan of building should be given with the details such as width of the main road on which plot is located, activities of the adjacent plots, width of main entrance, other entrance to the plot, Basement if any, Details of the activity carried out in Basement, Marginal spaces, approach roads around the building, and other details for industrial activities like transformer yard, utility block, raw material & finish goods storage, tank farm area, storage of hazardous gases, liquids etc, for e.g. LPG, A, B and C - class petroleum products, LDO etc. 15. Brief Note on Activities to be carried out in the building. If it is a Industrial or storage building then the Process flow chart of the plant duly certified by authorized person on his/her letterhead should be submitted. 16. In case of industry the list of raw material (including Consumable Materials like LPG Cylinders, Storage Qty for Diesel Generators etc) and finished goods with their quantity, their storage place in the plant should be marked on block plan. 17. If handling, processed or storage of any materials which requires permission from Govt. Agencies then, Copies of approvals taken from Govt. agencies like Chief Controller of Explosives (CCE), Excise Deptt. Gas Authority, MPCB, DISH, FDA, etc. In case of high rise building falling around airport, NOC from Civil Aviation Authority is required. 24

29 18. If the building is in existence and has obtained Occupancy Certificate then, Fire Approval and occupancy certificate issued by planning authority, copy of the same should be submitted. The set of approved drawings shall be submitted. 19. Copy of Registration and License of the company/ society should be submitted. 20. The Architect/ Civil Engineer shall certify that the plans of proposed construction are confirming with the development control rules of concern competent authority and or provisions of NBC Built up area statement on Architect letter head as follow Total plot area in sq. mtr. The buildings shall be visited to check if the elevations are executed as per the drawings approved during obtaining CC. However the decisions of the Section Head regarding requirement of submission, approval or rejection of proposal shall be final binding on the applicant parties. B) Guidelines for Aesthetic NOC 1. The form of the structure shall be such that it depicts the purpose for which the structure is being proposed. i.e. 'temple' structure should look like 'temple', 'school' structure should look like 'school', 'sports' structure should like 'sports centre'. 2. For religious buildings, the top most element shall be 'kalash-shikhar'/ 'dome'/ 'steep sloping roof which gives identity to the structure. 3. Essential architectural elements for that particular structure shall be invariably proposed to achieve architectural character for the structure, i.e. 'temple' structure should have elements like 'kalash', 'shikhar', 'arches' 'decorative parapet'. 'Masjid' structure should have elements like 'dome', 'arches', 'decorative parapet', 'jali pattern' etc. 4. All 'School/ College' buildings should depict 'educational character' e.g. 'discipline' can be manifested through straight lines of structure expressed on external surfaces, 'impartiality' can be shown by uniform size of openings etc. 5. 'Cultural and Linguistic' buildings shall depict the architectural character of that particular group / community /area. 6. The proposal should be exactly as per Project Report submitted to Social Services Section for allotment of the plot. 7. The plans enclosed with the proposal for aesthetic approval shall be the same as proposal submitted to 'Building Permission Section'. 8. The openings indicated in the form of windows on elevations and perspectives shall exactly match with the plan submitted. 9. The name of the building shall be prominently visible from all the roads. 10. Colour scheme of the building shall also reflect the character. 11. In no case, toilets shall be located on the road side/s of the structure. 27

32 5.0 GUIDELINES FOR NOC FOR OC (OCCUPANCY CERTIFICATE) (To be read in conjunction with chapter 7.0) For temporary water connection and electricity connection, no separate NOC will be required after issuance of Commencement Certificate 5.1 PSIDC NOC : Only applicable for cases where i) NOC is not obtained during Commencement Certificate. ii) The 1 st Tripartite agreement executed after obtaining C.C iii) There is change in Use/FSI/BUA 5.2 FIRE NOC : Following are the guidelines for issuance of Fire NOC for occupancy certificate. Note: Refer Annexure-III for formats / fees 5.3 Guidelines for Horticulture NOC (Please refer 7.4):- No separate NOC will be required from Horticulture Section the Building Permission section will verify the status as per following guidelines. 1) Guidelines :- a. As per the Tree act one tree should be planted for every 100 square meters of plot area. b. Trees should be healthy, well grown and of minimum 5 feet height from the ground level. c. Maintain minimum distance of 1.5 feet from the compound wall. d. Maintain minimum distance of 3 meter c/c between two trees. 2) List of documents :- a. Commencement certificate with assessment copy To know the area of the plot. b. Photographs of trees (The trees should be numbered and individual photographs of trees should be taken in such a manner that the tree should be clearly seen from bottom to top of the tree.) c. Drawing of the said plot with trees location. d. Form D undertaking for plantation and preservation of trees as per Tree Authority Act from applicant on stamp paper of Rs.100 with notary (Annexure-IV). 3) Fees/charges to be recovered :- Security deposit Rs.1000/- per tree before issuing tree NOC should be deposited with CIDCO by the applicant. 29

34 5.4 Guidelines for Health NOC No separate health NOC will be required from Public Health Section, Engineering Section at the time of verification of drainage system will verify the status as per following guidelines. A] Compliance of following points: 1) Removal of construction materials & debris from S. W. Drains / footpath/ road / inside and outside of plot area / any other place. 2) Rectification and Restoration of Drainage covers / slab damaged during the construction work. 3) Fixing of Drainage covers in proper manner. 4) Cleaning of Overhead & underground water tank. 5) Erection of Rung ladder to OH water tank with supporting system as well as railing in proper manner. 6) Fixing of Covers to OH & UG water tank in proper manner. 7) Proper septic tank with provision of soak pit / anaerobic filter as per CIDCO standard (if applicable). 8) Fixing of mosquito net to ends of vent pipe/gas pipe/over flow pipe. 9) Connection of internal sewerage network/drainage system to the external sewerage system of the Corporation. 10) Proper area development around building to avoid water logging. B] Documents required for Public Health NOC: 1) Commencement Certificate 2) Architect s Virtual Completion 3) 240 ltr. capacity 2 wheel Dustbin for 30 flats C] Fees & Charges: 1) Vector control administration Rs.10/sq.mtr. 5.5 ESTATE NOC (Please refer 7.1): Following are the guidelines for issuance of Estate NOC for occupancy certificate. 1) If the Licensee completes the construction in initial construction period as stipulated in Agreement to Lease, the NOC will be granted without any further scrutiny within 10 days. 2) If the licensee could not complete the construction in stipulated period or even in extended period as the case may be, he will have to obtain further extension by paying applicable additional lease premium. for the entire year whenever the Licensee approach the Estate Section. Also, he will have to pay the Service Charges for the current financial year. 3) In case where part O.C. is already granted and Use or FSI is increased, in such cases NOC may be granted within 30 days 30

35 5.6 Guidelines for Water Supply Connection (Please refer 7.6) Applicant may independently approach water supply section to seek temporary and permanent water supply connections. No NOC will be required for OC. Documents required a) C.C - for temporary connection b) OC For permanent connection. 5.7 Guidelines for DCC (Drainage Connection Certificate): Drainage NOC (Please refer 7.3) CIDCO is under process of developing another online software system for processing the applications for Drainage Connection Certificate (DCC). Once the system is operational, the applicant has to apply through this system for obtaining DCC. Upon completion of the process DCC will be granted by concerned engineering division. The process details are placed at Annexure-V. Documents required for FINAL INSPECTION REPORT List of Documents (For Tendered Plot / 12.5% Scheme plot & Temporary DCC) 1. Connection charges paid receipt. 2. Photograph of drainage connection showing that the connection is below bottom PCC of adjacent Storm water drain. 3. Final work completion certificate in prescribed format List of Documents (For BUDP) 1. Connection charges paid receipt. 2. Final work completion certificate in prescribed format 31

37 7.0 REFORMS IN THE PROCESS OF SEEKING NOC :- Reforms in the process of granting various NOCs are done for various Certificates by different departments, while granting Building Permissions. Some of the processes for obtaining the NOCs have been scrapped and some are clubbed together to ease the entire process of application for NOC for Occupancy Certificate and entire process is simplified. Earlier at the time of Occupancy Certificate, Seven (07) sections NOC s were required, now after reforming only four (04) sections NOC s will be required. All NOC s of different depts. within CIDCO are granted within 10 working days. SMS and personnel Digital Asst. are used for creating alerts and notification at every stage. 7.1 Estate NOC a) No dues certificate for time extension/service charges In order to grant NOC for time extension/service charges certain timelines have been specified as under i. If applied for NOC for seeking part Occupancy Certificate (OC) as per the Agreement to Lease, NOC shall be granted in 10 working days. ii. If applied for NOC for seeking part/full Occupancy Certificate (OC) after expiry of initial construction period, for this NOC, he will have to pay the Service Charges for the financial year concerned. Besides these, there may be cases where land use is changed or FSI is increased. All such cases require detailed scrutiny by Estate Section and hence NOC may be granted within 30 days. Further to reduce the need to approach Estate Department for receiving NOCs especially, for taking O.C. /C.C, these NOC processes will be incorporated as a part of COPAS and will be obtained online by the Building Permission Section. b) NOCs for Temporary water and electricity connection After granting Commencement Certificate (C.C.) during construction period, temporary connection for water supply and power will be given by water supply and MSEDCL. This is an independent activity and as per the set rates by the respective departments Commercial rates before OC and normal rates as per land use, after OC. However, as per prevailing process, the applicant has to approach estate section to get NOC for temporary water connection and temporary electricity connection. This activity since is only related to charges collection the same may be taken care by the payment of bills as raised through the system and hence there is no need to take NOC from Estate Section for this purpose. These NOCs have been scrapped. 7.2 PSIDC NOC and charges a. At present charges for power supply within Kharghar & Ulwe nodes are being charged by Electrical Section for developing electric supply network. After payment of required charges NOC is granted. Presently NOC are being insisted both at the time of issuance of CC and again before granting O.C. 33

38 b. As these charges are related to the plot area and BUA which are fixed at the time of granting C.C. itself, the same shall not be insisted upon at the time of seeking O.C. This will reduce NOC seeking process. However, if there is any change in BUA due to Additional FSI or change of use, such cases revised/ balance payments will be charged. c. The PSIDC will be charged at the time of CC through COPAS. However, if there is any change in BUA, use or plot area, under such circumstances, balance/ revised charges will be collected at the time of O.C by Building Permition Section. 7.3 Standardization of process for seeking Drainage Connection Certificate (DCC) a. As per the prevailing practices after the completion of the construction work, the applicant has to submit a proposal to the Nodal Executive Engineer concerned for obtaining Drainage Connection. The Drainage Connection charges will then be assessed by the Engineering Section concerned based on the distance from the nearest manhole from the plot. This includes the charges for Drainage, Sewerage Connection, excavation refilling charges etc. b. Considering the fact, that these activities can be carried out independently even much before submission of the application for O.C. Engineering Section concerned may process / consider such proposals even during construction stage of the building. c. The charges to be collected for DCC have been standardized by linking them to the plot area instead of distance criteria being followed at present, which is a cumbersome process. This will enable the applicant to estimate cost beforehand and pay the charges accordingly. Also, a separate software application has been developed by Engineering Department, to streamline and speed up the process for granting NOC online. However, payment is delinked from this process of NOC issuance. d. The standardized rate per Sq.M will be integrated with the COPAS and the charges will be collected at the time of granting C.C. itself by Building Permission Section. The charges for current financial year shall be at the rate of Rs. 55/- per sq. mtr. of plot area subject to minimum of Rs. 10,000/-. This rate and minimum amount shall be enhanced every year with effect from 1 st of April by 7% or as per actual inflation index, whichever is more. 7.4 Horticulture NOC a. As regards the process for seeking NOC from Horticulture Section, since the guidelines have already been framed (refer 5.3) and also there is provision in the GDCR for plantation of trees within the plot; No need to seek separate NOC from Horticulture Office except for cutting of existing trees in a plot. b. The cases, where cutting or replanting of tree is involved, the matter shall be referred to the Tree Authority, for permission separately. As per the Act provisions, NOC for such cases shall be submitted at the time of seeking C.C. c. The staff of Building Permission section will visit the site at the time of CC and OC to verify the compliance made by the owner/developer on site as per the guidelines given by the Tree Officer for preservation, protection and plantation of trees, distance of tree planted from compound wall and between two trees. Number of trees planted will be also verified against the requirement, as per guidelines. 34

39 7.5 Health NOC The required Health NOC for occupancy certificate is issued by health department after verification of certain aspects. However, it is observed that these aspects are more related to drainage /sewerage connection and safety measures to be taken from cleanliness point of view which may be verified and certified by Engineering Department Hence no separate health NOC will be required from Health Section, Engineering Section at the time of verification of drainage system will examine the norms as per above aspects. 7.6 Water Supply NOC Water Supply charges will be connected by water supply section independently based on CC and OC as per approved rates / policies. Hence NOC is not required. 8.0 ATTACHMENT OF VIDEO CLIP/ FOOTAGE As a step towards speedy clearances, a new approach is introduced in the COPAS. As a part of this, the applicant at the time of seeking O.C., will upload a video clip featuring the site, type of construction carried out, trees planted, execution of works related to drainage system, sewerage system, the testing conducted for Fire protection/ equipments installed in this respect, provision of parking made within the plot etc, which will comprehensively cover all the aspects verified by each Dept. before issuance of NOC. This video clip will be kept in public domain for benefit of citizens. The video clip has to indicate the location of the plot through its co-ordinates (GPS), the date and time of the video footage. The Architect has to submit this video clip as a self certification of the completed project, for which the OC is sought. Also, Architect's and Owner's name shall be displayed and they will be part of the Video Footage. As this will be the basis for the Authorities to process the application for granting NOCs, misrepresentation of facts and malpractices shall be treated serious and punishable. It is proposed to take penal action against the Architect and also the Owner in such cases, which the Corporation may determine. This will ensure that the Departments issuing NOC to visually assess for themselves the status of work carried out at site by the applicant and if the prior conditions for issuance of NOC are fulfilled or otherwise. By keeping this in public domain, it will bring in transparency. 35
