5 DIVISION 01 GENERAL REQUIREMENTS

6 FLORIDA DEPARTMENT OF TRANSPORTATION SECTION SUBMITTALS PART 1 - GENERAL 1.01 WORK INCLUDED A. The provisions of this Technical Special Provision Section apply to those required submittals that are related to individual units of Work, not to administrative submittals, such as payment requests, insurance certificates, and progress reports. B. In addition to specific provisions of this Technical Special Provision Section regarding Work-related submittals, Technical Special Provisions Sections in Divisions 02 through 16 contain submittal requirements. C. Specific requirements in other Technical Special Provisions Sections shall take precedence over the general requirements contained in this Technical Special Provision Section RELATED SECTIONS A. PRODUCT SUBSTITUTIONS: Section B. PROJECT CLOSEOUT: Section C. GUARANTEES/WARRANTIES/ REPAIRS: Section SUBMISSION AND APPROVAL SCHEDULE A. Prepare a complete schedule of Work-related submittals, including shop drawings, product data, and samples. Submit this Schedule of Submittals to the Engineer for review and acceptance concurrent with the submittal to the Engineer of the Working Schedule required by Article 8-3 Prosecution of Work of the Florida Department of Transportation (FDOT) Standard Specifications for Road and Bridge Construction, Latest Adopted Edition, as amended. Coordinate this Schedule of Submittals with the Working Schedule and revise as needed to reflect changes in the Working Schedule. The following requirements will be used in evaluating the sufficiency of the Contractor s Schedule of Submittals: 1. Submittals are listed in chronological order based on anticipated submission date. 2. Critical submittals, which will impact the Critical Path of the project, are clearly identified. 7 3. Submittals involving materials, products, and/or items that require a long lead time for procurement are clearly identified. 4. A generic description of work covered by the Submittal is indicated. 5. The Submittal is linked with an activity or event number on the Working Schedule. 6. Identification as to pertinent Technical Special Provisions Section. 7. Item(s) involved. 8. Name of pertinent Subcontractor or supplier and the name of pertinent manufacturer. 9. Schedule date of delivery of pertinent items to the Project. B. Color Schedule: Submit separate listing of items requiring color selection by Engineer PROCEDURE REQUIREMENTS A. Coordination: Coordinate the preparation and processing of submittals with the performance of the Work. Coordinate each separate submittal with other submittals and related activities such as testing, purchasing, fabrication, delivery and similar activities that require sequential activity. 1. Coordinate the submittal of different units of interrelated Work so that one submittal will not be delayed by the Engineer s or the Department s need to review a related submittal. The Department reserves the right to withhold action on any submittal. 2. Scheduling: In each appropriate administrative submittal, such as the Working Schedule, show the principal Work-related submittals and time requirements for coordination of submittal activity with related Work. 3. Coordination of Submittals Times: Prepare and transmit each submittal to the Engineer sufficiently in advance of the scheduled performance of related Work and other applicable activities. Transmit different kinds of submittals for the same unit of Work so that processing will not be delayed by the Engineer s or the Department s need to review submittals concurrently for coordination. 4. Coordinate both procedural timing and listing, including naming and sequencing, of reports and activities required by provisions of this Technical Special Provision Section and other Technical Special Provision Sections, to afford consistency and logical coordination between submitted reports or lists. Maintain coordination and correlation between separate reports by updating at monthly or shorter time intervals. Make appropriate distribution of each report and updated report to entities involved in Work. Brooksville Maintenance Yard SUBMITTALS

8 5. Review Time: No Contract Time extension shall be authorized due to the Contractor's failure to transmit submittals to the Engineer and the Department sufficiently in advance of the Work and in accordance with the approved submittal schedule. B. Submittal Preparation: 1. Each submittal shall comply with Section 5 - CONTROL OF THE WORK of the FDOT Standard Specifications for Road and Bridge Construction, latest adopted edition, as amended, and other requirements contained in this Technical Special Provision Section. 2. Each Submittal shall be organized by the specific Technical Special Provision Section applying to the item or items included in the Submittal and shall be so identified in the Submittal Schedule prepared by the Contractor. Submittals that are not organized by Technical Special Provision Section will not be accepted for review and will be returned to the Contractor without comment. (Example; submittals organized by TSP Section 05500, not Division 05.) 3. Submittals shall be complete and include all items required by the specific Technical Special Provision Section. C. Submittal Transmittal: 1. Package each submittal appropriately for transmittal and handling. Transmit each submittal from the Contractor to the Engineer on a submittal form acceptable to the Department. Submittals received from sources other than the Contractor will be returned to the sender "without action. 2. Record relevant information and requests for data on the submittal form. On the submittal form, or on a separate sheet attached to the form, record deviations from the requirements of the Contract, if any, including minor variations and limitations. Review of a submittal will be undertaken only if all information is provided. 3. Resubmittals whether total or partial shall be clearly marked Resubmittal and handled as submittals herein specified except that the revised information be clearly identified. D. Submittal Numbering: 1. The Contractor shall number consecutively each submittal. This numbering system shall be in order of submittal. Any resubmittal required shall have the same number as the original submittal followed by notation signifying that this is a second (or third, etc.) submittal; example: #10 (2nd submittal), #10a or #10R3. 9 E. Additional Copies: 1. Where applicable the individual Technical Special Provisions Section will indicate if any additional copies of submittals are required above the quantities specified in Section 5 - CONTROL OF THE WORK of the FDOT Standard Specifications for Road and Bridge Construction. 2. If a submittal requires additional copies and those copies are not provided, the Contractor will be notified by the Engineer of the need for these additional copies. The review of the submittal by the Engineer and the Department will proceed, but action on the submittal not be finalized until such additional copies are received. 3. The Contractor will not be entitled to any time extension or other compensation for any delays arising from his failure to provide required additional copies with a submittal SPECIFIC SUBMITTAL REQUIREMENTS A. General: 1. Where it is necessary to provide intermediate submittals between the initial and final submittals, provide and process intermediate submittals in the same manner as for initial submittals. 2. Shop Drawings, Product Data, and Samples submitted to the Engineer for Engineer s review shall first be checked and approved by the Contractor. Shop Drawings, Product Data, and Samples received without the Contractor's approval stamp will be cause for immediate return without further action. Each drawing correctly submitted will be reviewed by the Engineer and the Department and marked accordingly. 3. Specific submittal requirements for individual units of Work are specified in the applicable Technical Special Provision Section. Except as otherwise indicated in the individual Technical Special Provision Sections, comply with the requirements specified herein for each type of submittal. 4. Shop and setting drawings shall present complete and accurate information relative to all working dimensions, equipment weight assembly and sectional view, all necessary details pertaining to coordinating the Work of the Contract, lists of materials and finishes, parts lists and the description thereof, lists of spare parts and tools where such parts or tools are required, no-scale control diagrams for control wiring and control piping, and all other items of information that area required to demonstrate detail compliance with the Drawings and Technical Special Provisions. 10 5. If the Contractor proposes equipment requiring a different layout from that shown on the Drawings and if such substitution is acceptable to the Engineer, the Contractor shall submit drawings showing the revised layout of all affected structures, piping, and equipment. The cost of the revised layout shall be borne by the Contractor. B. Shop Drawings: 1. Information required on shop drawings includes, dimensions, identification of specific products and materials that are included in the Work, compliance with specified standards and notations of coordination requirements with other Work. Provide special notation of dimensions that have been established by field measurement. Clearly indicate deviations from the Contract on the shop drawings. 2. Coordination Drawings: Provide coordination drawings where required for the integration of the Work, including Work first shown in detail on shop drawings or product data. Show sequencing and relationship of separate units of Work that must interface in a restricted manner to fit in the space provided, or function as indicated. Coordination drawings are considered shop drawings. C. Product Data: 1. General information required specifically as product data includes manufacturer's standard printed recommendations for application and use, compliance with recognized standards of trade associations and testing agencies, and the application of their labels and seals (if any), special notation of dimensions which have been verified by field measurement, and special coordination requirements for interfacing the material, product or system with other Work. 2. Preparation: Collect required product data into a single submittal for each unit of Work or system based on Technical Special Provision Section. Mark each copy to show which choices and options are applicable to the Project. Where product data has been printed to include information on several similar products, some of which are not required for use on the project, or are not required for use on the project, or are not included in this submittal, mark the copies to show clearly which information is not applicable. a. Where product data must be specially prepared for required products, materials or systems, because standard printed data is not suitable for use, submit data as shop drawings and not as product data. b. Clearly mark each copy to identify pertinent products or models. c. Show performance characteristics and capacities. Brooksville Maintenance Yard SUBMITTALS

11 D. Samples: d. Show dimensions and clearances required. e. Show wiring or piping diagrams and controls. f. Indicate finish. g. Supplement standard information to furnish information specifically applicable to Work. h. Modify drawings and diagrams to delete information that is not applicable to Work. 1. Submit samples for the Engineer s visual review of type, color, pattern, and texture, and for a final check of the coordination of these characteristics with other related elements of the Work. Samples are also submitted for quality control comparison of these characteristics between the final sample submittal and the actual Work as it is delivered and installed. a. Refer to individual sections of these Technical Special Provisions for additional sample requirements that may be intended for examination or testing of additional characteristics. Compliance with other required characteristics is the exclusive responsibility of the Contractor; such compliance is not considered in the Engineer s and the Department s review and "Action" indication on sample submittals. b. Documentation required specifically for sample submittals includes a generic description of the sample, the sample source or the product name or manufacturer, compliance with governing regulations and recognized standards. In addition, indicate limitations in terms of availability, sizes, delivery time, and similar limiting characteristics. 2. Preparation: Where possible provide samples that are physically identical with the proposed material or product to be incorporated in the Work; provide full scale, fully fabricated samples cured and finished in the manner specified. Where variations in color, pattern, or texture are inherent in the material or product represented by the sample, submit multiple units of the sample (not less than 3 units), which show the approximate limits of variations. Where samples are specified for the Engineer s selection of color, texture, or pattern, submit a full set of available choices for the material or product. Mount, display, or package samples in the manner specified to facilitate the review of indicated qualities. Prepare samples to match the Engineer s sample where so indicated. 12 a. Refer to individual sections of these Technical Special Provisions for samples that are indicated to be returned to the Contractor for incorporation in the Work. Such samples must be in an undamaged condition at the time of use. Indicate such special requests regarding the disposition of sample submittals on the submittal form. 3. Mock-Ups: Mock-ups are special form of samples, which are too large or otherwise inconvenient for handling in specified manner for transmittal of sample submittals. Mock-ups and similar samples specified in individual sections of these Technical Special Provisions are recognized as a special type of sample. Comply with requirements for samples to greatest extent possible, and process transmittal forms to provide records of activity. a. Field Samples: E. Miscellaneous Submittals: (1) Construct mock-up for Engineer s visual examination, for quality control, and performance of required testing. (2) Erect at location acceptable to Engineer. (3) Size of Area: As specified in respective Technical Special Provision Section. (4) Fabricate each sample and mock-up complete and finished using materials, fabrication, and installation methods identical with those indicated for Work. (5) Remove mock-ups at conclusion of Work or when acceptable to Engineer if not incorporated into Work. 1. Inspection and Test Reports: Classify each inspection and test report as being either "shop drawings" or product data" depending on whether the report is specially prepared for the project, or a standard publication of workmanship control testing at the point of production. Process inspection and test reports accordingly. 2. Warranties, Bonds, and Maintenance Agreements: Refer to Technical Special Provision Section GUARANTEES/WARRANTIES/ REPAIRS, for specific general requirements on warranties, product bonds, workmanship bonds, and maintenance agreements. In addition to copies desired for the Contractor s use, furnish two (2) executed copies of such warranties, bonds, or agreements. Provide two (2) additional copies where required for maintenance manuals. 3. Standards: Where submittal of a copy of standards is indicated, and except where copies of standards are specified as an integral part of a Product Data submittal, submit a single copy of standards for the Engineer s use. Where workmanship, whether at the project site or elsewhere is governed by a standard, furnished additional copies of the standard to fabricators, installers and others involved in the performance of the Work. 13 4. Closeout Submittals: Refer to Technical Special Provision Section PROJECT CLOSEOUT, and to individual Sections of these Technical Special Provisions for specific submittal requirements of project closeout information, materials, tools, and similar items. 5. General Distribution: Provide additional distribution of submittals to subcontractors, suppliers, fabricators, installers, governing authorities, and others as necessary for the proper performance of the Work. Include such additional copies of submittals in the transmittal to the Engineer where the submittals are required to receive Action marking before final distribution. Record distributions on transmittal forms CONTRACTOR'S DUTIES A. Review submittals prior to transmittal; determine and verify field measurements, field construction criteria, manufacturer s catalog numbers, and conformance of submittal with requirements of Contract. B. Coordinate submittals with requirements of Work and of Contract. C. Submittals or Accompanying Transmittal Letter Shall Contain: 1. Date of submission and dates of previous submissions when applicable. 2. Project title and number. 3. Contract identification. 4. Names of subcontractor, supplier, and manufacturer. 5. Identification of product with Technical Special Provision Section number. 6. Field dimensions, clearly identified as such. 7. Relation to adjacent or critical features of work of materials. 8. Applicable standards, such as ASTM or Federal Specification numbers. 9. Identification of revisions on resubmittals. 10. Additional information required by Contract. 11. Contractor executed review and approval marking or stamp. 12. Blank space for Engineer s and Department s action marking or stamp. D. Clearly identify on submittals, or in writing at time of submission, deviations in submittals from requirements of Contract. Contractor s responsibility for deviations in submittals from requirements of Contract is not relieved by Engineer s and Department s review of submittals unless the Department gives written acceptance of specific deviations. Apply Contractor's mark or stamp, sign, and date, Signature of Contractor s authorized person certified verification of products, verification of field measurements and field construction criteria, and coordination of information within submittal with requirements of work and of Contract. Submittals without Contractor's executed mark or stamp and signature will be returned without disposition. F. Submittals that are received from sources other than through Contractor s office will be returned by Engineer without action. Delays resulting therefrom shall be Contractor s responsibility. G. Package each submittal appropriately for transmittal and handling. H. Distribute reproductions of shop drawings, copies of product data, and samples, which bear Department s stamp of approval, to jobsite file, record documents file, subcontractors, suppliers, and other entities requiring information. I. Do not fabricate products or being work which required submittals until return of submittal with Department s acceptance. 15 FLORIDA DEPARTMENT OF TRANSPORTATION SECTION PRODUCT SUBSTITUTIONS PART 1 - GENERAL 1.01 WORK INCLUDED A. This Technical Special Provision Section defines Products and specified administrative and procedural requirements for handling requests for substitutions PRODUCTS A. The term Product generally refers to materials, products, components, and other items that the Department and the Engineer have determined to be desirable to be incorporated into the project, which meet the established design criteria for the project, and which provide the desired quality. B. The Technical Special Provisions generally list a minimum of three (3) manufacturers/suppliers, with catalog/model numbers, for each product specified. The Contractor is advised that the use of Products on this Project is encouraged and will serve to expedite the review and approval of required submittals SUBSTITUTIONS A. If the Contractor proposes the use of a material, component, or other item for incorporation into the project that is not a Product, such items shall be considered substitutions. Approval of substitutions by the Department is required before the Contractor may make submittals as required by the appropriate Section of the Technical Special Provisions. Approval of substitutions is subject to the following requirements and conditions: 1. The burden of proof that a proposed substitution is equivalent to a Product shall rest entirely on the Contractor. 2. The Contractor shall provide documentation satisfactory to both the Department and the Engineer that the proposed substitution complies with the plans and Technical Special Provisions as follows: a. Applicable Technical Special Provision Section Numbers. b. Applicable Drawing Numbers. Brooksville Maintenance Yard PRODUCT SUBSTITUTIONS

17 c. Samples, where applicable or requested. d. A detailed comparison of the significant qualities of the proposed substitution relative to the specified item. e. Information on how the proposed substitution coordinates with other items of Work on this project including any modifications to the various items of Work necessary to accommodate the substitution. f. Certification by the Contractor that the proposed substitution will perform adequately for the intended application as required by the plans and Technical Special Provisions. 3. The Engineer s decision to accept or reject a proposed substitution shall be final. B. Where an accepted substitution require a different quantity or arrangement of foundations, supports, ductwork, piping, wiring, conduit, and any other equipment or accessories normal for the accepted substitution, the Contractor shall effect all required modifications including the work of other trades impacted by the substitution at no additional cost to the Department. 18 FLORIDA DEPARTMENT OF TRANSPORTATION SECTION PROJECT CLOSEOUT PART 1 - GENERAL 1.01 WORK INCLUDED A. This Section specifies general administrative and procedural requirements for project closeout. The requirements include, but are not limited to, the following: 1.02 RELATED WORK 1. Substantial Completion and Final Acceptance inspection procedures. 2. Project Record Document submittals. 3. Operating instructions and maintenance manual submittals. 4. Submittal of warranties, guarantees, and maintenance agreements. 5. Final cleaning. A. SUBMITTALS: Section B. PRODUCT SUBSTITUTIONS: Section C. CLEANING: Section D. PROJECT RECORD DOCUMENTS: Section E. GUARANTEES/WARRANTIES/REPAIRS: Section SUBSTANTIAL COMPLETION A. Prior to a request for an inspection for Substantial Completion, the Contractor shall maintain the following procedures: 1. The Contractor shall conduct weekly walk-through inspections in the presence of the Engineer in the month prior to the request for Substantial Completion. Each inspection shall determine outstanding work necessary to meet the Substantial Completion requirements stipulation Brooksville Maintenance Yard PROJECT CLOSEOUT

19 under this Section. A list of outstanding work required will be updated by the Engineer with the Contractor weekly. Brooksville Maintenance Yard PROJECT CLOSEOUT

20 2. The outstanding work list will be reduced progressively from the initial weekly inspection until, in the opinion of the Engineer, the Contractor s work qualifies as to the state of readiness for the formal inspection punch-list prior to Substantial Completion acceptance by the Department. B. Substantial Completion acceptance shall require that the following be accomplished: 1. The stage of completeness that constitutes the state of Substantial Completion acceptance is based on the essential completion of the Contract requirements including, but not limited to, the following: a. All civil, structural, architectural, mechanical, plumbing, and electrical work is complete. b. Letter from the Contractor stating that all code violations have been corrected along with copies of Final Inspection Reports representing each discipline to the Building Inspection/Permitting Agency. c. All mechanical, electrical systems have been made operational and tested under the direct supervision of the manufacturer's qualified factory representative, in the presence of the accepting authority having jurisdiction over the Work. (1) The manufacturers have issued a certified letter of compliance and satisfactory operation to the Engineer. (2) The manufacturers have provided the required operation training, for the purpose of aiding the Department's maintenance and operations personnel to become familiar with the systems. d. Turn over all releases enabling the Department unrestricted use of the Work and access to services and utilities. e. Complete clean up requirements, including touch-up painting. Touch-up and otherwise repair and restore marred exposed finishes. f. Provide the Engineer with the following list of approvals and certifications: (1) Letter of approval from the Building Inspection/ Permitting Agency inspector. 2. Upon the confirmation that the above requirements have been satisfied, the Contractor shall request the Engineer to schedule an inspection for Substantial Completion acceptance. 22 3. The Contractor shall provide the Engineer with a list of all items needed from the Engineer to request a Certificate of Occupancy for the facilities constructed for this project. These items may include, but are not limited to, the following: a. Certification that the structure meets or exceeds the flood plain criteria defined in the FEMA document 44 CFR - Part 60. b. Certification of compliance to the Department of Environmental Regulation Management Pollution Control. 4. After these items are provided, the Contractor may apply to the Building Inspection/Permitting Agency for a Certificate of Occupancy for the facilities constructed by this project. Upon receipt of the Certificate of Occupancy, the Contractor shall provide the following: a. Insurance changeover. b. Make final changeover of permanent locks and transmit keys to the Engineer. Advise the Engineer of changeover in security provisions. C. After the Contractor receives the Certificate of Occupancy, the Department will make a declaration of Substantial Completion acceptance covering only that portion of the Project subject to Substantial Completion acceptance, will occupy the new facilities, and will have two (2) weeks to list any deficiencies not apparent during the inspection for Substantial Completion acceptance. D. Substantial Completion acceptance shall continue until Final Acceptance FINAL ACCEPTANCE A. Prior to a request for an inspection for Final Acceptance, the Contractor shall maintain the following procedures: 1. The Contractor shall conduct weekly walk-through inspections in the presence of the Engineer in the month prior to the request for Final Acceptance. Each inspection shall determine outstanding work necessary to meet the Final Acceptance requirements stipulation under this section. A list of outstanding work required will be updated by the Engineer with the Contractor weekly. The outstanding work list will be reduced progressively from the initial weekly inspection until, in the opinion of the Engineer, the Contractor s work qualifies as to the state of readiness for the formal inspection punch-list prior to Final Acceptance by the Department. Provide separate manuals for each unit of equipment, each operating system, and each electric and electronic system. 2. Refer to Specification Sections for individual requirements on operating and maintenance of the various pieces of equipment and operating systems RECORD DOCUMENTS A. Record Drawings: 1. Maintain a clean, undamaged, updated set of blue or black line whiteprints of Contract Drawings, including sheets issued as part of Department authorized changes, and Shop Drawings. The set shall be marked to scale by a competent draftsman to indicated the actual installation and/or location where the installation and/or location varies substantially from the Work as originally shown due to Addenda, Alternates, Change Orders, Field Orders, etc. 2. Mark whichever drawings are most capable of showing conditions fully and accurately. Where shop drawings are used, record a cross-reference at the corresponding location on the Contract Drawings. 3. Use a red erasable pencil; use other colors to distinguish between variations in separate categories of the Work. 4. Give particular attention to concealed elements that would be difficult to measure and record at a later date. 5. Note related Change Order numbers where applicable. 6. Do not revise the prints by attaching the actual sketches issued by the Engineer. Where the work was installed exactly as shown on the Contract Drawings, the prints shall not be disturbed other than being marked PROJECT RECORD DOCUMENTS". 7. Each sheet shall be clearly marked "PROJECT RECORD DOCUMENTS. 8. Organize record drawing sheets into manageable sets by discipline, bind with durable paper cover sheets, and print suitable titles, dates, and other identification on the cover of each set. 9. Review the completed Project Record Drawings and ascertain that all data furnished on the prints is accurate and truly represents the work as actually installed. 28 10. The record drawing prints, including those changed and unchanged, shall be submitted to the Engineer for compliance review. 11. Any deviations from the method of executing Project Record Drawings as described above will be considered just cause for rejection by the Engineer and the Contractor will be required to conform and resubmit. 12. The record drawings shall be current with each month s pay estimate application, and subject to the Engineer s review for acceptability, as a prerequisite to monthly payment. B. Record Project Manual/Specifications: 1. Maintain one complete copy of the Project Manual, including all addenda, and one copy of other written construction documents such as Change Orders and Modifications issued in printed form during construction. Mark these documents to show substantial variations in actual Work performed in comparison to the text of the Specifications and modifications due to Addenda, Alternates, Change Orders, Field Orders, etc. 2. Neatly cross out the non-conforming portion of the Project Manual and add by writing in the revised portion of the Project Manual. Do not revise the Project Manual by cutting and pasting the actual Addenda, Alternates, Change Orders, Field Orders, etc., as actually issued by the Engineer unless otherwise directed by the Engineer. 3. Give particular attention to substitutions, selection of options and similar information on elements that are concealed or cannot otherwise be readily discerned later by direct observation. Note related Record Drawing information and Product Data. 4. The Volume(s) of Project Manual shall be clearly marked PROJECT RECORD DOCUMENTS. 5. Review the completed Record Project Manual and ascertain that all data furnished on the Project Manual is accurate and truly represents the work as actually installed. 6. Submit the Record Project Manual to the Engineer for compliance review. 7. Comply with delivery to the Department s sample storage area. E. Miscellaneous Record Submittals: 1. Miscellaneous record submittals shall include, but not be limited to, the following: a. Warranties. b. Inspection and test reports. c. Field records. d. Surveys. e. Mix records. f. Inspections by governing authorities. 2. This section specifies general administrative and procedural requirements for guarantees, warranties, and related repairs (or replacement) required by the Contract Documents, including manufacturer s standard warranties on products and special warranties. Disclaimers and Limitations: Manufacturer s disclaimers and limitations on product warranties do not relieve the Contractor of the warranty on the Work that incorporates the products, nor does it relieve suppliers, manufacturers, and subcontractors required to countersign special warranties with the Contractor RELATED WORK A. Defects due to faulty materials and/or workmanship developed during the guarantee period shall be repaired or replaced, as required, by the Contractor at no additional cost to the Department and as acceptable to the Department. 1. The guarantee shall state the name of the Department, provide full guarantee terms and conditions, effective date and termination date, and the name, license number, address and telephone number of the Contractor. The guarantee shall be signed by the Contractor or the Contractor s chief executive and notarized. C. The term start of the one (1) year guarantee will not be recognized until all outstanding work items (deficiency list) have been completed and acknowledged as accepted in writing by the Department MANUFACTURER, SUPPLIER, AND SUBCONTRACTOR WARRANTIES A. In addition to the Contractor s one (1) year guarantee, all other manufacturer, equipment supplier, and subcontractor warranties shall commence on the Date of Final Acceptance of the total Contract as acknowledged in writing by the Department, and taken over for use by the Department. 1. Plumbing Fixtures and Plumbing Systems will not be accepted nor the initiation of warranty start recognized until these systems are functioning properly and acknowledged as accepted in writing by the Department. B. Manufacturer and supplier warranties shall not relieve the Contractor of liability under the one (1) year guarantee. Such warranties shall supplement the one (1) year guarantee. 1. Written warranties made to the Department are in addition to implied warranties, and shall not limit duties, obligations, rights, and remedies otherwise available under the law, nor shall warranty periods be interpreted as limitations on time in which the Department can enforce such other duties, obligations, rights, or remedies. 2. Ensure that all warranties comply with these stipulations prior to submission. C. Repairs: 1. All repairs or replacements resulting from a breach of warranty shall be promptly performed. 2. If, with ten (10) calendar days after the mailing date of the written notice by the Department to the Contractor requesting repairs or replacement resulting from a breach of warranty, the Contractor shall neglect to make or undertake with due diligence to make the same, the Department may make such repairs at the Contractor s expense; provided, however, that in the case of emergency where, in the judgment of the Department, delay would cause serious loss or damage, repairs or replacement may be made without notice being sent to the Department, and the Department shall pay the cost thereof. 34 1.05 SUBMITTALS A. Submit written warranties to the Department prior to the Date of Final Acceptance. If the Department designates a commencement date for warranties other than the Date of Final Acceptance, or a designated portion of the Work, submit written warranties on the Department's request. B. Warranties shall be submitted properly executed by the Contractor, and also executed by the subcontractor, supplier or manufacturer, or a combination thereof, as stipulated in other TECHNICAL SPECIAL PROVISIONS. Warranties shall also be fully identified and contain all appropriate terms and conditions. C. Provide a bound manual for all manufacturer, equipment supplier, and subcontractor warranties required by the Contract Documents. Identify each warranty with proper TECHNICAL SPECIAL PROVISION. In both cases, salvageable items shall remain the property of the Department and be carefully removed from the structure as work progresses. Items to be salvaged or re-used shall be determined by Engineer and/or Department. 2.
