Engineering Construction Permit: Prior to land disturbing activity, the applicant shall submit 3 sets of final plans to the Tons Engineering & Design Services Division for stamping, schedule a preconstruction conference ith the Tons Senior Engineering Coordinator, and apply for an Engineering Construction Permit. 2. Performance Bond: Prior to Engineering Construction Permit submit an itemied cost estimate for all ork in the public right-of-ay and multi-modal path to Larry Tucker in the Engineering Services and Design Division A bond for 125% must be submitted to cover the estimated cost of construction. 3. Erosion Control Bond: A performance guarantee in accordance ith Section Bonds of the Ton Code of Ordinances shall be required prior to final authoriation to begin land-disturbing activities. This financial guarantee is intended to cover the costs of restoration of failed or failing soil erosion and sedimentation controls, andor to remedy damages resulting from land-disturbing activities, should the responsible party or parties fail to provide prompt and effective remedies acceptable to the Ton. 4. Pre-Construction Conferences: That pre-construction conference(s) shall be held ith the folloing staff prior to any construction activity: a. The Tons Engineering & Design Services Division ( ); b. The Tons nspections Division ( ); c. The Tons Office of the Fire Marshal Life Safety Division ( ); d. The Tons Stormater Management Division ( ); e. The Tons Urban Forester ( ) to revie procedures for protection and management of all protected landscape elements identified on the Landscape Plan, and to designate one or more persons as Landscape Protection Supervisor(s); f. The Orange County Erosion Control Division ( ); and, g. The Orange County Solid Waste Department ( );

Multi-modal Path: Applicant shall coordinate the precise location, final design, and timing of construction of the multi-modal path, ith Ton-sponsored roaday improvements. An Engineering Construction Permit is required for the multi-modal path and shall ensure coordination ith Ton sponsored roaday improvements. Completion of the multi-modal path is required prior to issuance of a Certificate of Occupancy (CO). 6. Repairs in Right-of-Way: Prior to expiration of the performance bond or issuance of the final CO, hichever occurs first, the applicant shall repair all damage for ork in the right-of-ay related to the construction of this project, hich may include pavement milling and overlay. 7. Traffic Lane and Sidealk Closure: Prior to any traffic lane andor sidealk closures, the applicant shall contact the Tons Traffic Engineering office ( ) at least 5 orking days before the proposed ork to apply for a lane closure permit. 8. Parking Lot Access and Circulation During Construction: The applicant shall provide ritten notice to all tenants of Rams Plaa of changes to the parking lot at least 5 days in advance. Such changes include, but are not limited to, modifications to driveay access, modifications to internal parking lot circulation, and closure of parking spaces. Stormater 9. Stormater Facilities: Prior to issuance of the final CO, the three documents enumerated belo must be submitted to the Tons Stormater Management Division and a final stormater management inspection must be scheduled, at least 1 days in advance of requesting the Certificate of Occupancy. a. Final Plat or Easement Exhibit; A copy of the final plat or easement exhibit, signed and sealed by a North Carolina-registered Land Surveyor and recorded by the Orange County Register of Deeds, shoing the "Stormater Facility Easements, the stormater management facilities, and the maintenance access locations. For purposes of maintenance, the maintenance access must be shon on the exhibit and extend from the "Stormater Facility Easement" to the nearest public right-of-ay. The folloing notes must be included on the recorded final plat or easement exhibit.

The Reserved Stormater Facility Easements and the facilities itthey protect are the sole responsibility of the oner. Until the storm ater facilities are accepted for maintenance by the Ephesus-Fordham Municipal Service District the oner shall provide for all required maintenance and operations as approved by the Ton Manager. ii. All engineered stormater management control, treatment, and conveyance structures located on or belo the ground shall be holly contained ithin an easement entitled: "Reserved Stormater Facility Easement Hereby Dedicated" and shall be reserved from any development hich ould obstruct or constrict the effective management, control, and conveyance of stormater from or across the property, other than the approved design and operation functions. The Easements shall provide for access by Ton staff, contractors and consultants to facilitate inspections and maintenance services once the stormater facilities are accepted for maintenance by the Ephesus- Fordham Municipal Service District. iii. The Reserved Stormater Facility Easement and the Operations and Maintenance Plan are binding on the oner, heirs, successors, and assigns. b. Maintenance covenant ("Operations and Maintenance Plan"); A copy of the maintenance covenant ("Operations and Maintenance Plan"), signed by the oner and recorded by the County Register of Deeds, for the stormater management facilities. The Operations and Maintenance Plan must include a description of the device or structure, an inspections checklist, and operating and maintenance procedures. The plan should identify contact information, ho ill perform the inspections, frequency of inspections, inspections and maintenance logs, any specific equipment needs or certifications (e.g., confined space certification), action levels or thresholds (e.g., remove sediment after depth exceeds one foot), and disposal methods. c. Professional Engineer certification; Certification, signed and sealed by a North Carolina-registered Professional Engineer, that the stormater management facilities ere constructed in accordance ith the approved plans and specifications. After performing the final inspection and revieing and approving the documents, the Tons Stormater Management Division or designee ill issue an Approval Notification to the Tons nspections Division via . (Please schedule the final stormater management inspection ith the Tons Stormater Management Division ( )).

Approved mpervious Surfaces: The total amount of impervious area shall be limited to a maximum of 14,213 square feet and the disturbed area to 2,234 square feet as shon in the calculations submitted for the Form District Permit. Any increase of impervious area that occurs as a result of construction over this permitted amount shall require a revised stormater management report and plan, signed and sealed by a North Carolina Registered Professional Engineer, be submitted to the Tons Stormater Management Division for revie and approval prior to the issuance of the CO. 11. Stormater nspection Report: An original inspection report shall be provided to the Ton beginning one year from the date of the Operation and Maintenance Plan is recorded and each year thereafter on or before the recordation date of the Operations and Maintenance Plan, until the stormater facilities are accepted for maintenance by the Ephesus-Fordham Municipal Service District. 12. Location of Stormater Structures: No portion of the storm ater structure may be located ithin the setbacks or rights-of-ay, except as shon in the approved plan. This includes any underdrains or the dongradient toe of French drains. 13. Liability: The oner may be liable if adjoining properties receive substantial damage associated ith the discharge of stormater from this property. 14. Erosion Control nspections: During construction, the applicant shall inspect the erosion and sediment control devices daily and after every rainfall, make any necessary repairs or adjustments to the devices, and maintain inspection logs documenting the inspections and any necessary repairs. Life Safety 15. Fire Code Compliance: Prior to any Temporary Certificate of Occupancy (TCO) and CO, the applicant shall demonstrate that site ork passes field inspections and fully complies ith the North Carolina Fire Prevention Code. 16. Public Safety Survey: Prior to the first TCO andor CO for any public use portion of the facility, the applicant shall hold a security survey ith the Police Department to identify and consider opportunities for public safety improvements.

Encroachment Agreement: That the applicant shall ork ith Ton Staff to obtain an encroachment agreement for the installation and maintenance of trees in the North Carolina Department of Transportation right-of-ay along Ephesus Church Road and Fordham Boulevard. Changes to the species or location of trees in the right-of-ay required by the North Carolina Department of Transportation shall not require a revision to the Form District Permit, provided the number and spacing of trees complies ith LUMO section Miscellaneous 18. Form District Permit Recordation and Validity: Prior to recordation of a commercial subdivision plat, the applicant shall record this Form District Permit at the Orange County Register of Deeds. This Form District Permit shall be invalidated if not recorded ithin 3 calendar days of issuance. 19. Subdivision: Prior to issuance of a Building Permit, the applicant shall record a commercial subdivision plat at the Orange County Register of Deeds. The plat shall reference the approved and recorded Form District Permit. 2. Contract for Work in the Right-of-Way: Prior to recordation of the commercial subdivision plat, the applicant shall submit a signed AGREEMENT FOR REMBURSEMENT FOR CONSTRUCTON OF PUBLC MPROVEMENTS (in the existing right-of-ay relating to Phase of the EphesusFordham roaday improvements) to the Ton s Engineering and Design Services Division. 21. OWASA Permit to Construct: Prior to issuance of a Building Permit, the applicant shall obtain a Permit to Construction from Orange Water and Seer Authority. 22. Construction Plans: This project ill require building permits to be issued by the Ton of Chapel Hill. Prior to issuance of a Building Permit, the applicant shall submit at least 2 paper sets and 1 electronic set of architecturalstructural, plumbing, mechanical, and electrical plans, ith a minimum scale of ¼ inch = 1 foot, to the Tons nspections Division for revie and approval. Please note that a separate permit for a construction trailer is required. Prior to submittal, the applicant shall schedule a pre-permitting conference through the Tons Permit Technician. 23. Construction Sign: The applicant shall post a construction sign that lists the property oners representative and telephone number, the contractors representative and telephone number, and a telephone number for regulatory information, prior to the commencement of any land disturbing activities. The construction sign design shall be in accordance ith Section (g) of the Land Use Management Ordinance.

Construction Noise: The applicant shall comply ith the Ton Noise Ordinance, Article 3, Section 11-4, limiting construction noise levels outside of the folloing operating hours: 7: a.m. to 9: p.m. on eekdays and 8: a.m. to 9: p.m. on eekends. Construction activity may occur during hours outside of the operating hours noted above if they are conducted ithin noise levels that are in compliance ith the Ton Noise Ordinance. Exceptions to this requirement must be approved in advance by the Ton Manager pursuant to the Ton Noise Ordinance. 25. Safety During Construction: During demolition andor construction, all aspects of Chapter 33 of the NC Building Code and the construction management plan shall be folloed. Compliance ith OSHA standards is also required. The Tons nspections Division is authoried to stop construction if violations are observed. 26. Proposed Changes: Any proposed changes to the approved plans may require revie and approval by Ton Manager and issuance of a revised Form District Permit. Changes to the approved plan set may require revie and approval of a revised Certificate of Appropriateness by the Community Design Commission. Design changes to the plans and structures must be submitted and approved by the Ton s nspections Division and prior to implementation. 27. Form District Permit Compliance: No building or structure for hich this permit has been issued may be used or occupied until, after final inspection, a Certificate of Occupancy has been issued indicating compliance ith the provisions of the Land Use Management Ordinance, and all other state and local las, including conditions of this permit and all other required permits. 28. Foundation Survey and nspection: Upon completion of foundation inspections, applicant shall submit a foundation survey shoing building footprint and measurements from right-of-ay and easement lines shoing compliance ith buildto-one and setback requirements as shon on site plan sheet C3-B. Applicant shall schedule an inspection ith the Zoning Enforcement Officer ( ). 29. As-Built Plans: Prior to Stormater nspection, the applicant shall: a. a. Submit original certified as-built plans, signed and sealed by a North Carolina Registered Professional Land Surveyor, to the Tons Stormater Management Division, the Tons nspections Division and the Tons Engineering & Design Services Division shoing building heights and elevation limitations, all building footprints and building designations, driveays, detailed calculations and totals for all other impervious surfaces (to include gravel) and any drainageconveyance piping and structures. The

As-built plans must be accompanied by a letter certified by a licensed architect, licensed appraiser, licensed engineer, licensed general contractor, or licensed surveyor that certifies compliance ith the lot parameters, building setbacks, build-to-one, building height, story height, ground floor elevation, transparency, pedestrian access, and building element requirements described in Sections and of the Land Use Management Ordinance. c.
