Background: Currently, with the exception of one (1) tractor, all of the right of way equipment owned by the city has been placed in the surplus yard due to age, condition and the need for extensive and expensive mechanical repairs. As you are aware, all of the equipment was purchased from state or federal surplus when we acquired it several years ago. Most of it, if not all of it is old and has been repaired time after time. We are in desperate need of some NEW and RELIABLE equipment if we are to continue to maintain our streets and roadways. Over a month ago, I requested vendors to submit quotes on known dependable equipment. I have received these quotes as you will find attached and offer my recommendation for consideration. All of the vendors with the exception of one, Georgia Deer Farm and Agri Center, submitted quotes on what was requested. This vendor quoted a smaller frame unit that I am not comfortable with for the type of use required. I am requesting the following equipment for council to approve to purchase: 1) New Holland TS 6110 Tractor with cab, triple remote Hydraulics, quick attach loader with bucket and grapple as quoted for $56, ) New Holland TS 6110 Tractor with cab and Alamo 20 ft. Versa Boom Mower (Side Arm Mower) as quoted for $91, ) Woods 10.5 ft BW126XHD, right offset, 2 section bat wing mower (same mower as is currently being utilized) as quoted for $10,636.00

Minutes of the Regular Meeting of October 7, 2014 Presentations (none scheduled) Public Hearing 1. Item : 14A 002, Public Hearing to consider an application to annex into the City 9400 acres located in Fulton County by the sixty percent (60%) method and to retain the current zoning designations placed by Fulton County. 2. Item : Resolution , To establish a moratorium that prevents the city from accepting and considering proposed conceptual site plans. The moratorium will expire in six months or upon the adoption of the revised zoning ordinance, whichever shall first occur, unless council takes further action. Minutes Regular Meeting of the Mayor and Council City of Chattahoochee Hills, Georgia October 7, :00 pm Call to Order Mayor Reed called the meeting to order at 7:00 p.m. Councilmembers present were Don Hayes, Faye Godwin, Richard Schmidt, John Taylor and Claire Williams. All members were present. Mayor Reed declared that a quorum was present. Also present was the City Attorney Mr. Lindsey. Mayor Reed led the assembly in the Pledge of Allegiance. Approval of Agenda A motion was made by Mr. Schmidt to approve the agenda with one addition (Item Consideration of the JAMS Mediation Fee Agreement), seconded by Ms. Godwin. The motion passed unanimously. Approval of Minutes 1. Minutes of the Regular Meeting of September 2, 2014 A motion was made by Mr. Hayes to approve the minutes from the regular meeting of September 2, 2014 with one correction (Item : motion was made by Mr. Taylor) and Ms. Godwin seconded. The motion passed unanimously. Presentations 1. Molcie Trimble Proclamation Mayor Reed called Molcie Trimble forward and read the proclamation thanking her for her years of volunteer service. 2. City of Newnan and Newnan Fire Department Proclamation Mayor Reed read the proclamation thanking the City of Newnan and its Fire Department for the generous donations of equipment recently given to Chattahoochee Hills, as well as significantly reducing the sale price of a fire engine. Public Hearing 1. Item : 14A 001, Public Hearing to consider an application by Serenbe Development Corporation to annex into the City acres located on Shell Road in Coweta County and to classify that property in the AG 1 Agricultural zoning district. Mayor Reed opened the Public Hearing and Mr. Lindsey read the guidelines that would be followed during the hearing. City Planner Mike Morton gave summary of the application and a staff recommendation to approve the annexation following the conditions set forth by Coweta County. Steve Nygren stated his desire to bring the parcel into the City and there are no plans for development at this time. There were no public comments in favor or in opposition to the annexation. The Public Hearing was closed. 2. Item : Ordinance , Action to consider an application by Serenbe Development Corporation to annex into the City acres located on Shell Road in Coweta County and to classify that property in the AG 1 Agricultural zoning district. (2 nd read) Mr. Taylor made a motion to approve Item and Ms. Godwin seconded the motion. It passed unanimously. 3. Item : 14U 001, Public Hearing to consider an application by Serenbe Development Corporation to obtain a Use Permit for a Country Inn at Hutcheson Ferry Road, as described in zoning ordinance section , to allow expansion of the existing inn. Mayor Reed opened the Public Hearing. Mr. Morton gave a summary of the application and a staff recommendation to approve the use permit with staff suggestion of adding a fire hydrant. Mr. Nygren gave a brief history of the inn and the approval process with Fulton County when the inn initially opened. He explained the added two (2) acres needed for wastewater treatment and extra parking area to provide better fire department access. Planning Commission Chairman Alan Merrill explained the definition of a special use permit and how it is applied. There were no public comments in favor or in opposition to the use permit. The public hearing closed. 4. Tammy Wheaton, 8726 Atlanta Newnan Road, stated that the land had been in her family for generations and she is impressed with what has been done so far. She is proud of the property and is in favor of the application. Steve Hurwitz, 9116 Selborne Lane, stated that he is an active volunteer in the community with the charter school and Cochran Mill Nature Center. He moved here from Dunwoody because the area reminds him of his hometown and he feels the vision of managed growth is important. He is in favor of the application and feels that artists can take the Chatt Hills vision out into the world. Mr. Nygren gave a history of his development and involvement in the community and the drive to become a city. He stressed the importance of protecting the rural nature and preserving the area. Mr. Nygren talked about the artist in residence program and how the art farm could benefit the program. He reported on improvements he has made to the existing house and how the storage containers would be used. He has been working with the architectural program at Auburn University to design cottages. Brandon Hinmen, of Carrollton GA, spoke in favor of the application and stated he had moved back to Georgia to have the opportunity to manage the property. Lee Foster, 425 Selborne Way, gave her families background in the performing arts and stated she and her husband moved here to support the arts and the beautiful community. She is in favor of the application and feels that the art farm would bring in people and act as an economic multiplier. Gordon Ramsey, 9132 Selborne Lane, stated that the art program at Serenbe has been excellent and has contributed much to the community. He is in favor of the application. Monica Olsen, Serenbe Lane, Vice-Chair of Chattahoochee Hills Charter School Board, spoke in support of the application and stated the art farm will be an advantage to the school by bringing in artists. John Graham, 445 Selborne Way, serves on the City s Parks Commission and feels that having artists here to do site specific art is important to the area. He is in favor of the application. Chris Condon, 9179 Selborne Lane, spoke in favor of the application and feels that it will benefit the area. Maria Hanson, 8135 Atlanta Newnan Road, is in favor of the application and is excited to have an art community down the road. Alan Merrill, 560 Tabb Way, spoke in favor of the application stating that it could be an economic stimulus to the area. Anne Jackson, Serenbe Lane, spoke in favor of the application and feels it is an amazing project. Gordon Chandler, 2453 Hwy 27S, Carrollton GA, stated that he is a sculptor in the area and feels that the potential of having quality artist from around the world is wonderful and that art is a reflection of the community. Barry Anbinder, Serenbe Lane, spoke of the influence art has on children and how it has affected his life. He stated it was important to approve the application so that art can flourish in the city. The public hearing closed. 6. Item : 14U 002, Action to consider an application by Serenbe Development Corporation to obtain a Use Permit for a Country Inn at Atlanta Newnan Road, as described in zoning ordinance section , to be used as a short term lodging and accessory art space. Ms. Godwin made a motion to approve Item and Mr. Taylor seconded the motion. Mr. Hayes stated that he feels Mr. Nygren has done a great job with Serenbe, but feels that allowing commercial in a residential area sets precedent. Ms. Williams stated that she sees an inn as a home made into a place for visitors to stay rather than separate cottages. Mayor Reed stated that there are other businesses in the same zoning. He sees no reason to vote against the application. It is supported by the comprehensive plan and zoning. The motion failed by a vote of two (2) in favor and three (3) opposed (Hayes, Schmidt, Williams). 7. Item : 14VC 003, Public Hearing and 2 nd reading to consider an application by Serenbe Development Corporation for two concurrent variances at Atlanta Newnan Road, for the placement of an accessory structure in the front yard, and to eliminate the side yard setback to allow the accessory structure to run to the edges of the property. Mayor Reed opened the Public Hearing. Mr. Nygren stepped forward and stated he was withdrawing the application based on the results of the last vote. Ms. Godwin made a motion to allow the application to be withdrawn and Mr. Taylor seconded. The motion passed unanimously. 8. Item : 14VC 003, Action to consider an application by Serenbe Development Corporation for two concurrent variances at Atlanta Newnan Road, for the placement of an accessory structure in the front yard, and to eliminate the side yard setback to allow the accessory structure to run to the edges of the property. No action taken. Application withdrawn. Unfinished Business New Business 1. Item : Ordinance , to provide for participation by the City of Chattahoochee Hills in the Georgia Municipal Employees Benefit System (GMEBS) Life and Health Program, in accordance with and subject to the terms of the GMEBS Life and Health Program Trust Agreement, the GMEBS Life and Health Program Participation Agreement, the Participating Employer s Declaration Page, and the Rules governing the Program, all as authorized and provided by Chapter 5 of Title 47 of the O.C.G.A.; to provide an effective date; to repeal conflicting ordinances; and for other purposes. Mr. Schmidt made a motion to approve Item and Ms. Williams seconded. The motion passed unanimously. Mr. Taylor made a motion to approve Item and Ms. Godwin seconded. The motion passed unanimously. 6. Item : Consideration of contract for JAMS fee agreement (added) Mr. Hayes made a motion to approve Item and Ms. Godwin seconded. The motion passed unanimously. Public Comments Louise Kidd, Cedar Grove Road, stated she was not opposed to hunting, but has an issue with people abusing firearms. One of her miniature horses was shot recently by gunfire coming from a neighboring property. She asked that the Council consider an ordinance regulating high powered rifles being shot in residential areas. Sara Ann Alford, 7415 Hopkins Road, expressed that the community of Serenbe has affected her life in many ways, such as starting the History Club. She is pro art and feels that sometimes we have to realize what art is. She also thanked Maribeth Wansley and Tom Blum for helping with the proclamation for Molcie. Nesha Bryant, Hutcheson Ferry Road, wanted assurance that there would be plenty of time to speak about the other pending annexation on the next Council agenda. Mayor Reed gave her the dates of the two (2) planned public hearings. Mayor and Council Comments Mayor Reed thanked everyone that came to participate in the meeting. Staff Reports Chief Matt Rook announced a new service to get notifications over phone calls, text messages or through TownStatus.net. Chief Rook also called Finance Director Kyle Jones forward and presented him with a certificate marking five years of service with the City. Chief Greg Brett announced donations for automated external defibrillators to be placed at Serenbe and other parts of Chattahoochee Hills (police cars, etc.). Adjourn Meeting Mr. Schmidt made a motion to adjourn the meeting and Ms. Godwin seconded. 16 6505 Rico Road Chattahoochee Hills Georgia MAYOR Tom Reed To: Mayor and City Council CITY COUNCIL John Taylor Richard Schmidt Claire Williams Faye Godwin Don Hayes CITY MANAGER Jim Williams (770) Fax (770) From: Mike Morton, City Planner Subject: Annexation and zoning of approximately 9400 Acres by the 60% method Date: October 29, 2014 Annexation Request The City has received an application to annex approximately 9400 acres of unincorporated Fulton County into the city. The application form indicates that the included petition represents 5,694 acres of the 8, private acres in the area (63.94%) and 267 of the 403 electors in the area (66.25%). Confirmation of these figures is not yet complete. Property Description The property borders the city between Rivertown Road and the Chattahoochee River and is bounded to the north by the Chattahoochee River and to the east by the LandLot line east of Highway 154, and to the south by Rivertown Road, with the addition of the parcel at the Southeast corner of Highway 154 and Rivertown Road. Where Union City encroaches into this area, the proposed annexation skirts Union City s boundaries with 50 foot separation to avoid creating an illegal unincorporated island. See the attached maps. The total area of the proposed annexation is approximately 9400 acres. The property includes the following county facilities: Fulton County Fire Station #17, 8675 Ridge Road Cedar Grove Community House, 9285 Cedar Grove Road Beaver Historic House and Greenspace, 8655 Cochran Road Zoning The current zoning is primarily AG-1, with about 1400 acres of MIX-CHC (making up the Fulton County portion of Friendship Village), and small pockets of C-1, C-2, R-1, R-2A, R-6 and CUP. Staff recommends that the zoning districts in the proposed annexation area remain unchanged from their current designations, which is reflected in the ordinance under consideration.

17 Fulton County Commission Action The city notified the Fulton County Board of Commissioners of the annexation application. On October 15 th, the Board of Commissioners approved an objection to the annexation because it will result in a material increase in burden upon the county due to a proposed change in land use. The Georgia Department of Community Affairs has initiated an arbitration process to resolve the objection. The city attorney has responded with a letter to the county pointing out that the city has proposed no changes to zoning or land use. The mayor has also sent a letter to Fulton Board of Commissioners chair John Eaves requesting a withdrawal of the objection since it fails to meet the standards set out by the General Assembly for objecting to an annexation petition. Staff Review City staff has developed service delivery plans and budgets demonstrating that the city can extend city services to the proposed annexation territory and that it can do so while continuing to balance its budget. Staff Recommendation: Staff recommends approval of the Ordinance. Planning Commission Recommendation: The Planning Commission will hold a Public Hearing on October 30 th. WHEREAS, the Mayor and Council of the City of Chattahoochee Hills were granted home rule powers under O.C.G.A ; and WHEREAS, the Mayor and Council of the City of Chattahoochee Hills received an application for annexation of certain property, with a more specific description attached as Exhibit A ; and WHEREAS, the application for annexation includes signatures of at least sixty percent (60%) of the electors resident in the land described in Exhibit A, and includes signatures of the owners of at least sixty percent (60%) of the land area of the land described in Exhibit A ; and WHEREAS, the land described in Exhibit A is located in Fulton County; and WHEREAS, the Mayor and Council of the City of Chattahoochee Hills believe the annexation of this land to be in the benefit of the health, safety, and welfare of the City of Chattahoochee Hills; and WHEREAS, the corporate limits of the City of Chattahoochee Hills were established in Senate Bill 553 of the Regular Session of the Georgia General Assembly and were amended by Chattahoochee Hills Ordinance No ; and WHEREAS, the voting designations for the Council Districts of the City of Chattahoochee Hills were established in Senate Bill 553 of the Regular Session of the Georgia General Assembly and were amended by Chattahoochee Hills Ordinance No ; and WHEREAS, the Zoning Ordinance of the City of Chattahoochee Hills regulates standards and procedures for the modification of the zoning regulations; and WHEREAS, the Mayor and Council of the City of Chattahoochee Hills update zoning regulations for the use of property as well as standards and criteria related thereto throughout the City of Chattahoochee Hills consistent with the Comprehensive Plan; and WHEREAS, the Mayor and Council of the City of Chattahoochee Hills must designate a voting district for the land described in Exhibit A ; and

19 WHEREAS, the Zoning Ordinance for the City of Chattahoochee Hills states that all territory annexed into the City of Chattahoochee Hills shall be classified in the R-1, Single Family Dwelling District until the Mayor and City Council change the Zoning District based on staff recommendation; and WHEREAS, the staff of the City of Chattahoochee Hills has recommended that the Mayor and Council of the City of Chattahoochee Hills retain the current zoning designations placed by Fulton County on the land described in Exhibit A, the current zoning designations of the City of Chattahoochee Hills being identical to the current zoning designations of Fulton County; and WHEREAS, the Mayor and Council of the City of Chattahoochee Hills, based on the staff suggestion, do not find the need to rezone the land to be annexed and shall retain the current zoning designations place by Fulton County on the land described in Exhibit A ; WHEREAS, the addition of the land described in Exhibit A to the City of Chattahoochee Hills will change the Zoning Map and the text of the Zoning Ordinance; and WHEREAS, the following regulations will address these issues and further the public health, safety, and welfare; NOW, THEREFORE, THE COUNCIL OF THE CITY OF CHATTAHOOCHEE HILLS HEREBY ORDAINS that: Section 1: The area contiguous to the City of Chattahoochee Hills as described in Appendix A, which is attached to and incorporated as part of this ordinance, is hereby annexed into the City of Chattahoochee Hills and is made a part of said city. Section 2: The area annexed into the City of Chattahoochee Hills under Section 1, above, shall be given the voting designation of Council District and shall vote at the same polling places as other territory in Council District. Section 3: The area annexed into the City of Chattahoochee Hills under Section 1, above, shall retain the current zoning designations placed by Fulton County on the land described in Exhibit A. Section 4: This ordinance shall become effective on the day of Section 5: The City Clerk of the City of Chattahoochee Hills is instructed to send a report that includes certified copies of this ordinance, the name of the county in which the property being annexed is located and a letter from the city stating the intent to add the annexed area to Census maps during the next survey and stating that the survey map will be completed and returned to the Census Bureau, Department of Community Affairs, and to the governing authority of Coweta County, within thirty (30) days after the effective date of the annexation as set forth above in Section 4.

WHEREAS, disastrous incidents and immediate response emergencies occur, during which conditions of extreme peril exist which threaten the safety of person and property; and WHEREAS, disastrous incidents and immediate response emergencies potentially present major public safety conditions, which are likely to be beyond the control of the personnel, equipment, facilities and other resources of the Chattahoochee Hills Fire Rescue Department; and WHEREAS, other political subdivisions of the State of Georgia are likely to be confronted with similar disastrous incidents and immediate response emergencies, which are likely to be beyond control of the personnel, equipment, facilities and other resources of those jurisdictions; and WHEREAS, by combining the resources of the Chattahoochee Hills Fire Rescue Department with the resources of the other political subdivisions of the State of Georgia during disastrous incidents and immediate response emergencies, the life and property of all citizens may be better protected; and WHEREAS, the Chattahoochee Hills Fire Rescue Department desires to provide the best possible protection to it s citizens, businesses, and visitors; and WHEREAS, the Chattahoochee Hills Fire Rescue Department desires to prevent disastrous incidents from occurring; and WHEREAS, the Chattahoochee Hills Fire Rescue Department desires to maximize the protection of life and property when disastrous incidents and immediate response emergencies occur; and WHEREAS, the State of Georgia has provided for Mutual Aid Resource Pacts through O.C.G.A et seq. and O.C.G.A et seq.

27 STATE OF GEORGIA COUNTY OF FULTON RESOLUTION NO NOW THERFORE, BE IT RESOLVED, as follows: Section 1: That the Chattahoochee Hills Fire Rescue Department may render aid and assistance during disastrous incidents and other immediate response emergencies outside it s jurisdiction. Section 2: That the Chattahoochee Hills Fire Rescue Department may form a Mutual Aid Resource Pact, known as the Georgia Mutual Aid Group, with other jurisdictions, as defined on O.C.G.A et seq., the Georgia Mutual Aid Group being a public corporation. seq. Section 3: That the Georgia Mutual Aid Group shall be governed by O.C.G.A et Section 4: That the Chattahoochee Hills Fire Rescue Department Fire Chief or his/her designee shall be authorized to act on behalf of the Chattahoochee Hills Fire Rescue Department on all matters relating to the activities and functions of the Mutual Aid Resource Pact once it has been established. Section 5: That the Chattahoochee Hills Fire Rescue Department may withdraw from the Georgia Mutual Aid Group by resolution and vote of the elected officials pursuant to O.C.G.A et seq. Section 6: That the Chattahoochee Hills Fire Rescue Department s liabilities, privileges, and immunities, including those of it s firefighters and other person s acting on it s behalf, shall be governed by O.C.G.A et seq.
