1 Regular Ketchikan City Council meeting was called to order by Mayor Williams at 7:00 p.m., January 19, 2017, with the following members present: Dick Coose, Mark Flora, Julie Isom, Robert Sivertsen and Judy Zenge. Councilmembers Janalee Gage and David Kiffer were absent. The Pledge of Allegiance was given by all persons in the Chambers. Staff present were Manager Amylon, City Attorney Seaver, Finance Director Newell, Police Chief Bengaard, Telecommunications Division Assistant Manager Lindgren, Civic Center Administrative Assistant McPherson, Public Works Director Hilson, Museum Director Gray, Library Director Tully and City Clerk Suiter. COMMUNICATIONS A memorandum from the manager was laid on the table requesting withdrawal of the executive session regarding the demolition of 347 Bawden Street. PERSONS TO BE HEARD Manager Amylon introduced the City's new Library Director Pat Tully, and the City's new Museum Director Lee Gray. Ms. Tully said she was thrilled to be in Ketchikan, and Ms. Gray agreed. Robert Boyle, Ketchikan Gateway Borough School District Superintendent, said he was proud to be a citizen of Ketchikan. Speaking both as a citizen and the superintendent, he expressed how proud he was of the Police Department, and felt it was due to Police Chief Bengaard's leadership. He figuratively tipped his hat to Chief Bengaard in appreciation of what he has done in our schools. Emily Chapel, representing Ketchikan Wellness Coalition, shared the work of the Behavioral Health Task Force and presented the Strategic Plan they've created. She explained the strategic plan pointed out three of the largest behavioral health needs in Ketchikan: 1) stress that leads to depression; 2) the large stigma that surrounds mental health; and 3) lack of knowledge of treatment and payment options. She noted they partnered with many organizations during the year and a half of the study, and she outlined the plans they have to address the identified issues. She said they are proud of the strategic plan that was developed. Mark Woodward, representing E & M Holdings, requested the City write a letter of support to AMCO for the on-site regulation of consumption that their business has proposed. He pointed out these regulations have been before the board time after time, and they keep tabling the discussion. He said comment for those regulations has ended, but he felt if the City wrote a formal letter to the commissioner he felt it would go a long way. He said if AMCO doesn't pass regulations, the City will need to look at a plan if they are not passed. He pointed out they have been state approved and have received other government approvals. He reminded there needs to be regulations in place. He answered questions from the Council. Page 1

2 CONSENT AGENDA Mayor Williams suggested moving the board appointment and Ordinance No to the Consent Agenda; no objections were heard. Approval of Minutes - Regular City Council Meeting of January 5, 2017 Moved by Sivertsen, seconded by Coose for approval of the minutes of the regular City Council meeting of January 5, Exempting the Procurement of Police Department Annual Licensing and Maintenance Support for Body Worn Cameras and Digital Evidence Storage from Competitive Bidding/Written Quotation Requirements - Taser International Moved by Sivertsen, seconded by Coose pursuant to subparagraph 6 of Section (a) of the Ketchikan Municipal Code, the City Council exempt the procurement of Police Department annual licensing and maintenance support for body worn cameras and digital evidence storage from the competitive bidding requirements of the Ketchikan Municipal Code; authorize the city manager to enter into an agreement for such annual licensing and maintenance support with Taser International at a cost not to exceed $13,227; and approve funding from the Police Department's 2017 Software and Equipment Maintenance Services Account No Liquor License Renewals - Alaska Fish House and 49er Bar and Liquor Store Moved by Sivertsen, seconded by Coose the City Council approve the renewal of liquor licenses: Beverage Dispensary - 49er Bar and Liquor Store and Alaska Fish House; and Package Store - 49er Bar and Liquor Store and Alaska Fish House. Declaration of Surplus Property - Telecommunications Division Copper Cable Moved by Sivertsen, seconded by Coose pursuant to Section (b) of the Ketchikan Municipal Code, the City Council declare as surplus property unneeded Telecommunications Division copper cable and authorize its sale as scrap metal. 3 Appointments to Boards and Commissions - Mayor Williams Mayor Williams submitted Michael G. Medford for reappointment to the Planning Commission and Halli Kenoyer as an appointment for the Museum Advisory Board, and asked if there were any objections. None were heard. Ordinance No Approving an Agreement Between NW Sports Net LLC and the City of Ketchikan d/b/a KPU TV for the Purchase of Television Programming Services - Second Reading Copies of Ordinance No were available for all persons present. Moved by Sivertsen, seconded by Coose the City Council approve in second reading Ordinance No approving an agreement between NW Sports Net LLC and the City of Ketchikan d/b/a KPU TV for the purchase of television programming services; providing for the filing of referendum petitions; and establishing an effective date. UNFINISHED BUSINESS - None NEW BUSINESS Public Works Department's 2017 Programmed Maintenance of City Streets Moved by Sivertsen, seconded by Coose the City Council approve the Public Works Department's programmed maintenance of City streets for 2017 as detailed in the senior project engineer's report dated January 10, Public Works Director Hilson answered questions from the Council. Change Order No. 1 to Contract No Centennial Building Restroom and Gallery Expansion, Dawson Construction Moved by Coose, seconded by Sivertsen the City Council approve Change Order No. 1 in the amount of $56, to Contract No , Centennial Building Restroom and Gallery Expansion, between the City of Ketchikan and Dawson Construction, LLC; authorize funding from the Museum Department's Centennial Building Gallery Expansion and Restroom Renovations Capital Account; and direct the city manager to execute the change order on behalf of the City Council. 4 Budget Transfer - First Student Shuttle Service to Ted Ferry Civic Center for the 2017 Wearable Art Show Moved by Zenge, seconded by Sivertsen the City Council authorize the city manager to contract with the First Student for shuttle service between the Centennial Building and the Ted Ferry Civic Center for the evening performances of the 2017 Wearable Art Show at a projected cost of $1,350; authorize a $1,350 budget transfer from Appropriated Reserves of the General Fund to the City Council's 2017 Community Promotion Account No ; and approve funding from the City Council's 2017 Community Promotion Account No Motion failed with Coose, Flora, Zenge, Sivertsen and Isom voting nay; Kiffer and Gage absent. Proposed City Council Request to Borough Assembly - Prohibiting Sales Outside of Concession Stands Moved by Sivertsen, seconded by Flora the City Council direct staff to file a formal request with the Ketchikan Gateway Borough Assembly on behalf of the City Council asking that the Borough Assembly amend its code relative to Conditional Use Permits to prohibit sales outside of concession stands. Mayor Williams reminded of the resolution that was sent to the Borough last year of the City's philosophy that was put into ordinance form relative to people selling products in their doorways. He said it has been suggested to write a letter to the Borough Assembly to request it be added to their ordinances. Councilmember Coose also brought up concerns relating to vendors at Berth IV, and Manager Amylon said he would reflect those concerns to the property owner. Resolution No Honoring Alan Bengaard for His Years of Service to the Ketchikan Police Department Moved by Sivertsen, seconded by Flora the City Council approve Resolution No honoring Alan Bengaard for his years of service to the Ketchikan Police Department; and establishing an effective date. Mayor Williams read the resolution and presented it to Police Chief Bengaard. He said people can judge a community by its police department, and it has been wonderful having Alan in there because as mayor, he doesn't get a lot of complaints and makes everything go smoothly for him. APPROVAL OF VOUCHERS Moved by Flora, seconded by Isom for approval of vouchers to the Ketchikan Daily News in the amount of $3, Page 4

5 CITY MANAGER'S REPORT KTN Water Street Rehabilitation Project - Minutes of Progress Meeting No. 30 and 31, Dawson Construction Inc. Manager Amylon provided the minutes of the Ketchikan Water Street Rehabilitation Project of December 20, 2016 and January 3, Ketchikan Medical Center Expansion Project - Owner/Executive Committee Meeting Summary Minutes of December 16, 2016 and January 6, 2017 Manager Amylon provided the minutes of the Owner/Executive Committee meeting that was held for the Ketchikan Medical Center Expansion Project on January 6, Resignation of Information Technology Department IT Network Administrator Manager Amylon transmitted a memorandum from Information Technology Manager Thomas informing that the IT Network Administrator Eric Weaver has resigned. Mr. Thomas indicated that the resignation reveals a concern with the current Information Technology job description structure, and he will work with the Human Resources Department to pursue changes. Continued Use of Former Main Street Fire Station by the City Museum Department Due to the installation of a special exhibit opening on April 28, 2017, Manager Amylon indicated his intent to authorize the Museum Department to occupy the former Main Street Fire Department for the balance of 2017, unless otherwise directed by the Council. January 26, 2017 Special Meeting of the City Council - Contract No , Planning and Design of Port Improvements Manager Amylon reminded the Council of the special meeting on January 26, 2017 relative to Contract No , Planning and Design of Port Improvements. Police Chief Recruitment Manager Amylon alerted the Council that an external recruitment will begin for the position of Police Chief. He said there was one internal application received, and after discussing it with the internal applicant, the application will be considered with any applications received as part of the external recruitment. He advised that Lieutenant Joe White will be acting Chief of Police upon the retirement of Chief Alan Bengaard. KPU MANAGER'S REPORT Page 5

6 Project Status Reports of the KPU Operating Divisions - Manager Amylon transmitted for Council review the project status reports of the KPU operating divisions for the month of. Councilmember Sivertsen spoke to metering water rates, reminding of the decreased supply of water in the lakes from which hydros run due to the cold weather. He noted the sizable amount of water the seafood processors use, and said the lakes is where the processors take their water from. General Manager Authorization of Budget Transfer - Transfer of Funds from Generation Diesel Fuel Account to Purchased Power Account As required by the Ketchikan Municipal Code, Manager Amylon notified the Council of the transfer of funds from the Generation Diesel Fuel Account to the Purchased Power Account. Resignation of Inside Plant Foreman Manager Amylon informed the Council that he was notified by Telecommunications Division Manager Cushing that Inside Plant Foreman Caryn Homan has resigned her position. After noting her significant efforts on behalf of the Telecommunications Division, he wished Ms. Homan the best in her future endeavors. CITY CLERK'S FILE - None CITY ATTORNEY'S REPORT Report of Significant Activities for the Month of December Office of the City Attorney Manager Amylon copied the Council with a report from City Attorney Seaver detailing the significant activities for the office of the City Attorney for the month of. FUTURE AGENDA ITEMS - None MAYOR AND COUNCIL COMMENTS Councilmember Flora welcomed the Museum and Library directors, saying he hoped Ketchikan was a good move for them. Councilmember Coose commented that we might need to think about talking to our federal delegation about a bridge again. He referred to an article in the paper about the possibility of extra ferry service due to increased passengers. He felt that clearly every report that has come out from the state indicated that the most economical thing we can do in the long run is a bridge to access that airport and land (on Gravina). Councilmember Zenge said while she understands the need for a shuttle service, the City needs to develop a policy. She pointed out for people to just come to the Council every couple of months before events puts a strain on what we do with community grants. Page 6

7 Councilmember Isom thanked Mayor Williams for appointing her to so many boards, as she has had lots of meeting the past two weeks. Mayor Williams said he was going to bring a new resolution back about Deer Mountain because we have a new delegation in Washington. He said the sewer thing at Thomas Basin really bothers him. He wondered if a contractor in the area could come up with an idea, and Manager Amylon said the question could be asked. He pointed out he has a lot of meetings as well.
