1 THE CORPORATION OF NORFOLK COUNTY REGULAR COUNCIL TUESDAY, SEPTEMBER 22, 2015 The following are the minutes of the Regular Council held on Tuesday, September 22, 2015, at 5:00 pm in the Council Chambers, County Administration Building, 50 Colborne Street South, Simcoe. No. 1 Mover: Councillor Doug Brunton Seconder: Councillor Peter Black THAT the agenda be approved as amended. 4. Public Meeting/Public Hearings Mayor C.H. Luke officially opened the Public Meetings, held under the Municipal Act, the Planning Act and the Drainage Act for the purpose of hearing applications and proposals and affording any Page 2 of 10

3 persons in attendance the opportunity to make representation to Council. The Mayor advised those in attendance that the Ontario Municipal Board has the power under the Planning Act to dismiss an appeal to either a Zoning By-Law and/or an Official Plan Amendment if the appellant does not make oral submissions at the Public Meeting or does not make written submission to Norfolk County Council before the Zoning By-Law is passed and/or before the Official Plan Amendment is adopted. A) (CONSENT) By-Law 49-Z-2015 being a By-Law to Amend Zoning By-Law 1-Z-2014, as amended, for Property described as Part Lot 1, Concession 7, Geographic Township of Townsend, Norfolk County, in the Name of Sitko Farms Inc. (ZNPL ) Mayor Luke officially opened the Public Meeting regarding By-Law 49-Z Pam Duesling, Manager of Community Planning, indicated that there is no related staff report. Mayor Luke asked if there was anyone in attendance that wished to speak in support, in opposition or wished to speak in general to By- Law 49-Z No one came forward to speak to the matter. Res. No. 2 Mover: Councillor Peter Black Seconder: Councillor Harold Sonnenberg THAT the public meeting respecting By-Law 49-Z-2015 be closed. Res. No. 3 Mover: Councillor Peter Black Seconder: Councillor Harold Sonnenberg THAT By-Law 49-Z-2015 be passed and signed by the Mayor and the Clerk and Sealed with the Corporate Seal. B) (CONSENT) By-Law being a By-Law to Provide for Drainage Works in The Corporation of Norfolk County for the Boc Municipal Drain Page 3 of 10

4 There are two By-Laws to consider first and second passage of under the Drainage Act. Mayor Luke reminded everyone that Council was not going to discuss the assessed costs of these projects as that is heard at a later stage. These meetings are to discuss the engineer s reports and to allow petitioners the opportunity to add or remove their names. There are no related staff reports for By-Law and as they were considered by Council at the September 8, 2015 Council Meeting. There was some confusion amongst some residents on the date that these items would be heard so Council was holding another public meeting on them to allow comment before the first and second passage of the By-Laws. Mayor Luke officially opened the Public Meeting regarding By-Law Mayor Luke asked if there was anyone in attendance that wished to speak in support, in opposition or in general to By-Law He also asked if there was anyone in attendance that wished to add or remove their name from the petition. No. 8 Mover: Councillor Roger Geysens Seconder: Councillor John Wells THAT pursuant to Section 239(2) and (3.1) of the Municipal Act, 2001, S.O., 2001 C.25, as amended, Council convenes at 5:20 p.m. in a meeting, closed to the public to discuss personal matters about identifiable individuals, including municipal employees or local board, and a matter in respect of which Council, Board, Committee or other body may hold a closed meeting under another Act. Adoption/Correction of Council Meeting Minutes A) Regular Council Meeting Minutes dated September 8, 2015 The minutes of the Regular Council meeting dated September 8, 2015, having been distributed to all members of Council and there being no errors reported, they were thereupon declared adopted and signed by Mayor Luke. 8. Communications A) Doug Stewart, Pioneer Solar Re: Request for FIT Rooftop Solar Resolution, Lee Ridge Pork Limited Partnership, 201 Windham Road 3 Res. No. 10 Mover: Councillor Noel Haydt Seconder: Councillor Roger Geysens WHEREAS capitalized terms not defined herein have the meaning ascribed to them in the FIT Rules, Version 4.0; AND WHEREAS Lee Ridge Pork Limited Partnership (the "Applicant") proposes to construct and operate a Solar Photovoltaic FIT Rooftop System (the "Project") on 201 Windham Road 3, Norwich (Norfolk), Ontario, PIN (the "Lands") in Norfolk County under the province's FIT Program; AND WHEREAS the Applicant has requested that the Council of Norfolk County indicated by resolution Council's support for the construction and operation of the Project on the Property; AND WHEREAS pursuant to the FIT Rules, Version 4.0, Applications whose Projects receive the formal support of Local Municipalities will be awarded Priority Points, which may result in the Applicant being offered a FIT Contract prior to other Persons applying for FIT Contracts; Page 6 of 10

7 NOW THEREFORE BE IT RESOVLED THAT Norfolk County Council supports the construction and operation of the Project on the Lands. 9. No. 12 Mover: Councillor Roger Geysens Seconder: Councillor John Wells THAT Resolution No. 6 of the Council-In-Committee minutes dated September 15, 2015, be adopted as presented which reads as follows: THAT the Staff Report D.C.S Hastings Drive Zoning Study - Final Terms of Reference, be received as information; AND THAT the final Terms of Reference attached to D.C.S be approved. Res. C) Minutes of the Norfolk County Environmental Advisory Committee Minutes dated August 10, 2015 Councillor Black questioned if item 7 of the minutes regarding the NEXT development should read the old airport property rather than Walmart. The County Manager advised that perhaps the Committee was intending the minutes to read the NEXT development opposite Walmart. Res. D) Minutes of the Health and Social Services Advisory Committee Meeting August 20, 2015 Res. (ZNPL ) (Passed under Public Meeting) By-Law being a By-Law to Authorize the Execution of a Tax Arrears Extension Agreement Pursuant to Section 378 of the Municipal Act, 2001, S.O. 2001, C.25 as Amended. (Roll No ) By-Law being a By-Law to Provide for Drainage Works in The Corporation of Norfolk County for the Boc Municipal Drain (1st and 2nd Readings Only) (Passed under Public Meeting) By-Law being a By-Law to Provide for Drainage Works in The Corporation of Norfolk County for the New Lakeshore Road Municipal Drain (1st and 2nd Readings Only) (Passed under Public Meeting) By-Law being a By-Law to Authorize the Execution of a Collective Agreement between The Corporation of Norfolk County and the Ontario Nurses Association (O.N.A.), Local 007. Notices of Motion A) Councillor Haydt - Quotation request from Long Point Region Conservation for forestry plan Councillor Haydt presented a Notice of Motion as follows to be considered by Council at its meeting on October 13, 2015: THAT the Long Point Region Conservation Authority be requested to provide Norfolk County a quotation to create a 30 year forestry plan for County owned woodlots; AND THAT Council waive the requirements of the Purchasing Policy in respect tendering / RFPing in respect to this matter. 15.
