6 Part II Attachment I Rev. 5 March Introduction The following document is an excerpt from the Nationwide Permit 39 Pre-Construction tification submitted to the U.S. Army Corps of Engineers, prepared by Blanton & Associates, Inc. The document demonstrates compliance with the Clean Water Act, demonstrating the delineation of wetlands and Jurisdictional Waters of the U.S. The findings demonstrate that no wetlands exist at the site. 7 Compliance with the Clean Water Act A desktop analysis of existing background information was conducted to identify potential waters of the U.S., including wetlands, within the project area. The desktop analysis included the review of the 2015 Bing aerial imagery; the U.S. Geological Survey (USGS) 7.5-minute topographic map of Ferris, Texas (USGS 1968); U.S. Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS) Web Soil Survey (USDA 2017a, 2017b); USDA Soil Conservation Service (SCS) Soil Survey of Dallas County, Texas (USDA 1980); United States Fish and Wildlife Service (USFWS) National Wetlands Inventory (NWI) maps; and Federal Emergency Management Agency (FEMA) floodplain maps (FEMA 2017). According to the NRCS, two soil mapping units occur within the project area (USDA 2017b). Both the Heiden clay and the Ferris-Heiden complex include well drained blackland clay soils on footslopes and sideslopes (USDA 2017a). hydric soils were identified in the project area. According to the NWI maps, no potential wetlands are present in the project area. These figures can be seen in Attachment E of the full pre-construction notification (PCN) Application. The project area is located within the Upper Trinity watershed (8-digit Hydrologic Unit Code ) (USGS 1968). blue line is noted within the project area and the topography of the project area is relatively flat, with surface water draining toward an unnamed tributary of Tenmile Creek and eventually on to the Trinity River (USGS 1968). In addition, the National Hydrography Dataset did not identify a stream in the project area. A review of the FEMA floodplain maps revealed that the project area is not within a 100-year floodplain (FEMA 2017). A 100-year floodplain (Flood Insurance Rate Map Zones A and AE) associated with Tenmile Creek is located west of the Union Pacific Railroad, downgradient of the project area (FEMA 2017). Blanton and Associates (B&A) biologists conducted a waters of the U.S. delineation and threatened and endangered species habitat assessments on January 26, The determination and delineation of wetlands and other waters of the U.S. was conducted in accordance with the 1987 U.S. Army Corps of Engineers (USACE) Wetlands Delineation Manual (USACE 1987) and the March 2010 Great Plains Regional Supplement (Version 2.0) to the 1987 USACE manual (USACE 2010). The field investigations confirmed that the project would not impact wetlands. Completed wetland determination data forms are provided in Appendix A. The ordinary high water mark (OHWM) of potential waters of the U.S. in the project area were mapped using differentially corrected Geographic Information System data from a Global Positioning System unit. An ephemeral tributary to Tenmile Creek exhibited a discontinuous OHWM. As seen in Table 1, a total of 400 linear feet of ephemeral stream were observed within the project area. It should be noted that only one stream was located within the project area and the stream segments are divided up by areas that exhibited an OHWM, listed upstream to downstream. Figure 5 in Attachment E of the full PCN Application also illustrates the areas where an OHWM was located. 17 1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in the review area, and the requestor of this PJD is hereby advised of his or her option to request and obtain an approved JD (AJD) for that review area based on an informed decision after having discussed the various types of JDs and their characteristics and circumstances when they may be appropriate. 2) In any circumstance where a permit applicant obtains an individual permit, or a Nationwide General Permit (NWP) or other general permit verification requiring preconstruction notification (PCN), or requests verification for a non-reporting NWP or other general permit, and the permit applicant has not requested an AJD for the activity, the permit applicant is hereby made aware that: (1) the permit applicant has elected to seek a permit authorization based on a PJD, which does not make an official determination of jurisdictional aquatic resources; (2) the applicant has the option to request an AJD before accepting the terms and conditions of the permit authorization, and that basing a permit authorization on an AJD could possibly result in less compensatory mitigation being required or different special conditions; (3) the applicant has the right to request an individual permit rather than accepting the terms and conditions of the NWP or other general permit authorization; (4) the applicant can accept a permit authorization and thereby agree to comply with all the terms and conditions of that permit, including whatever mitigation requirements the Corps has determined to be necessary; (5) undertaking any activity in reliance upon the subject permit authorization without requesting an AJD constitutes the applicant s acceptance of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any form of Corps permit authorization based on a PJD constitutes agreement that all aquatic resources in the review area affected in any way by that activity will be treated as jurisdictional, and waives any challenge to such jurisdiction in any administrative or judicial compliance or enforcement action, or in any administrative appeal or in any Federal court; and (7) whether the applicant elects to use either an AJD or a PJD, the JD will be processed as soon as practicable. Further, an AJD, a proffered individual permit (and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to make an official determination whether geographic jurisdiction exists over aquatic resources in the review area, or to provide an official delineation of jurisdictional aquatic resources in the review area, the Corps will provide an AJD to accomplish that result, as soon as is practicable.
