2 2 -Applicability- This Amendment is applicable to: All Indirect Air Carrier (IAC) operations involving cargo 16 ounces (453.6 grams) or greater in weight whereby the IAC or its authorized representative accepts screened cargo from a certified cargo screening facility () and then subsequently tenders the cargo to an aircraft operator or foreign air carrier under a full program (See 49 CFR (a) and 49 CFR (a) and (b) at airports within the United States and its territories. This section applies to all IACs and authorized representatives who tender cargo that was screened at a to a full domestic aircraft operator or full foreign air carrier (see 49 CFR (a) and 49 CFR (a) and (b) within the United States for domestic or international air transportation. 3 3 -General- Section 1 This Amendment is applicable to each IAC and authorized representatives that accept, handle or transport cargo that is screened by a Certified Cargo Screening Facility (). The measures in this Amendment are in addition to the provisions in the IACSSP and the IAC must continue to carry out both the IACSSP and this Amendment. A.The IAC must notify its authorized representatives in writing of their specific security functions when accepting, handling, and transporting screened cargo in accordance with this Amendment and Section of the IACSSP. B.The IAC must maintain a copy of the written notification and evidence of its receipt by each authorized representative for a minimum of 90 calendar days after the IAC discontinues its relationship with an authorized representative in accordance with Section of the IACSSP. C.These security functions must include chain of custody procedures in accordance with Section 2., Section 3., Section 4., Attachment 1 and Attachment 2 of this Amendment. 4 4 -Definitions- Certified Cargo Screening Facility Authorized Representative An individual who is not a direct employee of the that is authorized to act on the s behalf to perform security measures required by this Amendment. Conveyance A means of transporting cargo, such as a vehicle, truck, or railway car. Screened Cargo Identifier (SCI) A sticker, tag, or stamp that will be applied to screened cargo that displays a reference number. Tamper Evident Technology (TET) TSA-accepted technology that shows evidence of tampering if broken, manipulated or opened. 5 5 -Screened Cargo Acceptance and Verification Procedures- Section 2 The IAC must: A.Determine that the, IAC, aircraft operator or foreign air carrier appears on the TSA-Approved IAC and Air Carrier Master List or the TSA-Approved Weekly Master List and its weekly supplements. B.If the cargo tendered is from a shipper, the IAC must verify that the cargo being accepted is from a shipper with a known status following the measures in the IACSSP Section )This known shipper status check must occur prior to the IAC or its authorized representative accepting cargo from a, or at the point when a delivers cargo to the IAC. C.Obtain the applicable written certification from a that is also an IAC, a that is not an IAC, an IAC that is only authorized to accept and handle -screened cargo, and an aircraft operator or foreign air carrier described in Section 2.1.C.1. (-IAC), Section 2.1.C.2. (), Section 2.1.C.3. (IAC), or Section 2.1.C.4. (aircraft operator or foreign air carrier) when accepting screened cargo. 6 6 -Screened Cargo Acceptance and Verification Procedures- If the is also an IAC, the written certification must state: The IAC must ensure the applicable written certification described in Section 2.1.C. is: 1)Is obtained in electronic or hardcopy format, 2)Identifies the acceptance date and name of the employee or authorized representative of the tendering the cargo, and 3)Has all blanks completed and all applicable boxes checked. Date: Air waybill, bill of lading, company inventory, or other internal shipping document number: (IAC s name) is in compliance with its TSA-approved security program and all appropriate security directive(s). All cargo tendered in conjunction with this certificate was either: 1) accepted from a Known Shipper or an Unknown Shipper in accordance with TSA requirements specified in the Indirect Air Carrier Standard Security Program, or 2) accepted under transfer from another direct or indirect air carrier operating under a TSA approved or accepted security program. This IAC is also a TSA-certified cargo screening facility () and is in compliance with the TSA-approved certified cargo screening program (CCSP). Our number assigned by TSA is ( #), which is applicable only to this facility, located at (address). All cargo has been screened and transported in accordance with the CCSP requirements. A chain of custody method has been applied, and the cargo is being tender with the chain of custody method intact. 7 7 -Screened Cargo Acceptance and Verification Procedures- The IAC must maintain the applicable written certification in electronic or hardcopy format as described in Section 2.1.C. at the accepting IAC for a minimum of 30 calendar days from the date the cargo was accepted and make it available to TSA upon request. If the cargo does not have the certification listed above, the IAC must not represent the cargo as screened, either implicitly or explicitly. The IAC must ensure that all other acceptance procedures in IACSSP Chapter 2 are followed. 8 8 -Screened Cargo Acceptance and Verification Procedures- If the applicable screened certification is not accounted for at the time of acceptance, the IAC must treat the cargo as unscreened and obtain the applicable unscreened certification outlined in IACSSP section 6.2.A and section 6.2.B as follows. The IAC must apply all other acceptance procedures in IACSSP Chapter 2 are followed. Upon acceptance of screened and unscreened cargo, the IAC must ensure that screened and unscreened are not consolidate or combined under one MAWB. 10 10 -Chain of Custody Methods, Procedures and Verification Processes- The IAC must maintain the chain of custody process from acceptance of the cargo until the IAC tenders the cargo to a full aircraft operator or full foreign air carrier by: A.Holding the cargo in an area or conveyance that is locked, sealed, or under constant in-person (with a STA) observation. Access to such screened cargo must be only restricted to authorized individuals only. B.Ensuring that only persons who have successfully completed an STA must have access to the screened cargo, and C.Having processes and procedures to control access to screened cargo to prevent access by unauthorized individuals, and prevent or deter the introduction of any unauthorized explosive, incendiary, and other destructive substance or item. Locked Conveyance If conveyance is locked, then the ULD, skid, or piece level (whichever is largest) must have chain of custody technology applied in addition to a screened cargo identifier tag. The IAC employee or authorized representative must sign the applicable written certification as described in Section 2.1. of this Amendment after verifying the chain of custody method used on the conveyance. 13 13 -Verifying Chain of Custody for a Conveyance- When transporting screened cargo (accepted under this amendment 001) and unscreened cargo (accepted in accordance with the IACSSP ), such cargo must have separate MAWB however may be transported on the same truck or other means of conveyance. 14 14 -Verifying Chain of Custody for a Configuration- After completing the procedures in Section of this Amendment, the IAC or authorized representative must verify that the TET is intact on the largest level of configuration (for example, ULD pallet, ULD container, skid, or piece levels) for each shipment received, except when the screened cargo is transported in a conveyance that has a tamper-evident numbered seal or an escort. 15 15 -Verifying Chain of Custody for a Configuration- When the IAC receives -screened cargo in a conveyance that is closed with a lock, the IAC must check the TET applied to the cargo on the next largest level of the configuration within the conveyance (for example, ULD pallet, ULD container, skid, or piece levels). 17 17 -Tendering -Screened Screened Cargo- Section 3 In addition to the requirements in IACSSP Chapter 5 Section 5.2 and Chapter 6, the IAC must only tender -screened to an employee or authorized representative of an aircraft operator or foreign air carrier, or an IAC. If the IAC tenders -screened cargo to any other entity, then the chain of custody is broken and the cargo cannot be considered as -screened cargo. The IAC must transport -screened cargo using one of the methods specified below at any time the -screened cargo is outside an IAC s airport facility, AOA or SIDA at a U.S. airport. 1.Assign an escort to monitor the conveyance or containers. The escort may only escort one conveyance at a time. 2.Lock or seal vehicles or containers using the specific outlined procedures. In addition, the IAC must ensure that the escort has successfully completed an STA and provides constant in-person observation of the cargo when the conveyance doors are open. The escort must not perform any other functions except providing constant in-person observation of the conveyance. 19 19 -Cargo Tendering Measures- Only tender -screened cargo to an employee or authorized representative of a that is also an IAC, a that is not an IAC, an IAC that is only authorized to accept and handle screened cargo, or an aircraft operator or foreign air carrier. If the IAC transfers -screened cargo to any other entity, then the chain of custody is broken and the cargo cannot be considered as screened cargo. Secure every conveyance of cargo with a lock, tamper evident numbered seal, or escort before tendering -screened cargo to any regulated entity in accordance with Section of this Amendment. The IAC must ensure that only a person with an STA may hold the key to the conveyance of screened cargo. The IAC must limit the distribution of seals to its employees and authorized representatives who have successfully completed an STA in accordance with IACSSP Chapter 1 Section 1.6.4, and who have a need for access to the seals. In addition, the IAC must store tamper evident seal stock in a locked container. 20 20 -Tendering Certification- The IAC must provide a signed and dated written certification as described when tendering screened cargo to a that is also an IAC, a that is not an IAC, an IAC that is only authorized to accept and handle -screened cargo, or an aircraft operator or foreign air carrier. In addition to the written certification described, the IAC must: 1. Provide a copy of the written certification that was completed by the verifying that the cargo was screened. This certification may appear on any document (for example: an air waybill) associated with the cargo shipment being offered by the IAC 2. Maintain the s original written certification on file at the IAC station for a minimum of 30 calendar days. 21 21 -Tender Certification- The IAC must provide a signed and dated written certification (seen right) as described in this Amendment when tendering screened cargo to a that is also an IAC, a that is not an IAC, an IAC that is only authorized to accept and handle -screened cargo, or an aircraft operator or foreign air carrier. 22 22 -Training- Section 4 In addition to the requirements set forth in IACSSP Attachment 9, the IAC must train all direct employees and authorized representatives who handle screened cargo on acceptance, handling and tendering procedures for screened cargo. This training must be complete before the direct employee or authorized representative handles screened cargo. This training must be added to the training module currently used by the IAC. The IAC must maintain training records for each employee and authorized representative who is trained following the applicable measures in this Amendment, in accordance with IACSSP Attachment 9-3. 23 23 -Summary The Implementing Recommendations of the 9/11 Commission Act of 2007, 29 U.S.C (2007) (9/11 Act) required that TSA develop a system to screen 100% of cargo transported on passenger aircraft by August 3, The Transportation Security Administration (TSA) created the certified cargo screening program (CCSP) to enable industry to achieve the 100% screening mandate. The CCSP requires that a apply stringent chain of custody methods to safeguard previously screened cargo as it travels through the air cargo supply chain prior to being transported on a passenger aircraft.
