1 Notice of Bid The City of Pigeon Forge is requesting bids from qualified vendors on Mobile Live Fire & SCBA Confined Space Training System for the City of Pigeon Forge. Bid specifications are enclosed or may be obtained at the Pigeon Forge Monday through Friday between the hours of 8:00 am to 4:30 pm. Proposals not meeting the requirements will be rejected. The City of Pigeon Forge reserves the right to reject any or all bids or to accept the deemed most favorable to the city. We also reserve the right to accept any portion or all of a bid. Bids must be good through June 1, 2012 with the option to extend bid price for an additional year. Bidder agrees by placing bid that no bills will be submitted to the Pigeon Forge until all items on order are received and accepted by the Pigeon Forge as correct. Bids will be received by the City of Pigeon Forge until 1:30 pm (eastern time) November 7, 2011 at which time they will be opened and read aloud at Pigeon Forge. 2 LEGAL RIGHT TO SPECIFY The Pigeon Forge (for the remainder of this section referred to as the specifier ) chooses to exercise its legal right to specify as determined by the U.S. Supreme Court s affirmation of the decision handed down in the case of Whiten Corp. vs. Paddock. by the U.S. District Court of Massachusetts, the First Federal District Court, which in effect states: 1) That as trained professionals; specifiers make informed judgments on products that they feel best serve their needs. Also, that proprietary specifications (if chosen) DO NOT violate any antitrust laws. technically, very few brands of material or equipment are exactly alike, and if the specifier wants to limit the specifications to one source, he has the right to do so and enforce it. 2) Only the specifier has the responsibility and judgment for determining whether a proposed Substitution an or equal. 3) That from start to finish in the purchasing process, only the specifier can ultimately decide if another desirable product is available in lieu of the specification. 4) Finally, that the courts conclude the burden is on the supplier or manufacturer, who has NOT been specified, to convince the specifier that their product is equal for the purpose of a particular project. The specifier has determined that this product specification shall represent the product to which all offerings shall be compared. Due to the fact that fire firefighting is an ULTRAHAZARDOUS, UNAVOIDABLY DANGEROUS activity, only trained personnel with specific knowledge in the area shall be allowed to make the final determining decision on the selection of the appropriate product to serve the Pigeon Forge s needs.

3 Bid Evaluation and Award: a. The City of Pigeon Forge shall evaluate all bids, which are received prior to closing, based upon the requirements listed in this document. b. The City of Pigeon Forge may include criteria to determine minimum acceptability, such as inspection, testing, quality and suitability for intended use or purpose. The City of Pigeon Forge may, at its discretion, also include criteria that will affect the bid price for award, including but not limited to, delivery time-frame, transportation cost and total costs of ownership of a product. c. The City of Pigeon Forge may award based upon best value. d. After bid opening, the City of Pigeon Forge may conduct discussions for the purpose of clarification to assure full understanding of the bid. Vendor Qualification Requirements: a. Vendor shall submit Quality Assurance & Quality Control (QA & QC) Program Manual. b. Vendor shall submit welding certificates for current employees. c. Vendor shall employ an American Welding Society (AWS) Certified Welding Inspector and shall submit certificate. d. Vendor shall demonstrate that upon project delivery a memo prepared by a Registered Professional Engineer (PE) will be provided to indicate that rappelling anchors are in compliance with Occupational Safety and Health Administration (OSHA) standards.

4 General: a. The training system shall be constructed from new 8ft x 8.5ft x 40ft International Organization for Standardization (ISO) containers. b. The training system shall utilize ISO container chassis to maintain system mobility. c. The training system shall provide both Class A and Class B Liquid Petroleum Gas (LPG) live fire burn training capabilities that are in compliance with applicable National Fire Protection Association (NFPA) standards. d. The training system shall provide SCBA reconfigurable maze and confined space training capabilities. e. The training system shall provide rope rappelling training capabilities that are incompliance with applicable OSHA standards. f. The training system shall include sufficient egress to allow for various training scenarios. g. The training system exterior shall be painted the City of Pigeon Forge choice of color and the roof system shall consist of hot-dipped galvanized bar grating with hot dipped galvanized OSHA compliant safety railing and toe-kick.

5 h. The training system shall include an open floor plan. i. The training system shall be compliant with NFPA 1402, NFPA 54, NFPA 58, NFPA 86, and UL 508. j. The training system shall provide a low cost of ownership. Live Fire Burn Capabilities: a. Designated live fire burn area shall be fabricated as a secondary insulated mild-steel replaceable sleeve system. b. Designated live fire burn area shall provide the necessary system components to perform for both Class A and Class B LPG burn capabilities. c. Designated live fire burn area shall provide the necessary system components to create various fire scenarios. d. Designated live fire LPG burn area shall enable the user to remotely initiate gas flow, adjust flame intensity and terminate flame.

Designated live fire LPG burn area shall incorporate safety features consisting of Guarded EGO (Emergency Gas Off) button, gas valves that return to a closed position when electrical power and/or control gas pressure is terminated and automatic flame monitoring equipment. f. Designated live fire LPG burn area shall incorporate maintenance features consisting of non-proprietary commercially available gas delivery hardware, commercially available control hardware, and system diagnosis by a qualified furnace/boiler technician. g. Designated live fire burn area shall include a behind the wall fire prop for thermal imaging equipment training. SCBA Confined Space Capabilities: a. Designated SCBA confined space area shall provide a fully reconfigurable steel maze system with various specialty panels. b. Designated SCBA confined space area shall be multi-level with low crawl training capabilities. c. Designated SCBA confined space area shall include confined space tube and tri-pod training capabilities. d. Designated SCBA confined space area shall include cutting, breaching, and shoring training capabilities.

7 Rappelling Capabilities: a. Designated rappelling area shall provide negative edge, wall, and window bailout training capabilities. b. Anchor attachment points shall be in compliance with OSHA standards. Set Up and Training: a. The bid pricing shall include assistance, if needed with initial set-up of training simulators b. The bid pricing shall include initial training and train the trainer of the training simulators.

8 Shipping : a. The bid pricing shall include all shipping and handling charges. b. The bid shall allow for 100% delivery before items are paid for. c. The bid shall guarantee pricing until June 1, 2012.
