3 What is the legal framework? PCP were introduced in 2007 by the EC PCP do not constitute State Aid PCP do not fall under the remit of the 2014 Directives on Public procurement

4 Definitions : PCP and PPI- When? Pre Commercial Procurement (PCPs): - No solution or close to the market available - R&D is needed - Have a mechanism to compare pros and cons of alternative solutions - Public purchase will promote innovative solutions: derisk all the steps ( design, prototype, development and first product testing) Public Procurement of Innovative solutions (PPIs) - Product/service are close to the market - Not available on a large scale commercial basis - No R&D: just incremental innovation or non R&D innovation ( process/organisation)

5 Definitions : PCP and PPI- What? PCP: public authorities/sector buy R&D to steer development of solutions adapted to its needs, gather knowledge of alternative solutions, to avoid supplier lock-in PPI: public authorities/sector act as first buyer of products/services newly arriving on the market

6 Definitions : PCP and PPI- How? PCP: Public sector buys R&D from several suppliers in parallel. There is competition and selection after the critical milestones, risks and benefits of R&D are shared to increase incentives for a large commercialisation PPI: Public sector establish a buyers group which will buy a high volume of solutions after some final test/certification. It acts as a first customer.

8 Shared Benefits of PCP For the public authorities: - Product/service which fitstheir needs - Involvment in the development - Reduction of costs (-20% to 30%) and higher quality - Sharing costs for the whole procurement process - Create a more competitive market - Reduce risk of failure for large scale PPI For the companies: - to increase competition (no supplier lock-in, more SME) - To boost innovation - To access new markets and attract investors

9 The situation of the Intellectual Property Rights (IPR) IPR are kept by the participating R&D companies BUT Public procurers keep license free rights: - To use the developed solutions - To ask the companies to license the IPR to third party providers at reasonnable market conditions if the companies failed to commercialise the products within a specific timeframe after the PCP. (It secures the results of the IP). IPR risks and benefits are shared in order to maximise incentives for a wide commercialisation.
