5 Introduction to the Political framework The German government presented a concept for an accelerated change of energy policy on 6 th June 2011 Quote: The faster phase-out of nuclear energy means that [ ] the basic strategy t laid out in the energy concept relating to the switch to renewable energies and energy efficiency remains valid. Energy concept of the German government (September 2010) Quote: Starting in 2013 the peak equalisation will only be granted if the companies contribute to saving energy. Verification of these savings can be proven by means of the certified records in the energy management systems or by means of other equivalent measures. Comment: Standards DIN EN and ISO are named

9 Which organisations would profit from an EnMS? In principle, i every organisation that t is looking to improve its energy efficiency in the long-run can introduce an EnMS Energy-intensive manufacturing companies Trade and service companies Public sector (e.g. public authorities) The EU energy efficiency plan 2011 specifies that the public authorities should be a role model in terms of introducing an EnMS. 09/02/2012 9

Renewable Energies Act 2012 Explanation of term This constraint acc. to 40 EEG aims to retain international (or in the case of rail traffic, intermodal*) competitiveness. * Intermodal competitiveness refers to the competitiveness of rail traffic in particular compared to road traffic, shipping and air traffic
11 40 ff. Renewable Energies Act 2012 As a result of the amendment of the Renewable Energies Act (EEG), some application criteria i as defined d in 40 ff. have changed. This means that power-intensive manufacturing companies are eligible to apply if the electricity purchased from the power supply company and consumed within the company totalled at least 1 GWh/a at the delivery point and the ratio of the power costs to the gross value added totalled at least 14 percent and the EEG levy was passed on proportionally to the company and the energy consumption and the potential to reduce the energy consumption has been certified and assessed

Renewable Energies Act 2012 The term production companies only includes Mining and quarrying in acc. with Section B of the classification of the industrial sectors by the Federal Statistics Office (2008) Manufacturing companies in acc. with Section C This means that companies from the following industries are no longer eligible ibl to apply: o o Power supply in accordance with Section D Water supply; sewerage, waste management and remediation activities in accordance with Section E 09/02/
13 40 ff. Renewable Energies Act 2012 The amendment of the EEG has meant that some terms have been specified in more detail, making them more restrictive: Delivery point refers to the spatial and physical electrical equipment of a company that is located on contained company grounds and which is connected to the grid operator s grid via one or several delivery points. Independent company units must have their own balance sheets and profit and loss accounts in line with the German Commercial Code (HGB). Newly founded companies only those companies that initially start up after primarily new operating assets have been created; they may not be created by means of a reorganisation
