1 Parks & Recreation Department 9355 E Stockton Blvd, Suite 185 Elk Grove, CA REQUEST FOR WRITTEN BIDS TO: ALL PROSPECTIVE BIDDERS DATE: August 22, 2016 Bid Manager: Pamela Dawson, Administrative Specialist Project Manager: Justin Ellermeyer, Park Maintenance Manager Bid Due Date: September 7, 2016 at 10:00 AM PROJECT NAME: Project 135: Aquatic Vegetation Harvesting at Laguna Creek (Camden Lake) 2016 PROJECT DESCRIPTION The work to be performed under this contract includes the furnishing of all labor, materials, equipment, transportation and services necessary to harvest aquatic vegetation at Laguna Creek (aka Camden Lake). PROJECT LOCATION: Laguna Creek (aka Camden Lake) is an approximately 13.0 acre body of water located North side of Bond Road approximately 1,000 feet west from the Northwest corner of Bond Road and Elk Grove- Florin Road. COSUMNES COMMUNITY SERVICES DISTRICT The Cosumnes Community Services District (CSD) is an independent special district focusing on essential quality of life services including parks and recreation, fire protection and emergency medical services. The CSD is comprised of three departments: Administrative Services, Fire, and Parks and Recreation. The CSD serves the park and recreation needs of approximately 175,000 residents within a 157 square-mile jurisdiction that includes the City of Elk Grove and unincorporated areas of Sacramento County. Within the jurisdiction, the CSD maintains and operates 680 acres of parkland; 350 of acres of landscaped medians, corridors and greenbelts; two aquatic complexes; two community centers; four recreation centers; a skate park; three dog parks; 18 miles of trails and a nine-hole golf course. LICENSURE REQUIREMENTS: Each Bidder shall be a licensed contractor pursuant to the Business and Professions Code. Bidders who are ineligible to perform work on a public works project pursuant to Section or of the Labor Code are prohibited from submitting a Proposal on this project. SCOPE AND SCHEDULE OF SERVICES It is the responsibly of each bidder to visit the project location to identify any issues that are out of the normal Scope and Schedule of Services set forth in the attached Exhibit A, incorporated herein by this reference. Wage rates can be located online at The successful Bidder shall comply with all applicable Labor Code provisions, including but not limited to, hours of labor, employment of apprentices and debarment of contractors. CONTRACTOR REGISTRATION: Pursuant to Labor Code sections and , all contractors and subcontractors that wish to bid on, be listed in a bid proposal, or enter into a contract to perform public work must be registered with the Department of Industrial Relations. No bid will be accepted nor any contract entered into without proof of the contractor s and subcontractors current registration with the Department of Industrial Relations to perform public work. If awarded a Contract, the Bidder and its subcontractors, of any tier, shall maintain active registration with the Department of Industrial Relations for the duration of the Project. Complete and submit Exhibit D with Proposal Package. LABOR COMPLIANCE: This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. In bidding on this project, it shall be the Bidder s sole responsibility to evaluate and include the cost of complying with all labor compliance requirements under this contract and applicable law in its proposal. BID FORM Contractor must submit a completed Bid Form (Exhibit B) and attach the following items: Costs for all equipment and staff to do harvesting per day (based on 8 hr day), including all mobilization and transportation costs. List of proposed equipment to perform the work included in this project. Water depth drafted by the harvester (unloaded). Exhibit D is required to be submitted with the big package. Proposals shall be valid for 90 calendar days after the time specified above.

3 Request for Proposal 135 Camden Lake Harvest RFP 2016.doc; page 3 AWARD OF CONTRACT The District shall award the Contract for the Project to the Bid that is deemed most advantageous to the District. The Board of Directors of the Cosumnes Community Services District reserves the right to reject any or all proposals and to waive any informality in any Proposal. INSURANCE The Contractor must provide evidence of commercial general liability and professional liability insurance from an insurance company authorized to be in business in the State of California in an amount of not less than One Million Dollars ($1,000,000) for each occurrence. Contracted Bidder will be required to provide an insurance certificate naming the CSD as additionally insured. Contractor must provide certificate showing active policies of automobile liability, commercial general liability and property damage insurance from an insurance company authorized to be in business in the State of California. The following statement must appear on the certificate: "Additional insured endorsement names the Cosumnes Community Services District its directors, agents or employees are included as additional insured." PAYMENT The prices paid for the various items in the bid proposal shall include full compensation for furnishing all labor, materials, tools, equipment, and incidentals necessary to complete the finished product as provided in these specifications. Compensation in full for items specified in the bid proposal shall include payment for furnishing all labor, materials, tools, equipment, and incidentals necessary to complete the Services. Whenever it is specified that the Contractor is to do work or furnish materials of any class for which no price is fixed in the bid proposal, it shall be understood that the Contractor is to do such work or furnish such materials without extra charge or allowance or direct payment of any kind. The cost of doing such work or furnishing such materials is to be included in the price bid for such other items of work, as the Contractor may consider appropriate. The Cosumnes Community Services District (CSD) is an independent local government entity and a political subdivision of the State of California, established under Government Code Sections and 56439(c). The District provides emergency medical and fire protection services to the cities of Elk Grove and Galt and to unincorporated areas in south Sacramento County, and provides parks and recreation services to the Elk Grove Community. The District encompasses roughly 157 square miles and serves an estimated population of 174,400. The CSD is dedicated to the principles of competition and fairness. The District is committed to ensuring that local taxpayers receive the maximum value for every District expenditure. Toward that goal, we encourage qualified vendors to participate in doing business with the CSD.

4 Request for Proposal 135 Camden Lake Harvest RFP 2016.doc; page 4 EXHIBIT A SCOPE AND SCHEDULE OF SERVICES PAGE 1 of 2 DESCRIPTION: Laguna Creek (aka Camden Lake) is an approximately 13.0 acre body of water located North side of Bond Road approximately 1,000 feet west from the Northwest corner of Bond Road and Elk Grove- Florin Road. All areas reasonably accessible by the harvester shall be cleared of aquatic vegetation. The District expects a minimum of 85% of the creek surface to be cleared of aquatic vegetation. Tullies growing in the creek are not included in this project. PROJECT DURATION Thirty-two (32) hours of actual aquatic vegetation harvesting in the upper creek and sixteen (16) hours of actual aquatic vegetation harvesting in the lower creek. HARVESTER LAUNCH POINTS Upper Creek: designated area off Bond Rd. on the east side of the Mosquito Abatement property (see Exhibit C Map). This area requires access through a locked gate. Contractor will be provided one key for gate access. Contractor shall open gate only for equipment access/egress and gate shall be locked during harvesting operations. The Contractor will be required to sign the District s Key Agreement form. The gate key shall be returned at the end of the project. Project invoices will not be processed until the gate key has been returned to the District. The access road is comprised of mowed vegetation over compacted dirt. Contractor shall take all necessary actions to prevent the tracking of dirt/mud from the launch point onto Bond Rd. or adjacent roadways. Contractor is responsible to pay any SWPPP fines/penalties resulting from tracking dirt/mud onto roadways. Contractor will be responsible for street cleaning if dirt/mud is tracked onto the roadways. The surrounding area is comprised of tall vegetation. Contractor shall take all necessary fire prevention measures when working around the tall vegetation areas. Contractor may be held responsible for any fire control costs caused by Contractor negligence. Lower Creek: designated area on the south west side of Allister Way side of creek. Access to this launch point requires equipment to be transported across turf in the park. Contractor is responsible for protecting park property including, but not limited to: turf areas, sprinkler heads, valve boxes, trees, sidewalks, and park benches from damage. The District will mark all sprinkler heads, valve boxes, and existing sidewalk damage prior to project commencement. The District will assure the turf access area is dry prior to the scheduled equipment launch day. Contractor shall take all necessary actions to prevent the tracking of dirt/mud from the launch point onto roadways. Contractor is responsible to pay any SWPPP fines/penalties resulting from tracking dirt/mud onto adjacent roadway. Contractor will be responsible for street cleaning if dirt/mud is tracked onto the adjacent roadway. Launching vehicle/trailer shall not be left on turf area after equipment launching. Launching vehicle/trailer shall not be parked on the street overnight. This is a residential area; therefore, Contractor is expected to keep noise to a minimum. The CSD recognizes that some areas of the lower creek may be hard to access due to lower water levels. A shallow draft vessel may be required to achieve desired harvest results. Note: Previous contractors have kept harvester in the water overnight during the harvesting of the lower creek. This is acceptable as long as the harvester is secured and not accessible from nonauthorized users. The District is not responsible for equipment damage associated with equipment storage practices.

5 Request for Proposal 135 Camden Lake Harvest RFP 2016.doc; page 5 EXHIBIT A SCOPE AND SCHEDULE OF SERVICES PAGE 2 of 2 The Contractor is highly encouraged to inspect the launch sites to assure equipment will be capable accessing the launch points and the harvester can be properly launched and/or removed from waterway. VEGETATION DISPOSAL All vegetation removed from the upper creek shall be disposed of in the area designated (see Exhibit C Map) on the south west shoreline. All vegetation removed from the lower creek shall be disposed of along the south shore line on the lower creek (see map). The Contractor to spread/disperse vegetation piles at both disposal sites. Note: The lower creek disposal site is not accessible by land; therefore, vegetation will be required to be disposed along the shoreline directly from the harvester. SPILL CONTROL Contractor must have a hazardous materials spill control kit on site during the entire project. Re-fueling activities shall not result in fuel spillage into any waterway or on land. In the event of a hazardous material spill, the contractor shall call immediately followed by a call to the Project Manager. SCHEDULE OF SERVICE & PROJECT HOURS: Work shall start the week of September 12, 2016 and be completed by September 30, Permitted project work hours shall be: Monday Friday 7:00 A.M. to 5:00 P.M. No work shall be permitted on weekends and/or legal holidays. INCLEMENT WEATHER Contractor is responsible for determining when inclement weather will hinder their abilities to perform work safely. Contractor is expected to schedule work during favorable weather conditions. The District reserves the right, to postpone scheduled work if inclement weather is causing damage to District property, if inclement weather may cause damage to District property, or if inclement weather is negatively effecting harvesting production. No additional charges shall be realized when work is affected by inclement weather. BID PRICING Contractor must submit a completed Bid Form (Exhibit B) and attach the following items: Costs for all equipment and staff to do harvesting per day (based on 8 hr day), including all mobilization and transportation costs. List of proposed equipment to perform the work included in this project. Water depth drafted by the harvester (unloaded). NOTES: 1. The CSD will provide a State of California Fish and Game permit allowing for the work on Camden Lake. 2. Contractor shall monitor harvested aquatic vegetation as it is brought aboard the harvester and/or deposited on land for incidental catch of aquatic wildlife. Aquatic wildlife shall be returned to the water immediately.

The undersigned Bidder proposes and agrees, if this Proposal is accepted, to enter into an agreement with the Cosumnes Community Services District to perform and furnish all services as specified or indicated in the Scope and Schedule of Services and in accordance with all other terms and conditions of the signed agreement. 2. In submitting this Bid, Bidder represents: (a) Bidder has reviewed the Scope and Schedule of Services; and (b) Bidder has visited the Site and performed all tasks, research, investigation, reviews, examinations, and analysis and given notices, regarding the Project and the Site; 3. In response to the Request for Written Bid for the Project referenced above, the undersigned Bidder hereby proposes to the Cosumnes Community Services District to perform the Project Services for the PER DAY BID written below and to furnish all supplies, materials, labor, labor supervision, tools and equipment, and to perform all operations necessary to provide full and Project Services per the attached Scope and Schedule of Services. Bidder agrees that this Bid constitutes a firm offer to District which cannot be withdrawn for ninety (90) days from and after the Reply-By date, or until a contract is fully executed by the District and a Bidder, whichever is earlier. Bidder has attached any details as specified in the Scope of Services Bid Pricing. PER DAY BID (8 hour): $ 4.
