BUSINESS OUT OF MINUTES.1 Sumas Energy 2 Inc. - Public Information Meeting - April II, Update Councillor Ross updated Council on a public information meeting held April II, 2000, regarding the Sumas Energy 2 Inc. proposal to construct and operate a natural gas-fired 660 megawatt combustion turbine project in Sumas, Washington. She emphasized the potentially negative environmental impacts the proposed plant could have on the City of Abbotsford; observed that much of the environmental impact information currently available was not directly applicable to Abbotsford; and noted that the proposed facility would emit significant amounts of PM2.5's (particulate matter microns), which are harmful to human health. Despite the significant opposition expressed by Abbotsford Council and residents, the applicants were proceeding with plans for the construction of the facility, including transmission lines connecting the site to the B.C. Hydro Clayburn Sub-station through the East Abbotsford downtown area along the Canadian Pacific Railway right-of-way. Council was encouraged to join forces with appropriate agencies, and residents were urged to continue submitting letters of opposition to the Canadian National Energy Board. Moved by Councillor Peary, seconded by Councillor Gibson, that the verbal report from Councillor Ross, on the April II, 2000, public information meeting held in Sumas, Washington, regarding the Sumas Energy 2 Inc. proposal to construct and operate a natural gas-fired 660 megawatt combustion turbine project in Sumas, Washington, be received. Puddifant, 4009 Hacking Road - Environmental Development Permit Requirement for Old Yale Road ( I and ) B. Puddifant, 4009 Hacking Road, Tappen, B.C., chronicled her attempts to obtain a building permit from the City of Abbotsford, in order to construct a barn at the top of a steep slope on property located at Old Yale Road. The subject site is located on the mountainside above the Arnold area, and the proposed driveway would be cut into the slope. Although not entirely opposed to the requirement to obtain an Environmental Development Permit, Mrs. Puddifant was of the opinion that the requirements and costs were prohibitive, and requested that the terms and conditions of the required permit be modified. She stated that efforts to comply with the City's guidelines would include submission of a Soil Removal Permit application. R. Puddifant, 4009 Hacking Road, Tappen, B.C., displayed photographs depicting the topography of the site. He believed that all property owners in the area would benefit from the proposed road construction, and agreed with the suggestion that a Soil Removal Permit be obtained. Council was in receipt of a letter dated April 17, 2000, from B. and S. Heppner, Old Yale Road. While not opposed to the request to construct a bam and road access on the subject property, the writers stated that waiving the requirement for an Environmental Development Permit would set a precedent for similar applications in the future. They suggested that the area would be better utilized as controlled small acreage subdivision. Noting that the proposed driveway would require the removal of approximately 140,000 m' of material, Council members commented on the importance and appropriateness of the permitting process to construct roads on mountainsides, given the potential ramifications if the standards were relaxed. Moved by Councillor Peary, seconded by Councillor Redekop, that the delegation of R. and B. Puddifant, regarding a Building Permit application to allow the construction ofa bam on property at Old Yale Road, be received; and the matter be referred to staff and the City Solicitor to determine whether the Environmental Development Permit requirements could be reduced. Paxian, KPMG, highlighted the City of Abbotsford's 1999 audit, which was conducted in accordance with Canadian generally-accepted auditing standards that require planning and performing an audit in order to obtain reasonable assurance whether the financial statements are free of material misstatement. The audit examined evidence supporting amounts and disclosures in the financial statements, assessed accounting principles used and significant estimates made by management, and evaluated the overall financial statement presentation. Mr. Paxian stated that the City's consolidated financial statements presented fairly, in all material respects, the financial position of the City of Abbotsford as at December 31, 1999, and the results of its operations and changes in its financial position for Moved by Councillor Fast, seconded by Councillor Peary, that the delegation of R. Paxian, KPMG, reviewing the City of Abbotsford's 1999 Audit, be received. E CARRIED..3 J.M. Kirkpatrick, 4171 Balmoral Street - Industrial Noises Emissions/Sunset Crescent I.M. Kirkpatrick, 4171 Balmoral Street, spoke to her submissions, which included a letter dated April 17,2000, photographs, excerpts of by-laws from various municipalities, and a daily account of activities occurring at a neighbouring property at Sunset Crescent, where a 1,680 square-foot garage exists on the northeast corner of the site. Mrs. Kirkpatrick believed that the garage contained an industrial operation, and outlined her concerns related to noise and paint fumes emitting from the subject property which, she believed, negatively impacted the health of area residents, as well as the aesthetics and property values in the neighbourhood. The One Unit Suburban Residential Zone (RR4) was amended in October 1998 to increase lot coverage from 10% to 20%, in order to accommodate vehicle restoration and woodworking hobbies on the Sunset Crescent property. Amendments to the Building Code and City By-laws, specific to industrial uses in detached garages, were suggested by the delegate, including: establishing door height maximums to preclude commercial vehicles; reducing setbacks to a maximum of 1.5 m and lot coverage to 10%; prohibiting in residential areas industrial uses, or any use which creates objectionable levels of noise (over 55 decibels), heat or glare, and/or emits objectionable odors, dust, fumes, or any other toxic or noxious matter. Mrs. Kirkpatrick further proposed that hobby or home businesses operations be permitted only between the hours of7:00 a.m. and 9:00 p.m.

Kirkpatrick, 4171 Balmoral Street, discussing industrial noise emissions and requesting amendments to City by-laws to discourage industrial shops in residential areas, be received; and staff report on the possible industrial use at Sunset Crescent, and invite the property owner to attend the meeting when the report is presented. E CARRIED..4 H. and D. Longhurst, Old Yale Road - Subdivision Application ( fS99-24) H. and D. Longhurst, Old Yale Road, spoke to a submission dated April 17, 2000, which addressed their application to subdivide a 21-acre property into two parcels, in order to establish an additional family homestead on the land. Ms. Longhurst outlined the process employed in attempting to obtain approval of the subdivision application. While not opposed to dedicating a 10m portion of property as road in lieu of a preliminary road design, the delegates objected to the Approving Officer's requirement for a statutory right-of-way to accommodate future road realignment/reconstruction. Councillor Warawa left the meeting at 3 :55 p.m. The necessity of the right-of-way dedication for future road widening was explained by staff, and it was noted that lands dedicated to the City, but not required for future works, could be released back to the property owner. Council discussed the authorities of the Approving Officer who, as a statutory appointed official with separate and independent jurisdiction from local government, has the responsibility of independently administering Provincial statutes. The Approving Officer has discretion to refuse approvals of subdivisions plan deemed inappropriate. He may also, under the Municipal Act, determine that a property owner provide, without compensation, land of a greater width than that normally required in order to accommodate necessary road construction. Moved by Councillor Peary, seconded by Councillor Redekop, that the delegation of D. and H. Longhurst, discussing a subdivision application for their property at Old Yale Road, be received. E CARRIED.
6 held April at 2:00 p.m. in the Matsgui Centennial Auditorium Page 6.5 Abbotsford Youth Commission - Mandate/Services/Annual Budget G. Cropley, Vice President, Abbotsford Youth Commission, addressed a submission dated April 7, 2000, which outlined the Commission's mandate, services provided to Abbotsford's youth, and funding. The City contracts with the Youth Commission to identify youth needs, provide young people with a voice, and improve and increase services for youth. When the agreement was made that the Youth Commission would shift from a City program to a non-profit society, it was on the premise that core funding would not be affected. The agreement was confirmed in a yearly contract stating that the City would provide the necessary. level of support for the Commission to fulfill its mandate, including staffing, office supplies, telephone, etc. Further, the Youth Commission would have exclusive jurisdiction on additional funds raised by the Commission, which would not affect core funding from the City. Noting that current funding to the Youth Commission from the City of Abbotsford was below 1997 levels, Mr. Cropley requested an increase to $152,250 to reflect the provision of the core funding clause in the contractual agreement. It was commented that the Youth Commission should be treated consistently with other various organizations that receive grants-in-aid or fees-for-services from the City, all of which had seen increases in the year 2000 budget. Moved by Councillor Gill, seconded by Councillor Peary that, as requested in correspondence dated April 7, 2000, the 2000 fee-for-service to the Abbotsford Youth Commission be increased to $152,250. One member of Council commented that many churches and organizations exist throughout the community, which provide additional youth programs that may not be available through the Youth Commission. Developments, 3800 Block Lethbridge Drive - Rezoning Application ( /R96-16) In Report No. DEV dated April 12, 2000, the Deputy Approving Officer, commented on issues raised at the March 20, 2000, Public Hearing, relative to the C. and T.W. Developments Ltd. application to rezone property at 3800 block Lethbridge Drive from One Unit Country Residential Zone (RR3) to One Unit Urban Residential Zone (RS3) to allow the development of a single family residential subdivision over the western portion of the site. In response to concerns raised at the Hearing, it was clarified that the property is subject to an Environmental Development Permit, which requires a geotechnical report dealing with soil/slope stability issues, as well as preliminary site grading and sediment and erosion control. The applicants had agreed to work cooperatively with adjacent property owners to the north to coordinate site grading activities; construction access to the site would be restricted to the leg of Lethbridge Drive between the subject site and Old Clayburn Road; flag persons would be on duty where appropriate; and the contractor would be required to clean the streets daily. Moved by Councillor Wiebe, seconded by Councillor Redekop, that Report No. DEV dated April 12, 2000, be received from the Deputy Approving Officer; and By-law No , cited as "Abbotsford Zoning By-law, 1996, Amendment By-law No. 48", proceed for second and third readings at an upcoming Regular meeting of Council. Responding to Council questions and comments, staff advised that the application to develop the property to the north of the subject lands would be reviewed to ensure that sediment erosion control and slope stability were suitable, and guidelines would be stipulated in the Development Permit ensuring that drainage issues were adequately addressed. Council members emphasized the need to regularly monitor works being undertaken in development permit areas and enforce the requirements where necessary. The motion was then put and E CARRIED.
8 00028b held April 17,2000, at 2:00 p.m. in the Matsgui Centennial Auditorium Page 8.2 P. Dekker, 4109 Boundary Road - Development Variance Permit Application ( D00-15) Report No. DEV dated April 6, 2000, from the Director of Development Services, reviewed a Development Variance Permit application to allow for the construction of a partial replacement to an existing poultry bam, sited 3.7 m from the interior lot line, rather than the required 20 m, on the P. Dekker property at 4109 Boundary Road. The bam was constructed 3.7 m from the south property line, and the applicant was proposing to locate the replacement portion in the same place. While the former District of Abbotsford Board of Variance had granted a side yard variance from 30 m to 3.7 m, a building permit was never issued for the construction. Due to the close proximity of the proposed building to the south lot line, a two-hour fire rated exterior wall would be required, and FirelRescue Service indicated concern regarding the 3.7 m side yard, which would preclude access to the south side of the building, except from a neighbouring property. If approved, the reconstructed bam would be vented to the north, toward the interior of the subject property, and manure handling would follow Agricultural Best Practices. Moved by Councillor Wiebe, seconded by Councillor Fast, that Report No. DEV dated April 6, 2000, be received from the Director of Development Services; and: (1) the Development Variance Permit application to allow for the construction of a partial replacement to an existing poultry bam, sited 3.7 m from the interior lot line, rather than the required 20 m, on the P. Dekker property at 4109 Boundary Road, be approved in principle and forwarded for public comment to an upcoming Council hearing; and (2) the Mayor and Director of Administration be authorized to execute all documentation relating to this matter. E CARRIED..3 O. and R. Cheema, 3129 Coronation Court - Unauthorized Suite ( ) Report No dated March 30, 2000, from the Planning Technician outlined efforts to bring the O. and R. Cheema property at 3129 Coronation Court, where an unauthorized secondary suite exists, into compliance with City by-laws. The property owners had been advised that, pending legal action, a notice would be filed in the Land Title Office, and that an opportunity would be provided to them to be heard by Council at the April 17, 2000, Executive Committee meeting. Staff advised that the property owners had contacted the City, requesting that consideration of the report be postponed.

Cheema property at 3129 Coronation Court to ensure that any prospective purchaser is aware that the suite located in the house in unauthorized, and that legal action is pending. E CARRIED..4 Parking Surfaces In Single Detached and Rural Residential Zones C fROO-8) In Report No. DEV dated April 6, 2000, the Senior Planner sought direction on a proposed Zoning By-law amendment to require that unenclosed parking surfaces in single detached and rural residential zones be treated with a dust-free material capable of supporting the weight of a motor vehicle. Abbotsford Zoning By-law, 1996, currently allows grassed areas to be used for parking in single family residential areas, provided the grass is well-maintained and does not become a property maintenance issue. Moved by Councillor Wiebe, seconded by Councillor Redekop, that as recommended in Report No. DEV dated April 6, 2000, staff prepare and present an amendment to Abbotsford Zoning By-law, 1996, to require that off-street parking areas in single detached and rural residential zones (RS, RR, and some N Zones), which are not contained in a building or structure, be surfaced with a dust-free material capable of supporting the weight of motor vehicles. E CARRIED.. 5 Central Area Development Strategy C ) Moved by Councillor Gibson, seconded by Councillor Redekop, that consideration of Report No. DEV dated April 6, 2000, from the Manager, Community Planning, providing an update on recent work completed for the City's Central Area, and outlining the Central Area work program for the balance of 2000, be deferred to the May 1,2000, Executive Committee meeting. 10 00 () 2 8'/ held April at 2:00 p.m. in the Matsqui Centennial Auditorium Page 10.6 Central Fraser Valley Conventional and Custom Transit Systems /2001 Operating Agreement ( ) Report No. DEV dated March 30, 2000, from the Director of Development Services, presented the Annual Operating Agreements and the Master Operating Agreements for the term of April 2, 2000, to March 31, 2001, for both the Conventional and Custom Transit Systems. Given that B.C. Transit operates on a fiscal year ending March 31, 2000, the actual civic cost is based on 25% of the 1999/2000 budget and 75% of the budget. For the Custom Transit System, Abbotsford's share is 77.5%. The total cost to Abbotsford for the transit system for year 2000 was projected at $916,381, and $925,000 was budgeted, which represented a 3.9% increase over the 1999 budget. Moved by Councillor Wiebe, seconded by Councillor Gill that, as recommended in Report No. DEV dated March 30, 2000, from the Director of Development Services, the Mayor and Director of Administration be authorized to execute the Annual Operating Agreements and the Master Operating Agreements for the term of April I, 2000, to March 31, 2001, for both the Conventional and Custom Transit Systems.
