COMMONWEALTH OF PENNSYLVANIA DEPARTMENT OF ENVIRONMENTAL PROTECTION BUREAU OF CLEAN WATER MS4 REQUIREMENTS TABLE INSTRUCTIONS Revised, July 29, 2016 Intrductin The Pennsylvania Department f Envirnmental Prtectin (DEP) has develped a table cntaining all municipalities and mst nn-municipal entities in Pennsylvania with regulated small municipal separate strm sewer systems (MS4s) that have applied r are expected t apply fr Natinal Pllutant Discharge Eliminatin System (NPDES) permit cverage and the surface waters the MS4 is believed t discharge t that are cnsidered impaired accrding t DEP s latest Integrated Water Quality Mnitring and Assessment Reprt ( Integrated Reprt ). The MS4 Requirements Table ( Table ) cnsists f tw parts ne fr municipalities and ne fr nnmunicipal entities. The purpse f the MS4 Requirements Table ( Table ) is t identify the specific requirements fr MS4s during the next permit term relating t the remediatin f impaired waters. These requirements g abve and beynd the implementatin f the Minimum Cntrl Measures (MCMs) as part f an MS4 s strmwater management prgram and ther permit cnditins. In general, the next permit term begins in March 2018, althugh sme MS4s have permit cverage extending past this date. The requirements will be cntained in appendices f the NPDES permit r will be required as part f the PAG-13 General Permit Ntice f Intent (NOI) r individual NPDES permit applicatin, as discussed further belw. The Table was develped using GIS by initially drawing a 5-mile buffer arund each municipality s urbanized area (UA) based n the 2010 census layer r, if n 2010 UA existed, the municipal bundary. Drainage areas were then delineated within the buffer thrugh tpgraphical interplatin. If, based n these drainage areas, strmwater frm an urbanized area was expected t flw int impaired waters within the buffer, the impaired waters were selected fr the Table, as were attributes f the impaired waters, including infrmatin n the cause(s) f impairment and Ttal Maximum Daily Lads (TMDLs) that may have been develped fr the waters. See Figure 1, belw, fr a visual example f the analysis undertaken by DEP. DEP did nt utilize any infrmatin submitted by MS4s in develping the Table, as such infrmatin is generally nt in a frmat that can be used fr this purpse at this time. As a result, it is pssible that DEP verestimated discharges f strmwater frm MS4s int impaired waters. DEP is sliciting feedback frm MS4s n this Table. If an MS4 believes an errr has been made, a map identifying all MS4 utfalls and surface waters alng with a narrative descriptin f the errr is necessary and must be sent t the fllwing address s that DEP can review and update the Table as necessary: DEP Bureau f Clean Water Rachel Carsn State Office Building 400 Market Street, PO Bx 8774 Harrisburg, PA 17105-8774 The map and descriptin may als be sent via email t RA-EPPAMS4@pa.gv. Understanding the Table Cunties and municipalities are rdered alphabetically in the Table. The fllwing prvides a descriptin f each clumn: MS4 Name Name f the municipality. Every municipality listed in the Table is expected t currently have NPDES permit cverage, a waiver f NPDES permit cverage, and/r is expected t apply fr NPDES permit cverage by September 2017. NPDES ID The NPDES ID number assigned t the MS4 in DEP s data systems. If an MS4 has been issued an authrizatin t discharge frm DEP, the ID will be the NPDES permit number that is listed n the first - 1 -
MS4 Requirements Table Instructins page. If an MS4 has been issued a waiver, this number shuld be identified in the letter frm DEP apprving the waiver. Current waivers are nted with an asterisk (*) fllwing the ID number. If the NPDES ID N. is blank, DEP des nt have an ID number assigned t the MS4 at this time; where municipalities are listed in the Table because the 2010 census identified an urbanized area fr the first time, the NPDES ID N. will be generated fllwing the MS4 s submissin f an NOI r individual NPDES permit applicatin by September 2017. Nte MS4s with existing waivers may submit their renewal NOI/permit applicatin with a request fr a cntinued waiver, but it is nt a guarantee that a waiver will be granted fr the next permit term. Individual Permit Required? If Yes is indicated in this clumn, the MS4 will be required t submit an individual NPDES permit applicatin by September 2017 (r n later than 180 days prir t expiratin f permit cverage, whichever is later), regardless f the MS4 s existing cverage (i.e., an MS4 currently with PAG-13 General Permit cverage r a waiver will be required t submit an individual permit applicatin). Reasn The reasn an individual permit is required, where applicable. Reasns include: TMDL Plan A TMDL Plan will be required as part f an individual permit applicatin anytime a wastelad allcatin (WLA) fr nutrients and/r sediment (either specific/individual r aggregate/bulk) is specified in a TMDL fr the MS4. SP The MS4 has at least ne utfall that discharges t Special Prtectin (HQ r EV) surface waters. IP The MS4 is currently cvered under an individual permit and it is assumed that the circumstances that led t an individual permit are still in effect. Multiple reasns may be displayed (e.g., TMDL Plan, SP, IP ). If IP is the nly reasn listed fr an individual permit, it is pssible that the MS4 culd qualify fr PAG-13 General Permit cverage fr the next permit term. Impaired Dwnstream Waters r Applicable TMDL Name The name f the surface waters that, accrding t DEP s analysis as described abve, receives strmwater discharges (either directly r within 5 miles dwnstream) frm the MS4 and are cnsidered impaired accrding t DEP s latest Integrated Reprt. In additin, Chesapeake Bay is listed anytime an MS4 discharges strmwater t waters within the Chesapeake Bay watershed. Requirement(s) The requirements applicable t MS4s relating t the remediatin f impaired waters in the next permit term. The infrmatin is presented in the fllwing frmat: Permit Requirement Cause(s) f Impairment (Categry N.) Where: Permit Requirement The appendix (i.e., Appendix A, B, C, D r E) f the PAG-13 General Permit and individual NPDES permit that will be applicable t the MS4 r TMDL Plan (if a nutrient and/r sediment WLA exists fr the MS4 in a TMDL), fr each Impaired Receiving Waters listed. The appendices are cntained in the PAG-13 General Permit available n DEP s website. Instructins fr develping TMDL Plans will be available in a future versin f the individual NPDES permit applicatin. A summary f the requirements is as fllws: - Appendix A Pllutant cntrl measures (i.e., best management practices) must be implemented upn permit cverage t cntrl metals and ph in strmwater discharges t impaired waters (with r withut a TMDL). - Appendix B Pllutant cntrl measures must be implemented upn permit cverage t cntrl pathgens in strmwater discharges t impaired waters (with r withut a TMDL). - 2 -
MS4 Requirements Table Instructins - Appendix C Pllutant cntrl measures must be implemented upn permit cverage t cntrl pririty rganic cmpunds (e.g., PCBs, Chlrdane, etc.) in strmwater discharges t impaired waters (with r withut a TMDL). - Appendix D Chesapeake Bay Pllutant Reductin Plan must be submitted with PAG-13 NOI r individual permit applicatin t cntrl nutrients and sediment in strmwater discharges t waters in the Chesapeake Bay watershed. - Appendix E Pllutant Reductin Plan must be submitted with PAG-13 NOI r individual permit applicatin t cntrl nutrients and/r sediment in strmwater discharges t impaired waters withut a TMDL, r impaired waters with a TMDL but there is n WLA. - TMDL Plan TMDL Plan must be submitted with an individual permit applicatin t cntrl nutrients and/r sediment in strmwater discharges t impaired waters with a TMDL in which there is a WLA fr the MS4. Cause(s) f Impairment The cause f impairment as listed in DEP s data systems. Nte that the terms siltatin, suspended slids and sediment all refer t the same parameter/pllutant (inrganic slids). Als nte that causes f Excessive Algal Grwth and Organic Enrichment/Lw D.O. are surrgates fr nutrients (Nitrgen and Phsphrus). Categry N. The categry assciated with the impairment as cntained in DEP s Integrated Reprt. Categry 4a indicates that the waters are impaired and a TMDL has been cmpleted. Categry 5 indicates that the waters are impaired and a TMDL has nt yet been cmpleted, but is required. If n requirement fr impaired waters is applicable t an MS4, the phrase, N requirements at this time is used. If multiple requirements apply, the requirements are separate by a semicln. Other Cause(s) f Impairment Other causes f impairment, nt related t AMD metals and/r ph, pathgens, pririty rganic cmpunds, nutrients and sediment are shwn in this clumn.
