What events must be reported to OSHA and which employers have to keep records Occupational Safety and Health Administration September 2014

The rule expands the list of severe work-related injuries and illnesses that all covered employers must report to OSHA. Starting January 1, 2015 employers must report the following to OSHA: All work-related fatalities within 8 hours (same as current requirement) All work-related in-patient hospitalizations of one or more employees within 24 hours All work-related amputations within 24 hours All work-related losses of an eye within 24 hours

Method of reporting: By telephone to the nearest OSHA Area Office during normal business hours. By telephone to the 24-hour OSHA hotline ( OSHA or ). Electronically through OSHA's website.

313 Total Severe Injury Reports 233 Hospitalizations 80 Amputations Rapid Response Investigations Onsite Inspections

All Employers with 250 or more employees: Must submit OSHA 300A by July 1, 2017 Must submit OSHA 300A, 300, and 301 by July 1, 2018 Must submit OSHA 300A, 300, and 301 by March 2, Employers with 20 to 250 employees in Designated Industries: Must submit OSHA 300A by July 1, 2017 and July 1, 2018 Must submit OSHA 300A by March 2, 2019 Employers must also submit records if notified by OSHA for individual data collection

Federal Civil Penalty Adjustment Act passed by Congress on Nov 2, 2015 Agencies must increase penalties retroactive to last increase based on CPI. OSHA is approx 78% increase Adjustment in January 2017: +1.4% Adjustment in January 2018: +1.02%

TYPE OF VIOLATION PENALTY MAXIMUM Serious $12,934 Other-than-Serious $12,934 Posting, Non Reporting $12,934 Willful or Repeat $129,336 Failure to Abate $12,934 per day

Employees Percent Reduction or more None

OSHA INITIATIVES Protecting Temporary Workers Heat Illness Prevention Preventing Falls Protecting Health Care Workers Chemical Hazards Workplace Violence Emergency Preparedness

Rise of temp and contract workers 3 million people are employed by staffing companies every week. 11 million temporary and contract employees are hired by U.S. staffing firms over the course of a year. Source: American Staffing Association

Why Are Temp Workers At High Risk of Injury? New workers are at increased risk of injury Host employers don t have the same commitment to temporary employees as to permanent ones Employer who bears the risk of the injury (temp agency) does not control safety and health investment

Protecting Temporary Workers: A joint responsibility Both host employers and staffing agencies have roles in complying with workplace health and safety requirements and they share responsibility for ensuring worker safety and health Legally, both the host employer and the staffing agency are employers of the temporary worker Shared control over worker = Shared responsibility for worker

Temporary Workers: Outreach & Education Alliance with American Staffing Association Issued Temporary Worker Recommended Practices Developing Compliance Assistance Bulletins

Confined spaces, such as sewers, manholes, crawl spaces and tanks, are not intended for continuous occupancy. They can be very difficult to exit and they can be deadly. Effective date of new rule is August 3, CFR 1926 Subpart AA

Here are a few of the requirements in the new rule that differ from those in the existing general industry rule: A "competent person" must conduct the initial jobsite evaluation in the final rule. Information exchange requirements in the final rule inform employers what discussions must be conducted, and when, during confined space entry.

. Air contaminant and engulfment hazard monitoring must be done continuously, as the technology is readily available for most hazards. For substances where continuous monitoring technology is not available, periodic monitoring is required. The construction rule explicitly requires employers to coordinate emergency services before workers enter the confined space. During "controlled atmosphere" entry, employers may isolate physical hazards rather than eliminate all of them (such as using lock-out/tag-out, blocking off access to struck-by hazards, etc.).

Industries have 1 to 5 years to comply Construction- September 23, 2017 General Industry and Maritime June 23, 2018 Hydraulic Fracturing June 23, 2018 Engineering Controls June 23, 2021 Reduces PEL to 50 mg/m3 Engineering controls, PPE, limit access, written control plan Medical exams to monitor highly exposed workers
