1 Description Regular Meeting of the Castle Rock Town Council held July 6, 2010 at 100 N. Wilcox St. Castle Rock, Colorado Mayor Called the Meeting to Order at 6:00 P.M. Time Speaker Note 5:59 PM Invocation 6:00:00 PM 6:00:37 PM Pastor Mark Marble, Castle Rock Bible Church, gave the invocation. Called the meeting to order; All Councilmembers were present. Council Comments Items presented were informational only and did not require direction or action from Council. Appointment to Historic Preservation Board Moved to appoint Kevin Raasch to the Historic Preservation Board to fill the vacancy ending May 31, Seconded the motion to appoint Kevin Raasch. Motion passed :07:41 PM Town Manager s Report Stevens Stevens Proclamation In Remembrance and Recognition of Dr. Jan S. Heibreder for his Service on Town Council. Councilmember read a Proclamation recognizing former Councilmember Dr. Heibreder for his service on Town Council from Requested Council call a Special Meeting for August 11, 2010 at 6:00 p.m. at Town Hall for the Purpose of Meeting with the Douglas County Board of County Commissioners Moved to call a Special Meeting for August 11, Seconded the motion to call a Special Meeting. Motion passed 7-0. Noted there would be a Financial Worksession on Friday July 16 th at 8:00 a.m. in the Town Council Chambers. Requested the staff include discussion of the
2 Douglas Lane /Crystal Valley Interchange on the agenda for the worksession. 6:13:03 PM Town Attorney s Report Slentz No report was presented. 6:14:09 PM Acceptance of Agenda Donahue 6:14:44 PM 6:15:56 PM Hostetler Moved to accept the agenda as presented. Seconded motion to accept the agenda. Motion passed by a vote of 7-0 Consent Calendar 1) Minutes of June 22, 2010 Town Council Meeting Moved to approve the Consent Calendar as read. Seconded motion to approve the Consent Calendar. Motion passed by a vote of 7-0. Ordinance No : Repealing And Reenacting Chapter 2.18 Of The Town Of Castle Rock Municipal Code As A New Chapter Of The Town Of Castle Rock Municipal Code Regarding Historic Preservation; And Making Comprehensive Revisions To Such Chapter; And Providing Penalties For Violation Of Such Provisions (First Reading) Noted this Ordinance and the Downtown Overlay Ordinance were inter-linked and were both critical to maintaining the Downtown heritage and history. The proposed Ordinance would strengthen the landmark designation criteria, create specific demolition and relocation criteria in the Historic Downtown Area and provide for historic district creation and mandatory and enforceable design review by the Historic Preservation Board in the Craig and Gould neighborhood. This Ordinance would eliminate the conservation areas and would eliminate the provision that allowed for involuntary landmark designation. Town Council approval would be required for demolitions of historic properties. Noted his concern with the requirements and restrictions imposed by this ordinance in the Craig and Gould area. Also noted his concern that the Town was
3 Public Comment Donahue Hostetler 6:43:44 PM and essentially creating a Homeowners Association for the Craig and Gould neighborhood. Diane Evans stated she worked on the committee to draft the two ordinances and noted the committee recommended approval of both ordinances. Encouraged additional outreach to the Craig and Gould neighborhood. Noted property owners may not understand what this involuntary designation was. Stated he was concerned that the residents of Craig and Gould may not fully understand and this designation could possibly limit their property rights. Questioned if all the property homeowners were notified of the meeting to discuss the historic designation. Stated five or six meetings were held. Stated they felt the Town had done its due diligence in trying to notify the Craig and Gould neighborhood. Moved to approve Ordinance No Hudson Seconded motion to approve Ordinance Motion passed by a vote of 6-1, Donahue opposed. Ordinance No : An Ordinance Amending Section Of The Castle Rock Municipal Code And The Town Of Castle Rock Zoning District Map By Creating A New Downtown Overlay District Classification; Designating The Downtown Overlay District Boundaries; And Adopting A New Chapter Governing The Downtown Overlay District. (First Reading) Noted the Downtown Overlay District was a key element in the implementation of the Downtown Master Plan. Gave and overview of the Downtown Overlay Ordinance which included zoning modifications. Reviewed responsibilities of the Design Review Board. Reviewed key elements that would assist in the implementation of the downtown Master Plan and Historic Preservation Plan objectives including elimination of parking requirements, improved pedestrian connectivity, increased building heights,
4 Public Comment Wilson streamlined review process, the allowance of mixed use and incentives for historic preservation. Noted the Downtown Overlay was the same as the DDA plan minus the Fairgrounds. Noted the Downtown/Historic Team would like to see a Downtown Sign Code. Diane Evans stated the Downtown Overlay Ordinance allowed for not only the historic preservation of buildings but would also allow for the growth and economic development of new projects. Stated his concern with the building heights allowed under the proposed Ordinance. Noted he was also concerned that the Design Review Board would consist of only business owners. Moved to approve Ordinance No with the removal of section (b). Seconded the motion. Motion passed by a vote of 6-1, Councilmember opposed. 7:07:02 Discussion/Direction Backyard Beekeeping Taylor Public Hearing Logan Stated a Town resident had come before Council and requested reconsideration of the prohibition of backyard beekeeping to allow for non-commercial beehives. Per Council s direction, staff had researched beekeeping in other communities. Noted there were several other Colorado communities that allowed beekeeping. Noted communities that allowed beekeeping regulated the number of hives, required a fence or hedge around the property or imposed other similar restrictions. Mark Baughman currently had bees outside of the Town, and requested Town Council to do away with the prohibition on backyard beekeeping. Stated bees were usually harmless unless a person was within five feet of them. Dave Watts noted bees were essential for vegetables and fruits. Dan Dansor, beekeeper in the County, did not feel beekeeping should be considered a nuisance. Moved to direct staff to draft an ordinance to strike language prohibiting beekeeping and add
5 beekeeping as a permitted use in a single-family residential zoning district. Seconded the motion. Motion passed 7-0. Building Permit Fee Waiver Request for Lloyd Holman Noted Mr. Holman was not present and requested this item be scheduled on a future agenda. 7:33.02 The meeting was adjourned.
