November 8, 2013 Penfield & Smith Attn: Mr. Patrick Reeves 1327 Del Norte Road, Suite 200 Camarillo, California SUBJECT: INQUIRY REGARDING POTENTIAL AG TO M&I HISTORICAL ALLOCATION TRANSFER FOR RANCHO CAPANA HIGH SCHOOL SITE, DATED OCTOBER 8, 2013 Dear Mr. Reeves: Your letter, dated October 8, 2013 (Attachment 1 ), requested that Fox Canyon Groundwater Management Agency (FCGMA) staff review the submitted documents and confirm your understanding of the Agricultural (Ag) to Municipal and Industrial (M&I) Historical Allocation transfer program. Information provided in your letter, with associated attachments, included: the Assessor's Parcel Numbers for the proposed Rancho Capana High School site; wells in the vicinity of the site; and the well currently being used to irrigate the land. The procedures and requirements of an Ag to M&I Historical Allocation transfer are established in Chapter 5, Section 5.3 of the FCGMA Ordinance Code (excerpt attached). As part of the process (per Section ), Historical Allocation, associated with the extraction facility that supplied water to the site during the Historical Allocation base period (1985 to 1989), is to be transferred or prorated. Agency staff did perform research. It appears that the site was irrigated during the base period, (based on an aerial photograph taken on May 23, 1989). The onsite well being used to irrigate the site currently was installed after Historical Allocation base period. The two closest wells to the site with Historical Allocation are currently operated by the City of Camarillo. It is not clear if any of the identified wells in the vicinity provided water to the site during the base period. Agency staff spoke with you via telephone on November 5, 2013, requesting the source of water to the site during the base period. Your submittal for a transfer of HA would be incomplete without that information. Please call us if you have any questions. The well that Is being used for agricultural Irrigation Is 02N20W19A01 and It Is shown on one of your exhibits (attached). It Is located within the proposed school site, so It will have to be relocated to the north, within the remaining agricultural land and as shown on our exhibit. It is our Intent that a portion of the groundwater entitlement will be transferred to the City of Camarillo. The City will provide the proposed school with potable and irrigation water on the order of 31.3 acre feet per year. 7 Excerpt from FCGMA Ordinance Code (Adopted June 26, 2013 and last amended May 22, 2013): 5.3. Adjustments to Extraction Allocations Adjustments to extraction allocations may be necessary to provide some flexibility, while still maintaining the goal of reaching a safe yield condition by the year Adjustments may be accomplished by a transfer, an assignment of historical extraction allocation, or a demonstration of a new water source Subject to the provisions in this Section 5.3, transfers of extraction allocation are authorized provided they result in no net detriment to the Basins within the Agency. In making this determination, consideration shall be given to the location of extraction facilities, the aquifer systems being used, potential groundwater quality impacts, and the overall assessment of the cumulative impacts of transfers of extraction allocation Types of Transfers of Allocation. When irrigated agricultural land(s) changes to M & I use, a basic extraction allocation of 2 acre-feet per acre shall be transferred. In addition, a historical extraction allocation shall be transferred from the agricultural extraction facility(s) operators to the M & I provider in accordance with the following conditions: When the extraction facility is located on the land transitioning and did not serve other land during the historical allocation determination period, the M & I Operator shall receive a historical extraction allocation of 2 acre-feet per acre per year for the acreage transitioning to M & I use. Any historical allocation in excess of 2 acre-feet per acre for the land transitioning to M & I use shall be eliminated When the extraction facility is located on the land transitioning and served other land during the historical allocation determination period, the historical allocation associated with the transitioning property shall be allocated on a pro rata basis by acreage to the total property served. The pro rata share for the property transitioning shall be eliminated. Two acre-feet per acre per year, based upon the acreage being transferred, shall be provided to the M & I provider When the extraction facility serving the lands transitioning is not located on the land transitioning, the Executive Officer shall determine the allocation on an equitable basis for the remaining properties not transitioning to M & I. 8 year, based upon the acreage being transferred, shall be provided to the M & I provider The transfer shall be effective upon the approval of the Executive Officer, taking into account the ongoing use of the property Allocation originating from an agricultural extraction facility shall not be transferred to an M & I use except as provided in this Section Item 8E-5 - Page 8 of 8
