Tariffs and caps are adjusted quarterly according to demand in previous quarter: If at least 75% of the cap for the previous quarter is reached, rates decrease by a maximum of 2.5%, and the cap is increased by the same amount. If between 50 and 75% of the caps are reached, incentive levels and caps remain the same. 5/8

6 The annual digression rate is capped at 10%. Annual caps adjust in inverse proportion to digression (e. g. If rates decrease by 8%, caps will increase by 8%). More information: Taxes Property (cadastral) tax On FIT revenues Yes Yes Administrative procedures General administrative procedure Source: Royal Decree 661/2007 The Decree established a pre-registration mechanism, that, once each of the administrative steps are realized (administrative approval, connection, etc), projects will be entered into a registry, that will assign a tariff which will be received once the installation is completed. The preregistration will be made through four official announcements (quarterly calls) per year. The administrative steps to follow for installing a PV system are: a) Access concession and connection point to transmission or distribution network. 6/8

7 There are 5 big utilities in Spain and about 200 small ones. They are obliged to reply within 1 month (from last law RD661/2007). Normal time 1-3 months b) Administrative authorization for the installation (electric project), given by the Regional Government (should be applied to the Mines and Energy Territory Service of the Province). Note: For type I.1 (<20 kw roof-top systems), the administrative authorization is not requested. There are 17 regional governments and 52 provinces in Spain; therefore 17 different applications and possibilities of 17x52 variations). PV system projects(>10 kw) must be certificated by Registered Engineer Medium time for approval is of 3 months. c) Working license for the installation Project (development project) given by Municipality organism (Town Council). If the ground is classified as not to be developed, it is necessary to have approval from the Regional and Local Government. Depending on the Regional Government, it will be required an Environmental Impact Study, not generally applicable for roof-top installations (some regional government also request it for all roofs) The time for this step (main barrier) is very dependant on the town council. From 20 days to 6 months. Medium lead-time for this procedure, from 2 to 3 months. d) Bank Warranty (50 /kw for Subtype I.1. For others: 500 /kw) e) Final registration within the administrative Registry for power plants falling under the specific regime, depending on the competent body, if the installation has it at its disposal. The mentioned steps can be done in parallel, normally starting with the connection point. Order of preference for the Registry: older date of the latest date of the above five documents Simplified administrative procedure For systems of the type I.1 (<20KW roof-top systems), administrative authorization for the installation, given by the Regional Government, is not requested. *Exception: Until April 09, all installations below 100KWp don t need the administrative authorization. Grid connection For connecting the PV power plant to the transmission network (400 y 220kV), it is necessary to request it to Red Electrica Española, as system operator and transmission network manager.
