7 ECS Project No April 23, EXECUTIVE SUMMARY ECS Florida, LLC (ECS) was contracted by Rochelle Holdings / Project Orlando, LLC to perform an ASTM Standard E , Phase I Environmental Site Assessment (ESA) of an approximately 23-acre property located at 3515 and 381 West Ponkan Road. These two parcels are located in Apopka, Orange County, Florida. Any exceptions to or deletions from this practice are described in Section 2 of this report. The subject property consists of two parcels totaling approximately 23 acres. The western parcel measures acres and is used for cattle grazing. The northern portion of the property is wooded. A small metal shed is located on the south side of this parcel. A cattle feeding and watering area is located on the east side of this parcel. The eastern parcel measures approximately acres. This parcel is used for cattle grazing. The northwest portion of the parcel is occupied by concrete slabs and demolition debris from several small greenhouses that formerly occupied this portion of the parcel. The north adjoining properties are an undeveloped wooded parcel and Southern Landscaping and Irrigation. The east adjoining parcel is rural-residential with some hobbyist agriculture/pasture use. The south adjoining parcels are occupied by a small plant nursery, three rural residential lots and West Ponkan Road, followed by a golf course. Rural-residential development with some hobbyist agriculture use adjoins to the west of the subject property. Based on the records search, site reconnaissance and interviews, it appears that the site remained undeveloped without structures since prior to 1939 until circa Much of the subject property was developed as a small citrus grove from circa 1958 until circa The north central portion of the subject property was occupied by several greenhouse buildings from circa 1987 until circa 26. The site does not receive municipal water or sanitary sewer services. There may be an old (inactive) septic tank on the north central portion of the subject property near the former greenhouses, according to an interview with the former owner. ECS did not observe stained ground surfaces, stressed vegetation or evidence of underground storage tanks (USTs) on the site. A Standard Environmental records (SER) search was provided by Environmental Data Resources, Inc. (EDR), the subcontracted database search firm. The SER search involves searching a series of databases for facilities that are located within a specified radius from the subject property. The EDR report did not identify the subject property on any of the Federal, State, or County databases. The EDR Radius Report listed multiple sites within the minimum ASTM search distances. Based on our review of available public records, none of these facilities represent a recognized environmental condition for the subject property at this time.

8 ECS Project No April 23, ECS did not identify any significant data gaps that would lead to the classification of a recognized environmental condition for the property. No de minimis conditions were observed. While evidence of historical on-site pesticide/herbicide/chemical storage and/or mixing is suspected based on the subject property s past agricultural uses, application of herbicides and pesticides in accordance with manufacturer s approved rates is considered a deminimis condition under ASTM. No surficial evidence of misuse, misapplication or residual materials from pesticides, herbicides, or fertilizers were observed during the site reconnaissance or interviews. As with any agriculturally developed land, there exists the possibility that pesticides, herbicides, or fertilizers have been applied that may have impacted the site. However, given reasonably available information, it is ECS opinion that these conditions do not currently represent a recognized environmental condition for the Site. ECS has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E of the approximately 23-acre subject property located at 3515 and 381 West Ponkan Road. These two parcels are located in Apopka, Orange County, Florida. Any exceptions to, or deletions from, this practice are described in Section 2.3 of this report. As documented and qualified by this report, this assessment has revealed no evidence of recognized environmental conditions in connection with the property. This Executive Summary is an integral part of the Phase I Environmental Site Assessment report. ECS recommends that the report be read in its entirety.

9 ECS Project No April 23, INTRODUCTION 2.1 Purpose and Reason for Performing Phase I ESA The purpose of the ESA was to: evaluate the probability of impact to the surface water, groundwater and/or soils within the property boundaries through a review of regulatory information and a reconnaissance of the subject site and vicinity; evaluate historical land usage to identify previous conditions that could potentially impact the environmental condition of the site; conduct all appropriate inquiry as defined by ASTM E and 4 CFR Part 312; evaluate the potential for on-site and off-site contamination; and, provide a professional opinion regarding the potential for environmental impact at the site, and a list of Recognized Environmental Conditions. The reason for conducting this ESA is to conduct all appropriate inquiry into the uses and prior ownership of the subject property as a part of a pending real estate transaction. The ESA should allow the Users the opportunity to qualify for landowner liability protection under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) provided certain stipulations are met. The landowner liability protections are: an innocent landowner, a contiguous property owner, or a bona fide prospective purchaser. The User must meet the protection stipulations detailed in CERCLA to qualify. 2.2 Scope of Services The environmental assessment was conducted in substantial accordance with ASTM E and EPA Standards and Practices for All Appropriate Inquiry. The environmental assessment was conducted under the supervision or responsible charge of an individual that qualifies as an environmental professional, as defined in 4 CFR

10 ECS Project No April 23, Limitations The ESA involved a reconnaissance of the site and contiguous properties and a review of regulatory and historical information in general accordance with the ASTM standard and EPA regulation referenced herein. No non-scope considerations or additional issues such as asbestos, radon, wetlands or mold were investigated, unless otherwise described in Section 7. of this report. The conclusions and/or recommendations presented within this report are based upon a reasonable level of investigation within normal bounds and standards of professional practice for a site in this particular geographic and geologic setting. The intent of this assessment is to identify the potential for recognized environmental conditions in connection with the site; however, no environmental site assessment can completely eliminate uncertainty regarding the potential for recognized environmental conditions in connection with the site. The findings of this ESA are not intended to serve as an audit for health and safety compliance issues pertaining to improvements or activities at the site. ECS is not liable for the discovery or elimination of hazards that may potentially cause damage, accidents or injury. Observations, conclusions and/or recommendations pertaining to environmental conditions at the subject site are necessarily limited to conditions observed, and or materials reviewed at the time this study was undertaken. It was not the purpose of this study to determine the actual presence, degree or extent of contamination, if any, at this site. This could require additional exploratory work, including sampling and laboratory analysis. No warranty, expressed or implied, is made with regard to the conclusions and/or recommendations presented within this report. ASTM E defines a "recognized environmental condition" as: "the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water of the property. The term includes hazardous substances or petroleum products even under conditions in compliance with laws. The term is not intended to include de minimis conditions that generally do not present a threat to human health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies." ASTM E defines a business environmental risk as a risk which can have a material environmental or environmentally-driven impact on the business associated with the current or planned use of a parcel of commercial real estate. Client-imposed limitations and site condition limitations, if encountered, are detailed in Section 6.1 Methodology and Limiting Conditions.

12 ECS Project No April 23, Site Location and Legal Description 3. SITE DESCRIPTION The subject site consists of two legal parcels located in Apopka, Orange County, Florida. The east parcel is a acre parcel located at 3515 West Ponkan Road (Orange County Parcel ID Number ). The western acre parcel is located at 381 West Ponkan Road( Orange County Parcel ID Number ). Figure 1 (Appendix I) shows the subject property location. A legal description of the property was not provided to ECS. 3.2 Physical Setting and Hydrogeology The subject site is located in an area of commercial and rural-residential development along Golden Gem Road and West Ponkan Road. Refer to Figure 2 (Appendix I) for a site plan. According to the United States Geological Survey (USGS) 7.5 minute series Topographic Map (Apopka, Florida Quadrangle), the subject property is located in an area of elevation of approximately 11 feet above mean sea level. According to the USGS Topographic Map, the site topography is generally flat. Figure 1 (Appendix I) shows a copy of the USGS topographic map. The lakes, ponds, and smaller streams in Orange County form a poorly-defined drainage pattern. Surface water flow generally follows topography to drain into surface water bodies. The county s predominant surface waters consist of small creeks, and natural and man-made lakes and ponds. Two aquifer types are defined in Orange County Florida. The unconfined surficial aquifer overlies the Hawthorn Group. The surficial aquifer is generally recharged by rainfall. The Floridan aquifer, which is the primary drinking water source for residents of the area, lies below the Hawthorn Group and may reach 2, feet in thickness. In Orange County, the surface of the water table approximately conforms to the ground surface topography with groundwater drainage in a down-slope direction towards the nearest surface water body. Surface streams typically drain in a direction that is in accordance with the regional surface slope. Perturbations in the surface drainage are usually due to man-induced changes in the surface topography. Based on surface topography, as interpreted from the USGS Topographic Map entitled Apopka, Florida (Appendix 1, Figure 1), the groundwater flow at the site is variable. Factors such as seasonal fluctuations, soil and bedrock geology, elevation and other factors beyond the scope of this assessment may influence the actual groundwater flow.

The northwest portion of this parcel is occupied by concrete slabs and demolition debris from several small greenhouses that formerly occupied this portion of this parcel. 3.4 Current Uses of the Adjoining Properties The north adjoining properties are an undeveloped wooded parcel and Southern Landscaping and Irrigation. The east adjoining parcel is rural-residential with some hobbyist agriculture/pasture use. The south adjoining parcels are occupied by a small plant nursery, three rural residential lots and West Ponkan Road, followed by a golf course. Rural-residential development with some hobbyist agriculture use adjoins to the west of the subject property.

14 ECS Project No April 23, USER PROVIDED INFORMATION ECS was provided with a User questionnaire on April 13, 29. The User questionnaire was completed by Mr. Jim Palmer, representative of Project Orlando, LLC, the User of this report. ECS notes that Project Orlando is also the owner of the subject property. The owner interview is included in Section 8 of this report. 4.1 Title Information Ms. Debbie Trotter of Gray Robinson, P.A., forwarded a revised Limited Search of Ownership and Encumbrances (chain of title) for the subject property. This was completed by Chicago Title and dated April 22, 29. Based on this information, it appears that the subject property was owned by a fruit/agriculture company, by individuals or in trust from 1954 until 26, when it was purchased by the current owner (Project Orlando, LLC). A distribution easement for Florida Power is recorded (assumed to be for overhead power lines at the site). None of the owners' names would seem to indicate a use of environmental concern, especially in light of our findings from review of other historical records. A copy of the summary is included in Appendix IV. 4.2 Environmental Liens or Activity and Use Limitations The User reported that they were unaware of any environmental cleanup liens filed against the property. They also stated that they were unaware of any activity or land use limitations in place at the site. A Limited Search of Ownership and Encumbrances by Chicago Title for the subject property revealed no recorded environmental liens or activity and use limitations. 4.3 Specialized Knowledge The User stated that they did not have any specialized knowledge about the subject property or nearby properties. 4.4 Commonly Known or Reasonably Ascertainable Information The User stated that they were unaware of commonly known or reasonably ascertainable information about the property that would help ECS to identify conditions indicative of releases or threatened releases. They did not know past uses of the property. 4.5 Valuation Reduction for Environmental Issues The User did not disclose any valuation reduction information related to the subject property.

15 ECS Project No April 23, Owner, Property Manager, and Occupant Information The User informed ECS that the owner of the site is Project Orlando, LLC. Steve Sepp is the property manager and there are no occupants. 4.7 Degree of Obviousness The User was not aware of any obvious indicators that point to the presence or likely presence of contamination on the subject property.

16 ECS Project No April 23, RECORDS REVIEW A regulatory records search of ASTM standard and supplemental databases was conducted for the site and is included in Appendix III. The regulatory search report in the appendix includes additional details about the regulatory databases that were reviewed. The regulatory records search involves searching a series of databases for facilities that are located within a specified distance from the subject property. The ASTM standard specifies an approximate minimum search distance from the subject site for each database. Pursuant to ASTM, the approximate minimum search distance may be reduced for each standard environmental record except for Federal NPL site list, and Federal RCRA TSD list. According to ASTM, government information obtained from nongovernmental sources may be considered current if the source updates the information at least every 9 days or, for information that is updated less frequently than quarterly by the government agency, within 9 days of date the government agency makes the information available to the public. The following table indicates the standard environmental record sources and the approximate minimum search distances for each. 17 ECS Project No April 23, Based on our knowledge of the subject property and the surrounding area, ECS attempts to verify and interpret this data. While this attempt at verification is made with due diligence, ECS cannot guarantee the accuracy of the record(s) search beyond that of information provided by the regulatory report(s). Mapped and unmapped sites identified in the regulatory report(s) that are not addressed below were field verified and are not believed to be within the approximate minimum search distance and are excluded from this ESA report. ECS makes no warranty regarding the accuracy of the database report information included within the regulatory report(s). The Standard ASTM/EDR search distances were increased by.5 mile. 5.1 Federal Databases Federal National Priorities List (NPL) The NPL is a subset of Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) and identifies superfund sites that have had documented contamination incidents. The site was not identified on the NPL. No off-site properties within the minimum search distance of inquiry were reported as being on the NPL. Federal Delisted NPL The Delisted NPL identifies sites previously listed on the NPL where further response is appropriate. The site was not identified on the Delisted NPL. No off-site properties within the minimum search distance of inquiry were reported as being on the Delisted NPL. Federal CERCLIS CERCLIS contains data on potential hazardous waste sites that have been reported to the United States Environmental Protection Agency (USEPA). CERCLIS contains sites that are either proposed to or on the NPL and sites which are in the screening and assessment phase for possible inclusion on the NPL. The site was not identified on the CERCLIS database. No off-site properties within the minimum search distance of inquiry were reported as being on the CERCLIS database. Federal CERCLIS No Further Remedial Action Planned (NFRAP) CERCLIS sites designated as NFRAP have been removed from CERCLIS. NFRAP sites

18 ECS Project No April 23, may be sites where, following an initial investigation, no contamination was found, contamination was removed quickly without the need for the site to be placed on the NPL, or the contamination was not serious enough to require federal Superfund action or NPL consideration. The site was not identified on the CERCLIS NFRAP. No off-site properties within the minimum search distance of inquiry were reported as being on the CERCLIS NFRAP. Federal Corrective Action Report (CORRACTS) CORRACTS identifies hazardous waste handlers that have been subject to corrective action under Resource Conservation and Recovery Act (RCRA). The site was not identified by CORRACTS. No off-site properties within the minimum search distance of inquiry were reported as being on CORRACTS. Federal Resource Conservation and Recovery Information System (RCRIS) Treatment, Storage and Disposal (TSD) Facilities RCRIS identifies facilities that treat, store or dispose of hazardous wastes as defined by the RCRA. TSDs treat, store or dispose of hazardous waste. The site was not identified as a hazardous waste TSD facility. No off-site properties within the minimum search distance of inquiry were reported as being a hazardous waste TSD facility. Federal RCRIS - Generators RCRIS identifies facilities that generate hazardous wastes as defined by the RCRA. Conditionally exempt small quantity generators generate less than 1 kilograms of hazardous waste, or less than 1 kilogram of acutely hazardous waste, per month. Small quantity generators (SQGs) generate between 1 and 1, kilograms of hazardous waste per month. Large quantity generators (LQGs) generate more than 1, kilograms of hazardous waste or more than 1 kilogram of acutely hazardous waste per month. The site was not identified as a hazardous waste generator. No off-site properties within the minimum search distance of inquiry were reported as being a hazardous waste generator. Federal Engineering Controls (EC) List The Federal EC list identifies engineering controls including various forms of caps, building foundations, liners, and treatment methods used to eliminate pathways for regulated substances to enter environmental media or affect human health.

19 ECS Project No April 23, The site was not identified on the EC list. Federal Institutional Controls (IC) List The Federal IC list identifies institutional controls including administrative measures, such as groundwater use restrictions, construction restrictions, property use restrictions, and post remediation care requirements intended to prevent exposure to contaminants. The site was not identified on the IC list. Federal Emergency Response Notification System (ERNS) The ERNS list is a national database that stores and records information on reported releases of hazardous substances, including petroleum products. The site was not identified on the ERNS list. 5.2 State Databases Voluntary Cleanup Sites (VCP) The VCP is a listing of closed and active voluntary cleanup sites. The site was not identified on the VCP List. No off-site properties within the minimum search distance of inquiry were reported as being on the VCP List. Ethylene Dibromide Database (DEDB) The DEDB list documents Ethylene Dibromide (EDB), a soil fumigant, that has been detected in drinking water wells that exceeds the maximum contaminant level as stated in Chapter or 52. The site was not identified on the DEDB List. One or more off-site properties within the minimum search distance of inquiry were reported as being on the DEDB List. EDR lists 2 DEDB sites within the specified search distance. ECS also reviewed the Florida Department of Environmental Protection (FDEP) Map Direct (FDEP Consolidated Web Mapping Application). EDB application zones were mapped and neither the subject property nor the adjoining parcels were located within a delineated area. The closest EDB application zone is approximately 1,1 feet southwest and 3,3 feet to the west of the subject property. A copy of the Consolidated Application map showing EDB application zones is included in the Appendix. These EDB sites listed by EDR do not represent a recognized environmental condition at this time.

20 ECS Project No April 23, State Hazardous Waste Sites (SHWS) State Hazardous Waste Site records are the State s equivalent to CERCLIS. These sites may or may not already be on the federal CERCLIS list. Priority sites planned for cleanup using states funds are identified along with sites where cleanup will be paid by potentially responsible parties. The site was not identified on the SHWS List No off-site properties within the minimum search distance of inquiry were reported as being on the SHWS List. Drycleaners Database The Drycleaners list includes active drycleaning facilities in the state of Florida. The site was not identified on the Drycleaners List. No off-site properties within the minimum search distance of inquiry were reported as being on the Drycleaners List. Leaking Underground Storage Tank (LUST) List The LUST List is a record of reported leaking underground storage tank incidents. The LUST List may also identify properties that have had soil and/or groundwater contamination associated with documented releases from aboveground storage tanks, surface spills and other sources. The site was not identified on the LUST List. No off-site properties within the minimum search distance of inquiry were reported as being on the LUST List. Solid Waste Facilities/Landfill Sites (SWL) The Florida Solid Waste Section maintains a list of permitted solid waste facilities. These facilities may be active or inactive facilities or open dumps that failed to meet RCRA Subtitle D Section 44 criteria for solid waste landfills or disposal sites. The site was not identified on the SWL List. One or more off-site properties within the minimum search distance of inquiry were reported as being on the SWL List. The EDR report lists three SWF/LF sites. Mid Florida Materials, located approximately.68 mile northwest of the subject property, is listed by EDR as a SWF/LF facility. This facility is belong ASTM's minimum search distance of.5 mile. However, ECS reviewed the solid waste files for this facility at the FDEP Central District. This facility accepts construction and demolition debris and is listed as "active". Based on the latest available Semi Annual Groundwater Quality Monitoring report (HSA/Golder -

21 ECS Project No April 23, September 27), aluminum was detected in groundwater at a concentration that exceeded applicable groundwater standard. However, measured groundwater flow at this facility is toward the north-north west or west (away from the subject property). Given measured groundwater flow direction, this facility does not represent a recognized environmental condition at this time. The EDR report also lists Fields Robinson LCD (A.K.A. Acme Recycling for Land Clearing Disposal) as a SWF/LF site. ECS reviewed the solid waste files for this facility at the FDEP Central District. This facility accepted construction and demolition debris and is listed as "inactive". This facility's address is Plymouth Oaks Road and is located.7 mile southeast of the southeast corner of the subject property. Groundwater was measured to flow northeast at this site. Given the measured groundwater flow direction away from the subject property and distance, this facility does not represent a recognized environmental condition at this time. The EDR report also lists Golden Gem Road Landfill at 361 Plank Road as a SWF/LF site. This facility is located more than.45 mile northeast of the subject property. ECS reviewed the solid waste files for this facility at the FDEP Central District. This facility is a Class III landfill and is listed as "active". Based on the latest available Semi Annual Groundwater Quality Monitoring report (HSA/Golder - May 27), benzene was detected in groundwater at a concentration that exceeded applicable groundwater standard. It was noted in the report that the source of the benzene was suspected to be landfill gas that infiltrated into monitoring well headspace. Groundwater flow measurements are as noted: upper surficial: northwest; lower surficial: north-northwest; upper Floridan: southwest. These measurements were generally consistent with historical measurements. All measured directions of different zones were away from the subject property. Given measured groundwater flow direction, this facility does not represent a recognized environmental condition at this time. Spills List The SPILLS list is a record of oil and hazardous materials incidents. The site was not identified on the Spills List. Registered Above Ground Storage Tank (AST) List The Registered AST List inventories underground and aboveground storage tanks registered with the Florida Department of Environmental Protection (FDEP). This list does not identify USTs or ASTs that have not been registered with the FDEP, such as home heating oil tanks and other unregulated tanks. The site was not identified on the Registered AST List. One or more off-site properties within the minimum search distance of inquiry were reported as being on the Registered AST List.

22 ECS Project No April 23, The Orange County - Zellwood Maintenance Facility is listed by EDR as being.5 mile from the subject property. This AST facility is beyond the minimum ASTM search distance of subject property and adjoining properties. Both ASTs are listed as "removed". Based on measured groundwater flow at the north and west adjoining landfill facilities, this facility is located down-gradient from the subject property and is therefore not a recognized environmental condition. Based on information developed by ECS during a past environmental assessment of the area, we are aware of three ASTs formerly located at the subject property. Each diesel AST was steel and used to store diesel fuel for heaters in each greenhouse. The ASTs were located within a concrete block secondary containment structure, east of the former greenhouse structures. During our reconnaissance in June of 25, ECS observed one 1,-gallon and two-8, gallon ASTs. No leaks, stains, stressed vegetation or other evidence of a discharge was observed then. During our current reconnaissance, ECS observed a concrete block secondary containment area, but the ASTs were not present. No leaks, stains, stressed vegetation or other evidence of a discharge was observed in the area. Interviews with Mr. Duvall indicated that in 25 (shortly after our assessment and prior to sale) the ASTs were pumped, the contents sold to a local trucking company and the ASTs were removed from the site. Mr. Duval stated that he was not aware of any significant leaks or spills from these ASTs, nor was he aware of any impacts to the subject property from these ASTs. He still operates Tran Trex, the remainder of the indoor foliage company which he retained, on the south adjoining property. This property has its own diesel AST for heaters. He stated that he was not aware of any impacts to the south adjoining property from those ASTs. Based on the preceding the former ASTs do not represent a recognized environmental condition at this time. Priority Cleaners Database The Priority Cleaners list has been established by the Florida Legislature as a statefunded program to clean-up properties that are contaminated as a result of the operations of a drycleaning facility. The site was not identified on the Florida Priority Cleaners List. No off-site properties within the minimum search distance of inquiry were reported as being on the Priority Cleaners List. FINDS LIST Facility index system contains both facility information and pointers to other sources that contain more detail. EDR includes the following FINDS databases in this report: PCS (Permit Compliance System), AIRS (Aerometric Information Retrieval System), DOCKET (Enforcement Docket used to mange and track information on civil judicial enforcement cases for all environmental statutes), FFIS (Federal Facilities Information

23 ECS Project No April 23, System), STATE (State Environmental Laws and Statutes), and PADS (PCB Activity Data System). The site was not identified on the FINDS List. One or more off-site properties within the minimum search distance of inquiry were reported as being on the FINDS List. The Mid Florida Materials site is listed by EDR as a FL FINDS site. This facility is located across Golden Gem Road, approximately 2 feet west of the subject property. This facility is discussed in the RCRA SQG and SWF/LF sections and does not represent a recognized environmental condition at this time. Florida Sites The Florida Site list includes the Eckhardt list, the Moffit list, the EPA Hazardous Waste Site list, EPA's Emergency & Remedial Response Information System list, and existing department lists such as the obsolete uncontrolled Hazardous Waste Sites list. This list is no longer updated. The site was not identified on the Florida Sites list. No off-site properties within the minimum search distance of inquiry were reported as being on the Florida Site List. Cattle Dipping Vats The site was not identified on the Florida Cattle Dipping Vats List. No off-site properties within the minimum search distance of inquiry were reported as being on the Florida Cattle Dipping Vats List. Registered Underground Storage Tank (UST) List The Registered UST List inventories underground and aboveground storage tanks registered with the Florida Department of Environmental Protection (FDEP). This list does not identify USTs or ASTs that have not been registered with the FDEP, such as home heating oil tanks and other unregulated tanks. The site was not identified on the Registered UST List. One or more off-site properties within the minimum search distance of inquiry were reported as being on the Registered UST List. This facility is actually located well beyond the ASTM search distance of subject property or adjoining property. EDR reports three "in service" petroleum USTs at the site. 24 ECS Project No April 23, gradient from the subject property and is therefore not a recognized environmental condition. 5.3 Historical Use Information Sanborn Fire Insurance Map Review Historic Fire Insurance Maps (i.e., Sanborns) do not provide coverage of the area of the subject. The absence of such maps generally indicates that the site is located in an area where production of Fire Insurance Maps was not economically feasible. Aerial Photograph Review A review of historical aerial photographs was performed at the Orange County Department of Public Works. A copy of the 28 aerial photograph is included as Figure 3 (Appendix I). This aerial is from the Orange County Property Appraiser On-Line system. The 1939 aerial photograph showed the subject property and adjoining properties as vacant land with some trees. Lake Victor and low lying land were present to the east and south of the subject property. The 1947 aerial photograph showed no significant changes to the subject property or the adjoining properties from the previous aerial photograph. The 1958 aerial photograph showed agricultural development (citrus) on portions of the subject property. No significant changes appeared to the adjoining properties from the previous aerial photograph. The 1963, 1965, and 1967 aerial photograph showed no significant changes to the subject property or the adjoining properties from the previous aerial photograph. The 1967 aerial photograph showed West Ponkan Road as an unimproved dirt road. The 1969 aerial photograph showed no significant changes to the subject property or the adjoining properties from the previous aerial photograph. The 1971 aerial photograph showed no significant changes to the subject property or the adjoining property from the previous aerial photograph. Landscape nurseries and greenhouses appeared to the northeast and southwest of the subject property. The 1975 aerial photograph showed citrus on much of the subject property and a nursery building on the south adjoining parcel. West, south and east adjoining parcels were vacant or residential. The north adjoining parcel was wooded.

25 ECS Project No April 23, The 1978 aerial photograph showed the south central-adjoining property with several greenhouse buildings near the center. The subject property remains as citrus. No significant changes appeared to the adjoining properties from the previous aerial photograph. Plymouth Sorrento Road appeared to the east of the subject property. The 1981 aerial photograph showed no significant changes to the subject property or the adjoining properties from the previous aerial photograph. The 1984 aerial photograph showed no citrus on the subject property, or burned out (or potentially frozen) groves. No significant changes to the subject property or the adjoining properties from the previous aerial photograph, except: adjoining and nearby citrus generally no longer present. The 1987 aerial photograph showed greenhouses extending form the south-central adjoining parcel to the central portion of the subject property. The east and west portions of the subject property appear as pasture or woods. No significant changes to the adjoining properties from the previous aerial photograph. The 1994, 1997, 2 and 23 aerial photographs showed the no significant changes to the adjoining properties appeared from the previous aerial photograph. Additional ruralresidential development was apparent in the area. The 27 and 28aerial photograph showed the greenhouses formerly on the central portion of the subject property as demolished. City Directory Review One of the ASTM standard historic sources to be reviewed for previous site use are local street directories, commonly known as City Directories. The purpose of the directory review is to identify past occupants of the site, adjoining properties, or nearby properties. In some rural areas, street directories information is limited. City Directories for Orange County and Suburban Orlando listing former businesses at the street addresses of the subject property and the nearby properties were reviewed. City directories dated 1976, 1981, 1986, 199, 1991, 1997, 23 and 27 were reviewed. No listings for the subject property were identified in the city directories with the exception of a listing at 3515 W. Ponkan Road in the 27 directory (Tran Trex Foliage). No additional listings of concern were identified in the vicinity that were not otherwise identified by other means in this process.

26 ECS Project No April 23, Other Standard Historical Sources In accordance with the ASTM Standard, other historical sources should be reviewed, if necessary and if the information is likely to be useful, to obtain historical site use information. Other Standard Historical Sources may include property tax files, recorded land title records, historic USGS topographic maps, building department records, and zoning or land use records. ECS reviewed Orange County Property Appraiser On-line records. The west parcel is located at 381 West Ponkan Road (Orange County Parcel ID Number ). The east parcel is located at 3515 West Ponkan Road (Orange County Parcel ID Number ). Both parcels are owned by Project Orlando, LLC. Other Local Historical Sources Other credible historical sources may be reviewed to identify past uses of the property. These sources may include internet sites, county or State road maps, historical society documents, or local library information. No other local historical sources were utilized. Freedom of Information (FOIA) Requests No FOIA requests were made.

27 ECS Project No April 23, SITE AND AREA RECONNAISSANCE 6.1 Methodology and Limiting Conditions Mr. Cliff Hendrickson of ECS conducted the field reconnaissance on April 14, 29. The weather at the time of the reconnaissance was approximately 75 degrees Fahrenheit and rainy. ECS returned on April 15, 29. At this time weather was warm and sunny. Observations were made from a walking reconnaissance around the perimeter boundary and along several transects through the property. Photographs, taken at the time of the site reconnaissance, are included in Appendix V. 6.2 On-Site Features The majority of the subject property was used as cattle pasture. A cattle feed area (hay and water) was observed on the east portion of the west parcel. A small metal shed was observed on the south portion of the west parcel. This shed contained a few tools and a gasoline can (approximately five gallons). No stains or unusual odors were observed in or around this shed. The north portion of the west parcel was wooded, mostly with mature oak trees. The southern portion of the west parcel was grassy pasture. The west parcel was fenced with wood posts and barbed wire. A thin strip of land extended from the southwest corner of the west parcel to Ponkan Road to the south. A gate was observed at the strip's south end. The northwest portion of the east parcel contained the remains of several metal-framed greenhouse buildings. Concrete slabs and sidewalks were observed, in addition to PVC piping and plastic sheeting. A concrete block secondary containment area that formerly contained three ASTs was observed east of the old greenhouse building remains. These former ASTs are discussed in Section 5.2. The eastern portion of the east parcel was grassy cattle pasture with scattered trees. This parcel was also fenced with wood posts and barbed wire. Underground or aboveground storage tanks We did not observe aboveground storage tanks or evidence of underground storage tanks at the site. Based on information developed by ECS during a past environmental assessment of the area, we are aware of three diesel fuel ASTs formerly located at the subject property. Each AST was steel and used to store diesel fuel for heaters in each greenhouse. The ASTs were located within a concrete block secondary containment structure, east of the former greenhouse structures. During our reconnaissance in June of 25, ECS observed one 1,-gallon and two-8, gallon ASTs. No leaks, stains, stressed vegetation or other evidence of a discharge was observed then.

Strong, pungent or noxious odors We did not notice strong, pungent or noxious odors at the site. Surface waters We did not observe streams or other surface waters located on the site. Standing pools of liquid likely containing petroleum or hazardous substances We did not observe standing pools of liquid at the site. Drums or containers of petroleum or hazardous substances greater than five-gallons We did not observe drums or containers of petroleum or hazardous substances greater than five-gallons at the site. Drums or containers of petroleum or hazardous substances less than or equal to five-gallons The following observations were made with regard to drums or containers of petroleum or hazardous substances less than or equal to five-gallons at the site: ECS observed a metal gasoline can (approximately five gallons) inside the metal shed on the south side of the west parcel. No leaks or stains were observed. Unidentified opened or damaged containers of hazardous substances or petroleum products We did not observe unidentified opened or damaged containers of hazardous substances or petroleum products at the site. Known or suspect PCB-containing equipment (excluding light ballasts) We did not observe known or suspect PCB-containing equipment on the site.

Solid waste mounds or non-natural fill materials We did not observe solid waste mounds or non-natural fill materials at the site. Wastewater discharges into drains, ditches or streams We did not observe wastewater discharges at the site. Groundwater wells including potable, monitoring, dry, irrigation, injection and/or abandoned We did not observe groundwater wells at the site. Septic systems or cesspools We did not observe evidence of septic systems or cesspools on the site. Elevators We did not observe elevators on the site. Dry Cleaning We did not observe dry-cleaning operations on the site. Onsite Emergency Electrical Generators We did not observe emergency generators on the site.

30 ECS Project No April 23, Adjoining and Nearby Properties The north adjoining properties are an undeveloped wooded parcel and Southern Landscaping and Irrigation. The east adjoining parcel is rural-residential with some hobbyist agriculture/pasture use. The south adjoining parcels are occupied by a small plant nursery, three rural residential lots and West Ponkan Road, followed by a golf course. Rural-residential development with some hobbyist agriculture use adjoins to the west of the subject property.

31 ECS Project No April 23, ADDITIONAL SERVICES 7.1 Non-Scope Issues ASTM guidelines identify non-scope issues, which are beyond the scope of this practice. Non-scope issues have the potential to be business environmental risks. Some of these non-scope issues include; asbestos-containing building materials, radon, lead-based paint, lead in drinking water, wetlands and mold. We were not authorized to conduct non-scope services for the site. 7.2 Previous Reports Review We have not conducted previous environmental and/or engineering assessment activities at the site. We have not been provided with environmental or engineering assessment reports for the site completed by others.

32 ECS Project No April 23, INTERVIEWS ECS interviewed Mr. Jim Palmer, Managing Partner of Project Orlando, owner of the property. Mr. Palmer stated that he were unaware of environmental concerns associated with the subject property or adjoining parcels. He stated that the property has been purchased as an investment and that it had not been used for any purpose. ECS informed him that we observed cattle on portions of the property. He was not aware of any underground storage tanks at the subject property. He did not have information regarding the disposal of the former ASTs at the subject site, although he believed that Universal Engineering may have assisted with the removal of these ASTs. Further, he did not know how the greenhouse chemicals (herbicides, pesticides, etc) were disposed of. Mr. Palmer stated that he would try to find some information regarding these ASTs and chemicals. He stated that, to his knowledge, the subject property had not been used for the creation, manufacture, storage, handling, transportation, or disposal of hazardous waste, hazardous substances or solvents. He was not aware of any pending, past, or threatened administrative litigation or administrative proceedings relevant to hazardous substances or petroleum products in, on, or from the subject property. Mr. Palmer was not unaware of any government notices regarding any possible violation of environmental laws or possible liability related to hazardous substances or petroleum products. ECS interviewed Mr. Bill Duvall, a former owner of the subject property. He owned the property for approximately 25 years. He confirmed former use of diesel fuel for greenhouse heaters and approved (unrestricted) herbicides, pesticides and fertilizers during his ownership. He stated that he sold the property around June of 25 and that the former greenhouse section of property has not been used for any purpose since then. He stated that he sold the diesel fuel in the three ASTs to a trucking company for use in their vehicles. Sometime around June 25, he had the ASTs cut up and sold for scrap. He stated that he was not aware of any significant spills or leaks of diesel fuel. He also stated that the ASTs were located in a concrete block containment area that would have prevented any spilled contents from reaching the ground. He stated that the agricultural chemicals formerly located on site were moved over to the existing Tran Trex nursery (retained by Mr. Duvall). He stated that the agricultural chemicals were mixed and applied by a licensed grower and that they were used in accordance with manufacturer's instructions. He stated that he was not aware of any significant spills or leaks of these agricultural chemicals. He stated that each of the former greenhouses was underlain by "ground pack", a plastic weed inhibitor. He said that herbicides were not used in the greenhouses. He said that there is not a well on the subject property, but there is one on the Tran Trex parcel. He said that the greenhouses were torn down around June of 25. ECS contacted Ms. Lucy Albrecht at the Florida Department of Environmental Protection (FDEP), Central District, Division of Hazardous Materials. She stated that there are no waste compliance of cleanup files for the subject property addresses.

33 ECS Project No April 23, ECS utilized FDEP's OCULUS database to search of UST listing or hazardous waste cleanup files related to the subject property. There were no findings for the subject property addresses. ECS contacted Ms. Pat Hilton at the Florida Department of Environmental Protection (FDEP), Central District, Division of Storage Tanks. She stated that there are no UST files for the subject property addresses. ECS contacted Ms. Gloria -Jean De Pradine at the Florida Department of Environmental Protection (FDEP), Central District, Division of Solid Waste. She stated that there were solid waste files and groundwater monitoring files for Golden Gem Road Landfill, Acme Materials landfill and Mid Florida Materials landfill. ECS made an appointment at FDEP and reviewed these files. Please see Section 5 for more information.

34 ECS Project No April 23, FINDINGS The subject property consists of two parcels totaling approximately 23 acres. The western parcel measures acres and used for cattle grazing. The northern portion of the property is wooded. A small metal shed is located on the south side of this parcel. A cattle feeding and watering area is located on the east side of this parcel. The eastern parcel measures approximately acres. This parcel is used for cattle grazing. The northwest portion of the parcel is occupied by concrete slabs and demolition debris from several small greenhouses that formerly occupied this portion of this parcel. The north adjoining properties are an undeveloped wooded parcel and Southern Landscaping and Irrigation. The east adjoining parcel is rural-residential with some hobbyist agriculture/pasture use. The south adjoining parcels are occupied by a small plant nursery, three rural residential lots and West Ponkan Road, followed by a golf course. Rural-residential development with some hobbyist agriculture use adjoins to the west of the subject property. Based on the records search, site reconnaissance and interviews, it appears that the site has remained undeveloped without structures since prior to Much of the subject property was developed as a small citrus grove from circa 1958 until circa The north central portion of the subject property was occupied by several greenhouse buildings from circa 1987 until circa 26. The site does not receive municipal water or sanitary sewer services. There may be an old (inactive) septic tank on the north central portion of the subject property near the former greenhouses, according to an interview with the former owner. ECS did not observe stained ground surfaces, stressed vegetation or evidence of underground storage tanks (USTs) on the site. A Standard Environmental records (SER) search was provided by Environmental Data Resources, Inc. (EDR), the subcontracted database search firm. The SER search involves searching a series of databases for facilities that are located within a specified radius from the subject property. The EDR report did not identify the subject property on any of the Federal, State, or County databases. The EDR Radius Report listed multiple sites within the minimum ASTM search distances. Based on our review of available public records, none of these facilities represent a recognized environmental condition for the subject property at this time. ECS did not identify any significant data gaps that would lead to the classification of a recognized environmental condition for the property. No de minimis conditions were observed.

35 ECS Project No April 23, While evidence of historical on-site pesticide/herbicide/chemical storage and/or mixing is suspected based on the subject property s past agricultural uses, application of herbicides and pesticides in accordance with manufacturer s approved rates is considered a deminimis condition under ASTM. No surficial evidence of misuse, misapplication or residual materials from pesticides, herbicides, or fertilizers were observed during the site reconnaissance or interviews. As with any agriculturally developed land, there exists the possibility that pesticides, herbicides, or fertilizers have been applied that may have impacted the site. However, given reasonably available information, it is ECS opinion that these conditions do not currently represent a recognized environmental condition for the Site. ECS has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E of the approximately 23-acre subject property located at 3515 and 381 West Ponkan Road. These two parcels are located in Apopka, Orange County, Florida. Any exceptions to, or deletions from, this practice are described in Section 2.3 of this report. As documented and qualified by this report, this assessment has revealed no evidence of recognized environmental conditions in connection with the property.

36 ECS Project No April 23, CONCLUSIONS AND OPINIONS ECS has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E of the approximately 23-acre subject property located at 3515 and 381 West Ponkan Road. As documented and qualified by this report, this assessment has revealed no evidence of recognized environmental conditions in connection with the property.
