Box Dallas, Texas quest-env.com Statement of Qualifications It is Quest s sole purpose to give our clients data and recommendations that allow them to make the most accurate decisions possible pertinent to: Any Risk Management decision involving the Environmental Competency of a firm dealing with Waste Management practices, within a commercial, industrial, or plant setting, Lenders and borrowers evaluating properties that will be used for commercial, industrial, or public purposes and, who may, after purchasing the property, seek to claim protection from CERCLA, as amended by the Small Business Liability Relief and Brownfields Revitalization Act (Pub. L , 115 stat. 2345, the Brownfields Amendments ), such persons and businesses are required to conduct All Appropriate Inquiries prior to or on the date on which the property is acquired. Prospective landowners who do not conduct All Appropriate Inquiries prior to or on the date of obtaining ownership of the property may lose their ability to claim protection from CERCLA liability as an Innocent Landowner, Bona Fide Prospective Purchaser, or Contiguous Property Owner. These protections are available if the requirements under EPA s 40 CFR Part 312, Standards and Practices for All Appropriate Inquiries are met by following the ASTM Standard E , Standard Practice for Environmental Site Assessments: The Phase I Environmental Site Assessment Process. All persons needing due diligence questions answered on any Environmental Matter or Concern. 2 Please call Quest Environmental for all of your Environmental Service needs at Mr. Rocky Shaw, General Manager and EP of Quest, has been performing Environmental Management Services since 1974 when he graduated from Texas Tech University and went to work for Texaco, Inc., Production and Drilling as Health, Safety, and Environmental Director for the Western United States. Mr. Shaw also directed land management supervising Phase I, II, and III Environmental Site Assessments prior to and after Texaco's purchase of various properties, and comptroller duties. Mr. Shaw's responsibilities included Regulatory Compliance with all federal, state, and local regulatory agencies such as EPA, OSHA, DOT, RCRA, CERCLA, TDSHS, TCEQ, RRC, BLM as well as accident prevention, hazardous waste documentation, profiling, transportation, and disposal, petroleum spill clean up, Environmental Site Assessments through Bergstein Environmental, Inc. - General Manager and Hazardous Waste Specialist. Mr. Shaw supervised various Federal and State Superfund Site clean ups, including clean ups for Exxon in Alaska during the Valdez oil spill. Mr. Shaw acted as Incident Commander for various emergency responses for hazardous wastes such as chromium, lead, acids, arsenic as well as radioactive materials. Mr. Shaw also supervised oil clean up in the Persian Gulf after Desert Storm. Mr. Shaw also conducted Phase I, II, and III Environmental Site Assessments for many of Bergstein's clients. Supervised all marketing for Bergstein Vanguard Environmental, Inc. - Marketing Manager - Regulatory Specialist Supervise all marketing and sales for Regulatory Compliance Services to assure that Vanguard's clients were in compliance with all federal, state, and local regulations as per EPA, OSHA, DOT, RCRA, CERCLA, TDSHS, TCEQ, RRC, BLM, etc. Covered Texas, Louisiana, Oklahoma, Arkansas, New Mexico, and Colorado. Mr. Shaw also conducted Phase I, II, and III Environmental Site Assessments for all of Vanguards clients Quest Environmental - General Manager - Supervise Asbestos, Mold, and Lead site surveys, inspections, and abatement. Write all proposals, specifications, and protocols for abatement projects for asbestos, mold, and lead, and supervise all abatement and clean up projects. Conduct and supervise Phase I, II, and III Environmental Site Assessments and Clean Ups. Conduct all marketing for Quest throughout the United States.
