General Summary of Function/Purpose of Position This position is responsible for carrying out a range of professional research and analysis assignments while learning methods of work for workforce criminal background checks. The position will be expected to perform an increasing range of assignments up to the experienced level, and to independently make fitness determinations about whether an individual who seeks employment in a covered facility and other settings is eligible based on criminal history and other criteria authorized in state and federal statutes or the Code of Federal Regulations. The position conducts document review; interprets and analyzes reports, statutes, and regulations; communicates with employers, applicants, law enforcement or court agencies to validate information and reporting; ensures background check data system reporting is correct and updated when errors are discovered; consults with system developers about system errors; provides consultation to employers about system use; coordinates the processing of appeals from applicants. Statutory authorities include, but are not limited to: 1973 PA 116, 1979 PA 218, 1974 PA 258, 1978 PA 368, and provisions in the federal Adam Walsh Child Protections and Safety Act and the Child Care and Development Block Grant Act of 2014.

2 15. Please describe the assigned duties, percent of time spent performing each duty, and what is done to complete each duty. List the duties from most important to least important. The total percentage of all duties performed must equal 100 percent. Duty 1 General Summary: Percentage: 60 Make fitness determinations about whether an individual is eligible for employment based on criminal history and other criteria authorized in state and federal statutes or the Code of Federal Regulations (CFR). Research, collect, consolidate, analyze criminal history and other information or data obtained from various sources and through a workforce background check system for the Department/Bureau. Obtain hardcopy, confidential information needed to complete verifications from the Michigan State Police, FBI, law enforcement or court agencies. Make the determination about an individual s eligibility for or exclusion from employment based on all relevant documents and information collected and statutory authorities or CFR. Communicate disposition to an employer, individual the subject of the background check, or others and only release information to the extent permitted by law. Maintain confidentiality of protected data or information in accordance with state and federal requirements. Duty 2 General Summary: Percentage: 15 Review and develop policies and procedures related to the background check program/system. Provide professional analyst assistance to system support personnel and others. Assist management, as a professional analyst in the unit, in process improvement initiatives, system development or enhancement. Assist management, in the development of policies and procedures as unusual or new issues arise with background check processing; make recommendations about information on bureau/department website. Review and implement new statutory or regulatory requirements; ensure conformity in interpretation and dispositions with other unit members concerning existing law, regulations and policy. Present information to the public, employers, and others when assigned. Consult and coordinate system enhancements with programmers, other state agency representatives, and others as assigned. Duty 3 General Summary: Percentage: 10 Handle the processing of appeals and redetermination requests concerning disposition results.

3 Explain applicable laws, policies, and guidelines to individual who desires to appeal or seek review of dispositions results. Communicate to individual the filing requirements and suggest possible solutions. Answer questions regarding specific fact situations. Answer questions regarding legal requirements for the general public, attorneys, and others. Review file information on individual and analyze all relevant documents for an appeal or redetermination if one is received. Confer with supervisor or other management personnel for guidance when necessary about more unusual situations or when there is a threat of court filings. Process requests for hearings with all relevant, non-confidential documents through procedures established for the Michigan Administrative Hearing System (MAHS). Monitor progression of a hearing in MAHS; provide testimony if necessary to support disposition within the Department. Duty 4 General Summary: Percentage: 10 Monitor assigned submissions in background check system daily to ensure timely action is taken and to ensure accurate records and status of assigned workload. Other duties as assigned. Review submissions in system daily; retrieve necessary documents for review and analysis. Update information in database as necessary. Review pending submissions within time frame established and update information that is pending accordingly. Identify pending submissions that requires additional documents or information no less than monthly to determine status. Review system reports no less than monthly to determine need for further action or closure. Assist supervisor or bureau management in special projects, analysis activities, or other reporting when assigned. Compile reports, prepare correspondence, and participate in workgroups for system enhancement when assigned. Perform other duties as assigned. Duty 5 General Summary: Percentage: 5 Other duties as assigned. Other duties as assigned. 16. Describe the types of decisions made independently in this position and tell who or what is affected by those decisions.

4 Determine appropriate action to take regarding employment eligibility based on controlling state or federal law or CFR. Determine course of action under applicable unit or bureau policy or procedure and apply it to the situation presented. Determine course of action in response to questions asked in writing or verbal communications. Employers, job applicants, the bureau, and the department may be affected by decisions. Staffing levels and other requirements of health care facilities regulated by the state or federal government, and other state licensed facilities, may be affected by decisions. 17. Describe the types of decisions that require the supervisor's review. Supervisor review is necessary for matters that have Division, Bureau, or Department implications, involve more complex legal issues, or have potential media or legislative interest. Review is required as situations arise that are unique or new. Review is required when unusual requests are received or problems/difficulties surface that are not routine or otherwise not previously known by management personnel. 18. What kind of physical effort is used to perform this job? What environmental conditions in this position physically exposed to on the job? Indicate the amount of time and intensity of each activity and condition. Refer to instructions. This position requires general physical effort as it is performed in a general office setting. Minimal physical effort limited to sitting, standing, walking, carrying of files or other reference material. Daily keying or typing, answering telephone, completing data entry in databases, and constant use of VDT. Environmental conditions are limited to exposure to basic office environment such as heating, cooling and fluorescent lighting during the workday. 19. The Workforce Background Check Unit and program is housed within the Bureau of Community and Health Systems. The function of the work area is to ensure compliance with federal and state law with respect to criminal background check clearances that can affect employment decisions for regulated health and community facilities and providers. The position makes determinations about an individual s eligibility to be employed in various settings that under the auspices of the Bureau. The determinations are subject to appeal or reconsideration, and the position provides professional analysis related to determinations. 26. What are the minimum education and experience qualifications needed to perform the essential functions of this position. EDUCATIO: Departmental Analyst 9-P11: Bachelor degree in any major.

5 EXPERIECE: Departmental Analyst 9: o specific type or amount is required. Departmental Analyst 10: One year of professional experience. Departmental Analyst P11: Two years of professional experience, including one year of experience equivalent to the intermediate (10) level in state service KOWLEDGE, SKILLS, AD ABILITIES: Knowledge of statutory provisions helpful but not required. Writing, drafting, verbal and organizational skills to manage an assigned and constant workload are essential.
