PREAMBLE Pursunt to the provisions set forth in Title 5, United Sttes Code, Chpter 71, hereinfter referred to s the Civil Servie Reform At, the following Agreement is entered into etween the Deprtment of Defense (DOD) Domesti Dependent Elementry nd Seondry Shools (DDESS), hereinfter referred to s the Employer, Ageny, Mngement, or DDESS, nd the Federl Edution Assoition, Stteside Region, hereinfter referred to s the Assoition, Exlusive Representtive, or FEA-SR, nd olletively hereinfter referred to s the Prties. Setion 2 Intent nd Purpose. The intent nd purpose of this Agreement is to omply with 5 U.S.C. 7101, et seq., nd to enourge nd inrese effetive nd hrmonious work reltionships etween these two Prties. The Prties jointly ffirm nd delre tht it is their mutul gol to provide qulity edution for the hildren of the Deprtment of Defense Domesti Dependent Elementry nd Seondry Shools nd to mintin high stndrds of personl performne. The Prties hereto gree tht this n est e omplished through mile disussion, mutul onsidertion of mtters of interest to either prty, the exhnge of dt nd informtion pursunt to sttutory requirements, the estlishment of si understndings reltive to personnel poliies nd prties, nd ny other mtters ffeting other onditions of employment. Setion 3 Puli Poliy. Wheres the Congress finds tht experiene in oth privte nd puli employment indites tht the sttutory protetion of the right of employees to orgnize, rgin olletively, nd prtiipte through lor orgniztions of their hoosing in deisions whih ffet them, sfegurds the puli usiness, ontriutes to the effetive ondut of puli usiness, nd filittes nd enourges the mile settlements of disputes etween employees nd their employers involving onditions of employment. Wheres the Congress finds tht the puli interest demnds the highest stndrds of employee performne nd the ontinued development nd implementtion of modern nd progressive work prties to filitte nd improve employee performne nd the effiient omplishment of the opertions of the Government.. Therefore, lor orgniztions nd olletive rgining in the ivil servie re in the puli interest. d. The Ageny nd the Assoition reognize tht professionl edutor s responsiility is to serve the edutionl needs of the student; nd the employee s energies should, to the extent possile, e utilized to this end. 1

10 ARTICLE 2. MISSION STATEMENT It is understood y nd greed etween the Prties tht the primry mission of DDESS is to provide to its students the highest qulity of edution possile within its resoures. 2

11 Reognition of Exlusive Representtive. ARTICLE 3. RECOGNITION The Ageny herey reognizes the Assoition s the exlusive rgining gent nd representtive of ll employees in the unit identified y FLRA Cse Numer WA-RP-90087, Certifition of Consolidtion of Units, dted April 11, 2000, nd ny other FEA-SR professionl unit ertified y FLRA susequent to the dte of this Agreement. The rgining unit memers of DDESS overed y this Agreement re loted t the following lol DDESS shool distrits: Cmp Lejeune, North Crolin Dhlgren Fort Benning, Georgi Fort Brgg, North Crolin Fort Cmpell, Kentuky Fort Jkson, South Crolin Fort Knox, Kentuky Fort Ruker, Alm Fort Stewrt, Georgi Gum (Andersen Air Fore Bse nd Nvl Instlltion) Lurel By, South Crolin Mxwell Air Fore Bse, Alm Quntio, Virgini Roins Air Fore Bse, Georgi West Point, New York Any suessor unit ertifite issued y the FLRA will utomtilly mend the unit desription ontined in () nd () ove. The Prties will, however, engge in rgining on the following issues for ny new DDESS shool(s) nd/or distrit(s) whih my e dded to the unit: py nd offiil time. d The representtion ertifite identified in setion 1.. of this Artile is tthed t Appendix A. 3

12 ARTICLE 4. CONDITIONS OF THE AGREEMENT Setion 1 Lws, Regultions, Poliies, nd Prior Agreements. It is understood nd greed y the Prties tht in the dministrtion of ll mtters overed y this Agreement, exept s otherwise speifilly provided for within this Agreement, the Ageny, the Assoition, nd the Ageny s employees re governed y pplile lws nd regultions. The Prties lso gree tht ll prior greements, memorndums of understnding, letters of lrifition, grievne resolution, nd third prty deisions whih ruled on interprettion of ontrt provisions, exeuted etween 5 July 1999 nd the effetive dte of this greement, remin in full fore nd effet throughout the life of the Mster Lor Agreement unless superseded y this Memorndum of Agreement. This lnguge is not intended to e red s extinguishing other greement(s), letter(s), grievne resolution(s), or the like tht re not superseded y the Agreement. To the extent onflit rises etween ny lnguge of the Mster Lor Agreement nd ny lnguge of prior doument s desried ove, the lnguge of the Mster Lor Agreement will previl. Setion 2 Distriution of Agreement. Further, the Prties gree tht the Ageny will re-print the Mster Lor Agreement with ll mendments, hnges, nd modified provisions. The Ageny will distriute the reprinted Mster Lor Agreement in pper or ompt disk form to rgining unit memers nd provide the FEA- SR Are Diretor fifty (50) pper opies of the reprinted Mster Lor Agreement. The Ageny lso grees tht it will post the reprinted Agreement on n pproprite DDESS wesite. Upon reprinting nd distriution of the Mster Lor Agreement, the previous version will e resinded; however, the resinded version will e pplied in djudition of ny grievne or third prty proeeding, regrding ny dispute over provisions of the previous version, whih hs een initited through the negotited grievne proedure prior to the effetive dte of this greement. Whenever n ddendum to this Agreement is dopted y the Prties, opy of the ddendum will e provided to eh rgining unit memer s soon s possile fter rehing the Agreement. The ddendum will then e dded to the Agreement, nd eh opy provided therefter will inlude opy of the ddendum. 4

13 ARTICLE 5. AGENCY RIGHTS Sttutory Rights. The Prties expressly gree tht the Ageny retins the right to determine the mission, udget, orgniztion, numer of employees, nd internl seurity prties of the Ageny; In ordne with pplile lws: Hire, ssign, diret, lyoff, nd retin employees, or to suspend, remove, or redue in grde or py, or tke other disiplinry tions ginst employees; Assign work, to mke determintions with respet to ontrting out, nd to determine the personnel y whih Ageny opertions shll e onduted; With respet to filling positions to mke seletions for ppointments from: 1) mong properly rnked nd ertified ndidtes for promotion; or 2) ny other pproprite soure. d Tke whtever tions my e neessry to rry out the Ageny s mission during emergenies. 5

14 Setion 1 Exlusive Representtive. ARTICLE 6. ASSOCIATION RIGHTS The Assoition is reognized s the exlusive representtive of the employees in the unit desried in Artile 3 nd is entitled to t for nd negotite olletive rgining greements overing ll employees in the unit. The Assoition shll represent the interests of ll employees in the unit pursunt to 5 U.S.C. 7114() (1). The Assoition retins ll rgining rights provided under Chpter 71 of Title 5. Setion 2 Weingrten Rights. The Assoition shll e given the opportunity to e present t ny exmintion of unit employee y representtive of the Ageny onerning n investigtion if: (1) The employee resonly elieves tht the exmintion my result in disiplinry tion ginst the employee; nd (2) The employee requests representtion. The Ageny shll inform unit employees of their Weingrten rights y posting written notie, on ulletin ords t eh shool nd y distriuting sid notie in either written or eletroni form, to eh individul unit employee during Septemer of eh shool yer. All new employees will reeive like notie t the time of hiring. Setion 3 Forml Disussion Rights. The Assoition shll e given the opportunity to e represented t ny forml disussion (whih my inlude, for exmple, ommittees, meetings, trining, nd/or groups) etween one or more representtive(s) of the Ageny nd one or more rgining unit memers or their representtive(s) onerning ny grievne, ny personnel poliy or prties, or other generl onditions of employment. Whenever possile, prior to the Ageny inititing ny forml disussion involving resolution of grievne(s) or disussions of personnel poliy, prties, or other generl onditions of employment, the Assoition shll e given twenty-four (24) hours dvne written notifition. The Prties understnd tht the Assoition shll inform the Ageny, efore ny meeting herein desried, of the identity of the Assoition representtive(s) who will ttend the meeting. Setion 4 Announement of Assoition Offiers. The Ageny shll reognize the Assoition s the exlusive representtive of its professionl rgining unit employees nd, during the new teher orienttion nd initil shool distrit nd shool uilding fulty meetings of eh new shool yer, shll nnoune the nmes of the eleted nd designted offiils of the Assoition. Setion 5 Announements t Fulty Meetings nd Orienttions. The Assoition will e fforded the opportunity to mke presenttion of not more thn ten (10) minutes during the initil shool distrit, nd shool uilding meeting, of eh new shool yer, regrdless of when the shool distrit meeting is held. The Assoition will e fforded the opportunity to mke nnounements t ny regulrly sheduled shool distrit nd shool fulty/stff meeting. 6

15 The Assoition will lso e fforded the opportunity to mke presenttion of t lest ten (10) minutes prior to the end of sheduled new employee forml orienttions. Setion 6 Notifition of Ageny Responsiilities. Eh lol DDESS shool distrit will, within twenty (20) work- dys of the eginning of eh shool yer, provide the lol Assoition President, eh Fulty Representtive Spokesperson or Building Representtive, nd the Assoition Are Diretor with opy of the shool distrit phone diretory nd the nme nd phone numer of the mngeril point of ontt for the following issues nd topis: Equl Employment Opportunity (EEO); employee py; lor employee reltions; employee enefits; leve; workers ompenstion; retirement; trining; hiring; position lssifition; offiil trvel; purhsing; supplies / equipment / tehnology; shool uilding seurity; sfety; uilding mintenne; nd property ountility. Within twenty (20) workdys of the eginning of eh shool yer, the Ageny will provide to the Assoition Are Diretor opy of the DDESS phone diretory. Setion 7 Assoition Aess to DoD, Deprtment of Defense Edution Ativity (DoDEA), nd DDESS Issunes. The Ageny shll provide to the Assoition Generl Counsel urrent opy of Unlssified DoD Issunes on CD-ROM whih ontins ll urrent DoD Diretives nd Instrutions. The Ageny shll provide to the Assoition Generl Counsel two opies of ll urrent DDESS Diretives, Instrutions, nd Poliy Letters whih pply to rgining unit memers, s well s ll urrent DoDEA Diretives, Instrutions, nd Poliy Letters whih pply to DDESS rgining unit memers. The Ageny lso grees to mintin opy of these Diretives, Instrutions, nd Poliy Letters to whih ll rgining unit memers (t eh lol shool distrit) will hve ess. Updted hnges will e provided s issued. The Ageny lso grees to mintin t eh lol shool distrit set of urrent Shool Poliies, s well s poliies issued y the Superintendent, shool prinipls, or ny other mngement offiil, whih pply to rgining unit memers. The ove will e ville for review to ll rgining unit memers. The Ageny lso grees to provide opy of ll shool poliies mentioned ove to the Assoition Generl Counsel. Setion 8 Representtion on Committees. DDESS Level Committees Appointed y the DDESS Diretor (1) The Assoition shll e entitled to selet its representtives(s) to e memer(s) of eh DDESS level ommittee tht is omposed of Ageny representtive(s) nd rgining unit memer(s) nd tht disusses personnel poliies, prties, nd/or terms nd onditions of employment. The Assoition will e entitled to representtive or n equl numer of representtives, ut not to exeed three, s Ageny memers on the ommittee, whihever is greter. Assoition representtives will e in pid duty sttus while working on ommittee tivities, when required y the Ageny, regrdless of the time of dy or time of the yer tht the ommittee works. The Assoition representtives will e pid t their erned hourly rte. Trvel 7

16 expenses, inluding per diem, will e pid in ordne with the Joint Trvel Regultions (JTR). (2) The Assoition shll lso e entitled to nominte ommittee memers who re to ome from the rgining unit. The rgining unit memers will e in pid duty sttus while working on ommittee tivities, when required y the Ageny, regrdless of the time of dy or time of yer tht the ommittee works. The rgining unit memers will e pid t their erned hourly rte. Trvel expenses, inluding per diem, will e pid in ordne with the JTR. Lol Shool Distrit nd Shool Building Level Committees (1) The Assoition shll e entitled to selet n Assoition representtive to e memer of eh lol shool distrit nd shool uilding level group or ommittee tht is omposed of Ageny representtive(s) nd rgining unit memer(s) nd tht disusses personnel poliies, prties, nd/or working onditions. The Assoition representtive will e in pid duty sttus while working on ommittee tivities, when suh tivities re required nd pproved y the Ageny, regrdless of the time of dy or time of yer tht the ommittee works. The Assoition representtive will e pid t his/her erned hourly rte. Trvel expenses, inluding per diem, will e pid in ordne with the JTR. In the event n FEA At-Lrge Offier is eleted from the DDESS professionl rgining unit, the nk of hours of offiil time identified for the distrit where tht rgining unit employee works (Setion 11 of this Artile) will e inresed y 160 hours of offiil time for the shool yer(s) during whih the employee holds the position of FEA At-Lrge Offier. The FEA At-Lrge Offier will e orded up to mximum of twenty (20) workdys (160 hours) of offiil time s needed to ttend FEA Bord meetings, workshops, trining, nd the like. Requests for offiil time for this purpose will e sumitted, t lest five (5) workdys in dvne, to the Superintendent of the FEA At-Lrge Offier s Distrit on the form t Appendix B. When n Assoition representtive(s) eomes wre tht hnge in the ssignment of duties to professionl rgining unit memers hs ourred or is plnned to our whih the Assoition elieves rises to level whih should hve reted rgining oligtion nd the Ageny hs not provided notie of the hnge(s), the FEA-SR Are Diretor (or designee) will notify the ssigned DDESS Lor Reltions Speilist of the Assoition s desire to meet nd disuss the hnge. In n ttempt to resolve the mtter, pproprite DDESS offiil(s) nd Assoition representtive(s) will, within two (2) workdys of suh notifition, disuss the hnge(s); nd DDESS grees to onsider the Assoition s input in n ttempt to resolve the mtter. If, t the onlusion of the meeting etween DDESS offiil(s) nd the Assoition representtive(s), the mtter is not resolved to the Prties stisftion, either prty my pursue their respetive ontrtul nd/or sttutory remedies. 25 Setion 2 Mid-Term Brgining. The Prties gree tht during the twelfth (12 th ) month of this Agreement tht either side my propose rgining over ny DDESS-wide mtter not resonly overed y or ontined in this Agreement. When mid-term rgining is proposed, the following proedures will e followed: d Initil rgining requests will e sent vi ertified mil, return reeipt requested, or hnd-delivered with signed knowledgment of reeipt, to the DDESS Diretor; or, in the se of Ageny-requested rgining, to the Assoition Are Diretor. The initil rgining requests will inlude proposls nd written explntion of the result desired y the proposls. All requests y the Assoition for informtion will follow the proedures set forth in Setion 1.. of this Artile. Within thirty (30) dys of reeipt of the request to rgin, the Prties will meet to disuss ground rules nd susequent shedule for the sumission of ounter-proposls nd rgining. Setion 3 Brgining Levels. DDESS Level Brgining (1) Issues tht ffet more thn one DDESS shool distrit will e rgined t the DDESS/Assoition s regionl level. (2) The Assoition nd the Ageny will determine the mke- up of their own DDESS level rgining tems. (3) The Assoition rgining tem will e in pid duty sttus on offiil time during ll rgining, regrdless of the time of dy or prt of the lendr yer. Py for ll rgining tem memers during rgining will e t eh individul rgining tem memer s erned hourly rte. Lol Shool Distrit Level Brgining (1) Issues unique to lol shool distrit, or individul shool, will e rgined y the lol Assoition nd Ageny representtive(s). (2) The Assoition nd the Ageny will determine the mke- up of their own lol rgining tems. Eh lol Assoition rgining tem will e mde up of no less thn two memers. If the lol Ageny rgining tem exeeds two memers, then the lol Assoition rgining tem will e entitled to the sme numer s the lol Ageny tem. Eh employee my seek ssistne from his/her Assoition representtive t ny time during the duty dy when neither is involved in ssigned duties. If memer needs immedite ssistne from n Assoition representtive during instrutionl time, the employee shll ontt the shool prinipl; nd if the prinipl determines tht work onditions permit, the employee nd the Assoition representtive will e relesed nd provided overge for their responsiilities. The Assoition representtive will e required to omplete n offiil time request form (Appendix B) nd hve it pproved y the pproprite mngement offiil. Nothing in this Agreement shll require n employee to eome or to remin memer of the Assoition or to py money to the Assoition exept pursunt to voluntry, written uthoriztion y memer for the pyment of dues through pyroll dedutions. Setion 3 Offiil Personnel Files. Only douments or dt uthorized y Offie of Personnel Mngement (OPM) regultions shll e retined in the employee s Offiil Personnel File (OPF). Only one OPF shll e kept for eh unit memer, nd it shll e mintined t the serviing personnel offie. Upon written request, opy of the OPF will e furnished to the employee. In ddition to the OPF, the Ageny reserves the right to mintin employee file(s) t the DDESS Hedqurters, DoDEA Personnel Center, lol shool distrit, nd/or supervisory levels. Upon written request, the Ageny will notify the employee of ll files retined on sid employee. Employees will hve ess to, nd re uthorized to mke opies of, douments in their employee file(s) s provided y pplile lw, rule, or regultion. Informtion ontined in the OPF or ny employee file(s) will e mde ville to uthorized persons only for offiil use s provided y pplile lw, rule, or regultion. 18

Asent requirement under lw, rule, or regultion, or signed relese from the employee, the Ageny will only provide the following informtion: nme; position(s) held; nnul slry; nd period(s) of employment. Setion 4 Py Reords. In the event tht unit employee s pyhek is not reeived on the estlished pydy, upon the unit employee s request, the Ageny will request from the serviing finne offie tht replement hek e issued s soon s possile. The Ageny grees to py interest on ny py reeived more thn thirty (30) dys eyond its due dte s provided y lw, rule, or regultion. Unit employees re enourged, ut not required, to mintin offiil douments they reeive relted to py nd leve nd to rry suh douments with them when they re trnsferred or ressigned. When the finne reords of unit employee re lost, destroyed, or delyed in onjuntion with ressignment or trnsfer, the Ageny grees to ept the unit employee s most reent Leve nd Ernings sttement or Stndrd Form 50, Notifition of Personnel Ation, s evidene of the proper sis for pyment until the tul py reords hve een reonstruted or reeived. Setion 5 Investigtions. If unit employee is to e served with wrrnt or supoen or is to e interviewed in onnetion with n investigtion while t shool, the Ageny shll mke resonle efforts to ensure tht suh tivity is done in privte without the knowledge of other employees or students. Setion 6 Telephone Aess. The Ageny shll mke every resonle effort to ensure tht rgining unit memers responsile for onfidentil informtion, other thn lssroom tehers, will e provided telephone in their offie or work res. If the rgining unit memer is teher, then, where possile, the Ageny shll mke resonle effort to ensure tht memers hve telephone in their respetive lssrooms. Setion 9 Providing Position Desriptions. Upon initil employment, nd therefter upon request, eh rgining unit memer will e provided with opy of his/her urrent position desription. The Ageny reognizes tht the Assoition is entitled to rgin the impt nd implementtion of hnges to position desriptions tht hnge terms nd onditions of employment in ordne with 5 U.S.C. Chpter 71. The Prties gree tht, s of the dte of exeution of this ontrt, uniform position desriptions do not exist. Until uniform position desriptions re estlished y the Ageny, position desriptions do not onstitute personnel poliies, prties, nd/or terms nd onditions of employment for rgining unit memers. Setion 10 Compenstion Informtion. Upon eing hired, nd therefter t the eginning of eh shool yer, eh unit memer will e provided n pplile slry shedule. Upon rgining unit memer sumitting written request to the Ageny within the first sixty (60) dys of eh new shool yer, the Ageny will provide the unit memer with worksheet (Appendix D) explining their slry rekdown for the yer. If neessry, the worksheet will e updted nd redistriuted one during the yer if the employee so requests in writing. The worksheet will reflet wht the employee hs erned y py period ompred with wht the employee hs reeived nd the umultive result of slry erned ompred to slry pid. The Ageny shll not open loked storge res loted in the unit employee s work re unless the memer hs een given the opportunity to e present or hs given written onsent, exept for emergenies tht neessitte suh tion or situtions whih my endnger the helth or sfety of students or employees. Setion 14 Relotion of Equipment nd Furniture. The Ageny will mke resonle efforts to ensure tht unit memers who must hve unique mterils or lrge equipment to dequtely perform their duties (e.g., siene, musi, rt) shll e ssisted in the movement of these items nd not e required to move them lone. Relotion of equipment, furniture, storge inets, nd ookshelves loted in the unit memer s work re, shll our, if possile, when the employee is present. Setion 15 Stff Lounge. The Ageny will provide minimum of one fulty lounge per shool for use y rgining unit memers nd other Ageny stff. Where fesile, the lounge shll e furnished with ouh, hir, tle nd hirs, mirowve, refrigertor, sod mhine, nd telephone. The lounge will e mintined y the Ageny. Setion 16 Dress nd Apperne. Unit employees re expeted to omply with resonle pprel nd grooming stndrds tht re derived from onsidertion of helth, sfety, nd type of position oupied. Any prohiitions y supervisors on unit employee dress nd pperne must e sed on ler showing tht the prohiited pperne item ontriutes to n unsfe, non-produtive, or disruptive work environment. 21

In the event tht the grde(s) of student re hllenged, the employee will e provided with n opportunity to explin nd justify the grde(s) ssigned. In the event tht ny grde is hnged y the dministrtion of the shool, or the employee is direted y the dministrtion to hnge the grde(s), the employee will e provided with written sttement from the Ageny stting tht the grde(s) ws hnged y the shool dministrtion. 22

Employees my not utilize Ageny-produed employee listings, rosters, or diretories or utilize Ageny reords to produe suh listings, rosters, or diretories for the purpose of milings (to inlude eletroni trnsmissions) or soliittion of produts or servies. Setion 6 Sign-in / Sign-out. The Ageny hs determined tht DDESS Shool Distrits will not use generl sign-in nd sign-out requirements for rgining unit memers. However, individul sign-in nd sign-out requirements my e used, t the disretion of the Superintendent nd/or Prinipl, only for individul employees who hve trdiness prolems or who hve left the work site erly without permission. 24

To promote nd filitte understnding nd onstrutive reltionships etween the Assoition nd the Ageny, the DDESS Diretor nd the Are Diretor, FEA-SR, will meet periodilly to disuss mtters of mutul onern to inlude lor reltions trining for rgining unit memers. Setion 3 Communition. In the dministrtion of this Agreement, hnnels of ommunition for oth Prties shll normlly e s follows: (1) Individul Shool Level - Shool Administrtor nd Fulty Representtive Spokesperson (FRS). The Lol Assoition President will notify mngement of the rgining unit memer within the individul shool who represents the Assoition. (2) Distrit Level - The distrit Superintendent or designee nd the Lol Assoition President or designee. (3) DESS Level - The DDESS Diretor or designee nd the FEA-SR Are Diretor or designee. Every effort shll e mde to resolve disputes involving the pplition or interprettion of this Agreement t the lowest possile orgniztionl level prior to elevting the mtter to the next higher level. Copies of inspetion reports will e furnished to the Lol Assoition President. Setion 3 Sfety Equipment nd Apprel. The Ageny will mke resonle effort to notify employees of nelltions or delys s erly s possile. In the event shool is losed more thn two (2) dys during the shool yer, the Ageny my reshedule the dy(s) lost from non- instrutionl dys or extend the work yer. In the event the shool dy is offiilly neled y the Ageny, employees my e required to report for duty. Employees will e pid their erned hourly rte for ll dys required to e mde up eyond the work yer requirements s desried in Artile 18. When n erly dismissl hour is delred efore the end of the shool dy due to dverse onditions, unit employees my e exused from duty t time determined y the Ageny fter the students hve een dismissed for the dy. Setion 7 Assistne with Reument of Lost or Dmged Property. When unit memer suffers loss or dmge of personl items on shool grounds or filities, the Ageny will refer the employee to the lol offie of the Stff Judge Advote, Clims Setion, for pproprite informtion nd lims proessing. 27

The Ageny shll provide support nd ssistne to unit employees in their efforts to mintin disipline. When there re instnes of persistent nd/or severe misehvior, the Ageny, if it deems it pproprite, will ring together fmily, ommunity, shool offiils (inluding tehers), nd ny other pproprite individuls, inluding the unit ommnding offier, in n effort to filitte improvement in the student s ehvior. The Prties reognize tht the finl deision nd responsiility onerning student disipline is retined y the Ageny. Setion 2 Student Disipline Poliy. As suh, the Prties gree tht, when rgining is required, the required speil edution servies will e provided to students; nd ny greement susequently rehed through the rgining proess will e pplied retrotively. Setion 4 Ageny Considertion of Brgining Unit Memer Request for Plement of Students with Disilities. The plement of students with disilities is t the disretion of the Ageny nd must e in ordne with hild s IEP. However, t the end of the shool yer, the Ageny will ept requests from tehers for plement of students with disilities in their lss for the following shool yer. Setion 5 Teher Input. As memer of the CSC, the teher hs n equl voie in determining the nture nd delivery of servies required to meet the gols nd ojetives of the student s IEP. At ny time, the teher my request tht the CSC e reonvened to review the servies eing provided nd propose modifitions to the IEP sed on student progress in the lss. Setion 6 Pupil Teher Rtio (Clss Size). The Ageny reognizes the need to tke into onsidertion the numer of students with disilities nd the severity of their disilities when pling suh students in regulr lsses. Brgining unit employees my hve their Assoition dues deduted through pyroll dedution provided: d The employee is memer in good stnding of the Assoition; The employee hs ompleted n SF-1187, Request for Pyroll Dedutions for Lor Orgniztion Dues. This form my e sumitted nd dues withheld t ny time in ordne with Setion 4. of this Artile; The employee reeives py on the regulrly sheduled pydys; nd suh py is suffiient, fter ll dedutions required y lwful uthority, to over the full mount of the dues llotment; nd During ny py period in whih there re insuffiient funds in n employee s pyhek to over dues-withholding, no withholding will e deduted from tht py period. A list of employees hving insuffiient funds for dues-withholding purposes will e furnished to the FEA-SR Are Diretor. The Ageny will not e responsile for olleting dues not withheld due to insuffiient funds. Setion 3 Assoition Responsiilities. If the SF-1187 is sumitted fter Septemer 15, the dues dedution will egin the first full py period fter sumission of the SF-1187 ut not erlier thn Otoer 15. If less thn fifteen (15) full py periods remin in the py yer fter sumission of the SF-1187, the Ageny will ollet the norml dues mount (1/15 th of the totl dues llotment mount) from eh remining full py period. The Assoition will ssume responsiility for olletion from the employees of ny dues mount not withheld s result of there eing less thn 15 full py periods in the py yer remining fter sumission of the SF-1187; Trnsmit funds (remittne heks, eletroni fund trnsfer, et.) to the FEA Stteside Region for dues withheld for its ount. Employees my revoke their dues-withholding y sumitting n SF-1188 to the Lol Shool System pyroll tehniin, or serviing pyroll offie. After the initil one (1) yer period of dues withholding, the Ageny will honor ny dues revotion sumitted etween August 15 nd Septemer 15 of eh shool yer. Untimelysumitted dues revotion requests reeived y the Ageny will e promptly returned to the employee. Setion 6 Termintion of Dues-Withholding Allotment. An llotment for n employee will e terminted t the end of the py period during whih n employee is seprted from the Ageny s rolls through trnsfer, retirement, resigntion, deth, or for use. Allotments for ll employees will e utomtilly terminted in the event exlusive reognition is no longer orded to the Assoition. In the event the Ageny either improperly revokes or termintes dues-withholding, the Ageny will immeditely restrt the dues-withholding if ny py periods remin. If insuffiient py periods remin to over the full mount of the dues withholding, the Ageny grees to py only the mount of dues ffeted y the error. 37

During this orienttion, the Ageny will provide the memer opy of his/her position desription, slry shedule, written notie of enefits, opy of the Mster Lor Agreement, nd informtion onerning the employee s performne pprisl. Setion 2 Certifition nd Reertifition. d The Ageny shll determine the requirements for ertifition nd reertifition for ll unit employees. All employees re required to e ertified t the time of hiring nd reertified s pproprite. The Ageny my elet to hire or ple employees without proper ertifition, ut this deision is nongrievle. The Ageny shll require proof from ll unit employees tht they re in possession of urrent, vlid ertifite. The Ageny my initite pproprite orretive tion, inluding removl, when unit employees fil to meet ertifition requirements. The Ageny will give the employee twelve (12) months dvne written notifition of reertifition requirements. Suh notifition shll lso dvise employees tht if reertifition requirements re not omplished in the stted time frme, they my e sujet to removl. Setion 3 DDESS Uniform Certifition. 48 Setion 1 Workdy. ARTICLE 18. HOURS OF WORK AND SCHEDULING The shool workdy for rgining unit memers shll onsist of seven nd one-hlf (7 ½) hours inluding minimum of 30-minute duty-free lunh period. No ompenstory time will e erned for loss of duty-free lunh period. Unit employees re expeted to perform dditionl preprtion nd professionl tsks neessry for ompletion of their ssigned work. This work my e performed either t or wy from the work site. The workdy for prt-time rgining unit memers shll e estlished s needed to meet the needs of the Ageny. Typilly, prt-time employee sheduled to work more thn four (4) hours per dy will reeive 30-minute non-pid duty-free lunh period. In ddition to the workdy, rgining unit memers my e required to ttend one (1) meeting per week up to one-hlf (1/2) hour pst the workdy without dditionl ompenstion nd three (3) evening meeting/events per shool yer without dditionl ompenstion. Setion 2 Personl Plnning nd Preprtion. d Eh rgining unit employee with instrutionl duties shll hve minimum of 225 minutes per work week (5 dys) for personl plnning nd preprtion purposes. The Prties gree tht the intent of susetion. ove is tht eh full-time rgining unit employee with instrutionl duties shll, to the mximum extent possile, hve the personl plnning nd preprtion (desried in 2.. ove) during the instrutionl dy. The loss of personl plnning period s result of hnge in the instrutionl dy suh s ssemlies, field dys, speil events, eremonies, field trips, erly relese for students, or emergenies (dverse wether, om threts, fire drills, instlltion-imposed thret onditions, nd the like) will not e ompensted. In ddition, ompenstion will not e provided for Ageny-direted loss of one (1) personl plnning period for ny one employee per instrutionl qurter. In the se of mngement-direted loss of personl plnning periods eyond the onditions desried in the two preeding sentenes, the rgining unit memer will reeive ompenstory time in ordne with Artile 20, Setion 5. Setion 3 Work Yer. The work yer will onsist of 190 work dys. The 190 dys re to e lloted s follows: (1) 180 instrutionl dys; nd (2) 10 non-instrutionl dys to e used for orienttion, stff development, reord keeping, nd/or prent/teher onferenes. The Ageny is free to ssign dditionl workdys; ny dditionl workdys for full-time rgining unit memers (with the exeption of Summer Shool nd Extended Shool Yer Progrms) will e seven nd one-hlf (7½) hours with py sed upon n eight (8) hour dy. However, the Ageny reserves the right to ssign duties on ny prtiulr dy of the work yer. Setion 4 Clss Size. The Ageny retins the right to determine lss size. Clss-size determintions will e dependent on ville resoures s well s regionl redittion geny guidelines. The Prties reognize the importne of working towrd ntionlly reognized stndrds for lss sizes nd tht the hievement of those stndrds is worthwhile gol. Setion 5 Shool Clendrs. The Ageny grees to onsider lol Assoition input prior to dopting shool lendr nd rgin impt nd implementtion in ordne with Chpter 71 of Title 5. All unit employees will reeive opy of the respetive shool distrit-pproved lendr. Five (5) dys will e designted s potentil mke-up dys on the shool lendr in the event of missed instrutionl dys. Setion 6 In-Servie Progrms nd Stff Development. The Ageny grees to meet nd onsult with the lol Assoition when plnning in- servie progrms nd stff development ourses nd rgin impt nd implementtion in ordne with Chpter 71 of Title 5. 41

Setion 2 Conferene Attendne. d e The Ageny shll onsider ll requests for ttendne t edutionl lsses, professionl onferenes, seminrs, workshops, onventions, nd professionl in-servie trining sessions for individul development whih enefit the Ageny. The Ageny my py ll or prt of the rgining unit employee s expenses t the disretion of the Ageny in ordne with the Joint Trvel Regultions (JTR). Upon notifition of ville onferene(s), the Ageny will dvise the Assoition nd the unit memers of the onferene(s) long with the dte(s) nd time(s). The Assoition nd/or individul rgining unit employees my inform the Ageny of ville onferenes s well nd reeive the sme onsidertion. All rgining unit employees who desire to ttend onferene shll sumit requests to their respetive prinipl or supervisor. Upon endorsement y the prinipl or supervisor, the Superintendent or designee my pprove requests for onferene ttendne sed upon the needs nd resoures of the Ageny. Exused leve, in ordne with Artile 21, my e grnted for onferene ttendne t the disretion of the Ageny. Upon prior written pprovl, for the purposes of professionl development, employees my e permitted to visit other edutionl institutions, usinesses / government genies, or ples of historil interest, deemed y the Ageny to e of exeptionl edutionl vlue in onnetion with their tehing position. Setion 3 Trvel. The Ageny shll ide y requirements outlined in Volume II of the Joint Trvel Regultions when employees re pproved in dvne to ttend edutionl lsses, seminrs, workshops, onventions, professionl onferenes, nd other professionl in-servie trining sessions for individul development t government or personl expense. Aordingly, employees my, with the dvne pprovl of the Ageny, e pled on permissive trvel orders to ttend suh sessions t the employee s expense. 42

For oth full-time nd prt-time employees, step inreses will e effetive the first dy of eh py yer. (1) For full-time employees yer of servie is defined s no fewer thn 120 work dys. (2) For prt-time employees, yer of servie is defined s minimum of 900 hours in py sttus t the prior step. Hours in py sttus re umultive nd will e trked from py yer to py yer until the rgining unit memer ompletes the required 900 hours required for dvnement to the next step. An employee my, fter ompletion of 900 hours, sumit written request tht their py e set t the next py step. Upon reeipt of the written request, the Ageny will verify if the dt is orret, nd then proess the tion mking the effetive dte the next py period following sumission of the request. If no written request is sumitted, the step inrese will eome effetive t the strt of the next shool yer. (3) One rgining unit memer dvnes to the next step, he/she must e in py sttus minimum of 900 hours t the new step prior to eing eligile for dvnement to the next step. Setion 3 Py Setting. Prior experiene for py setting purposes will e orded for the life of the MLA s refleted on the mtrix t Appendix E. Py setting for rgining unit memers hired prior to 4 July 1999 will e in ordne with Setion 3.. of Artile 20 of the originl Mster Lor Agreement, nd qurter hours erned prior to 4 July 1999 will e treted s equivlent to semester hours. Brgining unit employees hired fter 4 July 1999 will hve their py set ording to the following: 43

(2) Py lne djustments sed upon ompletion of degree plus hours mens semester hours. Qurter hours will e onverted to semester hours on 3 to 5 sis (i.e., 3 semester hours equls 5 qurter hours). (3) Py lne hnges will e retrotive for py purposes to the eginning of the py period following reeipt of trnsript refleting wrd of the degree or ompletion of oursework, provided the employee sumits the request for py lne hnge within one-hundred twenty (120) dys of wrd of the degree or ompletion of the oursework. If the employee does not sumit the request for py lne hnge nd supporting trnsript(s) within this time period, the py lne hnge shll e effetive t the eginning of the py period following sumission. Setion 4 Proedures. Py nd enefits shll e provided in ordne with the pyroll nd leve ounting proedures set out in Deprtment of Defense Finnil Mngement Regultion, Volume 8, Civilin Py, Poliy nd Proedures. Setion 5 Compenstory Time. Employees will not reeive multiple forms of ompenstion for the sme period of work, i.e., not reeive oth si py nd ompenstory time for the sme period of work, not reeive ompenstory time nd dditionl pyment t erned hourly rte for the sme period of work, not reeive ompenstory time nd EDA pyment for the sme period of work, et. Employees normlly must use time efore the end of the shool yer in whih it ws erned. (1) If the employee fils to request to use the ompenstory time within the estlished time frme, the ompenstory time will e forfeited; nd ompenstion for the ompenstory time will not e pid. (2) If the employee requests to use the ompenstory time within the estlished time frme nd the request were denied due to work requirements, the employee my e ompensted t rte of twenty-five (25) perent ove the employee s si/erned rte of py. 44

If the employee requests to use the ompenstory time within the estlished time frme nd the request were denied due to work requirements, the employee my e ompensted t rte of twenty-five (25) perent ove the employee s si/erned rte of py. Setion 6 Extrurriulr Duty Assignments/Py. d e Extrurriulr duty ssignments shll e open to ll rgining unit employees. Shool yer or sesonl extrurriulr ssignments will e mde on fir nd equitle sis. The Ageny will post list of ll extrurriulr tivities whih shll inlude the following informtion: (1) The speifi ssignment; (2) The mount of ompenstion; (3) The losing dte for reeipt of pplitions; nd (4) The pproximte dte seletions will e mde. An employee my sumit reommendtion for n unlisted extrurriulr tivity to his/her supervisor. The Ageny, t its disretion, will deide whether to pprove the tivity. The DDESS Diretor, or designee, nd the Assoition Are Diretor will then determine the rte of ompenstion t whih the extrurriulr tivity will e pid. An employee seleted to perform n extrurriulr tivity will exeute the Agreement tthed s Appendix G. Compenstion for performing extrurriulr tivities will e proessed following ompletion of the tivity, will e in ordne with the shedule tthed s Appendix H, nd will e pid in single pyment. Upon reeipt of notifition from n employee tht n extrurriulr tivity hs een ompleted, the supervisor will promptly verify whether the employee hs stisftorily ompleted the extrurriulr tivity. If verified, the supervisor will promptly initite required tion to effet pyment to the employee. Setion 7 Method of Pyment. All DDESS employees re required to prtiipte in eletroni fund trnsfer s the stndrd method of pyment in ordne with the Det Colletion Improvement At of All permnent DDESS employees will e pid over 26 py periods. 45

The only exeption to the preeding sentene will e for FEA At-Lrge Offiers eleted from the DDESS rgining unit who use leve without py to ttend FEA Bord meetings, workshops, trining nd the like, pursunt to Artile 6, Setion 15. When n employee who is indeted for unerned leve is seprted, the Ageny reserves the right to: (1) Require him/her to refund the mount pid for the period overing the leve for whih he/she is indeted; or (2) Dedut tht mount from ny py due. All leve for full workdy s sene will e deduted sed upon n eight (8) hour workdy. Leve for less thn full workdy s sene will e deduted sed upon tul hours sent from the work site. When the lunh period is in onjuntion with prtil workdy s sene, the mount of leve hrged will exlude the lunh period. Sik nd personl leve my e tken in fifteen (15) minute inrements. g. Brgining unit employees my e dvned up to mximum of twelve (12) dys or 96 hours of sik leve in ny one py yer. Dispprovl of requests for dvned sik leve my not e grieved under the provisions of Artile 26 of this Agreement. Brgining unit memers, who t the eginning of new py yer hve negtive leve lne s result of using dvned sik leve, will hve their sik leve ount djusted to repy the mount of dvned leve. When rgining unit memer (who is indeted s result of dvned sik leve) is seprted, he/she is sujet to the provisions for repyment speified in Setion 1.d. ove. Permnent nd temporry employees who re re-employed will hve their most reent sik leve lne re-redited upon reeipt of doumenttion of their prior sik leve lne. Suh sik leve will e re-redited regrdless of the Federl geny in whih the sik leve ws originlly rued nd regrdless of the length of the rek in servie. Setion 3 Personl Leve. d Eh full-time rgining unit employee shll ern three (3) dys of personl leve to e used for ny purpose nd is never oligted to stte the reson for requesting suh leve. Personl leve will rue t the rte of hours for every one hour the employee is in py sttus during the shool yer, up to mximum of 24 hours of personl leve per shool yer. Eh prt-time rgining unit employee nd eh employee who works less thn the full shool yer shll ern the pro-rted mount of personl leve. Eleven (11) month employees nd summer shool employees shll ern n dditionl one-hlf (½) dy of personl leve per yer. Other rgining unit employees who work minimum of 10 dditionl work dys (80 hours on dditionl work dys) during reess period per py/leve yer shll rue dditionl personl leve t the rte of hours for every one hour the employee is in py sttus. Personl leve must e requested in dvne y the employee nd pproved y the Ageny. Employees re never required to stte the reson for requesting suh leve. Whenever possile, personl leve will e requested in writing t lest two (2) dys efore the dtes desired. Personl leve requested to e used on the dy efore or the dy fter holidy or sheduled vtion dy my e grnted if the supervisor determines tht it does not interfere with shool opertions. Personl leve my e umulted from yer-to-yer, not to exeed six (6) dys. Employees will not e ompensted for unused personl leve. However, unused personl leve in exess of six (6) dys will e onverted to sik leve. At no time will rgining unit memer s personl leve lne exeed six (6) dys. 48

Setion 10 Edutionl Leve. Brgining unit memers my pply nnully (sujet to ny dditionl riteri stted elow) for ny or ll of the following Ageny edutionl leve progrms: (1) Yerlong Edutionl Leve t Hlf Py; (2) Leve Without Py (LWOP) for Edutionl Purposes; nd (3) Administrtive Reemployment Rights (ARR) Progrm. Nevertheless, the Prties gree tht suffiient time should e llowed to omplete pproprite investigtions nd ft-finding nd tht undue hste is s undesirle s undue dely. Supervisors, unit employees, Assoition representtives, nd others involved in n investigtion will not dislose ny informtion gined through suh investigtions exept in the performne of their offiil duties. Disiplinry tions will not e ritrry or priious. The Ageny reognizes the onept of progressive disipline, nd generlly tions imposed should e the minimum tht n resonly e expeted to orret nd improve employee ehvior nd mintin disipline nd morle mong other employees. A rgining unit memer who is to e questioned y DoDEA or DDESS mngement employee in onnetion with n investigtion my request representtion y the Assoition t ny time tht he/she resonly elieves tht disiplinry tion my result ginst him/her. If requested, the rgining unit memer will e entitled to e represented y n FEA ttorney, t no ost to the Ageny, nd lol Assoition representtive. If the rgining unit memer requests Assoition representtion, y n FEA ttorney, or lol Assoition representtive or oth, no questioning will tke ple until the Assoition hs een given t lest 24 hours to onfer privtely with the rgining unit memer. In no event will the rgining unit memer e permitted to dely questioning eyond 24 hours. Setion 2 Informl Disiplinry Ations. Informl disiplinry tions re orl dmonitions nd letters of ution. When suh n tion is tken y supervisor, the employee will e dvised of the speifi infrtion or reh of ondut, when it ourred, nd will e permitted to explin his/her ondut or t of ommission or omission. Suh tions will not e pled in the employee s Offiil Personnel File (OPF). Setion 3 Forml Disiplinry Ations. Forml disiplinry tions onsist of written reprimnds, suspensions, demotions, nd removls. Before forml disiplinry tion is initited, n investigtion or inquiry will e mde y the immedite supervisor or other offiil designted y the Ageny to ensure him/her of the fts of the se. A Letter of Reprimnd must stte the reson(s) for its issune, the employee s right to file grievne under the negotited grievne proedure, nd the length of time the reprimnd will remin in the OPF. A Letter of Reprimnd my remin in the OPF for period of two (2) yers. If t the end of the first yer, there hve een no further disiplinry infrtions; the employee my 61

The supervisor should rrnge for meeting within five (5) dys of the informl presenttion of the grievne to fully disuss the mtter nd to ttempt informl resolution.
