3 THE CONTRACTOR SHALL FURNISH ALL PLANT, LABOR MATERIAL, EQUIPMENT, ETC. NECESSARY TO PERFORM ALL WORK IN STRICT ACCORDANCE WITH THE TERMS AND CONDITIONS SET FORTH IN THE CONTRACT TO INCLUDE ALL ATTACHMENTS THERETO. BID SCHEDULE CONTRACTOR FURNISHED SITE In order to be responsive to this solicitation, prices shall be submitted on all of the items in the Pricing Schedule, above. At the bidder s discretion, a bid may also be submitted under this Alternate Pricing Schedule. In the event a bidder elects to submit a price under the Alternate Pricing Schedule, all of the individual items in the Alternative Pricing Schedule shall be completed. At the time of bid the bidder must submit proof acceptable to the Contracting Officer that the Alternate Site is both permitted and has sufficient capacity to handle the estimated volume of material specified in the Bid Schedule- Contractor Furnished Site plus non-paid material in the allowable dredging prism. Disposal of all materials at a permitted upland disposal site. 5 CONTRACT AWARD A contract will be awarded on the basis of price and other factors to the lowest responsive, responsible bidder in accordance with FAR , Contract Award Sealed Bidding Construction. Contract award will be made based on the lowest cost to the O&M Dredging Program. Notes: *QUANTITY IS AN ESTIMATED AMOUNT, SEE SECTION 00700, FAR AND EFARS , , FOR SUBDIVIDED BID ITEMS AND FOR VARIATION IN ESTIMATED QUANTITIES CONTRACT CLAUSE. 1. Prices must be submitted on all individual items of the Pricing Schedule Government Furnished Site. Failure to do so may be cause for rejection of bids. 2. If a modification to a price based on unit price is submitted which provides for a lump sum adjustment to the total estimated price, the applications of the lump sum adjustment to each unit price in the Pricing Schedule must be stated. If it is not stated, the bidder/offeror agrees that the lump sum adjustment shall be applied on a pro rata basis to every unit price in the Pricing Schedule. 3. The lump sum, "LS", line items above are not "estimated quantity" line items and therefore are not subject to the Variation in Quantity contract clause. 4. EFARS ARITHMETIC DISCREPANCIES (a) For the purpose of initial evaluation of bids, the following will be utilized in the resolving arithmetic discrepancies found on the face of Pricing Schedule as submitted by the bidder: 1) Obviously misplaced decimal points will be corrected; 2) Discrepancy between unit price and extended price, the unit price will govern; 3) Apparent errors in extension of unit prices will be corrected; 4) Apparent errors in addition of lump-sum and extended prices will be corrected. (b) For the purpose of bid evaluation, the Government will proceed on the assumption that the bidder intends the bid to be evaluated on basis of the unit prices, the totals arrived at by resolution of arithmetic discrepancies as provided above and the bid will be so reflected on the abstract of bids. (c) These correction procedures shall not be used to resolve any ambiguity concerning which bid is low. 5. Bidders must complete and submit attached Dredging Plant and Equipment Schedule, forms P.1 and P.2, as part of their solicitation package for bid evaluation. Failure to do so may cause the bid to be considered nonresponsive. The Contractor shall demonstrate that all necessary equipment will be available and committed to this contract Bid Schedule

6 6. DREDGED QUANTITIES: For payment purposes, all quantities for which the Government will pay under this contract shall be based on the Government pre and post dredge surveys. 7. BASIS OF AWARD: Award will be based on the least cost to the Federal O&M program. A contract will be awarded on this basis to the lowest responsive, responsible bidder in accordance with FAR for the Alternate 1 Base or for Alternate 2 Base. Award will be made to the lowest responsive, responsible bid identified from this comparison. The Government intends to award a contract that provides the greatest depth for the available funding. The award amount cannot exceed the Independent Government Estimate to dredge and place material at the placement site that represents the Government's authorized standard. For this contract, the standard placement dredged material disposal is the SF In the event a bidder or bidders submit bids under the Pricing Schedule Award will be made to the lowest responsive, responsible bid identified from this comparison. 9. The nature of sediment deposition in the Redwood Harbor Channel is very dynamic owing to the affects of waves and tidal flows. Therefore, the Contractor should anticipate that the advertised dredge quantities and/or the distribution of dredge material may differ significantly during the period between the pre-solicitation update survey and the Before-Dredge survey. The Contractor shall be responsible for all shoaling during the execution of the dredging contract and this should be reflected in the Contractor's bid proposal. 10. If it is determined to be in the best interest of the Government, the Contracting Officer may negotiate a modification to the contract which could result in the selection of an alternative disposal site. This site could either be an upland site or an aquatic site in accordance with the Change Clause FAR The contractor shall complete the project of alternate 1 within 71 calendar days, alternate 2 within 98 calendar days after receiving Notice to Proceed Bid Schedule
