Please do not submit a bid unless you have a logger with this capability. TRACT LOCATION The timber sale area is located 14 air miles southeast of the city of Fayetteville in the southern portion of Cumberland County, NC adjoining Tabor Church Road across from the intersection of Hair Road. 2 DESCRIPTION OF TIMBER & LAND The timber sale area is composed of 2 blocks totaling 121 wooded acres for sale as shown on the attached sale map. All merchantable timber contained within the limits of the timber sale area is being offered for sale on a clear-cut basis. The majority over-story timber is composed of pine sawtimber trees of good quality and size with a small component of pulpwood. The tract's tree species consists mainly of longleaf and loblolly pine. The tract's terrain is gentle sloping with soils supporting excellent all weather logging. SALE BOUNDARIES The tract's exterior harvesting boundaries are designated by Pink-Glo flagging, Blue-Line Canals, and Tabor Church Road. No marked boundary line trees are to be cut SMZ s There are no streams present in the interior of the tract. There is a blue-line canal to the north which is the northern sale boundary. State Best Management Practices (BMPs) will need to be followed for harvesting near the Canal. LOGGING ACCESS Access for harvesting the timber is by an existing woods road from Tabor Church Road as identified on the attached sale map. There is a locked gate to access the eastern portion of the tract with the combination code being "8720". After your examination is complete, please be sure to re-lock the gate. BIDS All bids for this sale will be received on a lump sum basis only. Bids will be accepted and disclosed at 10:00 A.M. Thursday, March 16, 2017 at our office in Seven Lakes (1008 Seven Lakes Drive). If you cannot be present for the sale, you have until 9:59 a.m. the same day to place your bid by , fax ( ), office phone ( ) or cell phones ( ). **The owner reserves forty-eight (48) hours to determine the acceptance or denial of any or all bids** ATTACHMENTS CONDITIONS OF SALE, TIMBER SALE MAP, VOLUME SUMMARY SHEETS, SALE LOCATION MAP. CONDITIONS OF SALE 1) The Buyer will have eighteen (18) months from the date of execution of the timber deed to cut and remove the timber. 2) Forest Land Resource Consultant, PLLC, Agent of the Seller, is to be notified when logging operations begin and at least three (3) days prior to completion.

3 3) No trees, laps, limbs, or other debris resulting from the logging operation shall be left in any roads, fields, food plots, ditches, branches, or across boundary or cutting lines. Buyer agrees that no logging debris whatsoever will remain outside of the sale areas at the completion of logging. All logging decks should be established and maintained within the sale area. All logging debris piles shall be placed a minimum of 100 (one hundred) feet away from any property lines or unless otherwise negotiated with the Seller s Agent. 4) No line or corner witness trees are to be cut, and any destroyed property corner shall be immediately restored at the Buyer s expense. 5) Severe or unreasonable rutting by heavy equipment will not be permitted or tolerated to any areas of the property up to and including the Sale Area or Access road. Any occurrence will be restored to the satisfaction of the Seller's Agent. Further, the Seller's Agent will have authority to suspend harvest operations for rutting of land at anytime. A time extension of 10 days will be granted for each day harvest operations are suspended. 6) The Buyer will restore all existing or constructed roads, gates, and culverts including water bars where necessary to the original condition prior to use or better condition upon completion of logging at their own expense and to the Seller s Agent satisfaction. 7) All trash such as, but not limited to, oil cans, paper bags, sandwich wrappers, bottles, food cans, etc. are to be carried off on a daily basis. 8) The draining of oil, grease, or hydraulic oil onto the ground on this property is expressly forbidden. The Buyer agrees not to dispose of gasoline, petroleum products or other hazardous materials on the property. All standard equipment maintenance performed on the property must use catch pans or other methods to collect waste oil and must be removed from the premises. Equipment must be maintained to prevent excessive oil leakage onto the ground. Buyer agrees that it will not allow logging equipment, tires, and other mechanical parts to remain on the property at the completion of logging and that it will remove these materials which it may have placed on the property at its sole expense. 9) The Buyer shall indemnify and hold harmless the Seller from any and all liability for loss to any person whomsoever for property damage, personal injury, death, or otherwise during activities incident to or related to this contract, including any fines resulting from noncompliance with Best Management Practices. The Buyer will carry sufficient insurance and liability insurance to protect Seller from any liability whatsoever, and will furnish evidence of such insurance upon request of Seller and/or his Agent. 10) The Buyer shall at closing post a $3, performance bond with Forest Land Resource Consultants, PLLC. The bond shall be forfeitable in part or in whole upon the basis of a final inspection by the Agent. The amount of the bond is not intended to limit what the agent may determine to be the maximum damage that may have been incurred or inflicted.
