I: Envelop No. 01 shall contain EMD of Rs.5000/-(five thousand) and cost of Tender Document, if any, in the form of demand draft in favour of National Fertilizers Limited, Zonal Office, Lucknow plus technical bid duly signed by the tenderer. II: III. Each page of NIT shall be signed by the tenderer. This shall also carry all documents to be submitted by the bidder as per NIT. In envelop No. 02, Price Bid filled in as per schedule of rates duly signed and stamped by the Tenderer. The bidder should make himself known to the circumstances, conditions and atmosphere prevailing at site before submission of tender. Lump sum monthly rate for one Labour including all charges i.e Minimum wages, PF,ESI, other statutory charges,service charges etc., excluding Service tax र नश र (AMOUNT) 2. Total charges for four Labours including all charges i.e Minimum wages, PF ESI, other statutory charges,services charges etc., excluding Service Tax 3. Courier service charges for 01 trip per week to Corporate Office, NOIDA and back or as per requirement.(including daily allowance, all transportation charges i.e Rail & Bus fare, local conveyance charges etc., excluding wages) ( Approx. 50 trips in a year) प ट क हस त क षर न म : पत : फ न : 3

4 क र यय क ष त र (Scope of Work) 1. Cleaning and ponchha twice in a day for all Rooms/ including Cabins, bath rooms, toilets and ground floor & corridor, However, first trip should be finished by 9.30 AM. 2. Cleaning of all installations like tables, chairs, sofa, Computer Tables, Almirahs, telephone, fax windows doors carpet, switch boards, partitions, dustbins, wall, glasses, toilets with napthlen balls, phenyls, Acids Collins etc. every day before 9.30 AM. 3. Cleaning of ground floor & corridor with appropriate detergent/chemical once in 15 days preferably on 2 nd Saturdays/4 th Saturdays.. 4. Polishing of name plates and cleaning of other name plates. 5. Preparation/serving tea/water/snacks in a dignified manner to the guests. 6. Packing of printed stationary for field offices. 7. Cleaning of Conference Hall, record rooms/soil testing van. 8. Any other misc. jobs for official requirement. 9. Distribution of Local dak within premises, deposit of bills payment like electricity, telephone, water, correspondence with all our bankers etc. and any other requirement mailing of dak at speed post center etc. within municipal limit whenever required. Actual to & fro fair of public conveyance will be paid to the contractor. 10. Deputation of one Labour within provided 04 Labours as courier to & fro, CO/CMO, Noida, once in a week, who will collect dak from Zonal Office, Lucknow and distribute/deliver at CO/CMO, Noida and vice-versa. 11. Watering of flower pots/coolers, whenever, required. 4

The persons deployed by the contractor should be in good health for rendering services at NFL s premises in the age group of It will be the responsibility of the contractor to provide satisfactory services as per the prescribed norms/standards of performance of jobs for which the contract is executed. 3. It would be the sole responsibility of the contractor concerned for controlling and supervising the work/performance of the persons deputed for rendering services in terms of the contract executed/work order issued to the party. 4. The attendance record of the persons deployed for rendering services would be maintained by the Contractor himself and his monthly payment will be settled subject to satisfactory performance of the contract/rendering of satisfactory services by the personnel concerned deputed for the purpose. 5. On failure to provide satisfactory or adequate services on a particular day, the contractor would be liable for a penalty restricted to 2% monthly bill. 6. No direct payment in any way would be made by NFL to the contract worker(s). All dealing of such a nature should be directly made with the contractor concerned. Even for attending to any out station job (s), the contractor should be approached for getting the job done on agreed terms & conditions of such field duty movements of the concerned contract labour. 7. The contractor would be required to make available a copy of the Appointment Letter issued by him to the concerned Contract Labour along with his recent passport size photograph, who has been deployed for rendering services at our premises accompanied with a copy of application furnished by such person to the contractor for engaging him while deputing the person to NFL s premises for performing jobs as per the work order issued by the Company. 8. The tenderer should deposit Rs.5000/- as Earnest Money by an A/c payees Demand Draft, drawn on any Scheduled Bank except Rural or Co-Operative Bank in favour of National Fertilizers Limited, payable at Lucknow. The Earnest Money shall not be 5

6 accepted in any other form except specified. Earnest money should accompany the Tender in separate Envelope without which tender will not be opened and it will be considered as rejected. Earnest Money will remain with NFL in case of successful tenderer and no interest will be paid on Earnest Money. In case of unsuccessful tenderers, their EMD will be refunded within three Months from the date of opening of the tender on submission of application for refund of security 9. Tender shall be submitted in two separate sealed envelopes as under:- Envelope No.1:- will be superscripted Technical bid & EM (Earnest Money) and shall contain Technical bid, signed NIT, earnest deposit of Rs.5000/-, in the form of a crossed Demand Draft (Separate for both amount) issued by any scheduled bank except rural and C0-Operative bank in favour of National Fertilizers Limited, payable at Lucknow. Envelope No.2:-Will be super scribed Price Bid and shall contain rates and amount quoted in the prescribed proforma. All the two sealed envelopes shall be submitted in a separate sealed envelope super scribed Misc. Contract for Zonal Office, Lucknow. 10. The period of the contract initially will be for one year with a provision to extend the contract for another one year on the same rates, terms and conditions. Provision of the minimum wages for unskilled labour notified from time to time by State of U.P., shall be complied with, a copy of notification should also be accompanied with the monthly bill for payment. L-1, status on overall quoted rates basis shall be criteria for award of contract. 11. The following tenders will be liable to summary reject:- a) It a Tender, who resorts to any frivolous, malicious or baseless complaints/allegations with an intent to hamper or delay the tendering process or resorts to canvassing/rigging/influencing the tendering process, NFL reserves the right to debar such tenderer from participation in the present/future tenders up to a period of 2 years. b) Tenders which do not fulfill any of the conditions laid down in the tender documents or are incomplete, in any respect. c) Tender, which contain uncalled for remarks or any alternative additional conditions. 6

7 d) Tender received without EMD 12. The contractor has the option to receive payment through Electronic Funds Transfer (EFT/RTGS) process. For this option, they may submit their bank particular i.e Customers Name, Name of the Bank, Bank Account No. IFS code to enable NFL to release payment accordingly. All bank charges will be to their account. 13. The tenderer shall not be entitled to claim any cost, charges, expenses, losses incidental to the preparation and submission of this tender in any case. 14. The job shall be executed through 04 unskilled labours apart from courier service to CO/CMO, Noida. 15. Tender shall be addressed to Zonal Manager, National Fertilizers Limited, B-52 Mandir Marg, Mahanagar Extension, Lucknow The tender form may be obtained either from the Zonal Office, Lucknow or may be down loaded from NFL website कर(Taxes) a) The rates to be quoted by the party should be inclusive of all duties taxes, levies including VAT if any. b) Service Tax will be applicable as per rules of Government. c) Addition/deletion of taxes imposed by the State Governments/Central Government after submission of tender documents and during contractual period shall be to NFL s account. 18. अनधक रक ष त र (Jurisdiction) : Not with standing the place where the work under this contract is to be executed, it is mutually understood and agreed by and between the parties hereto that the contract shall be deemed to have been entered into by the parties concerned at Lucknow and the court of law in Lucknow alone shall have the jurisdiction on over all matter concerning to this contract. 19. मध र यस थत (Arbitration): a) Except where otherwise provided in the contract all matters, questions, disputes, or differences whatsoever, which shall at any time arise between the parties hereto, touching construction, meaning operation or effect of the contract, or out of the matters relating to the contract or breach thereof or the respective rights or liabilities 7

8 of the parties, whether during after completion of works or whether before or after termination shall after written notice by other party to the contract be referred to ED(M),CMO, Noida NFL for appointment of Arbitrator. b) The arbitration proceeding shall be governed by the Arbitration and conciliation Act, The Arbitration and conciliation (Amendment act 2015) or any further statutory modifications or re-enactment thereof & the rules made thereunder. c) If the arbitrator to whom matter is referred, vacates his/her office by any reason whatsoever then the next arbitrator so appointed by the authority referred above my start the proceedings from where his predecessor left or at any such stage he may deem fit. d) It is agreed by and between the parties that in case a reference is made to the Arbitrator or the Arbitral Tribunal for the purpose of resolving the disputes differences arising out of the contract by and between the parties hereto, the Arbitrator or the Arbitral Tribunal shall not award interest on the awarded amount more than the rate SBI PLR/Base rate as applicable to NFL on the date of award of contract. e) क षनतप नतय : The contractor shall indemnify and keep the NFL indemnified against all losses and claims for injuries or damages to any person or property whatsoever which may arise out of the consequence of the execution of the works and against all claims, demands, proceeding, damages, cost, charges and expenses whatsoever in respect of or/in connection thereto including his employees. 20. The contractor must be registered under the shops & Establishment Act of the State and also have a valid License under the Contract Labour (R&A) Act, 1970, wherever, applicable. 21.The contractor should have his own Employer s PF and ESI Account Number(s) and the contractor would be responsible for strict compliance of all Labour Laws and statutory provisions such as Employees, Provident Fund Scheme and pension scheme etc, as applicable in respect of the persons so deployed for providing the requisite services. 22.The Contractor shall get his liability under Workmen s Compensation Act 1923/ESI 8

9 through an insurance Company. The Contractor Shall also take Medical cover for the workmen deployed by him to cover the medical treatment in respect of his workmen. 23. In case of any dispute in regards to interpretation of words/sentence,the English version will prevail
