1 ADDENDUM No. 1 REQUEST FOR BIDS (RFB) WVNET #07004 IBM Products and Services March 23, 2007 A. CLARIFICATIONS AND MODIFICATIONS TO THE RFB 1. This Addendum is posted on the HEPC Purchasing webpage at the following address. The name of the successful vendor(s) will also be posted on the HEPC Purchasing webpage and will constitute official notification of the contract award Reminder: Sealed bids will be received until 3:00 PM, EDT, April 4, 2007, by: Chief Procurement Officer West Virginia Higher Education Policy Commission 1018 Kanawha Boulevard, East, Suite 700 Charleston, WV B. VENDOR QUESTIONS AND ANSWERS Questions that were received in writing by 5:00 PM, March 22, 2007, are restated below with the answers following the question(s): 1. Is it permissible for an IBM Business Partner (BP) to sell some of the categories listed? ANSWER: Yes, if the IBM Business Partner is an authorized IBM reseller of these categories. 2. If not, is it permissible to have some categories fulfilled with a subcontractor? ANSWER: Yes, if the subcontractor is an authorized IBM reseller of these categories. However, the vendor using subcontractors will be responsible for the subcontractor s performance in meeting the requirements of this RFB and the contract. 3. Part I, Item C states that all products must be shipped in a timely manner, within three working days of receipt of an order. Is this correct for all products? ANSWER: Yes. 4. IBM Passport Software categories are: DB2 and Information Management: Information on demand Lotus: Communication, collaboration, and productivity Tivoli: IT service management Rational: Business-driven development WebSphere: Business process management Page 1 of 5

2 Can these categories be substituted for the categories listed? If not, is it permissible for the response to show the category type referencing one of the IBM Passport Software categories? ANSWER: The IBM Passport Advantage program was not considered as part of this RFB. Please bid the software categories that are listed on the bid sheet. 5. Also, concerning the software, does the response want % off IBM List Price (not Education Pricing)? ANSWER: It is our understanding the IBM no longer offers educational pricing. Therefore, we would expect % off list price for the software. 6. Also, can VMware (sold through IBM) be added to the category list? ANSWER: VMware could be sold under the operating system category. There is no reason to add it elsewhere. 7. Can IBM education products be added to the category list? ANSWER: No, only those products and services identified in the RFB or an addendum may be bid. 8. Under Software Products. What is the definition of Learning Software? ANSWER: Learning software relates to question 7. Our definition of learning software is IBM Education/Training software. 9. Is it permissible to offer a range of % off published list prices? For example 5% to 15%. ANSWER: The percent off that you bid needs to be identified with a specific IBM product or service. You may offer (bid) a different percent off for different products or services, but not a range for the same product or service. 10. Will WVU accept additional financial incentives and/or support incentives that are not called for in the RFP? ANSWER: We cannot answer for WVU; however, HEPC and WVNET will accept additional financial incentives and/or support incentives in addition to the percent off in the purchase order to the successful vendor(s) for the IBM product or service. 11. Will WVU accepts alternate proposals that will provide HEPC institutions with IBM products (Software, Hardware & Services) as well as Business Partner specific enhancements? ANSWER: We cannot answer for WVU; however, HEPC and WVNET will consider Business Partner enhancements offered in the BP s bid provided these enhancements do not jeopardize IBM warranties or service. 12. With the new procurement law permitting purchases from contracts issued by other public agencies and entities will the HEPC (WVNET) consider other contracts if the other contracts offer additional financial incentives to Higher Education institutions? And, will HEPC (WVNET) permit other public entities to buy off of their contract? Page 2 of 5

What is the definition of Cluster servers? (AIX, Microsoft and Linux) 15. Under Hardware Products. What is the definition of Intel-processor based servers? (In relation to System x servers and BladeCenter) 16. Under Hardware Products. What is the definition of Linux servers? (System p, System i and System x and BladeCenter all run Linux) 17. Under Hardware Products. What is the definition of POWER processor-based servers? (In relation to System i and System p servers) 18. Under Hardware Products. What is the definition of AMD-processor based servers? (In relation to System x servers and BladeCenter) 19. Will HEPC (WVNET) make multiple awards as it has done in past procurements? ANSWER: HEPC reserves the right to make multiple awards. 20. Instead of doing an "IBM minus x%" arrangement, would your organization be willing to consider a "Vendor Cost plus x%" arrangement? This means we would agree to mark our cost up by a certain percentage across the board for any product you'd be purchasing. ANSWER: No, we prefer to have vendors offer (bid) the percent off the IBM s price identified on IBM s website. Page 3 of 5
