2 1 Introduction 1.1 Background This report has been prepared with respect to the proposed building at Farnell Avenue Carlingford as generally depicted in the plans prepared by A & N Design 1. The building comprises an early childhood centre on the upper level and storage on the lower level. 1.2 Compliance with the BCA The NSW Environmental Planning and Assessment Act requires that building work must comply with the Building Code of Australia 2015 (BCA), and that such work must not commence until a complying development certificate or construction certificate is issued for the work Compliance with the BCA can only be achieved by either complying with the deemed to satisfy provisions in the BCA, or by formulating an Alternative Solution which complies with the performance requirements or is at least equivalent to the deemed to satisfy provisions. Deemed to satisfy provisions are prescribed provisions in the BCA that satisfy the performance requirements in the BCA, whilst an Alternative Solution is an alternative method of complying with the BCA A reference to a Section, Part or clause number in this report is a reference to a deemed to satisfy provision in the BCA, except as otherwise noted. A reference to an Alternative Solution is a reference to an Alternative Solution as recognised by the BCA. 1.3 Purpose of this report The purpose of this report is to provide a general overview of the proposal in terms of compliance with the BCA, and an Alternative Solution for the proposed Type of fire resisting construction The report is suitable for submission with the application for the construction certificate for the proposed building. 1.4 Limitations This report is restricted as described in 1.3 of this report and does not include determining strict compliance with the BCA, compliance with Council s policies, or compliance with the Disability Discrimination Act. 1.5 The proposal The proposed building will be partially single and two storeys, with part of the single level Class 9b early childhood centre 2 being located over Class 7b storage to the lower level The early childhood centre will cater for forty (40) children each at least 5 years old. 1 2 Plans by A&N Design, being Pages 1 to 5, A22625 CC Issue B dated 31 March 2016 Early childhood centre as defined in the BCA means a preschool, kindergarten or child minding centre for the care or training of more than 5 children Farnell Ave Report 31 Mar 2016 Page 2 of 16

3 2 Fire Resistance 2.1 Fire Resistance and stability The proposed building would need to be constructed in Type B Fire Resisting Construction (Section C) due to the rise in storeys (2) where compliance with the DTS provisions was proposed To comply with the requirements for Type B construction the external walls would need to achieve a fire resistance level (FRL) and loadbearing internal walls would need to be concrete or masonry. The proposal is that no external walls to the early childhood centre will be fire resisting, and that no loadbearing walls to the early childhood centre will be concrete or masonry The Alternative Solution (in Section 6 of this report) will demonstrate that Type C construction is adequate, subject to the early childhood centre being fire separated from the storage by a floor achieving a FRL of 90/90/90, the walls and columns supporting this floor achieving a FRL of at least 90/90/90 and 90/ / respectively, and openings in the floor being protected (Part C3) to prevent the spread of fire The external walls to the early childhood centre would not need to achieve a FRL and loadbearing internal walls would not need to be concrete or masonry were the proposed building only required to be of Type C construction The early fire hazard indices for materials will comply (C1.10). Details demonstrating compliance should ideally be provided prior to the issue of the construction certificate, or in any event prior to installation. 2.2 Compartmentation and separation The proposed building will comply with the floor area and volume limitations (Part C2) applicable to a similar building of Type B and Type C construction The proposed building is not required to comply with the vertical separation protection requirements (C2.6) Separation of classifications in the same storey (C2.8) does not apply as the same classification applies to each storey, and separation of classifications in different storeys (C2.9) does not apply as the proposed building contains no Class 2, 3 or 4 part. 2.3 Protection of openings Openings in the external walls of the proposed building are more than 3 m from fire source features (e.g. side and rear boundaries) and are not required to be protected (C3.2) Any openings in the floor separating the early childhood centre from the storage will be protected to prevent the spread of fire (Part C3) as part of the Alternative Solution No other openings are required to be protected. 4 3 Access and egress general 3.1 Exits, travel distance and alternative exits The early childhood centre is served by a minimum 2 exits and the storage by one exit as required (D1.2) Travel to exits and the distance between alternative exits generally complies (D1.4 and D1.5 respectively). 3.2 Width of exits and paths of travel The exit stairs and paths of travel to exits will have a clear width of not less than 1 m measured clear of barriers, handrails and obstructions (D1.6) Doorways forming part of a required exit or in a path of travel to an exit will have a minimum clear unobstructed width of 750 mm (D1.6). 3.3 Construction of exits The exits serving the proposed building are not required to be fire isolated (D1.3) The exits discharge to open space as required and discharge to the public road via stairs and ramps that will comply (Section D) The suitability of the synthetic grass proposed to the ramp along the Southeast boundary will need to be addressed to ensure compliance (Section D) The doors to the single exit serving the storage area can swing against the direction of egress (D2.19), subject to the doors being fitted with an approved hold open device Notes on the plans and the specification require that barriers, handrails and window openings comply (D2.16, D2.17 and D2.24 respectively) has not been assessed. Compliance will include ensuring that barriers are of the correct height, gaps are within acceptable sizes, and that climbable zones are not included. Care will be taken where elements are located near, or form part of, the barrier. 3.4 Access for people with a disability The extent to which access for people with a disability complies is not addressed in this report (Part D3) The proposal is for access to be provided to the early childhood centre and to the storage area through the principal main entrance to each (Part D3) Accessible carparking spaces having minimum dimensions of 5.4 m x 2.4 m are allowed pursuant to AS/NZS where there is a shared area. The outdoor accessible carparking spaces will be designed to comply with AS/NZS , and bollards will be provided in the shared area in accordance with AS/NZS No lift is proposed as the early childhood centre and storage are accessed externally without the need for the two levels to be internally connected. The extent to which a lift may be required to address access for people with a disability has not been addressed in this report. Farnell Ave Report 31 Mar 2016 Page 4 of 16

5 3.4.5 The circulation spaces, doorways, and door/gate latches will need to comply. One of the multiple leaves to any doorways on each accessway will have a clear opening width of not less than 850 mm Required barriers, handrails and tactile surface indicators will be provided (Part D3). Handrails and grab rails will comply (Clauses 12 and 17 of AS respectively). The minimum unobstructed height of a continuous accessible path of travel will be 2 m, reducing to not less than mm only at doorways The proposed stairs and ramps will be designed to comply (Part D3) Any required letterboxes will be on a hard standing area connected to the accessible pathway Braille and tactile signage will comply (Specification D3.6) and will incorporate the international symbols as appropriate will identify each sanitary facility and all accessible entrances where an entrance is not accessible Tactile ground surface indicators will be provided: (a) (c) To stairways, and to ramps other than step or kerb ramps Where overhead obstructions are less than 2 m above the floor beneath Where an accessway meets a vehicular way All frameless or fully glazed doors, sidelights and any glazing on an accessway and capable of being mistaken for a doorway or opening will be clearly marked as required (AS ), except where there is a chair rail, handrail or transom that provides the required visual marking Details demonstrating compliance with Part D3 should ideally be provided prior to the issue of the construction certificate Hearing augmentation (D3.7) will be provided where an inbuilt amplification system, other than one used only for emergency warning, is installed. 6 4 Services and equipment 4.1 Sprinklers, hydrants, hose reels and extinguishers The proposed building is not required to be served by sprinklers (E1.5) The proposed building is required to be served by hydrants as the total floor area is more than 500 m² (E1.3). The proposal is to rely on existing and/or new external hydrants located at least 10 m from the proposed building to ensure compliance (E1.3). Details demonstrating compliance should ideally be provided prior to the issue of the construction certificate The storage and early childhood centre are each considered a separate fire compartment 3. Hose reels are not required to serve the proposed building as no fire compartment has a floor more than 500 m² (E1.4) The proposed building will be provided with portable fire extinguishers (E1.6 and AS ). 4.2 Smoke Hazard Management and lifts The proposed building is not required to be served by a smoke hazard management system As stated in of this report, no lift is proposed as the early childhood centre and storage are accessed externally without the need for the two levels to be internally connected. The extent to which a lift may be required to address access for people with a disability has not been addressed in this report. 4.3 Exit signs, emergency lighting, and sound and intercom systems The proposed building will be provided with exit signs and emergency lighting as required (Part E4 and AS ) A sound system and intercom system for emergency purposes is not required or proposed (E4.9). 4.4 Fire safety schedule I provide a proposed fire safety schedule in Table 1 of this report, being a schedule containing the proposed fire safety measures, and the minimum standard of performance for each measure The standard of performance will be as specified in the version of the BCA in force when the application for the relevant construction certificate is lodged. 3 A fire compartment as recognised by the BCA means a part of a building separated from the remainder by walls and/or floors each having an FRL not less than that required for a fire wall for that type of construction and where all openings in the separating construction are protected in accordance with the Deemed to Satisfy Provisions of the relevant Part Farnell Ave Report 31 Mar 2016 Page 6 of 16

8 5 Health, amenity and energy efficiency 5.1 Damp and weatherproofing The proposal if for damp and weatherproofing to comply (Section F), including: (a) (c) (d) (e) (f) Stormwater drainage (F1.1) and external above ground membranes (F1.4); Roof coverings (F1.5) and sarking (F1.6); Waterproofing of wet areas (F1.7) and damp proofing (F1.9 and F1.10); Provision of floor wastes (F1.11); Sub floor ventilation (F1.12); and Glazed assemblies (F1.13) Details demonstrating compliance should ideally be provided prior to the issue of the construction certificate, or in any event prior to installation. 5.2 Room heights, and sanitary/other facilities The minimum internal height of 2.5 m proposed in the early childhood centre complies (Section F) as not more than 100 persons will be accommodated The minimum internal height of 2.5 m proposed in the storage complies Sufficient sanitary facilities as required (F2.3) will be provided for the forty (40) children (each at least 5 years old), and for staff and visitors Accessible facilities (F2.4) will be provided, and the adjoining sanitary facility will be designed to ensure it is suitable for a person with an ambulant disability (AS ) Construction of sanitary compartments, urinals and washbasins will comply (F2.5 and F2.6 respectively). 5.3 Sound transmission, energy efficiency, light and ventilation The sound transmission and insulation requirements (Part F5) do not apply The energy efficiency provisions have not been assessed in this report and the proposal is to comply (Section J) Natural and artificial light complying will be provided to the storage (Part F4). Natural light (F4.1) will be provided to all playrooms or the like for the use of children (in the early childhood centre). Natural and artificial light (Part F4) will be provided as required to the other areas in the early childhood centre The intent of the requirement (F4.2) for the sills of 50% of the windows 6 in the children's rooms (in the early childhood centre) to be located not more than 500 mm above the floor level has been satisfied, as windows located at floor level comply Ventilation will be provided as required to the proposed building (Part F4). 6 Window as defined in the BCA includes a roof light, glass panel, glass block or brick, glass louvre, glazed sash, glazed door, or other device which transmits natural light directly from outside a building to the room concerned when in the closed position. 9 6 Alternative Solution 6.1 Compliance with the BCA Demonstrating that the Type of fire resisting construction complies with the BCA can be achieved by developing an Alternative Solution to demonstrate that the fire resisting construction will comply with the relevant performance requirements in the BCA without the need to require that the proposed building is Type B construction A0.5 of the BCA states that compliance with the Performance Requirements can only be achieved by: (a) (c) complying with the DTS provisions; or formulating an Alternative Solution which complies with the Performance Requirements or is shown to be at least equivalent to the DTS provisions or a combination of (a) and The BCA states that an Alternative Solution must be assessed according to one or more of the Assessment Methods in A0.9. The BCA states that the Alternative Solution will only comply with the BCA if the Assessment Methods used to determine compliance with the Performance Requirements have been satisfied A0.9 of the BCA states that the following Assessment Methods, or any combination of them, can be used to determine that a Building Solution complies with the Performance Requirements: (a) (c) (d) Evidence to support that the use of a material, form of construction or design meets a Performance Requirement or a deemed to satisfy provision as described in A2.2 Verification Methods in the BCA or such other Verification Methods as the appropriate authority accepts for determining compliance with the Performance Requirements Comparison with the DTS provisions Expert Judgement This report will rely on comparison with the DTS provisions and expert judgement to demonstrate that the Alternative Solution is at least equivalent to the relevant DTS provisions for a low rise building of Type C construction that is fire separated into multiple fire compartments The Alternative Solution will demonstrate that the proposed building will comply with the relevant performance requirements for fire resisting construction without the need to comply with the external and loadbearing wall requirements for Type B construction that would otherwise apply. 10 6.2 Relevant provisions Pursuant to A0.10 (a) the relevant DTS provisions are C1.1 and Table C C1.1 (Type of construction required) in part requires that: (a) The minimum Type of fire resisting construction of a building must be that specified in Table C1.1 and Specification C Table C1.1 requires that a Class 9b building having a rise in storeys of two (2) must be in Type B fire resisting construction. The proposed building has a rise in storeys of two (2) Pursuant to A0.10 the performance requirements directly relevant to C1.1 and Table C1.1 are CP1 and CP CP1: CP1 A building must have elements which will, to the degree necessary, maintain structural stability during a fire appropriate to (a) (c) (d) (e) (f) (g) (h) (i) (j) (k) CP2: the function or use of the building; and the fire load; and the potential fire intensity; and the fire hazard; and the height of the building; and its proximity to other property; and any active fire safety systems installed in the building; and the size of any fire compartment; and fire brigade intervention; and other elements they support; and the evacuation time. (a) A building must have elements which will, to the degree necessary, avoid the spread of fire (i) (ii) to exits; and to sole occupancy units and public corridors; and (iii) (iv) Application: CP2(a)(ii) only applies to a Class 2 or 3 building or Class 4 part of a building. between buildings; and in a building. Figure 1 (Section showing fire separation) One of the requirements for Type B construction is that the total floor area and volume of the proposed building is limited to between m² m² and m³ m³ respectively (Table C2.2 7 ). The total floor area and volume of each fire compartment will be less than 500 m² and m³, which is less than the maximum allowed for Type C construction m²/ m³ (Class 7b) and m²/ m³ (Class 9b), with the actual limitations determined based on the percentage of floor area and volume for each class m² and m³ for a Class 9b of Type C construction Farnell Ave Report 31 Mar 2016 Page 11 of 16

12 6.3.4 The fire separation of the early childhood centre from the storage (as shown in Figure 1 of this report) is superior to the fire resisting floor required were the proposed building required to comply with Type B and Type C construction 9. The walls and columns supporting this floor will also achieve a minimum FRL of 90/90/90 or 90/ / respectively It is my opinion that the proposed fire separation (as shown in Figure 1 of this report) creates two separate fire compartments (C2.7) such that a fire in the storage will not impact on the fire resistance of, or egress from, the early childhood centre It is my opinion that fire separation and egress from upper levels are the key considerations in the requirement for a Class 9b early childhood centre having a rise in storeys of two (2) to be Type B construction. I rely on the simple section through Building 1, Building 2 and the proposed building as shown in Figure 2 of this report to support my opinion. Class 2/3/9c Legend: Egress to open space Minimal fire resistance 90/90/ Building 1 (in Figure 2 of this report) is only required to be Type C construction as the lowest storey is not counted in the rise in storeys, and egress is directly to open space Building 2 is only required to be Type C construction (concession in C1.5) as it is served by an enhanced egress system consistent with but less safe than the egress system for the proposed building. 9 The floor separating storeys in Building 1 and 2 need only be lined on the underside with a fireprotective covering (clause 4.1 in Specification C1.1), including beams incorporated in it, if the floor is combustible or of metal Farnell Ave Report 31 Mar 2016 Page 12 of 16

13 6.3.9 It is my opinion that the fire resistance of the proposed building (as depicted in Figure 2 of this report) is superior to that for Building 1 and 2, as the early childhood centre is fire separated from the storage by construction achieving a FRL of at least 90/90/90, with all openings in the floor being protected to prevent the spread of fire (Part C3) The fire resistance of Building 1 and Building 2 (Type C construction) as shown in Figure 2 of this report satisfies CP1 and CP2 to the degree necessary even though the fire separation between storeys is minimal, and there is no requirement for vertical separation (C2.6) Travel distance to an exit serving the early childhood centre is allowed to be 40 m (D1.4) as at least two exits will serve the early childhood centre. The proposed egress system is excellent as multiple exits are proposed around the early childhood centre, and the actual travel distance to a single exit serving the early childhood centre is less than 20 m It is my opinion that egress from the early childhood centre in the proposed building is superior to the egress from the topmost storey of Building 1, as the early childhood centre is fire separated from the storey below by construction achieving a FRL of at least 90/90/90, and the maximum travel distance of less than 20 m is safer than the maximum 40 m allowed (D1.4) It is my opinion that egress from the early childhood centre in the proposed building is superior to the egress from the topmost storey of Building 2, as the early childhood centre is fire separated from the storey below by construction achieving a FRL of at least 90/90/90, egress is directly to open space and does not involve traveling down stairs, and the maximum travel distance of less than 20 m is safer than the maximum 40 m allowed (D1.4) Pursuant to A0.5 of the BCA compliance with the Performance Requirements can only be achieved by: (a) (c) complying with the DTS provisions; or formulating an Alternative Solution which: (i) (ii) complies with the Performance Requirements; or is shown to be at least equivalent to the DTS provisions; or a combination of (a) and It is my opinion that the fire resistance of the proposed building is consistent with the intent of Type B construction (which is based on the risk associated with the rise in storeys of a building and the egress system from the upper level), superior to Type C construction, and in any event superior to the fire resistance of Building 1 and The fire resistance of and egress from the early childhood centre will not be affected by a fire in the storage, as the proposed building will withstand the burnout of the storage in the event of fire, and egress from the early childhood centre is not reliant on egressing through the storage. 14 Where the proposed building is considered consistent with a building of Type C construction there is no requirement for the external walls to the early childhood centre to achieve a FRL, or for the loadbearing walls and columns to the early childhood centre to be concrete or masonry The early childhood centre is at least equivalent to a single storey building of Type C construction having a rise in storeys of one (1), and it is my opinion that the proposal to allow the proposed building to be Type C construction will comply with CP1 and CP2 to the degree necessary, subject to: (a) The floor separating the storeys achieving a FRL of not less than 90/90/90; Openings in the separating floor being protected to prevent fire spread (Part C3); (c) Walls supporting the separating floor achieving a FRL of not less than 90/90/90; and (d) Columns supporting the separating floor achieving a FRL of not less than 90/ /. 15 7 Conclusion This report has been prepared with respect to the proposed early child hood centre and storage at Farnell Avenue, Carlingford The purpose of this report is to provide a general overview of the proposal in terms of compliance with the BCA, and an Alternative Solution for the proposed Type of fire resisting construction The report is suitable for submission with the application for the construction certificate for the proposed building The report demonstrates that the proposal is capable of complying with the BCA, that some technical BCA matters will need to be addressed at the construction certificate stage, and that the proposal to allow the proposed building to be Type C construction will comply with CP1 and CP2 to the degree necessary, subject to: (a) The floor separating the storeys achieving a FRL of not less than 90/90/90; Openings in the separating floor being protected to prevent fire spread (Part C3); (c) Walls supporting the separating floor achieving a FRL of not less than 90/90/90; and (d) Columns supporting the separating floor achieving a FRL of not less than 90/ /. 16 8 Appendix A (About Michael Wynn Jones) After 13 years as a Local Government Building Surveyor Michael established a Building Regulations consulting company and became a permanent part time academic at Western Sydney University Over the next 15 years he helped develop, lectured in, and was eventually the Head of Program for, separate Post Graduate courses in Building Surveying, Fire Engineering and bushfire prone areas. He has delivered Building Regulations courses through the UTS Centre for Local Government for over 20 years, and is a former conjoint Professor at the University of Newcastle In addition to his academic pursuits Michael has personally provided consulting and education services for over 20 years to the private sector and over a dozen Councils through Michael Wynn Jones and Associates. This includes working as a Building Regulations expert and consultant rather than as a certifier Michael has also worked as a consultant to the NSW Department of Planning on various projects associated with the built environment, including the Commercial Complying Development Code and the Federal Premises Standards, and assisted the Department with the introduction of private certification in He is a co author of one of the original accreditation schemes recognised by the State Government for private certifiers, is accredited at the highest level as a private certifier, and assisted the Department on the 2013 White Paper A new planning system for NSW Michael is actively involved with several State Government committees and professional bodies that deal with certification of building work, and the impact of Building and Planning legislation on the built environment Michael s relevant qualifications, accreditations and details are as follows: (a) M App Sc.
