1 COMPETETIVE SEALED PROPOSALS (CSP) TO DESIGN, PROCURE AND INSTALL PLAYGROUND EQUIPMENT AND FALL ZONE MATERIAL AT BOYD, LAFRAY, MARILYN, AND SACAJAWEA PARKS Project # 09-10hb645pg The City of Missoula (City) is requesting proposals to design provide and install playground equipment and fall zone material in connection with four existing parks, City project No. PR HB645PG. The project is enabled through HB 645 Treasure State Endowment Program Grants for Four Playgrounds. The City will select one (1) to four (4) Supplier(s) to provide equipment, materials and labor for the parks as outlined in this request. SCOPE OF PROJECT This project consists of the design, procurement and installation of one (1) playground system including fall zone material at each of the following parks: Boyd Park, Lafray Park, Marilyn Park and Sacajawea Parks in Missoula, Montana. Work is to include the design of a play system within the constructed play area boundaries at each park per the exhibits, the provision and installation of said play system as well as the installation of commercial grade playground equipment at Boyd, Marilyn and Sacajawea Parks including all necessary equipment footings, drainage materials, landing mats, and fall zone material. Supplier shall connect to existing 4 schedule 40 PVC drainage system located at edge of Playground in each of three parks. Supplier shall provide geotextile separation fabric under engineered wood fiber fall zone material. Work shall not include installation of said play system at Lafray Park but Supplier shall provide an on-site oversight manager for the installation and certification of installation for this system. All materials including fall zone material and concrete footings for Lafray Park shall be provided Supplier. Supplier should be aware that ancillary infrastructure (sidewalks, edging, landscaping, etc.) for Boyd, Marilyn and Sacajawea Parks are out for bidding to general contractors and it is to be expected that this work will be complete by June 1, 2010 upon which time installation of play systems can occur. The playground infrastructure area for Lafray Park has already been completed and playground system can be completed as soon as supplier is selected and materials delivered. Two add alternates are included for Lafray in these ancillary infrastructure construction packages that include a pavilion and portable restroom shelter. These items are NOT considered part of this CSP but rather noted for information purposes. Playground Suppliers shall provide a maximum of (1) one design per Supplier for Boyd, Marilyn and Sacajawea Parks and two (2) designs per supplier for Lafray Park (See Detailed request under Design Element Guidelines & Playsystems Specifications) represented for the parks playgrounds. Suppliers may submit on any or all of the four specific Parks. The City of Missoula requires Suppliers to design a play system that meets or exceeds all current federal CPSC, ASTM, IPEMA standards and ADA requirements. The proposals shall include the costs of delivered play systems as designed, inclusive of the equipment structures, components,

Railroad Ave., Ste. 104 Missoula, Montana (cell) The City of Missoula shall be exempt from any liability for costs incurred by unsuccessful Suppliers in preparation of the proposals. DESIGN ELEMENT GUIDELINES & PLAY SYSTEM SPECIFICATIONS Suppliers should base their playground equipment designs on meeting all accessibility and safety standards as well as the guidelines & specifications listed in this CSP. Quality of equipment components, quality of design, play value, handicapped accessibility inclusiveness, cost, and appropriateness to location and target demographic must be taken into consideration in the design of the play system. The total dollar amount allocated for play system, installation and engineered wood fiber to Boyd, Sacajawea and Marilyn Parks is $50, The total dollar amount allocated to LaFray Park play system and engineered wood fiber is $50, (NOTE: Lafray Park installation by volunteers. Supplier provides oversight coordination) Any proposal varying more than $3, from the budgeted amount in either direction will be rejected. Required Items: 1. All play system elements must meet and/or exceed all federal, CPSC, ASTM & IPEMA guidelines. 2. Play system must include engineered wood fiber fall zone material to required minimum depth over play area with subsurface drainage system, drainage fabric and all concrete footings installed per all federal standards. Note that curbing, grading, and drainage sumps currently exist for the play system at Lafray and will be in place at Boyd, Sacajawea and Marilyn Parks prior to playground installation. 3. Play system must include landing pads for all equipment as appropriate. The following is a list of desired play system items in Priority Order for Each Park Boyd Park: Play System Features in Priority Order: 1. Provide a minimum of one structure designed for ages 5 to Sand Diggers 3. Provide one swing set which shall have minimum 2 swings for toddlers. 4. Other desired elements include: stand-alone spinner element, transfer tubes, stand-alone climbers, overhead slide track and slides, musical & sensory play elements. Citizen s comments for this park have been encouraging accessibility and a desire to integrate nature into the play experience. Marilyn Park: Play System Features in Priority Order:

3 1. Provide a minimum of one large multi-level platform structure 5 to Sand diggers 3. Provide one swing set which shall have minimum 2 swings for toddlers. 4. Other desired elements include: stand-alone spinner element, zip line, stand-alone climbers, spring toys, slide(s), and musical and sensory play elements. Suppliers are encouraged to consider the design, style and color system of the existing spray deck features at the park. Sacajawea Park: Play System Features in Priority Order: 1. Provide a minimum of one structure designed for ages 2 to Provide a minimum of one structure designed for ages 5 to Sand Diggers 4. Provide one swing set which shall have minimum 2 swings for toddlers. 5. Other desired elements include: stand-alone spinner element, slide(s), zip line and spring toys and sensory play elements. The following topics were discussed at a neighborhood workshop and respondents to the CSP are encouraged to take these comments into account when proposing features for Sacajawea Park: Programming Park is used by diverse groups with different needs. o access to Orange Street and restaurant o place to have lunch o throughway to high school Play counters to work at. The park should not look like a fort. Muted (neutral, subdued) colors Park amenities o swings for all ages o diggers o slides o Perceived (by children) hiding places -2 kid/toddler Keep the additions low key, it is a small neighborhood park Typical age/user group younger kids & adults Lafray Park: Play System Features in Priority Order for first design: 1. Provide a minimum of one large, comprehensive structure designed for ages 5 to 12. This structure should have at least 1 or 2 'gathering areas' for imaginative play. 2. Provide a minimum of one structure designed for ages 2 to Provide one swing set which shall have a minimum of 2 swings for toddlers and 2 regular swings. Lafray Park: Play System Features in Priority Order for Second design: 1. Provide a minimum of one large, comprehensive structure designed for ages 5 to 12. This structure should have at least 1 or 2 'gathering areas' for imaginative play. 2. Provide a minimum of one structure designed for ages 2 to Provide one swing set which shall have a minimum of 2 swings for toddlers and 2 regular swings. 4. Other desired elements include: fitness equipment which can be utilized by adults as well, stand-alone spinner element, climber style equipment to get into large comprehensive structure, see-saw style equipment, balance / spring toys, and sensory play elements.

4 5. Basket Ball Hoop to be installed by others at adjacent asphalt play pad. The focus of this play area is on imaginative play and physical exercise for both children and adults. The following topics were discussed at a neighborhood workshop and respondents to the CSP are encouraged to take these comments into account when proposing features for Lafray Park : Equipment o The number one request is for a variety of integrated equipment which addresses many unique abilities and age levels. o Some of the required elements include: swings, slides, climbing entrances and a 'gathering area'. o There should be a sense of adventure to the play equipment. o The park should be unique to Missoula. o The park should be fun to play on and also fun to look at. o The park should have a unique, contemporary climbing structure. o The parks apparatus should entertain all ages. o Use kid colors for equipment with a maximum of 3 different colors. o Include a swinging (suspended) balance beam. o Have a zip line. Concerns o Maintain open-views, no tunnels or walled off areas. 'Gathering areas' should not be completely walled off. Visibility in and out of the structure is requested. o Create a space able to be supervised. o Install workout stations for adults so they can exercise and watch the children at the same time. Preferred Play System Qualities: 1. All play system elements must demonstrate the highest level of durability in materials and finishes selected in consideration of child health and safety. 2. "Green" construction practices and materials are highly desired. Provide LEED or other green certification with the proposal. Montana, or at least regional,manufactured or supplied materials are encouraged. 3. Structures and elements should be unique to each park. If supplying designs for more than one park, suppliers are encouraged to submit different designs based on criteria noted. 4. Structures should provide a variety of built-in activities. 5. Play systems should have elements that are designed to encourage open-ended, imaginative, and social play. As this project is funded through Montana House Bill 645, use of local unemployed or under employed labor is desirable. In each proposal for each park submittal, provide a list of the designed components being proposed for that Park s play system as well as a time frame for product delivery once notified of award. Include structure and component model numbers, materials, color choices and recommendations, protective area requirements, target age ranges and developmental levels, target play type or activity, number of children play systems support, estimated lifetime of equipment including manufacturers warrantee and any other relevant descriptive information. Play system design shall safely fit in the playground area as shown on the site plans (Attachment A). Suppliers are encouraged to be creative in their designs and to maximize the role of

5 unstructured play in their proposals. Suppliers are encouraged to take accessibility into account in their designs. Inclusive play environments will be scored higher. Suppliers may submit proposals from non-traditional type playground structures, if desired, in whole or as components of any overall playground. ASSEMBLY/INSTALLATION AND INSPECTION The play system assembly and installation for Boyd, Marilyn and Sacajawea Parks will be provided and managed by the Supplier. The Supplier must supply direct supervision from manufacturer or supply qualified and certified representative familiar with playground installation. All tools and equipment required to install play equipment shall be provided by the Supplier for these parks. The Supplier will be given seventy five (75) calendar days to complete the proposed work including product delivery. Calendar days will begin as outlined in the Notice to Proceed. The Supplier will certify installation is in accordance with all manufacturers requirements including, but not limited to warranty and fall zone requirements. The play system assembly and installation for Lafray Park will be provided by volunteers for the City Parks and Recreation Department. The Supplier must supply direct supervision from manufacturer or supply qualified and certified representative familiar with playground installation. The Supplier shall notify City of tools and equipment required to install play equipment which will be provided by the City Volunteers for Lafray Park. The installation shall occur at mutually agreed upon time and is generally anticipated to occur during a four day period of Friday-Monday. The Supplier will certify installation is in accordance with all manufacturers requirements including, but not limited to warranty and fall zone requirements. A representative of the Supplier is required to conduct a post installation inspection of all equipment upon completion to insure the proper installation of the equipment. If not properly installed, modifications must be submitted in writing to the City and remedied immediately. Co-inspection with the Supplier's representative of assembly and installation work will be conducted by the City following installation. The City will supply the punch list for final completion generated by this coinspection. The Supplier shall submit to the City the manufacturer's certification of compliance and warranty following punch list completion. Warranty: Upon completion of installation, the Supplier must provide documentation attesting the equipment has been installed meeting all specifications thereby warranted by manufacturer. Additionally, it is the Supplier's responsibility to provide to the City the manufacturer's warranty of installed equipment. COMPLIANCE All equipment must meet and/or exceed all federal, CPSC, ASTM & IPEMA guidelines. Documentation of compliance must be provided to the City with the Supplier's proposal. All equipment must comply with Americans with Disabilities Act (ADA). The designs submitted by the Supplier must incorporate either a transfer platform or ramp in each design when necessary. In accordance with MCA , Nondiscrimination Provision in All Public Contracts and the city of Missoula s affirmative action plan, the Supplier will ensure that hiring is made on the basis of merit and qualifications and that there will be no discrimination in employment on the basis race, ancestry, color, handicap, religion, national origin, sex, age, marital status, creed, ex-offender status, physical condition, political belief, public assistance status or sexual preference except

6 where these criteria are reasonable, bona fide occupational qualifications. The Supplier and any persons doing work on this project will be required to obtain registration with the Montana Department of Labor and Industry (DLI) except as listed in MCA Information on registration can be obtained from the Department of Labor and Industry by calling The Supplier is required to have registered with the DLI prior to submitting a proposal on this project. ( Bid Only registration is available for out-of-state Suppliers.) All laborers and mechanics employed by Supplier in performance of this construction work shall be paid wages at rates as may be required by law. The Supplier shall utilize the Montana Davis-Bacon Wage Rates for Heavy Construction effective to the most recent date posted prior to bidding. Highway Construction wage rates will not apply to this project. The Supplier must provide an original Certificate of Product Liability Insurance with City named as certificate holder for a minimum of $10,000,000 coverage. PROPOSAL SUBMITTAL AND CONTENT Sealed proposals must be submitted to Missoula City Clerk's Office by 5:00 pm MST, March 30, 2010 and must be addressed as follows: Proposal for City Project # PR HB645PG. Playgrounds 4 Missoula Attn: Marty Rehbein, City Clerk City Clerk's Office 435 Ryman St. Missoula, MT PROPOSAL FORMAT Proposals shall be submitted in the following format: Supplier Name Park Name Statement that product meets CPSC, ASTM and IPEMA Guidelines Products Proposed-Description, photos, model numbers etc. Designs showing fall zones within play areas Design Analysis and color samples including Green materials, ISO certificate, LEED etc. Warrantee and insurance capabilities Any additional information relating to scoring criteria as listed below References Statement of understanding of Davis-Bacon and non discrimination requirement Cost Proposal product delivery schedule Proposals must include complete drawings for each design, specifications and pictures for each component in designs and colors available. Proposals must include a bid price for each design presented. Bids must list the cost of the equipment, fall zone material and labor separately. The City reserves the right to reject any and all proposals with or without cause, and to accept proposals which it considers most favorable. Proposals should include minimum of two references of installations similar to that proposed for Missoula. References shall include name of project, location, contact information including phone number and general cost of installation.

7 All delivery, assembly, installation and supervision costs must be included in the proposal. Payment for equipment and materials will be sent within sixty (60) days after delivery and assembly/installation and invoicing of the play system. All proposal amounts shall be guaranteed for not less than sixty (60) days after the proposal submittal deadline date. Each proposal must be accompanied by a Certified Check, Cashier s Check, or Bid Bond payable to the City of Missoula, Montana, in an amount not less than ten percent (10%) of the total bid amount. The successful Supplier shall furnish approved Performance and Payment Bonds, each in the amount of one hundred percent (100%) of the bid amount. Workmen s Compensation, Comprehensive General Liability, and Transportation insurance and insurance certificates shall be provided by the successful Supplier. Successful Suppliers are required to comply with City of Missoula Business Licensing requirements. No proposal may be withdrawn within a period of sixty (60) days after the bid opening date. Prices shall include delivery f.o.b., freight paid by the bidder to the jobsite. The Supplier must submit Two (2) hard copies and one (1) electronic copy, on a CD, of the proposal to the address listed above. Electronic copies must be organized the same as the hard copies for ease of review. All Proposals must comply with the specifications and guidelines provided in this document. This solicitation is being offered in accordance with state statutes governing procurement and with MCA Ch Part 3 and relevant ARM. Accordingly, the City of Missoula reserves the right to negotiate an agreement based on fair and reasonable compensation for the scope of work and services proposed, as well as the right to reject any and all responses deemed unqualified, unsatisfactory or inappropriate at the sole discretion of the City of Missoula. Warranty coverage Quality of design, uniqueness, creativity, theme of play system and target demographic "Green" materials/construction, ISO Certification, LEED, etc Use of unemployed or underemployed labor force, use of local

8 materials and/or labor Overall quality of proposal & references 0-10 Maximum Points: 100 Following the review and evaluation of all CSP submittals, a Selection Meeting will be held at 3pm on April 9, 2010, in the Parks & Recreation Conference Room at 600 Cregg Lane, Missoula MT, This meeting will be open to the public. The selection committee will present their ranking, selection and justification at the selection meeting. The selection meeting will result in the selection of one proposed design for each park or an appropriate short list of proposals. An interview may also be requested to aid in the selection of Supplier(s). The award will be made to qualified Supplier(s) whose proposal is deemed most advantageous to the City, all factors considered. Unsuccessful Suppliers will be notified in writing as soon as possible.
