RECORDS REVIEW RESULTS As stated in Section 3, the wind turbines are located entirely within the Township of Melancthon, approximately 14 kilometres from the Town of Shelburne and 30 kilometres from the Town of Orangeville, summarized as part of the Great Lakes Conservation Blueprint for Aquatic Biodiversity (Phair et al., 2005). The project location falls within the Nottawasaga Tertiary Watershed 2ED and Upper Grand Tertiary Watershed 2GA. The Nottawasaga Tertiary Watershed lies between the Nottawasaga Bay and Severn Sound and drains into the south end of Georgian Bay, Lake Huron. Approximately 8% of the watershed are protected and conservation lands, half of which are provincially significant life science ANSIs. The dominant land use is agriculture with small areas of pasture, developed land and coniferous plantation forest. Approximately 88% of the watershed is made up of stream systems, 3% of coastal systems and less than 1% is comprised of lake systems (Phair et al., 2005). The Upper Grand watershed drains into northern Lake Erie and includes the Nith, Conestogo and Grand Rivers. The majority of the watershed is agriculture. Large areas of developed land around major urban centres are present. Remaining cover is dominated by dense deciduous forest along with mixed forest, deciduous swamp and coniferous swamp. Approximately 92% of the watershed is made up of stream systems with less than 1% comprised of lake systems (Phair et al., 2005). 5.1 Water Bodies Based on our review and analysis of the records and resources outlined in Table 1, in accordance with Ontario Regulation 359/09, determinations were made whether the project location is in a water body or within 120 metres of the average annual high water mark of a water body (see Figures 3a through 3d). All mapping used for the Records Review is based on agency data (see Appendix B) and is not necessarily reflective of site conditions. Page 14

10 Dufferin Wind Power Inc Average Annual High Water Mark Determination For the purposes of this REA reporting, the average annual high water mark for streams means the usual or average level to which a body of water rises at its highest point and remains for sufficient time so as to change the characteristics of the land. In flowing waters, this refers to the active channel/bankfull level which is often the one-to two-year flood flow return level (MOE 2011) Lakes A search and analysis of the records and resources outlined in Table 1 did not identify any named lakes, as defined by Ontario Regulation 359/09, in the project location or within the surrounding 120 metres Lake Trout Lake As discussed above, a search and analysis of the records and resources outlined in Table 1 did not identify any Lake Trout lakes under management by the Ministry of Natural Resources (MNR), in the project location or within the surrounding 120 metres Permanent and/or Intermittent Streams Multiple streams cross or fall within 120 metres of a project component. These streams are tributaries of the Nottawasaga River and the Grand River, many of which have been delineated as agricultural drains. These stream crossings are discussed in Table 2 and shown on Figures 3a through 3d. Photographs of stream crossings can be found in Appendix C. Page 19

14 Dufferin Wind Power Inc Seepage Areas A search and analysis of the records and resources outlined in Table 1 did not identify any seepage areas, as defined by Ontario Regulation 359/09, in the project location or within the surrounding 120 metres. 5.2 Aquatic Species at Risk Species at Risk listed under the federal Species at Risk Act and provincial Endangered Species Act, 2007, with the potential to interact with the project location and/or adjacent lands are being considered in consultation with the appropriate agency. Reporting related to the protection of Species at Risk will be provided to the appropriate agency under separate cover as required. This reporting format meets the requirements as set out in Ontario Regulation 359/09, and is consistent with the direction provided by the MNR and the MOE. 5.3 Provincial Plan Areas Under Ontario Regulation 359/09, if any part of the project location falls within a provincial plan area the project may be subject to different criterion to evaluate the applicable water bodies. In addition, should development occur within the prescribed setback area of a water body, it may be subject to a different set of prohibitions under Ontario Regulation 359/09. Table 3 outlines the provincial plan areas that should be considered when planning a renewable energy project and identifies which, if any, are applicable to the project location. 15 Dufferin Wind Power Inc. 5.4 Regulated Areas Under the Conservation Authorities Act, NVCA and GRCA are responsible for the application and enforcement of the Regulation of Development, Interference with Wetlands and Alterations to Shoreline and Watercourses that was approved and then filed on May 4, 2006, (Ontario Regulation 172/06 for NVCA and Ontario Regulation 150/06 GRCA). Regulated Areas are lands in proximity to hazardous lands, wetlands and areas susceptible to flooding. Development within these Regulated Areas may require a permit. Regulated Areas within the project location and adjacent lands relating to watercourses and wetlands will be addressed under additional permitting or approval requirements from the GRCA and NVCA. 5.5 Baseline Information Water Quality and Quantity Nottawasaga Valley No information specific to the project location and surrounding 120 metres was available from MOE Provincial Water Quality Monitoring Network (MOE accessed February 2012). Provincial water quality monitoring sites within the Nottawasaga Valley are located well outside of the project location, east of the County of Dufferin boundary (South Georgian Bay-Lake Simcoe Source Protection Committee, 2011). No stream flow information is available for the specific water features outlined in Table 2. Stream health within the Nottawasaga Valley is strongly linked to the surrounding land uses and physical geography. Water crossings fall within four Nottawasaga subwatersheds. Overall water quality grading within these subwatersheds was given a final grade of A (Upper Nottawasaga) or B (Mad, Pine and Boyne; South Georgian Bay-Lake Simcoe Source Protection Committee, 2011). 16 Dufferin Wind Power Inc Grand River Watershed No information specific to the project location and surrounding 120 metres was available from the MOE Provincial Water Quality Monitoring Network (MOE accessed February 2012). Provincial water quality monitoring sites within the Grand River Watershed are located well outside of the project location; one near Eugenia Lake and another west of Orangeville along tributaries of the Upper Grand (Lake Erie Region Source Protection Committee, 2011). Flow regimes in this watershed consist of high spring flows and low summer flows which are influenced by the Luther Marsh reservoir. Stream health within the Upper Grand River is generally fair to good. Most of this area drains agricultural lands; however, the intensity of production tends to be less than other areas of the Grand River watershed (Lake Erie Region Source Protection Committee, 2011) Source Protection Areas Nottawasaga Valley After reviewing the Nottawasaga Valley Source Protection Area Assessment Report (2011), it was determined 91% of the population relies on groundwater as a source of drinking water through the municipality or private wells. The project location and setback area at water crossings 23 through 28 and 49 fall within Well Head Protection Area Zone D: Steady State Zone for the Town of Shelburne Well Supply. Crossings 29 and 30 also convey flow from lands with this designation. The project location and setback area at water crossing 44 falls within Well Head Protection Area Zone D: Secondary Protection Zone for Cardinal Woods Wells. Most of the project location and setback areas within the Nottawasaga Valley have been delineated as Highly Vulnerable Aquifers. These areas are particularly susceptible to contamination because of their location near the ground s surface or because of the type of materials found in the ground around it. Significant Groundwater Recharge Areas are concentrated around Shelburne but are sparsely located throughout most of the project location and setback areas. Mapping of these source protection area features can be found in Appendix A2. Page 24
17 Dufferin Wind Power Inc Grand River Watershed After reviewing the Grand River Source Protection Area Assessment Report (2011), it was determined approximately 82% of the Grand River watershed relies on groundwater as a source of drinking water. None of the water crossings within the Upper Grand fall within a Well Head Protection Area. Water crossings north of Shelburne are located within high or medium aquifer vulnerability areas compared to crossings south of Shelburne located within low aquifer vulnerability areas. A highly vulnerable aquifer is located in the area of the private easement along the 230 kv Line and in the area of Turbines 42, 43 and 45. Northern tributaries of the Upper Grand River have been identified within a large Significant Groundwater Recharge Area. South of Shelburne these areas are sparsely located around the project location s 230 kv Line and have low vulnerability. Mapping of these source protection area features can be found in Appendix A Summary of Records Review This report is intended to fulfill the requirements for the water assessment records review under Ontario Regulation 359/09. Table 4 summarizes the determinations made during this records review. All mapped water bodies within the project location and surrounding 120 metres are outlined on Figure 3a through 3d. Page 25
