3 Introduction Purpose of the Executive Summary This document is an Executive Summary of the multi-volume Environmental Assessment (EA) report for the Danang Priority Infrastructure Investment Project (PIIP). The Executive Summary has been prepared to meet requirements of both the Government of Vietnam (GoV) and the World Bank as part of the project preparation process. Resettlement issues are addressed separately in a Resettlement Policy Framework and Resettlement Action Plans. Project background Danang is the centre of politics, economy, and culture in Central Vietnam and an important gateway to the sea for the central highland areas as well as for Laos, Cambodia, and Thailand. It has a total area of 1, km 2 and by the end of 2005, had a population of 781,023 residents. The city faces challenges in ensuring productive employment and basic services for new residents (both migrants and internal population growth); dealing with a legacy of underinvestment in infrastructure; mitigating the risk of environmental degradation and traffic congestion; and better operation of industrial zones. The city is growing rapidly but the current situation of environmental sanitation is poor. There are major problems with pollution (particularly Phu-Loc River) and poor sanitation and drainage, especially in low-income communities. Pollution is affecting human health and flooding and wastewater disposal problems are posing significant challenges to further urban growth. The Danang Priority Infrastructure Investment Project (PIIP) was approved through the decision No. 31/QD-TTg dated 10/01/2007 of the Prime Minister. Funds were requested from the World Bank for the period for an IDA amount expected to be about 100,000,000 USD (subsequently increased to 150,000,000 USD). The project is an interdisciplinary infrastructure investment activity to reduce poverty and promote economic development in accordance with the city s development orientation as well as its Comprehensive Poverty Reduction and Growth Strategy (CPRGS). Project objectives and description Project development objectives The project development objectives are: The project aims to improve the efficiency, effectiveness and sustainability of urban services under the control of Danang City through a package of priority investments including urban upgrading, environmental improvement and strategic road access, as well as measures for institutional strengthening in the areas of investment planning, and the management of land and housing. Project components and phasing Component A: Urban Upgrading (Upgrading of Tertiary Infrastructure in Low Income Areas - LIAs) This component will help upgrade tertiary infrastructure for low-income areas and provide resettlement housing and micro-credit for housing improvements. Component B: Environmental Management This component will invest in improving environmental conditions, including flood control, construction of drainage trunks, wastewater collection, and wastewater treatment works. 5 Component C: Roads and Bridges for Economic Development This component will provide new roads to enhance economic growth. Component D: Institutional Development - This Component will enhance the efficiency of the City s departments and sectors in the implementation of the Socio-Economic Development Plan, period The Project is divided into two phases. Phase 1 consists of planned first year investments and Phase 2 are those that will follow in the remaining four years of the project. Detailed phasing of the project is presented in the table below. A map of the project area is presented below the table that also shows the major investments under Phase 1. Phasing of environmental impact assessment (EIA) The environmental impact assessment for this project was also accordingly divided into two phases. A full environmental assessment (EA) report has been carried out for all the activities planned for the first year (Phase 1). Detailed environmental guidelines have been prepared for the environmental assessments to be carried out for the Phase 2 activities. These EAs will be carried out as part of the process of preparing detailed investment designs. This Executive Summary reports on both the Phase 1 EA and the Environmental Guidelines for Phase 2. Environmental impact assessment process The EA of the Project was prepared according to the Vietnamese Law on Environmental Protection 2005, Decree No. 80/ND-CP dated Aug 9, 2007, and in compliance with World Bank safeguard policies. The Constitution of Vietnam states that state-owned enterprises, governmental agencies, cooperatives and national defense units must take full responsibility for implementation of policies which ensure reasonable use of the country s natural resources and environmental preservation. A summary of the most pertinent national laws governing environmental management includes, but is not limited to the following: Law on Environmental Protection dated 29 Nov Decree No. 80/2006/ND-CP dated 9 Aug on detailed regulation and implementation guidance for some clauses of Law on Environmental Protection. Circular No. 08/2006/TT-BTNMT dated 8 Sep on guidance on strategic environmental assessment, environmental impacts assessment and commitment to environmental protection. Decree No. 91/2002 (Nov. 11, 2002) on the Mandate, Organization and Functions of MONRE. Decision No. 45/QD-TTg (April. 2, 2003) on establishing provincial Department of Natural Resources and Environment (DONRE). MONRE Decision No. 35 / 2002 / QD-BKHCNMT on standards to be applied during the preparation of an Environmental Assessment (EA). Social and environmental development joint stock company (SECO) 5

7 Environmental setting Socio-economic setting The population of Danang City in 2005 was estimated at 790,191 people, of which the total male population was 384,806 people and the total female population 405,385. The rate of population growth in the city in 2005 was 2.35%, of which the rate of the natural population growth is approximately 1.18%, the remainder resulting from strong migration to the urban area. According to socio-economic surveys in the project area, workers constitute 25.5% of the population, small business employees 26.4%, and 21.2% are government civil servants. The others earn their living in fishing and agricultural productions or undefined jobs. Unemployment rate is 8.4%. Based on those surveys, 23.3% of the total households surveyed are considered poor according to the standard of Ministry of Labor, Invalids and Social Affair. The average income per capital is about VND 472,000 per month. In comparison with similarly-sized Vietnamese cities, the income level is relatively low. Natural conditions at project areas Danang has a typical tropical monsoon climate with annual average temperature above 25 0 C and annual average humidity 82%. There are two obvious seasons in Danang including a rainy season from August to December and a dry season from January to July. Tidal regime of Danang Sea is a diurnal tide with an irregular half-diurnal tide. a. Air quality at project areas The project areas are mainly affected by high concentration of suspended particulates. The tested total suspended particulates (TSP) values range from 5.1 to 49.2 mg/m 3, which are much higher than Vietnamese standards, especially at inner city roads such as Ong Ich Khiem Road and Nguyen Hoang Road. Residents living in LIAs and along the Phu Loc River have been affected by wastewater odors; the most affected areas are those close to the existing city wastewater outlets such as at Dung Sy Thanh Khe Bridge near the Clinic Centre at Tran Cao Van Road. b. Surface water quality The Phu Loc River is one of the main drainage channels of the city, originating from West Lake and flowing to Danang Bay through the estuary at Nguyen Tat Thanh Road, Thanh Khe Dong Ward. The river section to be rehabilitated has a length of about 2 kilometers and a width of 50 to 80 meters. The river has been polluted from domestic wastewater, rubbish, and some industrial pollution. According to test results, the pollution of the river is highest at the middle section and lowest at the outlet. Wastewater from the river is discharged into Danang Bay and contaminates coastal water quality. The figure below presents the river water quality. Groundwater quality Groundwater from aquifers in the project area is of good quality and could be used for domestic purposes as tested physiochemical parameters are within Vietnamese standards. However, fecal coliforms are detected in most of the samples from shallow wells (three quarters of the samples). Analysis of alternatives The alternative of the status quo was considered but rejected as an option. Under that scenario, people would continue to live in bad infrastructure conditions and in an unhealthy environment. Lack of adequate drainage systems would contaminate ground water and affect public health, especially during the rainy season. Flooding of lowland areas creates risks of epidemic disease and of economic damage. If the Phu Loc River is not rehabilitated and continues to receive untreated wastewater, pollution situation will become more serious and would lead to impacts on the local residents health. High concentration of pollutants in the river would impact aquatic ecosystems. The transportation routes to be constructed are necessary to meet increasing traffic demand and to create good conditions for economic and tourism development in the project area. Alternatives were considered for each of the major Phase 1 investments: Minimizing resettlement was carefully considered during designing of the project. Upgrading tertiary roads system in LIAs and realignment of Phu Loc River was considered based on willingness of communities. Alternatives for LIAs were chosen through three community meetings; two options were presented and discussed in the meeting and collected suggestions from communities were included in the basic design. Alternatives for realignment of Phu Loc River were considered to minimize resettlement and preserve cultural properties such as forefather houses and temples, and to avoid existing infrastructure such as the textile company and college. 9 Two major alternatives were considered for the dredging of the Phu Loc River (wet and dry dredging methods). Dry dredging was retained as the best option. Two alternatives of sludge disposal were considered and presented to City People s committee, including the city s disposal site and the Khanh Son Landfill. The Khanh Son Landfill was selected for disposal of dredged sludge due to better conditions, reduced environmental impacts, and availability of necessary facilities. Environmental impacts Expected environmental impacts from the project activities are summarized in the table below (a much more detailed table can be consulted in the EA report). Note that this table only includes impacts of Phase 1 investments. The works likely to be financed under Phase 2, but not yet definitively identified, include drainage construction and rehabilitation, sewer construction, two roads with 4 bridges, upgrading of 10 LIAs, pumping stations, and trunk infrastructure. For works under Phase 2 the types of anticipated impacts have been broadly identified and are described and addressed in the Environmental Guidelines for Phase 2 (see below). The precise impacts and mitigation measures will be identified during detailed environmental assessments to be carried out in the first year of the project. 10 The civil works under the project are anticipated to acquire about 83.8 ha of land, affecting about 1,744 households. Of these, 536 households would need to be relocated. To mitigate these impacts, a comprehensive Resettlement Policy Framework has been prepared and approved by the Prime Minister and detailed Resettlement Action Plans have been prepared for all known resettlements to be required for the Phase 1 investments. Impacts on cultural property Special attention has been paid to impacts on cultural properties such as pagodas, temples, shrines and beauty spots. Such impacts have been reduced based on the selection of reasonable technical options and consultation with affected communities. In Phase 1, there are five cultural works that will be affected (houses of forefathers and temples of village gods). Two of these will have to moved and others are only slightly affected. The two new roads under Phase 2 may pass some areas with a number of graves. In particular the currently proposed route of Nguyen Tri Phuong Hoa Quy Road will cross two cemeteries of Hoa Xuan and Hoa Quy wards. Compensation plans for relocation of graves will be carefully executed and thoroughly consulted with the affected public. Community and stakeholder consultation Recommendations of ward-level Peoples Committees and Fatherland Front Ward-level community consultations with the Peoples Committees were conducted in all city wards in the project area in April, Questionnaires were used to define existing environmental conditions and consult about potential environmental impacts. Most suggestions made concerned impacts of dust, noise, and pollution and all were carefully incorporated into the Environmental Management Plan. In the second public consultation conducted from July 2007, the Executive Summary of the EIA report for Phase 1 was sent to Ward PCs for their comments. Results of consultations are summarized as follows: Impacts and mitigation measures during construction: all wards agreed that impacts identified during construction are unavoidable but urged the project to conform to proposed mitigation measures. In addition, they also added other measures as follows, which were similarly incorporated into the EMP: Construction should be carried out quickly. Drainage system of Hoa Minh resettlement area should connect to existing sewers at North West new urban area. In case transportation construction triggers damages of existing roads, necessary rehabilitation should be taken. During rehabilitation of the Phu Loc River, it is necessary to propose mitigation measures in order to minimize damages to structures and to compensate affected assets. Construction of Thanh Khe 5 LIA should not be carried out for the whole LIA simultaneously to avoid impacts on local traffic. Business at Ma Voi market and along upgraded roads might be affected during construction stage. The project should have measures to support affected people. During construction of drainage system at LIA, wastewater should be pumped and conveyed to main sewers. Social and environmental development joint stock company (SECO) 10

11 Impacts and mitigation measures during operation phase: All wards agreed with the proposed mitigation measures during operation phase. The Thanh Khe Tay and Thanh Khe Dong Wards requested that the project propose measures to avoid pollution and sand deposits in the Phu Loc River. Recommendations of affected people Additionally, recommendations of affected people were collected through community consultation surveys conducted in June-July 2006 and June-August A few key results were the following: Most participants accepted there would be temporary impacts during construction stage. Participants requested that construction be carried out on schedule, without delays. Most participants agreed with proposed mitigation measures during construction stage and proposed mitigation measures during operation phases. They added that URENCO should have plan for regular dredging and inspecting of drainage system. Concerns were expressed about impacts on business activities. In case of temporary water supply interruption, announcement and temporary discharge option in construction process should be prepared. Additional specific suggestions were made for mitigation measures. Public disclosure The English version of EA report for phase 1 was disclosed in 31 August, 2007 at VIDIC and in Washington, DC on 31 August, The Vietnamese version of EA report was disclosed at PMU, Danang DONRE and related Wards on 24 September, Environment Management Plan (EMP) Existing Environmental Codes of Practice (ECOP) will be referenced in all contracts let under the project. A variety of institutional measures are in place to supervise the implementation of the codes (see section below). The project s Environmental Management Plan (EMP) provides details on the required mitigation measures. In addition, the EMP includes mitigation measures for major and project-specific impacts. The Danang PMU will implement the EMP together with DONRE. The Danang PMU will designate 1-2 environmental staff to take charge of monitoring, managing and implementing the objectives of EMP. Due to huge amount of work related to the EMP implementation, the PMU has insufficient capability to complete it independently. During project implementation, the PMU will therefore hire a local environmental consultant firm to assist them in implementing the EMP. This Independent Safeguards Monitoring Consultant (ISMC) will have tasks as follows: (i) supervise implementation of the EMP by contractors; (ii) guide community environmental supervision and management, especially with works of Components A; (iii) monitor project general environmental impact parameters; and (iv) set up the environmental training program under Component D. Together with Danang PMU, construction, management and operation contractors of the project are also responsible for monitoring environment quality during period of construction or operation of their components and they must conform to requirements in EMP, mitigation measures, terms and conditions and commitments in the contracts. Environmental monitoring plan Environmental monitoring will be conducted at the following four levels: Monitoring of project performance indicators; Social and environmental development joint stock company (SECO) 12

13 Monitoring of implementation of mitigation measures done by the contractors; Community based monitoring; and Overall regulatory monitoring of the project. Monitoring indicators have been agreed and are presented in the table below. The PMU will prepare for the Bank bi-annual performance monitoring reports, which will detail project progress with respect to agreed targets for environmental project performance indicators. 14 Participation of communities in Environment Management Plan Community participation in environment protection, especially their support in the project areas in Danang City is essential to success for the project. Mobilization and encouragement of community participation in environment protection activities will be carried out regularly in all phases of the project. Participation of the community in environment management will be implemented through environment consultation activities and information dissemination. Communities in the project area will be provided with full information about: Project activities (purpose, location, time, role and duty of the project participation objects etc.). Socio-economic and environment benefits when the project is put into operation. Impacts on the natural and social environment; mitigation methods; environment management program. Making people realize the importance of contributing to environment management or timely reporting about environment issues in the project operation process. All the community s opinions during project implementation will be recorded and dealt with by the project implementation units and environment management agency. Communities can directly or indirectly take part in management as well as monitoring environment through meetings or letters. The community-based monitoring program will allow the communities themselves in affected wards to play a major role in monitoring the project. Support will be provided for monitoring of the following environmental parameters: dust; noise; air pollution etc. during construction and operation; functioning and quality of water supply; drainage and sewerage; and solid waste collection and transfer during construction and operation. Capacity building Capacity building training for officers on environment issues is necessary to ensure environmental sustainability. Environmental specialists will coordinate with environment management specialists of DONRE in training for PMU staffs, construction contractors and other stakeholders (representatives of taking-over, management and operation units, representatives of community) on: Objectives and necessity of the project EMP; environment activities in various phases of the project. Standards, regulations on environment and applied impact mitigation methods. Role and duty of organizations, related units in the project. Organization and environment management methods of the project. Support and monitoring operation proposed in EMP. Budget Requirements for environmental management, mitigation and monitoring A summary of the proposed budgets for recommended environmental management, mitigation and monitoring measures is presented in the table below (for Phase 1 only). Detailed budgets will be determined for Phase 2 investments during detailed preparation of the pertinent EA reports. For Phase 2 of Danang PIIP, four major investment activities will be undertaken: urban upgrading of LIAs, trunk infrastructure, wastewater treatment plants (WWTPs), and urban roads. For Component A - urban upgrading (upgrading of tertiary infrastructure in LIAs), which is related to widening/paving of alleys in the lanes in the LIAs, construction of sewerage; water supply connections to houses; public lighting; and social infrastructure such as public places of amusement, public meeting houses, construction of primary schools, ward health care stations, upgrading of kindergartens, markets, etc., the Community Upgrading Plan (CUP) and Community Environmental Management Plan (CEMP) are sufficient for taking into account potential environmental impacts. This takes into account that standard Environmental Codes of Practices (ECOP) are included in TORs of all contractors. For Component B - environmental management, construction of primary and secondary infrastructure (trunk infrastructure), upgrading of existing WWTPs, and Component C - roads and bridges for economic development, a full scale Environmental Impact Assessment (EIA) including Environmental Management Plan (EMP) is needed. Specific guidelines The Environmental Guidelines have been completed and provide specific guidelines for preparing EIAs and EMPs for each component. The main points are as follows. EIA documentation will correspond to the World Bank safeguard policies OP 4.01 on Environmental Assessment and OP 4.11 on Physical Cultural Resources and the Vietnamese Law on Environmental Protection and Decree 80/2006/ND-CP. The scope of the environmental documentation includes: Site-specific EIA for proposed components Description of the sub-components Description of environmental conditions Legislative and regulatory framework Determination of potential impacts of the proposed components Analysis of alternatives to the proposed components Environmental Management Plan (EMP) Social and environmental development joint stock company (SECO) 15

16 Public consultation and public disclosure Reporting According to OP 4.01 Annex C, an EMP consists of mitigation, monitoring, and institutional measures to be taken during implementation and operation to eliminate or reduce adverse environmental and social impacts to acceptable levels. The plan also includes the actions needed to implement these measures. The EG also outline design practices, mitigation measures during construction and operation for each components. Specifically, the detailed Environmental Guidelines document includes the following: Environmental Assessment Outline TORs for the Community Environmental Management Plan TORs for roads and bridges to be financed under Phase 2 TORs for the drainage, wastewater collection and treatment investments As part of initial activities under Phase 1, a study on wastewater treatment options will be carried out and the design and EIA of the construction or possible upgrading of WWTPs will follow the result of this study on wastewater treatment options.
