2 Chapter 1 FAQ on ENS Q1 What is an ENS? In order to tighten the security within European Union (EU), EU decided to introduce a new legislation for risk assessment of the cargoes brought into EU. This new legislation requires that Entry Summary Declaration (ENS) needs to be submitted to EU customs for all goods brought into EU, regardless of their final destination. ENS must be declared for all cargo whether or not cargo is destined to the EU, including cargo remaining on board which are not discharged nor transhipped at EU ports. Cargo remaining on board is sometimes referred as FROB (Freight Remaining On Board). Q2 What information do I need to supply to K LINE? ENS is basically a dataset with information mostly provided by the Shipping Instruction. This is further explained in Chapter 2. Q3 What is the EORI? Economic Operator Registration and Identification. This is further explained in Chapter 2. Q4 Who must declare an ENS? Operating Carrier who brings the goods to EU is responsible for submission of ENS. Basically K LINE is responsible. For services where K LINE is using other carriers space (such as feeder services), those carriers are responsible for the submission of the ENS. K LINE will provide them with necessary information for the ENS submission. Q5 When must an ENS be lodged? The legislation requires that ENS for deep-sea movement must be lodged at least 24 hours before commencement of loading at each foreign load port and 2 hours before arrival at the first port in the EU for short-sea movement. Cases where ENS submission is required; a) Movement from Non-EU origin to EU destination. 2

3 Case 1) Shanghai (China) to Rotterdam (Netherlands) (Direct service between Shanghai to Rotterdam) K LINE submits ENS at Shanghai at least 24 hours before loading the cargo. Case 2) Tokyo (Japan) to Fos (France) (Transhipped at Kaohsiung for the mother vessel to Fos) K LINE submits ENS at Kaohsiung at least 24 hours before loading the cargo. Case 3) Singapore to Thessaloniki (Greece) (Direct service to Port Said then transhipped for non- K LINE feeder service) Feeder operator submits ENS at least 2 hours before vessel s arrival at first EU port. Case 4) Damietta (Egypt) to Constanza (Romania) (Direct service between Damietta and Constanza) K LINE submits ENS at least 2 hours before vessel s arrival at first EU port. b) Movement from Non-EU origin to Non-EU destination but transhipped at EU port. Case 5) Shanghai (China) to St. Petersburg (Russia) (Direct service to Rotterdam then transhipped for non- K LINE feeder service) K LINE submits ENS at Shanghai at least 24 hours before loading the cargo. Case 6) St. Petersburg (Russia) to Hong Kong (Non- K LINE feeder service to Rotterdam and then transhipped for K LINE mother vessel to Hong Kong) Feeder operator submits ENS at least 2 hours before vessel s arrival at first EU port. c) Movement from Non-EU origin to Non-EU destination but the carrying vessel will call at EU port. Case 7) Kumport (Turkey) to Ilychevsk (Ukraine) (Direct service between Kumport and Ilychevsk but our vessel calls Constanza, Romania prior to Ilychevsk) K LINE submits ENS at least 2 hours before vessel s arrival at Constanza. Q6 What is the definition of short sea movement? According to EU, short sea movement is defined as per below; [1] Movements between Greenland, Faroe Islands, Ceuta, Melilla, Norway, Iceland, ports on the Baltic Sea, ports on the North Sea, ports on the Black Sea or ports on the 3

4 Mediterranean, all ports of Morocco and all EU ports except French overseas departments, Azores, Madeira and Canary Islands. (No ENS is required for ex Norway cargoes.) [2] Movements with duration of less than 24 hours between all EU ports and the French overseas departments, Azores, Madeira and Canary Islands. Q7 Will K LINE introduce an advance cut-off time? Yes. Because of the requirement to submit ENS at least 24 hours prior to loading of the cargo for deep-sea cargo movement as explained in Q3, we have advanced documentation cut-off (DOC cut-off) and cut-off for the container yard (CY cut-off) for many ports including some ports which do not have direct service to EU ports. Please refer to Chapter 3 for service-wise and port-wise cut-off list for Europe bound mother vessels calling ports in Asia and USA. Q8 When does this legislation come into effect? According to EU Commission, ENS filing will only be enforced for voyages that begin after midnight 31/Dec/2010. This means that although vessel may be sailing from Hong Kong on 03/Jan/2011, if start of the voyage was at Dalian (North China) and its sailing date was on 30/Dec/2010, then ENS submission is not required for the whole of that voyage. K LINE's westbound voyages for Asia-Europe trade start from Asian port and eastbound voyages start from European or Mediterranean port for Europe-Asia deep-sea services. K LINE s eastbound voyages for US-Europe trade start from US port. We have prepared the First Vessel List for easy reference. Please refer to Chapter 3. Q9 Will K LINE charge for ENS Administration Fee? The process of updating our systems to handle these requirements has necessitated some additional investment. The additional work that is involved, despite automation of the process, will also result in costs being incurred. We hence decided to implement Cargo Declaration Data Charge as per below; Cargo Declaration Data Charge for every new ENS declaration: USD 25 per Bill of Lading Amendment fee for ENS already filed: USD 40 per Bill of Lading This charge is payable by Shipper prior to release of Bill of Lading. However we can accept the payment to be made at destination if requested. 4

5 Q10 What happens if I failed to supply Shipping Instruction before Documentation Cut-Off time? For the deep sea services, K LINE cannot load your cargo. Your cargo may need to be booked on next available vessel provided there is still space for the vessel to load. Any expense such as storage, rehandling at the terminal etc needs to be compensated by customers. For the short sea services, Customs may make an inspection of the cargo or hold the cargo at the terminal etc. It may result in delay of cargo and additional expense such as inspection fee, storage, rehandling etc and these expenses need to be compensated by customers. To avoid such incidents as above, please provide your Shipping Instruction by the Cut-Off time. Q11 Does empty Shipper s Owned Container shipment has to be declared? Yes. Likewise every other laden cargoes, empty Shipper s Owned Container needs ENS declaration to the EU customs. Q12 Does K LINE accept customers to submit ENS (3 rd Party Filing)? Yes. Unlike US24 hour regulation, where Customer and Carrier can both file for the same cargoes, EU does NOT allow such dual filing. For EU24 hour legislation, Customers can only declare ENS to the EU customs with Carrier s consent and knowledge. K LINE will be asking those customers who wish to file ENS on their own, to sign a contractual agreement. Should you wish to declare ENS on your own, please contact your local office. Q13 Does NVOCC need to provide House B/L details? No for the moment. NVOCC who is not filing ENS on their own, does not need to provide House B/L details. K LINE will declare ENS to the EU customs as per SI provided by NVOCC. However please note that this situation may change if EU customs tighten this rule. They may request Operating Carriers to provide NVOCC s House B/L details at later stage. 5

6 Chapter 2 Data for ENS K LINE will ask customers to provide required information in Shipping Instruction. You may have noted from the EU Commission website the list of data requirements for submission of an ENS declaration under the forthcoming European Advanced Manifest Rule. We have prepared a table for our customers to have a clear understanding of how much of this information has to be provided in Shipping Instructions (SI) and where necessary we have also endeavoured to explain the level of accuracy and detail that is necessary to enable K LINE to submit the necessary ENS declaration. It is a basic rule that all information must be accurate and correct. Any erroneous data provided to K LINE may result in rejection of ENS, delay of cargo or penalties and fines. There are some items of information that we will require in addition to that already contained in standard SI that are currently submitted to K LINE for Europe bound cargo. There are also items of information that must be shown in your SI in the correct format, such as addresses. This will assist us to load information into our manifest system in a format that will produce a correct ENS submission. 6

An EORI number is a number, unique throughout EU, assigned by a customs authority in a member state to Economic Operators (also called EO; exporters, importers, traders etc) or persons. EORI numbers can be used in all communications with customs at any member state in EU. EORI commenced across EU on 1 July K LINE strongly recommends customers to supply EORI numbers in SI where available. ENS declaration is made against the vessel actually in the EU first port of entry. Cargoes entering EU by feeder service will therefore be declared by those feeder companies. For the movement from Non-EU origin in Europe to Non-EU destination but transhipped at EU port which is outlined in Q4-case 6) of Chapter 1, [St Petersburg to Hong Kong], where cargo is transhipped to mother vessel at Rotterdam, the EU port, it is most likely that carriage from Non-EU port to first EU port (in this case St. Petersburg to Rotterdam) is made by feeder companies and your Shipping Instruction needs to contain all necessary and acceptable data from the cargoes loaded on to feeder vessels which are scheduled to sail after midnight 31/Dec/2010. Please consult with our local office for more details on the first applicable vessel for this regulation. We have also prepared a cut-off table for USA/Asian ports in service-wise.
