1 The Corporation of Delta COUNCIL REPORT Regular Meeting F.10 To: Mayor and Council From: Human Resources and Corporate Planning Department Date: March 31, 2014 Port Metro Vancouver Land Use Plan Update The following report has been reviewed and endorsed by the Chief Administrative Officer. RECOMMENDATION: THAT the Mayor sends a letter regarding Port Metro Vancouver's draft land use plan, including the following comments: The Corporation of Delta does not support the handling of bulk liquid products at the Roberts Bank terminal, as allowed in the 'Port Terminal' designation. The Roberts Bank planning area should correspond more closely with areas of port activity. The 'Conservation' designation should extend to both sides of Purfleet Point Park Reserve on Annacis Island. The Land Use Plan should include a commitment to no expansion of port activities on agricultural land. With regard to local transportation impacts, there should be an emphasis on greater collaboration between transportation agencies. With regard to the Project Review Process, there should be a further commitment to ongoing monitoring of project impacts after completion. PURPOSE: The purpose of this report is to provide an update regarding Port Metro Vancouver's land use planning process and to provide comments on the proposed changes to land use designations in Delta. BACKGROUND: In January 2012, Port Metro Vancouver began a two-year process to consolidate and update its Land Use Plan. Staff have been involved throughout this process and have provided comments, endorsed by Council, on the various draft documents. This is the final phase of consultation on the plan and Port Metro Vancouver is accepting comments until April 13, 2014, with the expectation of presenting the final document to their Board for approval in the fall of this year.
2 Page 2 of 4 PMV Draft Land Use Plan March 31, 2014 Consultation Materials and Interactive Map: The draft Land Use Plan is available on Port Metro Vancouver's website at: In addition, there is an interactive map available at which allows users to add comments directly on the map and also to view comments made by other users. DISCUSSION: Delta staff met most recently with Port Metro Vancouver staff in early March to discuss the draft land use plan and to consider the implications of Port Metro Vancouver's decision to allow the head lease with the Province to lapse at the end of For the first time, the maps in the draft land use plan reflect the upcoming change in jurisdiction which, for Delta, means that there is significantly less land under PMV's jurisdiction than previously. The only areas which remain under Port Metro Vancouver jurisdiction in Delta are: Planning Area 6 - Roberts Bank (Attachment 'A'); and Planning Area 5 - Fraser River Central (Attachment 'B') which includes Annacis Island, and waterlot properties west of 120th Street to approximately 80 th Street. As discussed in previous Council reports, the port has defined 8 land use categories which are intended to be quite broad and to provide greater flexibility than municipal zoning designations. The following issues have been identified for further comment: Roberts Bank has two designations: a) 'Port Terminal' - this designation applies to deep-sea and marine terminals which handle a variety of commodities, including autos, break bulk, dry bulk, liquid bulk and containers, as well as cruise passengers. Terminals are not defined by product carried; therefore, even though the 'Port Terminal' designation contemplates liquid bulk, it does not mean that a specific terminal will handle th at product. 1. Delta has previously expressed concerns regarding the potential management of bulk liquids at the proposed Terminal 2, therefore, it is recommended that Port Metro Vancouver be reminded that Delta Council is opposed to any liquid bulk management at any Roberts Bank terminal, existing or proposed. b) 'Special Study Area' - this designation applies to two areas located on both sides of the causeway extending to the foreshore. The current designation is Port Marine Land and Port Water. Under the proposed designation, these areas will require additional study, consultation and planning to determine their future land use. Until this additional work is done, the current use remains unchanged. Port Metro Vancouver is in discussions with Tsawwassen First Nation regarding future uses of this area. The outline of the area designated around Roberts Bank exceeds the actual activity area and Delta had previously requested that the area be amended to more closely correspond with areas of activity. This request will be reiterated.
3 Page 3 of 4 PMV Draft Land Use Plan March 31, Fraser River Central: The 'Conservation' designation at the west end of Annacis Island around Purfleet Point Park Reserve applies only to the northern side of the point while the 'Log Storage' designation applies to the southern side of the point. A 'Conservation' designation on both sides of the point would align more closely with Delta's Environmentally Sensitive Area designation of these lands. Land Use Policies: a) Objective 1.3, Policy continues to advocate for the "acquisition of sites to protect availability for future port use" without addressing Delta's and other stakeholders' concerns over the use of agricultural land for port expansion. A policy should be added which commits to no expansion of port activity on agricultural land. b) Goal Statement 2 and associated policies regarding transportation should include the need to minimize and mitigate impact of port activities on local transportation systems. Delta previously commented that policy statements in this section should emphasize greater collaboration among transportation agencies. Policy statements have not changed since the Phase 3 Plan. c) Objective 4.3, Goal notes that potential project impacts are to be minimized and mitigated through a Project Review Process. Delta previously requested that Port Metro Vancouver's policies take this one step further with commitment to ongoing monitoring of project impacts after completion. There have been no amendments or additions to the policies to address this request. Implications: Financial Implications - there are no financial implications. CONCLUSION: Staff comments on the final draft of Port Metro Vancouver's new Land Use Plan are provided for Council's endorsement. 'j I,!....
