3 1. Eligibility to Submit a Quote This is not a tender call or a request for proposals. This ITQ is not intended to, and shall not create any legal obligations or duties for the Regional District towards any person for any reason whatsoever, whether in contract, tort, or otherwise. The Regional District, at its sole discretion, and at any time, may or may not enter into negotiations with one or more persons submitting quotations in response to this ITQ, or with any other person. 2. Overview of the Requirements You are invited to submit your price quotation for the supply of the following items: A. 1 (one) 30 cu.yds. Leak Proof Roll-off Bin B. 7 (seven) 50 cu.yds Roll-off Bins Information on technical specifications is attached in Appendix A and the required quantities are detailed under the Schedule of Quantities and Prices under Appendix B. The Respondent may offer alternatives. 3. Invitation to Quote Definitions Throughout this Invitation to Quote, the following definitions will be used: a) Regional District means the Regional District of Kitimat Stikine or the project management firm or corporation appointed by the Regional District of Kitimat Stikine to act on its behalf. b) Closing Time has the meaning set out in section 4.2. c) Contract means a contract between the District and a Respondent for performance of the Work. d) Supplier means a Respondent who received a Notice of Award e) Respondent means a Supplier that submits a Response. f) Response means a quotation submitted by a Respondent in reply to this ITQ. g) ITQ or Invitation to Quote means the process described in this document. h) Specifications means the specifications for the Work attached to this document as Schedule A. 1

4 4. Invitation to Quote 4.1 Enquiries All enquiries related to this ITQ are to be directed, in writing, to: Mircea L. Cvaci, P.Eng., Information obtained from any other source is not official and should not be relied upon. 4.2 Closing Time and Submission One (1) complete hard copy of each Response must be received before 4:00 PM, Pacific Time, on October 30 th, 2015 (the Closing Time ) and must be received by the office of: OR Mircea Cvaci, P.Eng. Sperling Hansen Associates Inc East Keith Road North Vancouver B.C., V7J 1J3 One (1) complete electronic Response must be received by at mcvaci@sperlinghansen.com before 4:00 PM, Pacific Time, on Friday, October 30 th, (the Closing Time ). It is the responsibility of all Respondents that submit electronically to ensure that their submissions are received. Respondents must choose one delivery method only and must submit a Response either in hard copy format or electronically by . Responses received after the date specified in section 4.2 will not be accepted or considered, and will be returned unopened. 4.3 Revisions to Quotations Quotations may be revised; however, the revisions should be submitted in a new Quotation, delivered in hard copy with an accompanying amended single consolidated pdf file to the location set out in Section 4.2, at any time before the Closing Time, but not after. Faxed or ed revisions are discouraged. Only the most recent Quotation submitted by a Respondent will be considered. 2

5 5. Project Description 5.1 Project Overview The Regional District is constructing the new Thornhill Transfer Station, which will be located approximately 6 km from the 4-way stop of Highway 16 and Highway 37, along Old Lakelse Lake Drive. Under this ITQ the Regional District requires services to supply, deliver and commission roll-off bins as described in section Delivery Schedule As part of this ITQ, the Respondent must confirm that it can meet the Substantial Performance expected delivery deadline of June 1 st, Time is of the essence with respect to all provisions within this ITQ. The Regional District may elect, in its sole discretion, to postpone delivery of the bins for as long as required to finish construction but without exceeding November 1 st, The Supplier will be solely responsible for accessing the site. 6. Additional Instructions Responses should be irrevocable and open for acceptance by the Regional District for a period of 90 calendar days from the day following the Closing Date as set out in Section 4.2. If within this period the Regional District delivers a written notice ( Notice of Award ) by which the Regional District accepts a quote, the Supplier will be expected to: within 5 Days of receipt of the written Notice of Award deliver to the Regional District: a Performance Bond, valid for minimum 1 year from Substantial Performance of the Contract, in the amount of 50% of the price quoted or as agreed upon by the Respondent and the Regional District, issued by a surety licensed to carry on the business of suretyship in the province of British Columbia, and in a form acceptable to the Regional District; a Baseline Delivery Schedule; and a clearance letter indicating that the Respondent is in Worksafe BC compliance; enter into a written Contract for the Work with the Regional District. 3

6 7. Work Coordination with onsite Contractors The Supplier shall coordinate material delivery with the Contract Administrator, the Regional District and Other Contractors, as necessary. The Supplier shall have no cause for claim against the Regional District whatsoever with respect to delays or other interruption of the Work by Regional District forces or due to the above requirement to coordinate the Work with the Contract Administrator, the Regional District and Other Contractors. 4
