2 RE: Neiman Marcus, Oak Brook, IL Project 2 Page 2 GENERAL SCOPE OF WORK: Neiman Marcus currently operates an approximately 99,880 s.f., three (3) level retail store at 6 Oak Brook Center in Oakbrook, Illinois, and intends to remodel approximately 67,000 square feet of this existing store. The Neiman Marcus store will be operating for business during construction of the Work. The Scope of Work for this Tenant Improvement Package is the renovation of the affected areas in the existing retail spaces as shown in the Interior Construction Documents prepared by Gensler and McGuire Engineers (MEPC) and as noted in these Instructions to Bidders. Neiman Marcus (Owner) reserves the right to make revisions in the Scope of the Work prior to bids being received. Revisions will be issued to all bidders by written addenda. Receipt of any addenda must be acknowledged on the Bid Proposal Form BID DOCUMENTS A. It is the responsibility of the subcontractor to review the attached drawings and specification and advise Pepper Construction if additional documents are needed for the subcontractor to complete pricing of the work PREPARATION OF BIDS AND QUESTIONS Please include clarifications and itemized breakdowns as required to confirm the scope of your bid. Please submit all questions in writing via to Nick O Neil (noneil@pepperconstruction.com) or Dan Moran (dmoran@pepperconstruction.com) by Tuesday, February 25 th, We will forward the questions to the architect for clarification as required. Please do NOT contact the owner or architect direct with questions PREQUALIFICATIONS All subcontractors bidding must be prequalified with Pepper Construction and the qualifications must be up to date. BIDS WILL NOT BE ACCEPTED IF PREQUALIFICATION IS NOT COMPLETE. If you have previously prequalified and want to check the paperwork has been accepted or that your prequalification has not expired, please contact prequal@pepperconstruction.com For any subcontractor that needs to prequalify with Pepper, you must fill out the forms found on the Pepper website ( located under Working with Pepper. Follow the directions given with the form and on the website TAXES This project is NOT tax exempt. Refer to Gensler's construction documents for construction phasing plans Please include in your bid escalation and any phasing cost as required per the project schedule. Please indicate all durations on proposal HOISTING AND SCAFFOLDING Any scaffolding and hoisting must conform to any and all code requirements, including but not limited to OSHA, etc. and is the sole responsibility of each subcontractor CLEAN-UP Trade Contractors will be required to clean up their respective work areas on a daily basis in order to keep the project clean, orderly and hazard free. Upon completion of work, and prior to leaving the site, each trade contractor must receive approval and acceptance by Pepper Construction that all final clean-up requirements have been met and that the area is ready for final inspection. Trade contractors to breakdown their debris into the smallest possible form prior to placing it in the dumpsters. Multiple trash gondolas will placed in work areas for subcontractors to place discarded materials to be hauled to the dumpster by PCC. Should the trade contractor fail to clean up after themselves on a daily basis, Pepper Construction reserves the right to perform the clean up and back charge the trade contractor. This is the least desirable method and Pepper encourages all trade contractors to avoid this situation. Each subcontractor will be responsible for their suppliers and/or sub-trade contractors LAYOUT AND ENGINEERING All Subcontractors will perform layout and engineering as required to complete the work within the scope of their respective Contract INSURANCE REQUIREMENTS Pepper Construction Company standard insurance requirements and standard Subcontract Agreement will be required. NO EXCEPTIONS, EXCLUSIONS, MODIFICATIONS, DELETIONS, ETC. to these requirements will be permitted SUBCONTRACT AND SAFETY REGULATIONS

5 RE: Neiman Marcus, Oak Brook, IL Project 2 Page 5 Pepper Construction Company standard Subcontract Agreement will be required to be signed without modifications. Pepper s SAFETY REGULATIONS must be adhered to by any and all trades performing work on the project, please see Pepper Subcontract Agreement for the SAFETY REGULATIONS and ensure costs are included in your bid SITE VISIT AND CONDITIONS AFFECTING THE WORK It is the responsibility of the Subcontractor to visit the site in order to examine and become familiar with local conditions under which the work is to be performed, which may impact the work and/or the cost of the work. Conditions observed should be correlated with the requirements of the Contract Documents. Local conditions include, but are not limited to: the existing site, existing structures, (if any) obvious obstructions not shown on the Bid Documents, etc. Also, please note that due to the tight site constraints there will not be any long-term storage of material on site, all material should be just-in-time deliveries. Lastly, there will not be any trades people parking on site OPERATIONS/MAINTENANCE MANUALS & AS-BUILTS Each subcontractor will be required to submit their Operations & Maintenance Manual, Sample Warranties, and As-Built Drawings to date at 50% completion of their scope of work. Final warranties and as-built drawings to be turned in no later than (5) business days after substantial completion QUALITY All trade Contractor and vendors must comply with Peppers Quality Program. Each subcontractor will also be required to develop a project specific quality plan. A template for each specific quality plan is attached. The subcontractor awarded this project will be required to complete the attached trade specific quality plan. Each tradesperson will attend a one (1) hour quality and building orientation meeting ESCALATION Escalation through the end of the project, July 2014, shall be included. This applies to all tiers of trade contractors, their subcontractors and/or material suppliers EXECUTION OF FORMS The successful bidder will be required to execute the following standard forms: Pepper Construction Company s Subcontract Agreement (Exhibit F) Pepper Pre-Qualification Form (Exhibit G) Insurance Certificate per Pepper Subcontract (Exhibit H) Pepper Construction Company s Safety Handbook (Exhibit K) 1.18 ALTERNATES/ALLOWANCES/UNIT PRICES

6 RE: Neiman Marcus, Oak Brook, IL Project 2 Page 6 Bidders are appraised that the base bid is to be in complete accord with the Contract Documents, no substitutions are allowed DUST CONTROL All subcontractors shall provide their own dust control as directed by Pepper Construction FIRST AID Each subcontractor will be required to maintain first aid equipment on site at all times TRAFFIC CONTROL All traffic control required for deliveries, scaffolding, etc., will be the responsibility of the Subcontractor SITE ACCESS The use of the site shall be restricted to those areas designated and coordinated by Pepper MANAGEMENT/ADMINISTRATION Subcontractors shall assign a single Project Manger and a single Superintendent to this project. Both individuals will be required to attend regularly scheduled project coordination meetings DAILY REPORTS All Subcontractors will submit to Pepper s office, each day, a daily report indicating the manpower and brief description of the work that was performed on that day. The subcontractor shall also submit, at each coordination meeting, to Pepper his purchase order lists showing his various suppliers, purchase order number and date, a description of the material involved, the jobsite delivery date and the date of the installation completion EXPEDITING The subcontractor shall be responsible for the cost of expediting all deliveries in accordance with the project schedule FIELD DEMINSIONS/TRADE RELATED LAYOUT Notwithstanding the dimensions given on the plans, specifications, shop drawings, and other documents, it shall be the obligation and responsibility of the Subcontractors to take field measurements to ensure the proper matching and fitting of the Subcontractors work with the work of the other trades. Each trade to provide their related layout. Pepper Construction Company shall provide control lines and control elevations only TELEPHONES

7 RE: Neiman Marcus, Oak Brook, IL Project 2 Page 7 Each Subcontractor is to provide their own phones, fax machines and other communication equipment LIFTS/SCAFFOLDING Each subcontractor will be responsible for providing their own lifts and scaffolding required to perform their work. All required OSHA certifications on lifts, scaffolding, and cranes must be obtained and presented to the Pepper superintendent for record purposes LEED CERTIFICATION This project does not have LEED requirements PERMITS / INSPECTIONS Pepper construction will be responsible for obtaining the Construction Permit. All other trade related permits and inspections are the responsibility of the subcontractor NON-SMOKING PROJECT The Neiman Marcus Oak Brook project will be a non-smoking project SCOPE OF PROPOSAL The undersigned agrees that no claim will be made on account of any increase in wage scale or material prices. Sums quoted also cover the manufacture, handling, transportation and the storage of the work indicated in the Drawings and Specifications, including all incidental work in connection therewith SUBMISSION AND ACCEPTANCE OF PROPOSALS A. The Undersigned acknowledges that the Owner reserves the right to waive any irregularities or informalities, to accept any Bid, or reject any or all without explanation. B. The Undersigned declares that the preparation and submission of this Proposal, and other quotations contained herein, do not obligate the Owner in any way, and further agrees and understands that the Owner assumes no obligation to enter into a Contract for the work.
