2 INTRODUTION My full name is Richard George Schneideman. I am ompany Director of DF Souvenirs and live at 46 Weka Street,. I am the Trustee and Settlor of the Richard Schneideman Investment Trust (the Trust). The Trust owns the property at 48a Fendalton Road which contains a residential dwelling (the building) that has been listed in the replacement District Plan (the prdp) as a significant heritage item. The Trust has lodged a submission seeking the removal of the building from the prdp. I am authorised by the Trust to make this statement in support of the Trust s submission. SOPE OF EVIDENE 4 My evidence will address the following matters- (a) (b) (c) (d) (e) brief background Damage caused to the building by the anterbury Earthquakes Settlement of the Trust s insurance claim Personal circumstances around the time of settlement What will it mean for the Trust if the building must be repaired. EXEUTIVE SUMMRY 5 Our family home at 48a Fendalton Road has suffered extensive damage after the anterbury Earthquakes. I have spent a large number of hours negotiating with EQ, the Trust s insurer Vero Insurance (Vero), tradesmen and experts on whether the house can be repaired or rebuilt. 6 During the settlement negotiations a number of stressful personal events occurred. decision was made by the Trustees and myself that it would be better to cash settle the Trust s insurance claim rather than having to continue with the ongoing stress. In hindsight I realise this was not the best idea as the settlement amount is unlikely to cover the full cost of repair to the building. Page /7

3 KGROUND 7 The Trust purchased the property at 48a Fendalton Road in November 008. In May 009, my then wife, Susan, and our two girls moved into the house as our residential home. 8 We found out about the heritage listing of the building prior to purchasing the property. The building has had a number of significant modifications. I understand that at one stage the building was converted into four flats. It has since been converted back to one family dwelling, however a number modifications have been made to it. 9 The building suffered extensive damage in the anterbury Earthquakes. fter the February 0 earthquake an engineer determined that it was not safe for people to live in. The house has remained empty since February 0. I have always had the intention of repairing the house and have spent over 500 hours with EQ, insurance and tradesmen since the earthquakes. I have also maintained the 700m² garden since the earthquakes. 0 I was surprised when I received a letter from the ouncil saying that the building would remain on the heritage listing in the prdp. I did not expect that it would retain its heritage listing given the extent of modifications that has occurred on the building over time and the extent of damage that the building suffered from the anterbury Earthquakes. fter receiving legal advice I understand that the demolition of a heritage building is not a straightforward process and that it requires resource consent. I also now understand that to repair the building will also require a resource consent to ensure that the heritage values are maintained. I am concerned about what added cost this will mean, over and above my insurance settlement amount. DMGE USED TO THE UILDING Y THE NTERURY ERTHQUKES, The building was extensively damaged after the February 0 earthquake. Immediately after the earthquakes my contractor, Dax Morel from Morel onstruction, assessed the property to complete emergency works. He told me that the property was unsafe for my family to live in. The house was then Page /7

4 assessed by an engineer and was deemed to be un-inhabitable. It has remained empty since February 0. The Trust engaged Kirk Roberts onsulting Engineers to prepare a structural assessment and determine repair options. Vero decided that Kirk Roberts was taking too long to prepare the structural assessment so engaged EOM to complete the repair methodology and prepare design plans and a repair methodology. copy of the design plans are attached at ppendix. 4 The EOM report was given to Morrel onstruction Limited to cost. Dax prepared an estimate for the cost of repair and also the cost of demolition and rebuild. These costing were provided to Vero and formed part of the settlement negotiations. 5 I understand from my conversations with the engineers, Vero and Dax that extensive repairs are needed to the building. It is estimated that it will take up to a year for the repair to be completed, not taking into account the time to obtain building and resource consents. SETTLEMENT OF THE TRUST S INSURNE LIM 6 The Trust negotiated with Vero Insurance from soon after the February earthquake to mid December 04. The Trust and I always had the intention of repairing the building and for my girls and me to move back into our family home. 7 Given the personal circumstances that I have mentioned below, in particular the passing of my father, the Trust and I decided that cash settlement would be the best option moving forward. 8 In January 05 I received a settlement figure of $, , as shown in the correspondence attached at ppendix. This settlement amount remains in the Trust s account. 9 t the time of settlement I was under immense personal stress and pressure. In hindsight I realise that this was not the best decision because of the risks involved with repairing heritage buildings. 0 I have had lengthy talks with builders and professionals on repairing the building and have been told with the age of the house and the extent of Page 4/7

5 damage, there are a number of risks to repair. We have been advised from, Morrel onstruction that heritage buildings often require a number of variations and a number of things can go wrong during repair. s we have cash settled with the insurance company, any variations would need to be paid for by the Trust and it is possible these could be over and above the settlement figure. When discussing with our builders they have suggested that we would be better off demolishing the building and rebuilding a new dwelling at a fixed cost. The Trustees agree with this recommendation. PERSONL IRUMSTNES ROUND THE TIME OF SETTLEMENT hallenges finding alternative accommodation My children and I have moved four times since the earthquakes due to the limited long term tenancies available after the earthquakes. In February 0, immediately after the big earthquake we moved into temporary accommodation for a couple of weeks. We then found a 6 month lease for a property out in Tai Tapu. Susan, and I decided to take our daughters out of athedral Grammar for a term and for them to go to school at Tai Tapu. The lease for the Tai Tapu property ran out in September 0. We then moved back into town, and moved into Garreg Road. In September 0, Susan went over to Perth for a work conference and when she returned she asked me to move out of the family home. 4 I continued to pay the rent at Garreg Road, but moved in with my father. Susan and I agreed to a 50/50 custody arrangement. Moving back in with my father was very stressful for him as my mother passed away in In November 0 I found a house on Straven Road for my daughters and me to live in. We moved back into my father s house in February 05 as my father passed away earlier this year. We will need to move out of this property and find another rental property early next year as we have nearly come to an agreement with the insurance company on my father s house. EQ only handed it over to the insurance company late last year. Page 5/7

6 Separation and divorce 6 s mentioned above, my wife, Susan and I separated in 0. Susan and I are still in the process of matrimonial settlement and I have been advised by her lawyer that she will be taking legal proceeding against the Trust for her share of the Fendalton Road property. 7 The whole process of shifting homes and dealing with the divorce has been very unsettling and stressful for my two girls and myself. My girls are and 9 and have not had a home they can all their own for almost 5 years. I would like everything to be resolved so that I can find a family home and move on with our lives. Death of my father 8 My father was diagnosed with a brain tumour in September 04 and passed away in January 05. The girls and I moved back into his house to help organise his belongings. 9 I am one of the executors of my father s estate. His estate is very complex and will not be settled for quite a while yet. Dealing with the death of my father has been a very hard emotional time and also very stressful and time consuming dealing with his estate. Effect of the earthquakes on my business and property interests 0 I am the company director of DF Souvenirs Limited, we specialise in selling tourist souvenirs. Prior to the earthquake we had a large retail store in a building we owned on the corner of olombo and Gloucester Street. While sorting the insurance settlement for my family home, I have also been organising the insurance settlement for this building. Working through this insurance claim has been a very difficult task and we only settled with our insurance company last year. We are still negotiating with anterbury Earthquake Recovery uthority (ER) about the compulsory acquisition of this land. t this stage it is unknown when this will be settled. Page 6/7

7 WHT WILL IT MEN FOR THE TRUST IF THE UILDING MUST E REPIRED The most important thing for me is for my girls and me to have a permanent home. Our lives have been transient for the past 5 years and I would like for them to be able to go back to normal. I am concerned that there is large risks involved with repairing the building as there are a number of uncertainties in the settlement figure. I am concerned that if these risks eventuate then the cost of rebuild will run over the settlement amount and that the Trust will have to pay any cost over and above that amount. 4 If the building retains its heritage listing and the Trust is required to repair the building it will need to reassess the options available to it such as selling the property on an as is where is basis. ONLUSIONS 5 My family home was extensive damaged through the anterbury Earthquakes. fter the earthquakes it was deemed unsafe to live in and has remained empty since February 0. 6 repair methodology was prepared commissioned by Vero and costed by Morel onstruction. The Trust and I decided to settle the insurance claim because at the time of negotiation I was under significant personal stress. I understand that there are a number of uncertainties in the settlement figure and that there is a large risk that the repair strategy could run over the settlement figure. ny amount over and above the settlement figure will need to be covered by the Trust. 7 Given all the stress I and my children have been though over the last 5 years, we would like to move on with a new house and not have the continual stress of repairing and all the problems and risk that will go with it.
