6 1. Introduction 1.1. Project background 1. The Power Transmission Investment Program ( Investment Program ) is an integral part of the National Power Development Master Plan VII ( PDMP VII ) and comprises of: - Transmission Network Expansion Component to expand and upgrade 500 kv and 220 kv transmission lines and associated substations throughout Viet Nam; - Operational Improvement Component for strengthening operational effectiveness and efficiency of the National Power Transmission Corporation ( NPT ); and - Project Implementation Support Component for detailed technical design, construction supervision, safeguard compliance, and preparing subsequent projects of the Investment Program. 2. The Asian Development Bank (ADB) provides financing for the development the subprojects of Power Transmission Investment Program - Tranche 1, which includes the subproject of the 220 kv Song May Uyen Hung Transmission Line. 3. The National Power Transmission Corporation (NPT) of Viet Nam is the executing agency (EA) while the Southern Power Project Management Board (SPPMB) is the implementing agency (IA) of the sub-projects. 4. The sub-project has a total length of about km from 500kV Song May substation in Dong Nai province to 220kV Uyen Hung substation in Binh Duong province. Locations of this subproject are listed in Table 1: Table 1. The 220kV Song May Uyen Hung Transmission Line starts from the 220kV busbar of the 500kV Song May Substation at Bac Son commune, Trang Bom district, Dong Nai province to ends at the 220kV busbar of the 220kV Uyen Hung Substation at Uyen Hung district, Binh Duong province. The subproject will affect 214 households and 08 institutions and agencies in which 36 households is acquired land for constructing tower foundation and 15 households with grade 4 and 5 are affected. There are not any public facilities, historical and cultural structures affected by the subproject. 8. Total land affected by subproject is about 469, m2, of which 15,478.4 m2 of land, including 7,614.7 m2 managed by the Government, is permanently acquired for tower foundations and 453, m2 of land affected by ROW. 9. The total land of 7,086.4 m2 in Binh Duong province is permanently occupied by construction of tower foundations (38 towers). While the total area for constructing 32 tower foundations in Dong Nai is 8,392 m2 including m2 propertied by the local GOV that will not be compensated. 10. The main environmental issues during construction phase of the subproject are identified as following: Impact on vegetation: Trees and crops will be potentially damaged by construction activities such as assembly of steel towers, transmission line stringing, and temporary facilities such as materials storage, construction camp, and assembly areas. Soil runoff: Dong Nai River, Song May stream, irrigation and drainage canals in the subproject area will be affected by potential runoff during the construction phase. Impact on water quality: domestic sewage from construction workers, contamination due to spillage of oil and other lubricants, contamination due to disposal of construction wastes, and wastewater from washing of construction equipment and vehicles will potentially pollute the rivers, including the drainage canals and irrigation canals. Impact on air quality: Air quality in the area can be affected by exhaust gases containing total suspended particulates (TSP), SOx, NOx, and CO due to the movement of construction vehicles, excavation and backfilling works. Noise: Movement of vehicles transporting, construction activities make noisy and impact to surrounding residential areas. Construction waste: During the construction of the transmission towers, construction wastes such as discarded construction materials, cement bags, wood, steel, lubricants, fuels, and vegetation debris will be generated. 3

9 Disruption to traffic: The movement of construction vehicles along provincial and communal roads may cause increased traffic volume to and from the construction sites. Damage to infrastructure: The movement of vehicles and other construction activities may cause damage to irrigation and drainage canals crossed by or adjacent to the construction sites. The increased movement of vehicles along the existing access roads may also potentially damage the roads. Occupational health and safety: Construction activities may cause harm and danger to the lives and welfare of workers. Community health and safety: The project construction will result to impacts to community health and safety such as construction traffic, transport of materials, fires, emergency spills of materials, and unauthorized entry by the villagers into dangerous working areas. 11. To meet Vietnam regulations on environmental protection and ADB safeguard policy, the IEE report and EPC of the 220kV Song May Uyen Hung Transmission Line were approved by ADB and the state management agency on environment protection Report Purpose 12. This semi-annual report will describe progress with implementation of the EMP and compliance issues and carry out the environmental and social management programs during the work execution phase. The main contents are as follows: (i) (ii) Subproject implementation progress; Compliance with ADB loan covenants and applicable government laws, regulations and requirements; (iii) Incorporation of safeguard requirements into project contractual arrangements; (iv) (v) (vi) Environmental mitigations and compensation measures implemented; Summary of inspection activities; Key issues and recommendation. 4

10 2. Project Implementation Progress 13. The 220kV Song May Uyen Hung transmission line has 22,213km long and 70 towers. The construction progress of 220kV Song May - Uyen Hung up to end of December 2014 achieved 100%. 12 3. Compliance with ADB loan covenants and applicable government laws, regulations and requirements 16. The subproject shall be complied with ADB safeguard requirements, Vietnam laws and regulations including Vietnam s obligations under international law. 17. The Table 4 presents the Laws and regulations which the subproject shall be complied. 13 18. The subproject compliance with the ADB safeguard requirements are as the in Table 5. 14 1 Periodic monitoring report The SPMB prepared and submitted the following monitoring report: - Quarterly internal monitoring report No.1 in March, No.2 in June, No.3 in September, No. 4 in December 2014; - Semi-annual report No.1 in June The subproject compliance with the Vietnam regulations on environmental protection is presented in the Table 6. Incorporation of Safeguard Requirements into Project Contractual Arrangements 21. The Contract Agreement for construction the 220kV Song May Uyen Hưng Transmission Line has been signed between National Power Transmission (NPT), represented by the Southern Vietnam Power Project Management Board and Songda11-ThangLong Joint Stock Company. 22. The contractual agreement between the client (SPMB) and the Contractor indicates that the Contractor shall be undertaken mitigation measures in execution phase to avoid and minimize negative impacts on social and environment. The Environment management plan was enclosed in the working contract with Contractor. 23. The Biding Documents and the Contract Agreement included safeguard requirements, in which EMP mentioned in the IEE and the ECP are being adhered to during construction phase. 24. Monitoring program undertaken by the SPMB and Contractor during the excuting phase is presented in Table 7: 10

Environmental Mitigations and Compensation Measures Implemented 25. The mitigating measures to minimise the environmental impacts on environmental quality include the following: Air quality: It shall apply measures to avoid and minimize air pollution caused by the construction activities such as regularly maintained construction vehicles to limit exhaust fumes generation, water sprinkling in access road near communities to reduce dust during dry and windy conditions. Water quality: It shall apply measures to prevent waste water running off from construction site, material storage area and worker camps to drainage and irrigation system. Noise quality: The contractor shall apply appropriate measures to control noise and vibration, creating by construction equipment such as regularly checking and maintaining vehicles and equipment, limit to use powered equipment at night near residential and school areas. Solid waste management: Excavated materials to be reused as fill material and the other construction debris will be disposed in an approved site by the village 12

18 authorities. Domestic solid waste will be stored in a covered container and periodically collected by functional agency. Hazardous management: Hazardous waste will be managed accordance with Circular 12/2011/TT-BTNMT dated l4/4/2011. Soil environment: It shall apply technical measures to minimize negative impacts on soil environment. Biodiversity and natural resources: It shall identify and inventory the affected trees by the construction activities and the workers only allow cutting permitted trees and prohibit from harvesting wood in the project area. Health and safety: Training courses and orientation will be conducted for workers to improve their knowledge and skill on construction health and safety management. Health and safety program will be prepared and strictly implemented by the contractors including provide first-aid facilities, properly sanitation, water supply and personal safety devices for workers; provision of signs, barriers, and gates/posts surrounding transmission towers particularly in built-up areas. Living conditions: the contractors apply measures to limit and reduce negative impact on living condition of local people including avoiding disturbance of field crops within one month of harvest wherever possible 5.1. Environment compliance at construction site 26. Table 8 shows the implemented mitigation measures on environmental and compensation by the contractors. The SPMB s staff for environmental and technical supervision regularly visits the construction site and monitors the safeguard compliance of the contractors. The safeguards undertaken compliance as following: - Supervise the Contractors in their performance of safety methods and safety regulations on the site. - Examine, request, and supervise the Contractor in its implementation of traffic organization methods within the site and at the locations crossing the existing roads. - Instruct and supervise the Contractors to carry out the environmental and social management programs during the work execution; 20

26 - Examine and supervise the environment protection methods in favour of the workers on the site and the surrounding environment proposed by the Contractor, including: dust and noise mitigation measures, waste treatment and site clearing methods. Contractors Inspection 30. Contractors mobilize enough human, technical resources to timely prevent or mitigate possible advert environmental impacts caused by construction works or recovery works at site. Contractors daily implement mitigation measures and undertake internal monitoring safeguards compliance including conducts detailed inventory of the identified environmental and social impacts that will be caused by executing the works. 31. Contractors timely prevent or mitigate possible advert environmental and social impacts caused by construction works and recovery works. National Safeguard Consultant for Environment 32. The Consultant undertakes environmental safeguard policy compliance monitoring as below: - Coordinate with the related agencies to ensure that the EMPs including all proposed mitigation measures and monitoring programs are properly implemented. - Monitor environmental safeguard policy compliance of subprojects during implementation including pre-construction and construction phase. 7. Key Issues And Recommendation 7.1. Key Issues Safety and land subsidence 33. Project s activities of tower erection and implementing cable stringing may cause unsafe for worker, community in especial cases as follows: - In the rainy and stormy season and the works in lower land area such as tower foundation No. 20, 21, 22, 23, 24, 25, 27, 22A, 23A and 23B. - In areas adjacent to the existing transmission lines such as in area crossing the 550kV Song May Tan Dinh transmission line at location from 4B to G5A, and 500kV Pleiku-Tan Dinh at location from G8A to G8B, and in area of parallel with existing transmission line at location of G0-G1, G5B G6, G6 G7, G9-G10. - In the area crossing Dong Nai River, provincial road N0 768 and N

27 34. Some tower locations have sign of land subsidence, particularly at tower No. 29 and No.37. Hygienic sanitation at worker camp and material storage area 35. Contractor uses some area for worker camps and material storage areas such as material storage at Thai My commune, worker camp in Bac Son commune. It generates domestic waste and redundant materials from worker daily activities and construction works. The contractor shall keep hygienic sanitation before demobilize workers and hand over these areas to local people Recommendation Safety and land subsidence 36. The Contractor shall apply measures to prevent the works flooded in rainy season, especially in the lower areas. 37. The Contractor should enhance safety measures for workers, especially working in high elevation, in area crossing and parallel with the existing transmission. The Contractor shall apply, but not limited to, the following measures: - The Contractor should provide sufficient personal safety devices for workers including: safety boots, helmets, gloves, protective clothes, safety belt; - Theo Contractor should provide medicine cabinet and equipment for first aid at the site; - Each construction team should have at least a staff who knows first aid for emergencies. 38. The contractor shall apply measures to ensure community safety, particularly during cable stringing. The Contractor shall apply, but not limited to, the following measures: - It should have more concern on warning signs and barrier and has warning lamp at night when implement cable stringing over the barricades. - It should more pay attention on erecting scaffold and arrange flag person when cable stringing over the significant barricades such as Dong Nai river and roads, and crossing other existing electrical transmission line. 22

28 39. Land subsidence: - Treatment the land subsidence area: The contractor shall undertake suitable measures for treatment land subsidence of tower No. 29 and No Land subsidence monitoring: It should be regularly inspected during tower construction and have timely solution. Hygienic sanitation at worker camp and material storage area 40. Hygienic sanitation at worker camp and material storage area: - The Contractor shall remove from the worker camps and material storage areas all waste from whatever source on site. - Any spoil or debris from construction works being deposited on worker camp and storage area shall be removed and the affected land and areas will be restored to their natural condition before handover these areas to local people. Recommend for operation stage 41. The operation phase shall comply with regulations on performance, maintenance and repair of power transmission line. It should have regular inspection and timely solutions for the illegal activities on safety corridor, issues raising during operation as well as the impacts to local people. 23
