3 General Information The 37th Annual Seminar of the Florida Municipal Attorneys Association (FMAA) will be held at The Ritz-Carlton Key Biscayne, Miami on July 12-14, The seminar will begin on Thursday afternoon at 12:45 p.m. with sessions on Friday and Saturday mornings. A tentative program has been included as a general representation of topics to be discussed. Although unlikely, the tentative program is subject to change. A full reception including cocktails and heavy hors d oeuvres is planned for Thursday evening. Up to two tickets for the reception are included in the registration fee. Additional reception tickets may be purchased at a cost of $15.00 for children ages 5-12 and $25.00 for children older than 12 and adults. A luncheon is planned for Friday afternoon and one ticket is included in the registration fee. Additional luncheon tickets may be purchased for $ Seminar Registration You are encouraged to register in advance to avoid any delays at the seminar registration desk. Visa or MasterCard payments are also accepted, but must be made online only. When your registration form is received, a confirmation of registration will be ed. Please Note: If you are physically challenged and require special services, or if you have special dietary needs, please attach a written description to your registration form. 1

4 Online Registration FMAA offers a convenient online registration option through our website at Simply follow the instructions and complete the registration form. You can select to send a check to the address noted above, or you can pay directly online with a Visa or MasterCard. Registrations submitted and paid online via credit card will automatically be marked as paid and you will receive your seminar confirmation immediately via ! (You must supply your address to receive your confirmation.) Confirmations include your registration information, totals and registration number for your reference. Please note that payments via credit card may only be made online. NOTE: Online registration is subject to the same deadlines as regular registration. If you select to pay by check, your payment must reach the FMAA office postmarked no later than June 21, 2018, to qualify for the early registration fee. Otherwise, your registration will be subject to the higher regular fee. Registration Fee The early registration fee for the 37th Annual Seminar is $ and must be postmarked on or before June 21, Registrations postmarked after June 21 will be subject to the regular registration fee of $ This fee covers all refreshment breaks, two tickets for the reception on Thursday evening, one Friday luncheon ticket and all printed materials. 2

5 Refunds In the event prepaid registrants find it impossible to attend the seminar, a letter or fax received in our office to that effect by 5:00 p.m., Friday June 29, 2018, will authorize a full refund. Prepaid registrants not canceled by 5:00 p.m., Friday, June 29 will be included in the guaranteed attendance count. Because of the need to give advance guarantees, no refunds can be made after June 29, or for early departure from the seminar. Hotel Accommodations The Ritz-Carlton Key Biscayne, Miami is the location for the FMAA Seminar in Located on a barrier island just minutes from the heart of Miami, the resort offers a wide variety of opportunities for entertainment and relaxation. FMAA has negotiated the reduced rate of $215/night for standard guest rooms. Valet parking is also available for the reduced rate of $20/day. Reservation Procedures Reservations can be made by calling 1-(800) and referencing the FMAA Annual Seminar; or via an online link that you will receive with your registration confirmation. Reservations must be made prior to June 11, 2018, to help ensure rate and availability. Remember that we are unable to guarantee reservations for anyone, nor the exact date on which the hotel block will sell out, so don t delay. Resort Policies Check-in time is after 4:00 p.m. Check-out time is before 11:00 a.m. Cancellations must be made at least 7 days in advance of scheduled arrival in order to avoid a two-night penalty. A credit card is required to guarantee reservations. Tax exempt forms must be shown at time of payment, or sent with payment if paying in advance. 3

Whistleblower Protection Laws: An overview of state and federal whistleblower protection laws applicable to public employees, recent legal developments, and practice tips for city attorneys. 2. Sexual Harassment Policies and Training: Guidance for the city attorney on prevention, policies and procedures for addressing sexual harassment in the workplace, including issues associated with conduct of elected officials and persons doing business with the city. 3. Constitutional Claims in Municipal Employment Actions: A presentation on constitutional claims and possible defenses to them that may arise in municipal employment actions, including First Amendment, Fourth Amendment, Section 1983, and Title VII claims. 2:20 p.m. - 3:40 p.m. Municipal Liability 1. Qualified Immunity Update: The nuts and bolts of various legal proceedings against public officials and employees and recent caselaw, including interlocutory appeals on questions of qualified immunity. 5

Appellate Law Basics for the City Attorney: A primer on the types of appellate processes typically encountered in municipal law practice, their associated procedural and substantive requirements, and the role of the city attorney within them. 3. Section 1983 Civil Rights Actions: A presentation on municipal liability under Section 1983, including recent cases and trends, and best practices for a good municipal defense. 3:45 p.m. - 5:00 p.m. Ethics and Professionalism for the City Attorney 1. State and Local Ethics Codes: An overview and update on recent decisions relating to the state code of ethics for all public officers and employees, code of ethics provisions and decisions uniquely affecting city attorneys, as well as considerations for jurisdictions having or considering local ethics ordinances. 2. Managing the Attorney-Client Relationship During External Agency Investigations: A presentation on the role and duties of the city attorney when the city, its officials or employees are subject to investigations or inquiry by outside agencies, such as the Office of Inspector General, the Federal Bureau of Investigation, the Florida Commission on Ethics, or local ethics bodies. 5:45 p.m. Reception Friday, July 13, :45 a.m. - 8:15 a.m. Continental Breakfast 7:45 a.m. - 12:00 p.m. Registration 8:00 a.m. - 9:30 a.m. Technology and the City Attorney 1. The City Attorney s Role in Planning for and Responding to Crisis: Sharing insights and practice tips gained from recent mass casualty tragedies on how the city attorney can help municipal governments better prepare, respond, and manage. 2. Our Friend FEMA: Practice tips and legal considerations for contracting and reimbursement strategies relating to the Federal Emergency Management Agency. 3. Legal Considerations in Natural Disaster Planning, Preparation, Response and Recovery: A presentation on the array of considerations that arise in disaster planning and recovery, including shelter planning, public meeting cancellations and rescheduling, employee/workplace issues for critical employees during declared emergencies, code enforcement, and fee or permit extensions or waivers. 10:55 a.m. - 12:10 p.m. Intergovernmental Relations: Planes, Trains and Automobiles 1. The Federal Aviation Administration and Airports: A presentation on unique issues associated with airports that arise in municipal law practice, including applicable FAA regulations, zoning and land use issues, and applicability of ad valorem taxes. 2. The Regulation of Railroad Activity: An overview of legal issues involving freight and passenger railroads that traverse municipal jurisdictions, as well as available strategies for municipalities to address potential impacts. 7

Legal Issues in Planning for Sea Level Rise: An introduction to the legal implications of planning (or not) for sea level rise, particularly liabilities associated with impacts to infrastructure such as roads and stormwater, and legal and property rights considerations associated with various coastal adaptation and mitigation strategies. 2. The Marjory Stoneman Douglas High School Public Safety Act of 2018: A presentation on aspects of SB 7026 that impact municipal governments, particularly new processes for law enforcement to obtain Risk Protection Orders for the surrender of firearms, the seizure of firearms incident to a Baker Act proceeding, and the provision of school resource officers by municipal law enforcement agencies. 3. Issue Campaign Advocacy by Cities and Elected Officials: An overview of Florida s election code requirements governing issue campaign advocacy by municipalities and their elected officials. 10:40 a.m. - 11:55 a.m. Hot Topics II 1. Private Property, Public Use & the Beach: An overview of the unique challenges associated with balancing the public s right to access and use the beach with the interests of beachfront property owners, including recent legislative and legal changes relating to customary use. 2. Annexation: A presentation on unexpected issues that arise in annexation proceedings and how to avoid the unexpected, including special considerations for non-contiguous properties, right-of-way and utility considerations, and drafting considerations for annexation agreements. 3. Legislative and Constitutional Amendment Update: A review of bills that passed (and some that didn t but are sure to be back) in the 2018 legislative session, as well as a review of constitutional amendments that will be on the 2018 ballot in November. 12:00 p.m. Adjourn 9
