5 EECS Dmain Prtcl A Intrductin The framewrk specified in the EECS Rules and the detailed prcedures and cnditins specified in this Dmain Prtcl have the main bjective f ensuring rbustness and transparency in the facilitatin f EECS Schemes fr all EECS Participants. A Dmain Prtcl prmtes quality and clarity, as it: makes lcal rules transparent; prvides clear infrmatin t all stakehlders (cnsumers, market parties, ther members, gvernment, the EU Cmmissin etc.); facilitates assessment f cmpliance and permissible variance frm the EECS Rules; facilitates audit; and translates lcal rules int a single frmat and language, supprting each f the abve. Imprtant cntact infrmatin is prvided in Annex 1. The bjective is t ensure an acceptable level f rbustness and transparency in the facilitatin f the EECS Electricity Scheme fr all Scheme Participants. B General B.1 Scpe B.1.1. This Dmain Prtcl sets ut the prcedures, rights and bligatins, which apply t the Dmain f France (metrplitan and verseas) and relate t the EECS Electricity Scheme as defined in the EECS Rules. B.1.2. Prductin Device qualificatin fr this Dmain will be determined by cnnectin t the electricity system f France (metrplitan and verseas) such that, in electrical terms, the Prductin Device is effectively lcated in France. B.1.3. Pwernext is authrised t Issue EECS Certificates relating t the fllwing EECS Prduct(s): EECS-GO, including EECS-GO-RES and EECS-GO-CHP, ICS. Pwernext SA has been appinted as Authrised Issuing Bdy and Cmpetent Bdy by a decree f the French Ministry f Eclgy, Sustainable Develpment and Energy dated December 19th 2012 and published n January 15th 2013 t act as Issuing Bdy fr EECS-GO. This designatin enters int frce n May 1st 2013 and shall be valid fr five years thereafter. As such it registers Prductin Devices, issues, transfers and cancels EECS-GO. Pwernext als acts as Registry Operatr. As such, it administrates the peratin f the EECS Registry within France. The Registry technical and peratinal supprt is exercised by Pwernext. 6 EECS Dmain Prtcl B.2 Status and Interpretatin B.2.1. The EECS Rules are subsidiary and supplementary t natinal legislatin. B.2.2. The EECS Rules and its subsidiary dcuments are implemented in France in the manner described in this Dmain Prtcl. Any deviatins frm the prvisins f the EECS Rules that may have material effect are set ut in sectin C.5 f this dcument. The capitalised terms used in this Dmain Prtcl shall have the meanings ascribed t them in the EECS Rules except as stated in sectin C.5 f this dcument. B.2.3. This Dmain Prtcl is made cntractually binding between an EECS Participant and Pwernext by agreement in the frm f the Standard Terms and Cnditins. B.2.4. In the event f a dispute, the apprved English versin f this Dmain Prtcl will take precedence ver a lcal language versin. B.3 Rles and Respnsibilities B.3.1. The Authrised Issuing Bdy fr EECS-GO in France is Pwernext. Its rle is t administer the EECS Registratin Database and its interface with the AIB Cmmunicatins Hub. As Authrised Issuing Bdy, Pwernext is the Prductin Registrar that registers the Prductin Devices and as such, carries ut a systematic verificatin f each Prductin Device registered. In this rle, it is entitled t request assistance frm the Measurement Bdies, wh are the relevant Transmissin r Distributin System Operatrs, fr the verificatin f Prductin Devices. Accrding t Article R f the Energy Cde, the relevant Transmissin r Distributin System Operatr is bliged t answer such verificatin request frm Pwernext in due time. B.3.2. The Cmpetent Authrity fr EECS-GO in France is the French Energy Ministry. Its rle is defined by legislatin t be respnsible fr the peratin f fr EECS-GO in France. B.3.3. The Authrised Measurement Bdy are listed hereunder: RTE (Réseau de Transprt d Electricité) ERDF (Electricité Réseau Distributin de France) List f Lcal Distributin Cmpanies (Entreprises lcales de distributin en France ELD) available n the fllwing website : They are the bdies established under natinal regulatin t be respnsible fr the cllectin and validatin f measured vlumes f energy used in natinal financial settlement prcesses. 8 EECS Dmain Prtcl C Overview f Natinal Legal and Regulatry Framewrk C.1 The EECS Framewrk C.1.1. Fr France, the relevant lcal enabling legislatin is as fllws: The relevant EU legislatin is Directive n /EC f April 23 rd 2009 n the prmtin f the use f energy frm renewable surces. This EU Directive has been implemented int French law by Ordnnance n f September 14 th This Ordnnance intrduces new articles in the Energy Cde. The mechanism f Guaranties f Origin in France fr renewable energy and cgeneratin is implemented in the law by the article R314 f the French Energy Cde. It specifies the bligatin and pwers f the entity in charge f issuing, transferring and cancelling GOs. It als details hw the French GO mechanism is functining. Disclsure rules and bligatin are implemented in the law by the article R333 f the French Energy Cde mdified by the Decree n f July 11 th French Energy Cde is available n this website: 208&dateTexte= The main items are the fllwing: Accrding t Article L f the French Energy Cde, nly GOs can certify the rigin f the electricity prduced frm renewable surces in rder t prve t final cnsumers that subscribed t a green ffer the quantity f energy prduced frm renewable surces. Guarantees f Origin are issued fr net prductin n a mnthly basis. Guarantees f Origin may be issued within 5 mnths frm the end f the related prductin perid and expire after 12 mnths after the end f the related prductin perid. Article R details the GO recgnitin frm ther Eurpean cuntries. Unless Pwernext has well-funded dubts abut the accuracy, reliability r veracity f GOs frm anther Eurpean Cuntry, then Pwernext ntifies the French Ministry. The French Ministry then decides whether r nt t accept GOs frm this cuntry. The article R specifies that t prve the rigin f electricity cnsumed in respect f a calendar year, GOs must be used befre the 31 st March f the fllwing year. 9 EECS Dmain Prtcl Arrêté f Nvember 8 th 2007, prvides rules relating t the prductin that can be certified as energy prduced frm renewable surces and CHP surces. C.1.2. Pwernext has been prperly appinted as an Authrised Issuing Bdy fr EECS-GO under Arrêté f December 19th 2012, published n January 15 th 2013 which designates Pwernext as the Cmpetent Bdy fr issuing, transferring and cancelling GOs. C.2 Natinal Electricity Surce Disclsure C.2.1. Legislatin and regulatin: Article R f the French Energy Cde mdified by the Decree n f July 11 th 2016, describes the bligatin fr suppliers t disclse infrmatin t the final cnsumer regarding the electricity supplied. Suppliers have t indicate n their bill (r an attached dcument) and n any prmtinal dcument the share f the different primary energy surces that have been used t prduce the electricity sld. Suppliers als have t indicate infrmatin n the quantity f carbn dixide emissins and/r radiactive waste per kwh prduced frm these primary energy surces.the French residual mix published by Pwernext must be used by the supplier insfar as his supplier mix cnsists f untracked electricity. GOs are the nly accepted tracking mechanism that is recgnised with regard t electricity frm renewable surces. Accrding t Article L f the French Energy Cde, nly GOs can certify the rigin f the electricity prduced frm renewable surces in rder t prve t final cnsumers that subscribed t a green ffer the quantity f energy prduced frm renewable surces. Fr cnsumptin f year N, GOs must be cancelled befre 31 st March f year N+1. Article R f the French Energy Cde mdified by the Decree n f July 11 th 2016, ntifies that Pwernext is in charge f the disclsure f the French residual mix. It is published befre June 15 th f the fllwing calendar year. The calculatin methd is in line with the methd used by the AIB, in that manner, it prevents duble cunting f renewable energy surces. Article R f the French Energy Cde mdified by the Decree n f July 11th 2016, describes the bligatin fr suppliers t reprt t the French Ministry f Energy their supplier mix befre December 31 st f the fllwing calendar year. Agents frm the Ministry have the pwer t enquire in rder t verify disclsed data. The same regulatin applies t verseas territries (DOM-TOM). The nly exceptin is that ne residual mix is calculated per territry (see C.3.2.). C.2.2. Summary f the disclsure methdlgy and prcess: Fr all their green ffers, suppliers have the bligatin t use guarantees f rigin t certify the renewable rigin f the energy sld. The quantity f guarantees used ver a certain perid must be at least equal t the quantity f green energy sld. Furthermre, suppliers can use additinal guarantees in rder t increase the renewable share in their supplier mix. Pwernext 2016 Page 9 f 39

Fr standard ffers, the residual mix is used as a basis fr the calculatin f the supplier mix fr untracked electricity. C.2.3. Residual Mix: A residual mix is required t be calculated by the Registry Operatr. The methdlgy f calculatin is based n the Transactin based Eurpean Standard. The residual mix is published by the Registry Operatr befre the 15 th f June f the fllwing year. It is published n the fllwing website: Overseas are nt taken int accunt in the metrplitan residual mix. In case f GOs transactins in ne f these territries, a residual mix wuld als be calculated fr this territry. In the meantime, the residual mix fr each versea territry is equal t the prductin mix f the same territry. C.3 Natinal Public Supprt Schemes In France, different types f supprt schemes are in place. Prductin supprts France intrduced a feed-in tariff mechanism t supprt renewable energy thrugh the applicatin f article 10 f Law n f 10 th February 2000.Sme French renewable energy prducers (running wind farms, phtvltaic and ther types f prductin devices depending n their size) are guaranteed regulated feed-in tariff fr their utput, regardless market price. A few defined market participants are bliged t buy this electricity at this feed-in price and are then reimbursed by the French state. Regulated feed-in tariffs depend n the type f prductin devices cncerned and are published by arrêté that are revised peridically. Details n this mechanism can be fund n the ministry website (in French): Prducers selling their renewable utput under this scheme cannt apply fr the issuance f guarantees f rigin fr this utput; nly bligated buyers can d s. Prductin supprts n a specific prductin device are systematically indicated n each EECS-GO f this prductin device, alng with their duratin and amunt in eur. France intrduced a feed-in premium mechanism thrugh the applicatin f Decree n f 27 th May Prducers selling their renewable utput under this scheme cannt apply fr the issuance f guarantees f rigin fr this utput. The amunt f green electricity prduced under this scheme will be cunted in the residual mix. Investment supprts There exist varius investment supprt schemes in France at natinal level r reginal level. Investment supprts n a specific prductin device have t be indicated n each EECS-GO f this prductin device, alng with the amunt received. C.4 EECS Prduct Rules C.4.1. The EECS Prduct Rules as applied in France are set ut within sectins D and E f this dcument. Pwernext 2016 Page 10 f 39

11 EECS Dmain Prtcl C.5 Lcal Deviatins frm the EECS Rules D Registratin French legislatin differs frm the EECS Rules n the fllwing pints: - "A Registrant may request Pwernext t issue Guarantees f Origin. Such request must be submitted t Pwernext n later than five mnths after the end f the prductin perid. A Registrant cannt request the issuance f GOs fr prductin perids exceeding ne calendar mnth, unless the Output f a Prductin Device during a calendar mnth is less than ne MWh. In that case, such Output may be carried frward fr a perid f up t five mnths until the lwer limit f ne MWh is reached, and the prductin perid in the request may be extended accrdingly. - Pwernext shall issue a number f Guarantees f Origin equal t the amunt f electricity prduced during the prductin perid t which the request relates, runding dwn t whle MWh. Any remaining amunts f electricity shall nt be carried frward. - Accrding t Decree f 8th Nvember 2007, the prductin f renewable electricity frm a pumped strage hydr pwer plant fed by natural inflw as well as by pumping that can be subject t EECS-GO issuance is equal t the ttal electricity prductin frm the Prductin Device, minus energy cnsumed in pumping, assuming a nrmative yield f 70% fr pumped energy - Accrding t Decree f 8th Nvember 2007, the prductin f energy frm a municipal waste incineratin plant that can be subject t EECS-GO issuance is equal t 50% f the ttal electricity prductin frm the Prductin Device. - Accrding t Decree f 8th Nvember 2007, EECS-GO can be delivered t cmbined Prductin Devices prducing electricity bth frm bimass and cmbustin fuels ther than thse mentined in the paragraph abve, nly if their fractin f nnrenewable energy is less than 15% f the primary energy it cnsumes n a yearly average. If such is the case, then the part f electricity that is renewable and can be subject t EECS-GO issuance is equal t 85% f the whle electricity prduced by the Prductin Device. - The Pwernext Registry handles EECS-GO and EECS-GO certificates with an additinal ICS label that can be used in France, accrding t the French legislatin. Pwernext des nt accept Nn-Gvernmental Certificates. D.1 Registratin f an Accunt Hlder D.1.1. Applicatins Any legal persn wh is nt a member f the Assciatin f Issuing Bdies r such member s affiliate r agent can be a participant f the EECS Scheme. An applicatin t becme an Accunt Hlder is dne by cnnecting t the public website f the Issuing Bdy in the registratin sectin in rder t btain the registratin frms (such request can als be dne by phne r by regular mail). Pwernext sends the applicant the dcumentatin that must be filled in rder t becme an Accunt Hlder. These dcuments must be cmpleted and signed by the applicant and sent back t Pwernext. They include : The Standard Terms and Cnditins; (2 cpies) Pwernext 2016 Page 11 f 39

12 EECS Dmain Prtcl The admissin frm, including a specific questinnaire n the future activity f the Accunt hlder n the registry; (1 cpy) Identificatin infrmatin abut the applicant (registered ffice address and VAT number); A list f the senir managers and ther representatives with the pwer t sign all f the dcuments relating t the peratin f the registry (authrised signatries) A cpy f the annual reprt, cmpany registratin, articles f assciatin and the senir managers pwers, prepared in accrdance with the legislatin f the applicant s hme cuntry. The cmpleteness and the adequacy f the dcuments sent back t Pwernext by the applicant are then checked by the market peratins and market surveillance team f Pwernext, which assess whether the applicant can be accepted. Mrever: As the case may be, additinal dcumentatin may be required frm the applicant; Depending n the analysis f the cmpany, a risk prfile will be attached t it. If a cmpany raises awareness, a specific attentin will be paid t its actins n the registry; In case the market surveillance team has serius dubts regarding the applicant cmpany, it can alert the cmpetent authrities (Ministry r else). When the assessment f the applicatin is cmpleted by Pwernext and the applicatin has been accepted, Pwernext signs the Standard Terms and Cnditins and sends its cpy back t the applicant wh then becmes an Accunt Hlder. Alng with the Standard terms and Cnditins, Pwernext sends the Accunt Hlder the physical ID keys tgether with the lgin and passwrd which will be used t cnnect t the secure part f the website. Fr security reasns, the lgin and passwrd are sent separately. Pwernext will answer any applicatin request as quickly as pssible. It shuld take place within ne mnth after receipt f the cmplete necessary data fr applicatin. Tariff f services can be fund n ur website: D.1.2. Maintenance f standing data An Accunt Hlder must ntify Pwernext withut any delay f any upcming changes that will result, r unplanned changes that have resulted, in the infrmatin recrded in the EECS registry in relatin t the Accunt Hlder becming inaccurate. The Accunt Hlder himself is respnsible fr keeping the Accunt Hlder infrmatin recrded in the EECS registry accurate. This can be dne by lgging nt the Registry and nly by an accredited user f the Accunt Hlder. Mrever, any change dne this way will ultimately be validated by Pwernext. D.2 Resignatin f an Accunt Hlder In accrdance with the Standard Terms and Cnditins, the Accunt Hlder must ntify Pwernext f its intent t clse its Accunt in written frm. Such request shall be effective ne (1) mnth after receipt by Pwernext. Pwernext 2016 Page 12 f 39

Any EECS-GOs remaining in the Accunt f the EECS registry at the time f lcking will remain there until being expired. Outstanding charges are still due accrding t the invices received. D.3 Registratin f a Prductin Device D.3.1. Prcesses: In rder t issue EECS-GOs, the Accunt Hlder must register prductin devices accrding t the prcess described in the chart hereunder and described in the fllwing paragraphs. Registratin f a Prductin Device 1. The Accunt Hlder cnnects t its persnal secure accunt n the Registry and g t the «Prductin Device» sectin. It fills in the Prductin registratin Frm. 2. The Accunt Hlder sends the dcuments needed abut the Prductin Device. 3. Autmatic and peratinal check: are the infrmatin n the Prductin Device adequate and sufficient in rder t prve its cmpliance with EECS rules and the French Dmain Prtcl? 4. Further infrmatin are asked by Pwernext t the Accunt Hlder. 5. An peratr frm Pwernext pre-validates the prductin device in the database and send the relevant data t the relevant TSO/DSO. Applicatin A: Autmatic check f cmpleteness, but the prcess is manual fr the Accunt Hlder/TSO Prductin Devices can nly be registered if they meet the Prductin Device Qualificatin Criteria fr EECS-GO and the French relevant legislatin. T be qualified, Prductin Devices must: M: The cherence f the infrmatin is manually checked by Pwernext be lcated in France (metrplitan r verseas), be capable f prducing electricity using renewable energy surces r cgeneratin, and be equipped with an electricity-metering device capable f measuring the electricity prduced. Only the wner f a Prductin Device, a cmpany duly authrised by the wner f a Prductin Device, r an bligated energy purchaser identified in the French feed-in tariffs scheme (as defined in article L , L et L f the French cde de l énergie ) may register a Prductin Device, which is lcated in France in the EECS registry. A prducer wner f a prductin device that satisfies the criteria in the paragraph abve and which prduces electricity sld t bligated energy purchasers at the French feed-in Pwernext 2016 Page 13 f 39

In rder t register a prductin device, the fllwing prcedure applies: The Accunt Hlder must cnnect n its persnal secure accunt n the Registry and g t the Prductin Devices sectin. The Accunt Hlder must fill in the Prductin Device electrnic registratin frm (see Annex 3) and send the dcumentatin requested abut the Prductin Device, in accrdance with the Prductin Device Qualificatin Criteria fr EECS-GO and the French relevant legislatin. This dcumentatin cmprises the infrmatin hereunder. This list might evlve depending n Prductin Device Qualificatin Criteria fr EECS-GO and the French relevant legislatin pssible evlutins. Prductin device: name, address/lcatin, start date, cmmissining date, installed capacity, the types f supprt (investment and/r prductin supprt, as apprpriate), wner, Accunt Hlder, transmissin r distributin system peratr n which the Prductin Device is cnnected, applied EECS Schemes, references f the explitatin authrizatin, references f the grid access cntract, Cdes f all pssible fuels which can be cnverted int electricity by the Prductin Device accrding t the fuel cdes in AIB EECS fact Sheet, Technlgy cde f the Prductin Device accrding t technlgy cdes in AIB EECS Fact Sheet 5, Specificatin whether the Prductin Device is eligible fr any kind f supprt scheme (including investment supprt and feed-in tariffs), crrespnding amunt and perid f the supprt scheme. In case f feed-in tariffs, reference t the purchasing bligatin cntract, Additinal fields can be required fr specific Prductin Devices such as cgeneratin devices. The attentin f the Accunt Hlders is drawn t the fact that sme f the required infrmatin n the Prductin Device will nt appear n the EECS- GO. In sme cases (e.g. the reference f the declaratin f cnnectin f the prductin device t the grid r the amunt and duratin f supprt schemes), the data will be indicated n the French EECS-GO but might be lst when the EECS-GO is exprted. An autmatic check is carried ut in rder t ascertain whether the frms have been crrectly filled in. Operatrs frm Pwernext will then check whether the infrmatin given by the Accunt Hlder is in the right frmat and cherent. If the infrmatin given t Pwernext is adequate, data are sent t the relevant Transmissin r Distributin System Operatr in rder fr it t check them subject t the cnditins f the cntract signed with each f them. The relevant Transmissin r Distributin System Operatr checks the data required based n the infrmatin it pssesses n the Prductin Device and sends the utcme f this check t Pwernext. If the check is psitive, the Accunt Hlder is ntified when its Prductin Device is activated. A unique number is assciated with the prductin device, accrding t the AIB numbering. If the check is negative, Pwernext ntifies the Accunt Hlder and the Prductin Device is nt activated. A Prductin Device is registered fr three years. Pwernext 2016 Page 14 f 39

15 EECS Dmain Prtcl In case the Accunt Hlder r its affiliate is nt the wner r the sle wner f the Prductin Device, it must include in the applicatin Either a pwer(s) f attrney signed by the (ther) wner(s) f the Prductin Device, Or the Cntract f Purchasing Obligatin that links the prducer and the Accunt Hlder. Such agreement shall particularly ensure that duble issuing f EECS-GO is excluded. D.4 De-Registratin f a Prductin Device The Registrant must ntify Pwernext in the GO registry f its intentin t unregister a Prductin Device via written frm. The applicant must warn Pwernext at least 15 business days in advance f its intentin f de-registering a prductin device. Pwernext will answer the request by deactivating the prductin device in the shrtest delay and at maximum in a ne-mnth perid f time. Re-registratin requirements are similar t the registratin requirements described in D.3.2. Outstanding charges are still due accrding t the invices received. D.5 Maintenance f Prductin Device Registratin Data D.5.1. The Registrant f a Prductin Device must ntify Pwernext f any upcming planned changes that will result, r unplanned changes that have resulted, in: the infrmatin recrded in the EECS registry in relatin t the Prductin Device becming inaccurate; r the Qualificatin Criteria fr the EECS Prduct ceasing t be satisfied with respect t that Prductin Device. The Registrant ntifies Pwernext f such changes by making the necessary amendments t Prductin Device infrmatin in the EECS registry. On receipt f a change f details ntificatin (fllwing an inspectin r therwise), Pwernext will evaluate the impact f the changes n the Prductin Device Qualifying Criteria and respnd t the Registrant within sixty (60) days specifying the decisin taken. Pwernext may respnd t the changes by apprving r disapprving them in the EECS registry, r by requiring verificatin by the relevant Transmissin r Distributin System Operatr. If Pwernext des apprve the change, the prductin device is mdified with an effective date assciated t the change. 16 EECS Dmain Prtcl When Pwernext becmes aware that a Prductin Device n lnger fulfils, r will n lnger fulfil, the Prductin Device Qualificatin Criteria, the EECS registry recrd fr that Prductin Device will be updated t shw that the Prductin Device n lnger qualifies fr EECS-GO Prduct Certificates with effect frm: the date n which such planned changes are due t cme int effect, when such change has been planned and ntified in advance; r as sn as reasnably practicable after becming s aware, in case f ther changes. D.5.2. The registratin f a Prductin Device expires after three years. The Registrant must cnfirm the re-registratin f the Prductin Device befre expiry. D.6 Audit f Registered Prductin Devices D.6.1. Re-registratin f the Prductin Device every 3 years Pursuant t article R f the Energy Cde, Pwernext shall verify the accuracy f the data given in the requests fr issuance that it has received with the supprt f Transmissin System Operatrs and Distributin System Operatrs if needed. When re-registering a Prductin Device, Pwernext will verify tgether with the Accunt Hlder that the data n the Prductin Device have nt changed. In case a change is reprted, the relevant Grid Operatr will be cntacted. D.6.2. Regular check f the Prductin Devices with the Transmissin and Distributin System Operatrs At the regular meetings between Pwernext and the Grid Operatrs wh check the reliability f the Prductin Device data and the Issuance data, a systematic check is dne t verify the validity f the data registered n the Prductin Devices. In case f a change, the prcedure described in D.5.1. will apply. D.6.3. On-site audits are perfrmed t a sample f prductin devices by Pwernext Registered Prductin Devices which have been used fr requests r prcurement f EECS- GOs can be subject t n-site audits within the three years fllwing their registratin in the database f the Registry. This prcess is distinctive as it is mstly managed utside the sftware tl and implicates bth functinal peratrs and auditrs. The prcess described hereunder targets the cases where the auditr: belngs t the Pwernext emplyees authrized by reginal prefects fr this task r is a subcntractr chsen by Pwernext and whse emplyees have been authrized by reginal prefects fr this task. Audits are carried ut accrding t a prcedure, methds and evaluatin criteria which are transparent and in cnfrmity with Article R f the Energy Cde. This prcess is described hereunder: A ntificatin is sent t the Accunt Hlder (and t the wner f the Prductin Device if the Accunt Hlder has a pwer f attrney). A specific attentin is drawn t the Prductin Device Diagram, the place f the Meters and the calculatin f the net energy certified. If the result f the audit is psitive, the peratr indicates that the Prductin Device has been audited and is in cnfrmity with the registratin. The Accunt Hlder is ntified f this. A reprt stating the date, lcatin and nature f the bservatins made and testifying f the cnfrmity with the declaratin made n the Registry is sent t the Accunt Hlder and t the reginal prefect. If the result f the audit is negative, the peratr indicates n the Registry interface that the Prductin Device has been audited and is nt cmpliant. The Accunt Hlder is ntified f this and the Prductin Device is deactivated. If it appears that EECS-GOs were inaccurately issued as a result f this errr, then the prcedure described in E.9 may apply. A reprt stating the date, lcatin and nature f the bservatins made and testifying f the nn-cnfrmity with the declaratin made n the Registry is sent t the Accunt Hlder and t the reginal prefect. After deactivatin f the Prductin Device, the Accunt Hlder cannt request issuance f EECS-GOs fr this Prductin Device. In rder fr the Prductin Device t be reactivated, the Accunt Hlder will have t ask fr an additinal audit, which will be inviced t it. The Prductin Device will be reactived nly if the new audit is psitive. All the Prductin Devices registered can be subject t n-site audits. Peculiar attentin will be paid t the Prductin Devices whse EECS-GO s issuance fllws particular rules such as, fr instance, pumped strage hydr pwer plants, bimass prductin devices, cgeneratin devices, prductin devices cmbining bth renewable and nn-renewable surces. Fr n-site audits f Prductin Devices carried ut in accrdance with Article R f the Energy Cde, the Prductin auditrs can either be emplyees frm Pwernext authrized by reginal prefects r subcntractrs appinted by Pwernext whse emplyees have been authrized by reginal prefects. Fr cnsumptin declaratin apprvals in case f bimass cmbined prductin devices and cgeneratin plants, Prductin Auditrs must be independent frm the wner f the prductin device and need t be accredited by Pwernext; they d nt hwever need t be authrized by reginal prefects. The prcess f accreditatin is the fllwing: the legal entity (r the persn) wanting t becme a Prductin Auditr needs t apply fr such a rle, by sending t Pwernext a frmal letter alng with its credentials. On the basis f this applicatin, Pwernext will decide whether r nt t apprve such applicant. The answer will be given within tw mnths fllwing the receipt f the letter by Pwernext. Frm its date f registratin, and during the three years fllwing this registratin, the Prductin Device can be audited n-site by authrized agents. D.6.4. Accunt Hlders and wners f Prductin Devices agree t grant access t Pwernext agents fr n-site audits. Refusal t permit access shall be cnsidered a breach f the Standard Terms and Cnditins. D.6.5. If an inspectin identifies material differences frm the details recrded n the EECS Registratin Database, the Registrant must re-apply fr registratin f the Prductin Device. Pwernext 2016 Page 17 f 39

Any errrs in EECS Certificates resulting frm an errr in the registered data f a Prductin Device will be handled in accrdance with sectin E.9. D.7.2. Errr handling If Pwernext detects errrs in the Accunt Hlder infrmatin, it will ntify the Accunt Hlder in rder t ensure that the errr is rectified by the Accunt Hlder. If expressly authrised by the Accunt Hlder, Pwernext may rectify the errr itself. If Pwernext detects an errr in the infrmatin f a Prductin Device in the EECS Registry, the fllwing prcedure is applied: If the errr is minr and that the Prductin Device is still eligible fr EECS- GOs issuance, then Pwernext will ntify the Accunt Hlder in rder t ensure that the errr is rectified by the Accunt Hlder. If expressly authrised by the Accunt Hlder, Pwernext may rectify the errr itself; If the errr means that the Prductin Device ceases t be eligible fr EECS- GOs issuance, then the Prductin Device is deactivated. Fr the Prductin Device t be reactivated, the Accunt Hlder will have t ask fr an nsite audit, as described in Sectin D.6, which will be inviced t it. If it appears that EECS-GOs were inaccurately issued as a result f this errr, then the prcedure described in E.9 may apply. 19 EECS Dmain Prtcl E Certificate Systems Administratin E.1 Issuing EECS Certificates EECS-GOs can be issued: in respect f the qualifying energy utput f such a Prductin Device during any perid in which it was registered in the Pwernext registry fr the purpse f the EECS-GO Scheme; and fr a prductin perid f 1 mnth, it can be f a lnger perid in case f very small plants if the mnthly prductin is fewer than 1MWh. Even in that case, they can never exceed 5mnths;and when the issuing request fr a specific prductin was submitted nt later than 5 mnths after end f the prductin perid; and t an Accunt Hlder wh des nt have any utstanding fees payable t Pwernext in cnjunctin with EECS-GOs; and Each unit f qualifying energy utput can nly be certified nce fr electricity disclsure. The amunt f the prductin cncerned shall cincide with measurement data frm the Transmissin r Distributin System Operatr. These data will be checked by the relevant Transmissin r Distributin System Operatr. Additinal fields can be required fr specific Prductin Devices such as cgeneratin devices. An autmatic check is carried ut by Pwernext in rder t ascertain whether the initial infrmatin given by the applicant at this stage is sufficient and adequate, including a first check n the amunt f net prductin declared by the Accunt Hlder cmpared t the installed capacity f the Prductin Device and a check n the validity f the EECS-GO (dates f the issuance request accrding t E.1). The cmpleteness and the adequacy f the dcuments sent t Pwernext by the Accunt Hlder are then checked by Pwernext. As the case may be, the Accunt Hlder may als be requested t send additinal infrmatin. Specifically in case f cgeneratin r cmbined Prductin Devices, additinal dcuments are required in rder t check the additinal data required as mentined ine5 and E6. If the utcme f this check is negative, the Accunt Hlder is required t mdify its request. In case the check is psitive, tw different prcesses will be implemented t have the data checked by the relevant Measurement Bdies depending n the cntract signed between Pwernext and the relevant Measurement Bdy: Systematic check prcess: The Measurement Bdy sends the net prductin data based n the metering data it pssesses n the Prductin Device regarding this prductin perid. The EECS-GO is issued depending n the net prductin and the Accunt Hlder is ntified. Regular check prcess: In this case, the Accunt Hlder is required t send the metering data crrespnding t the EECS-GO t be issued. This dcument is checked by Pwernext tgether with metering data prvided by the Measurement Bdy. If the check is psitive, the EECS-GO is issued and the Accunt Hlder is ntified. Several times a year n a regular basis, (t be defined in the cntract with the Measurement Bdy), data n EECS-GO issued are then recnciled by the Measurement Bdy. The EECS-GO wuld then be crrected afterwards accrding t the methdlgy described in E.9 if any errr was detected by the Measurement Bdy during ne f its regular checks. Pwernext will answer any issuing request as quickly as pssible. Accrding t Article R f the Energy Cde, issuing shuld take place within thirty (30) days after receipt f the cmplete necessary data fr issuance. Accrding t Decree f 8th Nvember 2007, implementing Article R314 f the Energy Cde, EECS-GO can be delivered t cmbined Prductin Devices prducing electricity bth frm bimass and cmbustin fuels ther than thse mentined in the paragraph abve, nly if their fractin f nn-renewable energy is less than 15% f the primary energy it cnsumes, n a yearly average. If such is the case, then the part f electricity that is renewable and can be subject t EECS-GO issuance is equal t 85% f the whle electricity prduced by the Prductin Device. This yearly average is calculated n the basis f the previus calendar year r n the basis f the expected values fr new prductin devices. E.6 Cgeneratin Prductin Devices The way t calculate the amunt f prductin n which EECS-GOs can be issued is fully in line with Directive n 2012/27/EC. Accrding t Decree f 8 th Nvember 2007,implementing Article R314 f the Energy Cde, amngst cgeneratin Prductin Devices, nly thse justifying a rati f mre than 10% f primary energy saving calculated accrding t Annex I and II f the herementined Decree can issue guarantees f rigin. Accrding t the same Decree, a cgeneratin Prductin Device, the installed capacity f which is belw 1 MW, can be cnsidered eligible t the issuance f guarantees f rigin if their energy savings are higher than 0%, as ppsed t the 10% limit set fr larger devices. Accrding t Decree f 8 th Nvember 2007, implementing Article R314 f the Energy Cde, the prductin f electricity frm cgeneratin that can be subject t GOs is equal t: the entire electricity prductin in case the prductin device has a glbal annual yield f mre than 80% and is a cmbined cycle gas turbine with heat recvery r a steam turbine with cndensatin turbine (clsed cycle), the prductin device has a glbal annual yield f mre than 75% and is anther type f cgeneratin plants (accrding t EECS types f prductin devices fact sheets) the quantity f heat issued frm the prductin device multiplied by the pwer t heat rati, as calculated in annex I and II f Decree f 8 th Nvember 2007, implementing Article R314 f the Energy Cde. In rder t prve this data, a specific cnsumptin declaratin reviewed by a Prductin Auditr has t be sent t Pwernext. Only persns duly authrized by the Accunt Hlder may request the transfer f EECS-GO ut f that Accunt Hlder s Transferable Accunt. Only EECS-GO can be transferred frm and t the Pwernext Registry. This excludes the transfer f cancelled r expired EECS-GO. In particular, nly EECS-GO still valid accrding t French law can be imprted in the Pwernext Registry. EECS- GO with additinal label (ICS prducts) can als be transferred frm and t the Pwernext Registry. Only RES EECS-GO and CHP EECS-GO can be imprted t and exprted frm the Pwernext registry. E.8.1. The initiatin f transfers is made by the selling Accunt Hlder. E.8.2. The transfer f EECS-GO and the cnfirmatin f that transfer are dne in accrdance with the fllwing prcedure: The selling Accunt Hlder cnnects t its persnal secure accunt n the Registry and ges t the Transfer sectin. It is then requested t indicate the beneficiary Accunt Hlder f the transfer (frm the Pwernext registry r frm anther AIB registry) as well as the EECS-GOfrm ne f its Transferable Accuntst be transferred. This excludes withdrawn, expired r already cancelled EECS-GOs that are in his cancellatin accunt. An autmatic check is carried ut in rder t ascertain whether the infrmatin given by the applicant at this stage is sufficient and adequate. In the case f an imprt, the AIB hub sends t Pwernext an imprt request f EECS-GOs frm an Accunt Hlder in anther AIB registry. This request details the EECS-GOs t be transferred t a specific Accunt Hlder in the Pwernext registry. The infrmatin given by the Accunt Hlder r by the AIB hub (in the case f an imprt) is then autmatically checked by Pwernext (type f certificates allwed in the French registry). In case f an exprt r an imprt, the peratr might cntact the ther AIB registry in which the cunterpart is lcalized in rder t be sure f Pwernext 2016 Page 24 f 39

If the infrmatin is cmplete and adequate, Pwernext pre-validates the transfer: data n the EECS-GO are shwn t the beneficiary wh must cnfirm the transfer. In the case f an exprt, data are sent t the relevant AIB registry via the AIB hub, which may accept r refuse the exprt. If the beneficiary (r the relevant AIB registry in the case f an exprt) refuses the transfer, the transfer is cancelled and the EECS-GO certificates are returned t the riginal transferable accunt f the Accunt Hlder; the selling Accunt Hlder is ntified f the rejectin. If the beneficiary cnfirms the transfer, the EECS-GO are withdrawn frm the Accunt f the selling Accunt Hlder and transferred t the Accunt f the beneficiary. Bth Accunt Hlders are ntified f the transfer f the EECS-GOs. E.8.3. Administratin f malfunctins, crrectins and errrs Pwernext has the right t perfrm crrective actins such as withdrawal r transfer f EECS-GOs in the Pwernext Registry. Shuld Pwernext ntice an errr in anther EECS registry, it will cntact the ther registry in rder fr a slutin t be fund. E.8.4. Where it is impssible t transfer fr technical reasns, this can be vercme by cancelling certificates fr use in anther dmain, with the agreement f the imprting issuing bdy. Any such cancellatins are ntified t the imprting issuing bdy and the AIB Secretariat. E.9 Administratin f Malfunctins, Crrectins and Errrs E.9.1. Once issued, the details f an EECS Certificate cannt be altered r deleted except t crrect an errr. In the event that it transpires that the data in any EECS-GOs is inaccurate (whether r nt thrugh an act r missin f the Registrant f the riginating Prductin Device): Pwernext shall either withdraw thse Certificates (prvided that such EECS- GOs are, at the time f such Withdrawal, in the Transfer Accunt f that Registrant) r crrect this errr n the fllwing mnths by issuing mre r less EECS-GOs frm the same Prductin Device f the Accunt Hlder. In case the Prductin Device is nt active anymre, the certificates frm similar Prductin Devices culd be withdrawn ; and The Accunt Hlder shall pay Pwernext the cst f securing the agreement f anther Accunt Hlder t the Withdrawal f EECS-GOs f the same type frm that ther Accunt Hlder s Transfer Accunt, s that, as far as reasnably practicable, EECS-GOs are withdrawn with an adequate vlume and financial value. In case the Certificates are n lnger in the French dmain, Pwernext might cperate with ther Issuing Bdies t withdraw the errneus Certificates. Pwernext may als alter EECS-GOs held in its EECS registry s as t rectify an errr which ccurred prir t its transfer int the Accunt in which it is held at such time, prvided: the Accunt Hlder has agreed t such alteratin; it is reasnably satisfied that any unjust enrichment f a EECS Participant as a cnsequence f such errr has, t the extent reasnably practicable, been nullified; it is reasnably satisfied that the alteratin itself des nt give rise t undue enrichment f the Accunt Hlder. 26 EECS Dmain Prtcl E.9.2. In case f internatinal transfer failure, Pwernext immediately reacts as sn as pssible in rder t crrect the transfer and avid any risk f duble cunting f GOs. The GO registry is checked every business day s that transfer failure issues are addressed quickly. When a transfer failed, Pwernext first cntacts (r is cntacted by) the SuperUser f the AIB Hub. Pwernext cnfirms whether the EECS-GOs are still in the French GO registry r if the EECS-GOs are already deleted frm the Transferrable Accunt f the Accunt Hlder. In case the EECS-GOs are still in the French GO registry, then Pwernext retry the transfer, after having crrected the ptential technical errrs. In case the EECs-GOs are nt in the French GO registry anymre, Pwernext immediately cntact the ther registry t cnfirm the transfer. When an bvius errr has ccurred and is agreed between tw registries, Pwernext can mdify the crrespnding EECS-GO even if Pwernext was nt the Issuing Bdy fr this EECS-GO. E.10 End f Life f EECS Certificates Cancellatin E Cancellatin is remving a Certificate frm circulatin. Once Cancelled, a Certificate cannt be mved t any ther accunt, and s is n lnger tradable. E The initiatin f Cancellatins is undergne by the relevant Accunt Hlderin accrdance with the fllwing prcedure: The Accunt Hlder cnnects t its persnal secure accunt n the Registry and ges t the Cancellatin sectin. The Accunt Hlder specifies the EECS-GO t be cancelled amngst the list EECS-GOs in ne f its Transferable Accunts. This excludes withdrawn, expired r already cancelled EECS-GO. The Accunt Hlder can specify as well the cuntry f cnsumptin (being mandatrily France, with the nly exceptin f exdmain cancellatins), cancellatin purpse, usage categry (being mandatrily disclsure), name, type and lcatin f beneficiary and related cnsumptin perid. E The cancellatin f certificates is partly autmated. When an Accunt Hlder asks fr the cancellatin f EECS-GO, an autmatic check is carried ut. The cmpleteness and adequacy f the infrmatin is then verified by the peratinal team f Pwernext. If the data are nt crrect, the cancellatin f the EECS-GO is abandned. If the data are cmplete and accurate, the EECS- GOs are cancelled by Pwernext. Cancelled certificates are remved frm the Transferable Accunt f the Accunt Hlder and cannt be cancelled r transferred anymre. E The cnfirmatin f the success r failure f a cancellatin is ntified t the accunt hlder by Pwernext. In case f success, a dcument (cancellatin statement) can be dwnladed by the Accunt Hlder thrugh the registry by Pwernext cnfirming the cancellatin f the EECS-GO Certificates (see E.9.6 Frms). In case f rejectin f a cancellatin, the Accunt Hlder is furthermre explicitly ntified by Pwernext abut the rejectin and the reasns fr it. E Only EECS-GOs relating t renewable electricity and cgeneratin may be cancelled in the Pwernext registry. E A cancellatin statement can be printed ut frm the registry by the Accunt Hlder rganisatin that has perfrmed the cancellatin. A template is available in Annex 5. In the case Pwernext wuld be replaced by ther Issuing Bdy fr the French dmain by a new Decree, AIB wuld be infrmed immediately. In this situatin, Pwernext wuld take the necessary actins t guarantee a right transitin t the new Issuing Bdy. G.2 Cmplaints t the AIB G.2.1. Accunt Hlders can send cmplaints and questins by t GOsupprt@pwernext.cm. Fr cmplaints related t AIB, Pwernext will be the liaisn and will respnd back t the participant. H Change Cntrl H.1 Cmplaints t Pwernext Pwernext endeavur t deal with cmplaints received as sn as pssible. Cmplaints can be filed by , phne call cnfirmed by r registered letter. They shuld be addressed t the relevant cntact listed in Annex 1, accrding t whether the cmplaint cncerns general, peratinal r administrative issues. Pwernext will answer within five (5) wrking days after receipt f such cmplaint, infrming the custmer f the applicable prcedures. Pwernext strives t reslve all cmplaints within ne (1) mnth. Where fr whatever reasn this prves impssible, Pwernext will infrm the custmer f the reasn fr the delay and keep them infrmed n further prgress. Upn reslutin f a cmplaint, Pwernext will send written cnfirmatin f the utcme. H.2 Disputes All disputes arising ut f r in cnnectin with the validity, interpretatin, perfrmance, nnperfrmance r terminatin f the Standard Terms and Cnditins shall be submitted t mediatin accrding t the CMAP s 1 Rules f Mediatin and, in the event that n settlement is thereby reached, t arbitratin accrding t the CMAP s Rules f Arbitratin, t which the parties undertake t adhere. H.3 Change Requests An Accunt Hlder may prpse a mdificatin t this Dmain Prtcl. Such a prpsal will include a detailed descriptin, including an exact specificatin f any prpsed mdificatin f this Dmain Prtcl and be passed in writing t Pwernext.
