4 1 INTRODUCTION The Caribu Recvery Pilt Prject (the Prject) has been established t further develp the cncept f a predatr-free fenced area t supprt a small breeding subppulatin f wdland caribu (the Pilt). The Pilt is prpsed as ne cnservatin management tl in a suite f cmplementary recvery actins fr breal caribu and which may be endrsed and implemented by the Gvernment f Alberta (GA) as part f caribu actin and range plans. Bth habitat restratin and ppulatin management are likely required t ensure self-sustaining wdland caribu ppulatins in nrtheast Alberta and the Pilt culd prvide immediate recvery benefits t cmplement lnger-term habitat recvery effrts. The primary bjective f the Pilt is t establish and maintain a small breeding ppulatin f caribu in a fenced predatr-free exclsure within their natural habitat in nrtheast Alberta. The intent f the Pilt is t imprve caribu survival and reprductive success inside the fenced area and t translcate caribu brn within the exclsure t reinfrce extant lcal ppulatin(s). This management apprach is imprtant fr supprting habitat prtectin and restratin measures that are aimed at addressing landscape-scale factrs f caribu decline that are ultimately linked t human-caused habitat alteratin, primary prey enrichment and changes in predatr-prey dynamics (DeCesare et al. 2010, Butin et al. 2012, Wittmer et al. 2013). Because the Pilt cncept is a new and untested management tl fr Alberta, it has been, and will cntinue t be, imprtant t develp the Pilt with the knwledge and experience that reginal interested parties have t make the Pilt a success. This includes traditinal knwledge frm years f living n the land and being stewards f the envirnment as well as current knwledge frm living and wrking within identified ptential Pilt candidate areas. This Engagement Reprt (the Reprt) describes the engagement that tk place with identified Abriginal cmmunities during 2016 and 2017 in supprt f the Pilt. The full scpe f wrk that was cnducted during this perid is described in the Caribu Recvery Pilt Prject Summary Reprt (Harding et al. 2017). If a decisin t prceed with a Pilt is made, the GA will be respnsible fr the land use decisins made in respect f the Pilt and will be respnsible fr cnducting frmal cnsultatin with Abriginal cmmunities prir t Pilt implementatin. The intent f the early engagement described in this Reprt was t prvide insight and guidance fr the GA and the Pilt prpnent and engagement actins taken r recmmendatins made d nt replace the duty r need fr frmal cnsultatin. 1.1 Reginal Cntext The landscape f nrtheast Alberta encmpasses fur caribu ranges, the Richardsn, West Side Athabasca River, East Side Athabasca River and Cld Lake ranges. Caribu herds within each f these ranges are currently nt self-sustaining, with the East Side Athabasca River and Cld Lake herds cntaining an estimated 150 animals r less. As the mst critical f the ranges, the East Side Athabasca River and Cld Lake ranges were identified by the Prject Team t be the fcus fr the candidate area selectin. 5 The East Side Athabasca River and Cld Lake ranges are rughly bunded by Frt McMurray t the nrth, the Athabasca River t the west, Lac La Biche t the suth and the Saskatchewan brder t the east. This gegraphic area lies within the Lwer Athabasca Reginal Planning Area and prvides fr a number f land uses including fr and by: settlements, Reserve Lands, parks and prtected areas, First Natin and Métis traditinal territries and industrial and cmmercial dispsitins. 1.2 Prject Team CncPhillips Canada, Devn Energy, Nexen, Suncr and Athabasca Oil Crpratin have prvided funding fr the Prject thrugh Canada s Oil Sands Innvatin Alliance (COSIA). The Prject Team is cmpsed f: members f the funding cmpanies; and cntracted specialists frm REDES Inc., EcBrealis Cnsulting Inc. and Schaldemse and Assciates. GA representatives als supprted the Prject by participating in: the Steering Cmmittee (e.g., Prject versight, scpe, scheduling); the Technical Advisry Cmmittee (e.g., feedback and directin n technical aspects f the Prject); and Abriginal engagement (participated as an bserver during multi-party wrkshps). 2 CARIBOU RECOVERY PILOT PROJECT DESCRIPTION The Prject prpses t advance the cncept fr building a large fenced area, safe frm predatrs, that will prvide a cntrlled envirnment t increase the prductivity f caribu and establish a viable ppulatin as part f an integrated slutin fr caribu recvery. Key design assumptins fr the Pilt include: the apprximate size f the Pilt fenced area culd be up t 100 km 2 (ne twnship); the duratin f the Pilt is prpsed t be apprximately 10 years with the ptential t cntinue r expand if successful; the Pilt is expected t prvide a surce f surplus animals t supplement lcal wdland caribu ppulatins; the caribu fence cncept is being advanced by the Prject Team, with input sught frm Abriginal cmmunities; and upn cmpletin f Prject scpe, the GA will determine if, when and hw t implement a Pilt. 6 Preliminary wrk cnducted t advance the Pilt has been nging thrugh the Oil Sands Leadership Initiative (OSLI) and COSIA since Wrk cnducted t date has included: technical feasibility studies; investigatin f ptential fence designs and small scale field trials; analysis f cst effectiveness; assessment f ppulatin recvery tls; and the develpment f a preliminary fence design, regulatry radmap and stakehlder engagement strategy. Previus wrk has prvided an understanding f the technical and ecnmic feasibility f the Pilt cncept and this Prject will further advance a predatr fence design fr GA cnsideratin as a cmpnent f the nrtheast Alberta wdland caribu range and actin plans. Imprtant t mving frward with the Pilt has been, and will cntinue t be, engagement and cllabratin with Abriginal cmmunities. If a decisin is made by the GA t prceed with a Pilt, implementatin is expected t include planning, cnstructin, and peratin phases fllwed by a 10-year review where a decisin wuld be made t decmmissin the Pilt r extend peratin beynd 10 years if the Pilt is successful. 3 ADVANCING THE PILOT CONCEPT The scpe f this Prject t advance the Pilt cncept included: identifying a ptential candidate area(s) within the East Side Athabasca r Cld Lake caribu range fr up t a 100 km 2 fenced area fr a breeding caribu ppulatin; develping a detailed fence design fr the ptential candidate area(s); develping supprting management planning guides and recmmendatins fr the implementatin f the Pilt, estimated t be in place fr apprximately 10 years with the ptential t cntinue r expand if successful; and develping a package, based n the abve, fr submissin t the GA fr cnsideratin as part f their Nrtheast Caribu Range Plan. Caribu Recvery Pilt Prject Objective: t advance the fence Pilt cncept, such that the GA can cnsider implementatin as part f their Nrtheast Caribu Range Plan. 4 IMPORTANCE OF ENGAGEMENT TO ADVANCE THE FENCE CONCEPT Pilt wrk cnducted t date identified that stakehlder engagement, particularly cllabrative engagement with Abriginal cmmunities, wuld be essential t advancing the Pilt. Key t engagement was the ability f the Prject Team t wrk with stakehlders t nt nly identify interests, issues and cncerns but t actively wrk with stakehlders t fine tune the engagement methds that will best wrk fr them t effectively participate and cllabrate - a flexible apprach was critical t managing and executing the engagement strategy. 7 Engagement with Abriginal cmmunities was imprtant because these grups: represent imprtant land users and rights-hlders in the regin; have deep understanding and lng histries f living in the area and n the land identified as ptential areas fr Pilt siting; are culturally rted as envirnmental stewards f the landscape; have lng identified the need fr the cnservatin f caribu including vluntarily refraining frm Abriginal harvesting f caribu ver the last several decades; and ffer a valuable and lcal resurce in the deplyment f the Pilt. 5 SCOPE OF ABORIGINAL ENGAGEMENT Engagement with Abriginal cmmunities, as bth rights-hlders and stakehlders, was the fcus f the scpe f wrk described in this Reprt. Abriginal engagement played a key rle in infrming Prject deliverables and this Reprt has been prepared t detail the engagement prcess and utcmes. Key aspects f Abriginal engagement included the fllwing: prvide relevant infrmatin frm the preliminary wrk that was cnducted, including ratinale fr the Pilt; slicit initial feedback n the cncept, including cncerns and interests; prgress wrk with a cmmn understanding, infrmed bth by western science and traditinal and land use knwledge; and develp a frum t prvide infrmatin, gather infrmatin, integrate shared infrmatin and ensure fllw up ccurred in a timely manner. Abriginal cmmunities lcated in clse prximity and whse imprtant traditinal use areas encmpass ptential candidate areas were identified as ptentially having a keen interest in the design and planning f the Pilt, particularly as it may relate t Abriginal and Treaty rights, caribu as a key cultural species, and pprtunities in implementatin. Traditinal knwledge and cmmunity input will be imprtant t identifying ptential Pilt candidate areas, identifying cncerns and sensitivities and develping management planning guides and recmmendatins fr implementatin. This Prject fcused n early engagement with relevant Abriginal cmmunities and des nt cnstitute cnsultatin. It will be the respnsibility f the GA t frmally cnsult n the Pilt with Abriginal and stakehlder grups (nted belw) prir t implementatin. Other ptential stakehlders grups have been previusly identified (Antniuk et al. 2016) and include: industrial tenure hlder (e.g., il and gas, frestry, mining); envirnmental grups; recreatinal grups; municipal gvernments; and nn-tenure hlder industrial and cmmercial land users. 8 5.1 Determining Which Abriginal Cmmunities t Engage Determining which Abriginal cmmunities t engage was based n tw key factrs: prximity f cmmunity and traditinal territry t the East Side Athabasca River and Cld Lake caribu ranges 1 ; and guidance frm the GA Abriginal Cnsultatin Office. Based n these criteria, the fllwing 12 First Natin and Métis cmmunities were cntacted t determine ptential level f interest in the Pilt (i.e., pre-engagement): Beaver Lake Cree First Natin; Chipewyan Prairie Déné First Natin; Cld Lake First Natin; Frt McMurray #468 First Natin; Whitefish Lake First Natin; Heart Lake First Natin; Métis Lcal 193 Cnklin; Métis Lcal Willw Lake/Anzac; Métis Lcal 1909 Lakeland; Métis Lcal Frt McMurray; Métis Lcal Owl River; and Métis Lcal Lac La Biche. 5.2 Engagement Gal and Objectives Over the curse f a year (Octber 2016 t Octber 2017) the Prject Team engaged Abriginal cmmunities with the intent t: engage early, t benefit frm cmmunity perspectives in fence cncept develpment; take int accunt and be respectful f the interests f participants (e.g., Abriginal and Treaty rights within and arund prpsed candidate areas); be infrmed by current and future Abriginal cmmunity activities t identify siting cnstraints and sensitivities; be infrmed by the traditinal knwledge f years f living n the land in ptential candidate areas, thus prviding enhanced site-specific infrmatin n the landscape and animals including such things as caribu habitat and use and animal mvements; be designed in cnsideratin f site-specific landscape and land user identified prs and cns (e.g., terrain cnstraints, seasnal animal mvements); 1. It was identified that a degree f risk wuld be assciated with limiting initial engagement based n Cmmunity lcatins and reserve lands alne. Therefre, an verlay f traditinal territry maps n the ESAR and Cld Lake range maps helped determine which Abriginal cmmunities t engage. As traditinal territries can be large, the scping exercise als included cmmunity-identified preferred r high use traditinal areas. Caribu Recvery Pilt Prject: Abriginal Engagement Reprt Page 5

9 be designed with supprting management plans and recmmendatins t ensure that Abriginal cmmunity sensitivities, cncerns and pprtunities have been identified and/ r addressed, hence increasing the likelihd f successful implementatin and peratin f the Pilt if a decisin t prceed is made by the GA; develp best practices infrmed by bth western science and traditinal knwledge; and be perated in a manner that is respectful f, and supprted by, interested and ptentially affected Abriginal cmmunities Abriginal Cmmunity Engagement Gal The Prject Team is cmmitted t wrking with Abriginal cmmunities by keeping them infrmed and engaged during the Prject. Building strng relatinships with Abriginal cmmunities thrugh cllabratin and engagement is crucial fr the success f this Pilt and will result in enhanced Pilt decisins. Recmmendatins t the GA will als cmmunicate a respnsibility t, and the imprtance f, keeping Abriginal cmmunities infrmed and meaningfully invlved thrughut all Pilt phases Abriginal Cmmunity Engagement Objectives The fllwing five bjectives were defined fr Abriginal cmmunity engagement: prviding accurate, cnsistent and timely infrmatin regarding the Pilt t Abriginal cmmunities; btaining Abriginal cmmunity feedback n the Pilt including candidate sites as well as ptential cncerns and sensitivities; wrking with Abriginal cmmunities t ensure ptential cncerns are fully understd and apprpriately addressed r managed and that ptential trade-ffs are acknwledged; facilitating meaningful invlvement with Abriginal cmmunities t identify cmmn grund fr actin and innvative slutins; and wrking with Abriginal cmmunities t implement agreed upn decisins and apprach. 5.3 Cmmunity- Specific Engagement Plans An engagement plan fr each cmmunity was develped t supprt f the scpe, gal, and bjectives as utlined abve. A final draft plan was reviewed by cmmunities during initial engagements and adjusted t be cmmunity-specific, reflecting each cmmunity s specific engagement prtcls and preferences. The template that was used fr cmmunity-specific engagement plans is included as Appendix A. This template was prepared early in Prject develpment and is included as it was submitted t cmmunities withut reflecting changes that ccurred as the Prject evlved. 5.4 Cmpnents f Engagement Engagement with Abriginal cmmunities was designed t be meaningful and meet the specific interests f the cmmunities. The Prject Team used an adaptive apprach t engagement, which allwed the Prject Team t be flexible and respnsive t the interests f the cmmunities. Engagement was initiated early in the Prject, and Abriginal cmmunities were invlved thrugh the entire duratin f Prject wrk. Caribu Recvery Pilt Prject: Abriginal Engagement Reprt Page 6

10 The engagement prcess included the fllwing three cmpnents: 1. Pre-engagement t determine interest in the Pilt and apprpriate level f engagement. 2. Initial ne-n-ne meetings t: identify ptential cncerns and sensitivities; gather Abriginal cmmunity and stakehlder input fr initial planning; understand the level f interest in the Pilt; and cnduct traditinal knwledge mapping. 3. Wrking cllabratively thrugh a multi-party prcess cnsisting f three 2-day wrkshps t: select ptential Pilt candidate areas based n mapping layers and criteria infrmed by participating Abriginal cmmunities; infrm fence siting and design; infrm management planning guides; develp a reprt f recmmendatins as identified by participating Abriginal cmmunities; and review key prject plans and decisins resulting frm the engagement prcess, prir t submissin f the Pilt t the GA. Multi-party engagement cnsisted f five mdules t supprt each cmpnent f the Pilt definitin and planning phases: Mdule 1: Candidate Area Selectin Infrmatin and Definitin OBJECTIVE: Identify and define cmmunity-infrmed criteria (mapping layers) fr ptential site selectin. OUTCOME: Cmmunity-infrmed mapping layers t take frward t Mdule 2. Mdule 2: Candidate Area Site Selectin and Ranking OBJECTIVE: Identify (using a cnstraints mapping apprach) and rank (e.g., based n prs and cns) candidate sites. OUTCOME: Cmmunity-identified preferred candidate area(s) t take frward t Mdule 3. Mdule 3: Detailed Fence Siting and Design OBJECTIVE: T seek input n fence layut and design fr preferred candidate areas(s). Mdule 5: Abriginal cmmunity Recmmendatins Reprt Review OBJECTIVE: T finalize an Abriginal cmmunity Recmmendatins Reprt. OUTCOME: Final cmmunity-develped Abriginal cmmunity Recmmendatins Reprt Pre-engagement with Abriginal Cmmunities Based n the scping exercise described in Sectin 5.1, the Prject Team cntacted all 12 Abriginal cmmunities by phne. The first cntact was brief and intrductry and in mst cases t set up a half hur t ne hur call t intrduce the Pilt cncept and discuss cmmunity interest and capacity fr further engagement. Understanding that the degree f interest in the Pilt will vary amngst Abriginal cmmunities based n such criteria as prximity t ptential candidate areas and ptential traditinal use and access interests, the pre-engagement phne call included the fllwing elements: a brief Pilt verview describing the cncept, its ratinale and its develpment t date; a preliminary discussin t better understand if ptential candidate areas verlap with high pririty r intensive traditinal land use areas; a discussin n the cmmunity s preliminary thughts n, and interest in, the cncept; and a descriptin f the intent fr early engagement t determine cmmunity interest in participatin and engagement preferences. Of the 12 cmmunities identified, pre-engagement phne calls ccurred with nine f the cmmunities during the first week f Octber All nine cmmunities expressed that they wuld be interested in an initial face-t-face meeting. Pre-engagement calls ccurred in mid-nvember 2016 with Lac La Biche Métis Lcal 2097 and Owl River Métis Lcal Bth f these cmmunities als expressed interest in an initial face-t-face meeting. Lakeland Métis Lcal 1909 was unreachable after several phne and attempts during Octber and Nvember In summary, the fllwing 11 Abriginal cmmunities participated in a pre-engagement phne call and expressed interest in a fllw-up face-t-face meeting: Beaver Lake Cree First Natin; Chipewyan Prairie Déné First Natin; Cld Lake First Natin; Frt McMurray #468 First Natin; Caribu Recvery Pilt Prject: Abriginal Engagement Reprt Page 8

12 Whitefish Lake First Natin; Heart Lake First Natin; Métis Lcal 193 Cnklin; Métis Lcal Willw Lake/Anzac; Métis Lcal Frt McMurray; Métis Lcal Owl River; and Métis Lcal Lac La Biche. During pre-engagement a final cntact list was develped with the apprpriate cmmunity engagement staff and/r representatives and cmmunity-specific databases t track engagements, infrmatin exchanges, cncerns, real-time respnses and fllw-up items were prepared. Bth were reviewed and validated by the participating Abriginal cmmunities. Any discrepancies, missins r revisins were updated in the apprpriate dcuments Initial Engagement with Abriginal Cmmunities Initial engagement with Abriginal cmmunities was carried ut at a cmmunity level with cmmunity representatives and members f the Prject Team (Prject Directr and Engagement Lead) and included tw specific elements: initial face-t-face meetings; and cmmunity traditinal knwledge mapping sessins. Initial engagement (described in the text belw and summarized n Figure 1) included the fllwing steps: 1. Cntact was made by phne t set a date and time fr a face-t-face meeting between cmmunity engagement representative(s) and Prject Team members. 2. An infrmatin package cntaining a meeting agenda and Pilt verview dcument was sent electrnically t each Abriginal cmmunity/grup cntact. 3. A face-t-face meeting in the cmmunity, r lcatin f the cmmunity representative s chice, was held t prvide an verview presentatin n the Pilt and prpsed engagement prcess, discuss the infrmatin package, ask questins and share infrmatin abut the Prject including acknwledgement f the cmmunity/grup s interests and interest in the Pilt. Meeting bjectives included: intrduce the Pilt and preliminary wrk cmpleted t date; answer preliminary questins with regard t the Pilt; cnfirm that the template engagement plan meets engagement needs fr effective participatin and cllabratin (and if nt, gather additinal input t finalize the cmmunity-specific final engagement plan); Caribu Recvery Pilt Prject: Abriginal Engagement Reprt Page 9

13 gather initial input n cncerns and advice related t the Pilt; and discuss next steps including scheduling. 4. Based n step 3 abve, if the cmmunity expressed interest in further engagement, the engagement plan was refined t be cmmunity-specific. The plan was then shared with the Abriginal cmmunity t review, request revisins if necessary and validate the prcess. 5. Preparatin fr a cmmunity mapping sessin including scheduling and prvisin f preliminary infrmatin frm cmmunities (e.g., traditinal territries, traplines) and base map develpment. 6. Half-day cmmunity mapping sessin were held t cllect high-level baseline data t develp mapping layers fr use in the selectin f ptential candidate areas including ptential g and n g areas. The mapping sessin included presentatins n the Pilt and was a wrking sessin with traditinal knwledge hlders, elders. trappers, land users, engagement staff and cmmunity technical supprt. Attendance and participants varied and was specific t the cmmunity s specific engagement plan. 7. Cmmunity develped maps were prvided t the Prject Team t digitize. The maps were then prvided back t each respective cmmunity t validate with the understanding that they wuld be cnslidated with infrmatin frm ther cmmunities int mapping layers fr use in the multi-party wrkshps. 8. Infrmatin exchanges, cncerns, real-time respnses and fllw-up items were entered int each cmmunity-specific database fr tracking and fllw up purpses. 9. Each cmmunity was prvided the database fr their review and verificatin n meeting utcmes, descriptin f cncerns r sensitivities, and need fr fllw-up and/r reslutin. Initial engagement with Abriginal cmmunities: allwed preliminary infrmatin abut the Pilt, based n wrk dne t date, t be shared; began the cllabrative prcess with cmmunities t understand preliminary interests and sensitivities; and infrmed baseline infrmatin with cmmunity land use and traditinal knwledge t prceed int the multi-party prcess. 26 6.2 Multi-party Engagement A series f multi-party wrkshps were planned based n five identified mdules f wrk: 1. Site Definitin and Validatin; 2. Site Ranking and Selectin; 3. Fence Layut and Design; 4. Infrmed Management Plans; and 5. Abriginal cmmunity Recmmendatins Reprt Cllabratin. Each f these wrk mdules prduced utcmes that supprt Prject deliverables Selectin f Preferred Candidate Areas Objectives: t identify and define cmmunity-infrmed criteria (map layers) fr ptential candidate area selectin fr the Pilt; and t rank and select preferred candidate areas (based n the results f Day 1) fr future siting f the Pilt. Wrkshp participants reviewed key elements f the Pilt as well as the technical and cmmunity infrmatin cllected t date that infrmed the develpment f a series f mapping layers and definitins. Mapping layers were categrized under ne f fur categries: 1. Eclgical (e.g., caribu habitat); 2. Ecnmic (e.g., il sands prject ftprints); 3. Lgistical (e.g., transprtatin [rads and railways]); and 4. Cmmunity (e.g., suitable areas fr fence [as identified thrugh cmmunity mapping sessins in the initial engagement phase]). Each layer was assigned a negative, psitive r neutral value based n its effect n siting the Pilt (e.g., caribu habitat (+), prject ftprint (-), transprtatin (~), suitable areas identified by cmmunities (+)). Wrking sessins fcused n reviewing and validating map layers and definitins (including making recmmendatin fr additinal mapping layers and making changes t values), wrking thrugh divergent views identified during initial engagements (e.g., having n industry activity vs. sme industry activity within the fence) and understanding the mapping prcess t use fr selecting pssible sites fr the Pilt. Eight pssible candidate areas were generated nce the map layering prcess was applied. Wrkshp participants then applied a number f eclgical, ecnmical, lgistical and cmmunity cnsideratins (e.g., Is there gd habitat available?; Is there a cmmunity relatively clse t supprt this Pilt?) t select three preferred candidate areas with an expansin f ne candidate area t include an area surrunding Egg Lake. 29 6.2.2 Fence Layut and Design Objective: T share infrmatin, knwledge and cnsideratins n: ptential fence layuts within the three preferred candidate areas; and fence design. Wrkshp participants reviewed the utcme f Wrkshp #1, including the preferred candidate areas, hw we determined the three preferred areas, what we heard abut thse three areas frm cmmunities and the criteria used t identify ptential fence layuts. Criteria fr identifying ptential fence layuts included: aviding il sands prject bundaries, aligning with existing rads and linear features (t reduce cst and need t create new disturbance), minimizing intersectin with wet areas (t ensure fenceline integrity), and prviding a diversity f habitats fr caribu (summer and winter). A first wrking sessin fcused n reviewing maps f ptential fence layut(s) and criteria used fr each f the three candidate areas. Fr each candidate area, participants discussed fence layut ptins that were develped prir t the wrkshp based n the criteria, adjustments t the prpsed ptential fence layuts, ther lcatins within the candidate area and the prs and cns f the fence layut ptins. The utcmes f this wrk were then reprted back t the larger grup. A secnd wrking sessin included a grup presentatin, discussin and questins and answers n the design f the fence. Using Ggle Earth and a virtual flyver and examples f ther facilities, participants discussed design cnsideratins based n the fllwing design principles: Precautinary Principle Design t: be practive vs. reactive; enable husbandry and animal management as required; allw fr mnitring and evaluatin; and be respnsive and allw fr adaptive management; minimize animal handling (capture, release, mnitring, emergencies, etc.); and maximize calf survival and d n harm t caribu. Outcme: cmmunity-infrmed pssible fence layut(s) fr each f the three candidate areas (Figure 8) as well as cmmunity verificatin and input int the ptential design f the fence. Five plans were identified: Access Management Plan, Operatins and Maintenance Plan, Caribu Husbandry Plan, Predatr and Wildlife Management Plan, and Research and Mnitring Plan. The remaining plans were cvered in Wrkshp #3. A wrkbk was prvided prir t the wrkshp fr participants t begin dcumenting their thughts t take int the wrkshp n each f the plans, r alternatively, t fill ut with additinal input and prvide t the Prject Team prceeding the wrkshp. Fr the identified pririty plans, a wrking sessin had participants mving thrugh tw grups, Grup 1 fcused n Access and Maintenance and Grup 2 fcused n Caribu Husbandry, Predatr and Wildlife Management and Research and Mnitring. Fr each plan, what we heard frm previus engagements were discussed (including if it applied t mre than ne plan) and participants shared additinal input and knwledge specific t each plan. Fr the remaining plans, wrking sessins included participants wrking in ne large grup. The first gruping f plans included Risk Management and Emergency Respnse. The secnd gruping included Cmmunicatins and Outreach, Stakehlder Engagement and Abriginal Cnsultatin. Fr each grup f plans the Prject Team prvided a brief presentatin summarizing the structure and draft elements. Fr the Risk Management and Emergency Respnse plans, participants wrked thrugh identifying key risks/hazards frm a draft list as well as t share additinal ptential risks and hazards that may be imprtant t the Pilt. Fr the Cmmunicatins and Outreach and Stakehlder Engagement plans, participants identified ptential stakehlders in additin t a draft list prvided and shared cmmunicatins and engagement tls and methds fr cnsideratin int the plans. Fr the Abriginal Cnsultatin plan, participants identified key issues t cnsider and shared cnsultatin best practices and cmmunity preferences. The utcmes f each wrking sessin were reviewed and reprted back n t ensure all infrmatin was recrded and accurate. 32 In preparatin fr Wrkshp #3, a draft f the Abriginal Cmmunity Recmmendatins Reprt was prvided t participating cmmunities. The draft included recmmendatins shared thrughut engagement t date. A series f presentatins were prvided that walked wrkshp participants thrugh the structure and intent f the Abriginal Cmmunity Recmmendatins Reprt as well as the draft cntent including recmmendatins we heard t date. A first wrking sessin fcused n prviding additinal recmmendatins as well as prviding additinal infrmatin and/r detail n the recmmendatins that we previusly prvided and cnslidated int the draft. Participants tackled this in tw wrking grups: ne that fcused n recmmendatins by Pilt phase (final site selectin, cnstructin, peratin and ten-year review) and ne that fcused n pprtunities (respecting Abriginal and Treaty rights and interests, supprting cultural relevance, integrating traditinal knwledge, recgnizing existing and future land use, building capacity, emplying lcal Abriginal cmmunities and sharing respnsibility). At the end f the wrking sessin participants validated new cntent and discussed infrmatin t be included in appendices t the Abriginal Cmmunity Recmmendatins Reprt. This was then fllwed with a reprt back t the larger grup. A secnd wrking sessin cnsisted f a rund table t: reflect n utcmes f the grup wrk and t verify alignment n the recmmendatins t prvide in the Reprt; ask questins; prvide additinal input/cmments n recmmendatins t be prvided t the GA/prpnent; and cnfirm next steps t finalize the Reprt. Outcme: Cmmunity-develped recmmendatins t finalize the develpment f the Abriginal Cmmunity Recmmendatins Reprt. Fllwing the wrkshp, participating Abriginal cmmunities were prvided the updated draft fr review, feedback and apprval. The Abriginal Cmmunity Recmmendatins Reprt is prvided as Appendix C. 7 ANALYSIS AND RECOMMENDATIONS The fllwing summarizes the verall prcess and feedback received n the engagement prcess and apprach. Thrughut this summary are recmmendatins n hw future Abriginal engagement may prceed, given the experience frm this Prject Team. Summarized in Appendix C are recmmendatins frm Abriginal cmmunities, mainly related t Pilt implementatin, shuld it g frward. 7.1 Abriginal Engagement Plan As discussed in Sectin 5.3, a cmmunity-specific engagement plan was drafted fr review by each Abriginal cmmunity during initial engagements and cmmunity feedback was used t refine the engagement plan and engagement bjectives. 33 In the analysis f meeting the intent and desired utcmes utlined by the engagement plans, there are tw key elements that require discussin: (1) develping a traditinal knwledge sharing agreement; and (2) final ne-n-ne engagement Traditinal Knwledge Sharing Agreement Over the perid f Octber 2016 t January 2017 the Prject Team wrked with individual Abriginal cmmunities t put a traditinal knwledge sharing agreement in place. Sme cmmunities had template agreements t share and ther cmmunities required an agreement t be develped by their legal r ther representatives r did nt use a sharing agreement t guide the cllectin and use f cmmunity member knwledge. Because the Prject scpe was unlike a regulated industrial prject it was nt clear what shuld r shuld nt be included in the agreements. Bth the Prject Team and cmmunities felt that it was necessary t be respectful f the knwledge shared and agreed that sitespecific knwledge was prprietary t the hlder and the cmmunity and culd nt be made publicly available. Ultimately, sharing agreements were nt finalized r signed. Instead, the Prject Team and each cmmunity agreed t the fllwing terms t ensure that cnfidential infrmatin remained cnfidential and that the infrmatin needed t prvide baseline infrmatin t aid in candidate area selectin culd be used in a public setting (i.e., multi-party Wrkshp #1): while site-specific infrmatin and knwledge was shared, this infrmatin was cnslidated and digitized int G and N G area mapping layers; cmmunity-specific maps were prvided back t each cmmunity t bth ensure accuracy as well as t validate that the infrmatin depicted n the map was at a scale f reslutin that it wuld be prtective f cmmunity prprietary infrmatin; and final mapping layers used in the multi-party wrkshps were cnslidated int larger G and Ptential G and N G areas that were representative f all input frm all cmmunities and nt attributed t any specific individual r cmmunity. Cmmunities placed a great deal f trust in the prcess and in the Prject Team t be respectful f the use f cmmunity traditinal knwledge. This is nt typical nr des it represent a best practice and is nt recmmended shuld the Pilt g frward. Had the Prject Team develped a draft sharing agreement fr the Prject scpe, it is mre likely that sharing agreements wuld have been in place prir t the cmmunity mapping sessins. Prject Team Recmmendatin - Shuld the Pilt advance, it is recmmended that the GA and/r prpnent develp a draft traditinal sharing agreement specific t the elements f the Pilt t be used fr the cllectin and sharing f cmmunity traditinal knwledge Final One-n-One Engagement Originally, a final phase f engagement with Abriginal cmmunities t cnduct further ne-n-ne engagements was planned t: ensure that cmmunity and stakehlder-specific cncerns falling utside f the wrkshp prcess were addressed; Caribu Recvery Pilt Prject: Abriginal Engagement Reprt Page 30

Cntributing factrs included: attendance f the multi-party wrkshps by a representative f AEP t address ut-f-scpe respnses (related t the larger range planning initiative); attendance f Prject Team members t prvide real-time respnses; timely fllw-up n wrkshp input and incrpratin int planning and design plans; and structuring the multi-party wrkshp t include reprting n the previus engagement and hw cmmunity input was cnsidered, clearly prviding a wrkshp-specific radmap including intended utcmes and articulating next steps in the engagement prcess. As well, participant feedback prvided insight n hw t present certain infrmatin (e.g., mre discussin n the status f management planning guides and hw the wrkshps were helping infrm cntent that was being develped as ppsed t respnding t an already develped draft). The Prject Team engaged cmmunities ver the curse f apprximately ne year, with wrkshps beginning in March f 2017 and with rughly 60 business days between wrkshps (accunting fr July and August as nn-business times when cmmunities wuld be busy with hlidays and traditinal land use activities). Based n survey feedback, mre time, bth fr each tw half-day wrkshp and verall, was generally desired by participating cmmunities. There are variatins amng different grups regarding the degree f agreement necessary t finalize a grup decisin. The prcess f grup deliberatin; hwever, has many cmmn elements that are definitive f cnsensus decisin making. These include: Inclusive: As many stakehlders as pssible are invlved in grup discussins. Participatry: All participants are allwed a chance t cntribute t the discussin. Cllabrative: The grup cnstructs prpsals with input frm all interested grup members. Any individual authrship f a prpsal is subsumed as the grup mdifies it t include the cncerns f all grup members. Agreement Seeking: The gal is t generate as much agreement as pssible. 54 INTRODUCTION Canada s Oil Sands Innvatin Alliance (COSIA) Land Envirnmental Pririty Area (Land EPA) has been prgressing a suite f caribu recvery tls, ne f which is the Caribu Recvery Pilt Prject (the Pilt). The Pilt is a cnservatin apprach that establishes and maintains a small breeding subppulatin f caribu in a large fenced area within its riginal range. The fence wuld be designed t exclude wlves and bears s that caribu reprductive success is imprved, allwing surplus yearlings frm within the fenced area t be mved utside t supplement the surrunding range ppulatin(s). Upn cmpletin f Pilt design, apprvals and planning phases, the Gvernment f Alberta (GA) will determine if, when and hw the fenced area culd be implemented. The bjective fr the Pilt is t identify ptential fenced area lcatin(s), advance fence design and prepare a regulatry package, infrmed by interested Abriginal cmmunities and ther key stakehlders, t psitin the GA t cnsider cnstructin f a caribu fence in nrtheast Alberta. The caribu fence is a management tl that may be cnsidered fr the Nrtheast Alberta Wdland Caribu Range Plan. Because a fenced area fr caribu is a cncept that has nt been tried in Alberta, and is a ptential new management tl freseeable t the GA s Range Plans in supprt f the Federal Caribu Recvery Strategy, it will be imprtant t develp the Pilt with the knwledge and experience that reginal interested parties have t make this prject a success. This includes traditinal knwledge (TK) frm years f living n the land and being stewards f the envirnment as well as current knwledge frm living and wrking within identified ptential prject lcatins. This dcument describes COSIA s plan t engage interested parties in general n this Pilt t hear abut this knwledge and experience fr inclusin n Pilt design and peratin. Understanding that the GA is respnsible fr land use decisins fr a prject f this scpe and size and that the fenced area may becme part f the nrtheast range plan, it will be the GA that will be respnsible fr frmal cnsultatin n the Pilt. BACKGROUND Caribu are ne f Canada s mst recgnizable natinal symbls and their ppulatins are under threat in many regins fr a number f reasns. This includes the effects f industrial, recreatinal and urban develpment n habitat and increased predatin by wlves and bears, which have increased in ppulatin and range in respnse t an increase in numbers f deer and mse, their primary prey. Under the Species at Risk Act breal wdland caribu are listed as threatened. During federal cnsultatins n the draft recvery strategy the cmments and TK received frm Abriginal cmmunities identified that all animals are cnnected t each ther and that breal caribu are Page 1

55 essential t the balance f nature and fr their rle in the breal ecsystem [and the] need fr cntinued presence f self-sustaining lcal ppulatins in all breal caribu ranges acrss Canada. 1 T this end, and supprted by best available infrmatin, including bth western science and TK, the verall recvery gal f the Federal Caribu Recvery Strategy is t achieve self-sustaining lcal ppulatins in all breal caribu ranges thrughut their current distributin in Canada, t the extent pssible. The Strategy recgnizes that achievement f this gal fr ppulatins that are currently nt self-sustaining, as is the case with all Alberta caribu ppulatins, will require a cmbinatin f crdinated habitat restratin as well as ppulatin management actins. Wdland Caribu in Nrtheast Alberta Wdland caribu in nrtheast Alberta are currently nt self-sustaining. Ppulatins are declining rapidly and will likely disappear within the freseeable future if an integrated apprach that includes bth habitat cnservatin and restratin (ver the lng term) as well as ppulatin recvery (in the immediate term) is nt implemented quickly. In 2011, the GA established a Wdland Caribu Plicy 2 that prvides a framewrk fr range level planning in Alberta. Tw f the tls utlined in the plicy (caribu habitat restratin and predatr and prey management) are management levers fr which industry culd prvide sme expertise, research, and funding in supprt f Alberta s caribu recvery bjectives. In additin t already advancing sme innvative appraches fr habitat restratin effrts, the COSIA Land EPA is investigating appraches fr supprting caribu recvery with mre immediate effects, ne f which is a caribu fenced area. COSIA is prpsing t advance the cncept, thrugh the Caribu Recvery Pilt Prject, f a caribu fenced area t act as a bridge t enhance current caribu ppulatins fr the several decades required t restre and/r reclaim ld frest and frested-peat caribu habitat. Each f COSIA s caribu recvery prjects are intended t be cmplementary, aimed recvering caribu t self-sustaining ppulatins. Caribu Recvery Pilt Prject Gal: The desired utcme f a landscapescale fenced area fr caribu is t establish and maintain a viable breal wdland caribu lcal ppulatin that is currently declining and facing a high risk f extirpatin. Ideally, the fenced area will als prvide a surce f surplus animals t supplement ther wdland caribu lcal ppulatins. Ptential Pilt Prject Benefits COSIA has identified caribu fenced areas as an innvative, but untested ptin with great ptential benefits t caribu as a ppulatin recvery management ptin. Ptential benefits f the Pilt include: 1. Prvides a cntrlled envirnment t increase the prductivity f caribu within the fenced area and establish a viable ppulatin in a regin where ne des nt currently appear t exist. 2. Prvides a secure surce f breal-ectype caribu fr regular translcatin t augment declining ppulatins. Therefre, a single fenced area culd als increase caribu abundance utside the fenced area. 3. Prvides a cntrlled envirnment t test the feasibility f habitat restratin and ppulatin management ptins and t undertake research n cause-effect relatinships cntributing t caribu decline in the absence f predatin. If research becmes an imprtant bjective, replicate fenced areas with different treatments might be pursued. The Pilt will be designed t achieve ptential benefits, but n net harm t current caribu ppulatins. Thrugh engagement, additinal Pilt benefits may als be identified by Abriginal cmmunities and ther stakehlders. Page 4

58 PILOT PROJECT ABORIGINAL AND STAKEHOLDER ENGAGEMENT Engagement Overview While preliminary wrk suggests the Pilt is technically and eclgically feasible, the verall success f the Pilt will depend n engagement and cllabratin with Abriginal cmmunities and stakehlders n the ptential lcatin(s), design and peratin f the Pilt. Fr example: TK will infrm site selectin r ruting f the fence within a given site; abriginal cmmunity and stakehlder engagement will identity mitigatins and recmmendatins that will be included in management plans including fr access management, predatr and alternate prey management, animal husbandry and emergency respnse; engagement with il and gas tenure hlders may identify areas likely t be develped; and engagement with regulatrs will help determine the types f permits required. The abve wrk prducts will be prvided t the GA. The GA will determine if, when and hw the fenced area culd be implemented. By engaging and cllabrating with Abriginal cmmunities and ther interested parties, the Prject will: take int accunt and be respectful f the interests f participants (e.g., gvernment plans, tenures in and arund the prpsed fenced area and Abriginal and Treaty rights within and arund the prpsed fenced area); be infrmed by current and future Abriginal cmmunity and stakehlder activities t identify siting cnstraints and sensitivities; be infrmed by the TK f years f living n the land in ptential candidate areas; therefre, prviding enhanced site-specific infrmatin n the landscape and animals including such things as caribu habitat and use and animal mvements; be designed in cnsideratin f site-specific landscape and land user identified prs and cns (e.g., terrain cnstraints, seasnal animal mvements); be designed with supprting management plans and recmmendatins t ensure that bth Abriginal cmmunity and stakehlder sensitivities, cncerns and pprtunities have been identified and/ r addressed, hence increasing the likelihd f successful implementatin and peratin f the Prject nce handed ff t the Prvince; develp best practices infrmed by bth western science and TK; and be perated in a manner that is respectful f, and supprted by, interested and ptentially affected Abriginal cmmunities and stakehlders. Pilt Prject Abriginal Cmmunity and Stakehlder Engagement Gal: COSIA JIP members are cmmitted t wrking with Abriginal cmmunities and ther key stakehlders by keeping them infrmed and engaged during the first tw phases f the Caribu Recvery Pilt Prject. Building strng relatinships with stakehlders thrugh cllabratin and engagement is crucial fr the success f this Pilt and will result in enhanced prject decisins. Recmmendatins t the GA will als cmmunicate their respnsibility t, and the imprtance f, keeping stakehlders infrmed and meaningfully invlved thrughut all Pilt phases. As engagement is initiated and prgresses, this plan is intended t be flexible in its apprach t ensure that it allws Abriginal cmmunities and ther key stakehlders t nt nly identify interests and cncerns, but t be fine-tuned t best wrk fr effective participatin and cllabratin. IDENTIFIED STAKEHOLDERS Key Stakehlders Abriginal Cmmunities Abriginal cmmunities lcated in clse prximity and whse imprtant traditinal use areas encmpass ptential candidate areas have been identified as ptentially having a keen interest in the design and planning f the Pilt, particularly as it may relate t Abriginal and Treaty rights, caribu as a key cultural species, and pprtunities in implementatin. TK and cmmunity input will be imprtant t identifying ptential Pilt lcatins, identifying cncerns and sensitivities and develping management plans and recmmendatins fr implementatin. Page 6

Tenure hlder engagement will be imprtant t determine their develpment plans and willingness t participate in the Pilt. The nature f engagement with tenure hlders is currently being develped. Gvernment Agencies Engagement with gvernment agencies has been identified as being imprtant t cnfirm the Pilt s regulatry requirements, cnfirm the Pilt s cntributin tward prvincial and federal caribu recvery gals and bjectives and t cnfirm alignment with current land use in ptential candidate sites. The nature f engagement with gvernment agencies is currently being develped, and is expected t include, at a minimum, directin n regulatry prcess and updates n general range planning initiatives. Other Ptential Stakehlders Other ptential stakehlders include envirnmental grups, recreatinal grups, municipal gvernments as well as nn-tenure hlder industrial and cmmercial land users. As engagement prceeds ther stakehlder grups may be engaged, r at a minimum, prvided with Pilt prject prgress updates. Ultimately, it will be the respnsibility f the GA t frmally cnsult n the Pilt with all stakehlder grups prir t implementatin. 71 Regulatry Cntext Caribu and Land Management In a regulatry cntext, bth the federal and prvincial gvernments have vested interests in caribu recvery effrts under varius pieces f species at risk and land management legislatin and plicy. The federal gvernment is the respnsible authrity fr the prtectin and recvery f wdland caribu and the preservatin f, and ptential effects t, Abriginal and Treaty rights including but nt limited t the use f lands and resurces fr traditinal purpses. The prvincial gvernment is the respnsible authrity fr the management f lands, natural resurces and wildlife in Alberta. This includes implementing plans with respect t federal strategies when directed t d s by the federal gvernment as it the case with wdland caribu recvery. Bth the federal and prvincial gvernments have a duty t cnsider Abriginal treaty rights and cnsult with Abriginal cmmunities and grups in circumstances where an activity may have a negative impact n ptential r established rights. Within this cntext, and in expectatin that the Prvince will determine if, when, and hw the Prject may be implemented as part f the Nrtheast Wdland Caribu Range Plan, the prvincial gvernment, and t a lesser extent the federal gvernment, have been identified as key stakehlders t engage in the planning and design phases. Included in the planning and design f the Pilt is t cmpile all applicable regulatry applicatins in accrdance with federal and prvincial legislatin and plicy and in cllabratin with Abriginal cmmunities and ther key stakehlder grups. Management Plans and Recmmendatins As part f the planning and design phase f the Pilt, a number f management plans will be develped in cllabratin with Abriginal cmmunities and ther key stakehlders. These plans will detail the management apprach t imprtant aspects f the prject including cnstructin, peratins and maintenance, animal husbandry, predatr management, access management and emergency respnse. Additinal plans imprtant t the cnstructin, peratin and decmmissining f the Pilt may als be identified and develped thrugh engagement. In additin t management plans, the final package prvided t the GA will als include recmmendatins develped cllabratively t either supprt the management plans r prvide guidance fr future prject phases. 78 Caribu Recvery Pilt Prject Multi-party Prcess Caribu Recvery Pilt Prject Scpe The Caribu Recvery Pilt Prject is a Jint Industry Prject between CncPhillips Canada (Prject Lead), Devn, Nexen, Suncr and Statil Canada. The Pilt prpses t advance the cncept fr building a large fenced area, safe frm predatrs, that will prvide a cntrlled envirnment t increase the prductivity f caribu and establish a viable ppulatin. The scpe f this initiative includes: identifying a ptential lcatin(s) within the East Side Athabasca River r Cld Lake caribu range fr up t a 100 km 2 fenced area fr a breeding caribu ppulatin; develping a detailed fence design fr the ptential lcatin(s); and develping supprting management plans and recmmendatins fr the implementatin f the Pilt, estimated t be in place fr apprximately 10 years with the ptential t cntinue r expand if successful. The Pilt cncept is being advanced by the Caribu Recvery Pilt Prject industry partners and develped cllabratively with Abriginal cmmunities. COSIA is advancing the cncept, thrugh the Caribu Recvery Pilt Prject, f a caribu fenced area t act as a bridge t enhance current caribu ppulatins fr the several decades required t restre and/r reclaim caribu habitat. Each f COSIA s caribu recvery prjects are intended t be cmplementary and aimed at recvering caribu t self-sustaining ppulatins. Preliminary wrk cnducted t advance the Pilt has been nging thrugh COSIA since This wrk prvided an understanding f the technical and ecnmic feasibility t mve the Pilt frward. Imprtant t mving frward with the Pilt has and cntinues t be engagement with Abriginal cmmunities and key stakehlders t determine if there is interest in the Prject. In Octber 2016, Abriginal cmmunities were engaged based n prximity t ptential prject siting in the East Side Athabasca River r Cld Lake caribu ranges and interest in the Prject. Engagement was als guided by the Abriginal Cnsultatin Office and current reginal best practices. In all, twenty First Natin and Métis grups were identified; nine grups were in clse prximity with a ptentially high level f interest and three additinal grups identified in mre distant prximity but ptentially having high t mderate interest in the Prject. Initial engagement resulted in nine f these twelve grups mving frward int the multi-party engagement prcess t cllabrate n the detailed planning f the Prject including prject lcatin, design and planning 1.
