T00-0 FOR DOUBLE AND SINGLE SURFACE TREATMENT APPLICATION IN THE MUNICIPALITY OF SIOUX LOOKOUT Tenders are invited for the supply and application of approximately,000 kilograms of HF- 0S EMULSION and 0 tonnes of CLASS II AGGREGATE SURFACE TREATMENT on various roads within the Municipality of Sioux Lookout. Contract Completion Date: NO LATER THAN SEPTEMBER, 0. Sealed Tenders clearly marked Surface Treatment Application Request for Tender No. T00 0 will be received by The Corporation of the Municipality of Sioux Lookout ( the Municipality ) up to but not later than: :00 a.m., Thursday, April, 0 After which Tenders will be opened at :00 p.m., Thursday, April, 0 in Council Chambers at the Municipal Office, Fifth Ave. Sioux Lookout ON. Late submissions will be returned unopened. Certain Tender Forms ( Tender Forms ) are required to be submitted with the Request for Tender (RFT). Please submit such completed RFT to: Brian P. The Municipality reserves the right to reject any or all Tenders, to waive irregularities and informalities therein, and to award the contract in the best interest of the Municipality in its sole and unfettered discretion. Bidders are also advised that revisions to the scope of the work may be required to conform to set budget limits.

4 The Corporation of the Municipality of Sioux Lookout REQUEST FOR TENDER No. T SURFACE TREATMENT APPLICATION. SCOPE OF WORK TENDER SPECIFICATIONS The roads to be treated with single and double surface treatment are listed in the "Roads Requiring Surface Treatment" section of this Tender document. The "Materials and Itemized Bid" table must be used by all bidders for submission of Tender prices along with the Contractor's Certification Page.. BASIS OF REJECTION OF TENDER Tenders may be rejected for any of the following reasons: - Bids received after the closing date and time. - Bids received on other than the Tender form supplied. - Bids not completed in ink or by typewriter. - Incomplete bids. - Qualified or conditional bids. - Bids not properly signed. - Bids received by fax. TENDER DEPOSIT If the Bidder has completed contract work for the Municipality within the last Three () years, a deposit will not be required. If the Bidder has not completed contract work for the Municipality within the last three () years, a certified cheque made payable to the Municipality in the amount of 0% of the total Tender must be submitted with the Tender. The cheques accompanying the unsuccessful Tenders will be returned to the Contractors within ten (0) days of the Tender opening. If the successful Bidder is required to submit a deposit, they may also choose to file with the Municipality a completed performance bond signed and sealed by a recognized bonding company in the amount of 00% of the total estimated Tender. Upon receipt of the performance bond, the cheque submitted with the Tender will be returned.. LIABILITY INSURANCE The Contractor shall take out and keep in force until the date of acceptance of the entire work by the Municipality a comprehensive policy of public liability and property damage insurance acceptable to the Municipality, providing insurance coverage in respect of any one accident to the limit of at least $,000, exclusive of interest and cost, against loss or damage resulting from bodily injury to or death of one or more persons, and loss of or damage to property, and such policy

5 shall name the Municipality as an additional insured thereunder and shall protect the Municipality against all claims for all damage or injury including death to any person or any persons and for any damage to any property of the Municipality or any other public or private property resulting from or arising out of any act or omission on the part of the Contractor or any of his servants or agents during the execution of the contract and the Contractor shall forward a certified copy of insurance, including company name and policy number, to the Municipality before the work is started.. WORKPLACE SAFETY AND INSURANCE BOARD COVERAGE Prior to commencing the work, the Contractor shall provide a certificate of clearance from the Workplace Safety and Insurance Board.. INDEMNIFICATION The Contractor shall indemnify and hold harmless the Municipality, its elected officials, officers, partners, agents, and employees from and against all claims, actions, demands and expenses arising out of any matter in relation to the Contractor or the Contractor's employees performance or nonperformance of the contract, including but not limited to any such claims, actions, demands and expenses resulting from the failure to exercise the reasonable care, skill, and diligence expected of the Contractor in the performance of the work. The Contractor shall also be responsible for any costs or damages arising from actions, errors and omissions of any expert professionals or consultants retained by the Contractor, or its agents or employees in the course of conducting the work for the Municipality.. HARMONIZED SALES TAX (HST) COMPLIANCE The successful Contractor shall also deliver proof of HST compliance, if applicable, prior to the starting date of the project.. COMPLIANCE WITH OCCUPATIONAL HEALTH AND SAFETY It is the responsibility of the Contractor to comply fully with Occupational Health and Safety Act standards.. MUNCIPAL REPRESENTATION All work will be inspected and accepted prior to payment by the Public Works Manager or a designate appointed by the Public Works Manager. 0. SURFACE TREATMENT For the roads specified for double surface treatment application, the work shall include the final preparation of the granular road base, including the dampening of the road base, fine grading and compaction prior to the application of double surface treatment. The double surface treatment shall include the supply of HS 0S emulsion and Class aggregates. The Municipality will ensure

6 that all roads scheduled for double surface treatment application will be stripped of existing surfacing material and rough graded (shaped) prior to the Contractor performing the work. For the roads specified for single surface treatment application (double surface treatment was applied last year), the Municipality will ensure that all existing roads surfaces are repaired and cleaned prior to single surface treatment application. The single surface treatment shall include the supply of HS 0S emulsion and Class aggregates. The Contractor shall be responsible for determining the application rates for both the emulsion and the aggregate, and must provide the rates to the Municipality in writing prior to starting the work. All work shall be done in accordance with OPSS 0, revision date November 0, and all OPSS documentation referenced within OPSS 0 shall be included. Any work conducted outside the parameters specified in OPSS 0 shall be restored to the Municipality s specifications at no cost to the Municipality.. BASIS OF PAYMENT Payment at the Contract price shall be full compensation for performing the work specified in the Tender document including the supply of all labour, equipment and materials necessary to complete the work. This work will include the dampening of the road base, fine grading and compaction of the road base prior to the initial binder application. Measurement of surface treatment for payment shall be in square meters (m ). Payment at the Contract rate shall also include all mobilization and demobilization efforts required.. TERMS OF PAYMENT Payment will be made in response to the Contractor's invoice and when all work has been completed to the satisfaction of the Public Works Manger. Payment to the Contractor will be verified from measurements taken and recorded by the Municipality. The Contractor will be required to enter into an Agreement with the Municipality for the required work; the Agreement will be a Unit Price Contract as per CCDC. As per CCDC Unit Price Contract, the Municipality shall retain a holdback payment of 0% of the total invoiced amount. Release of holdback shall be made after forty -five () days of work completion, subject to the provisions of the Construction Lien Act RSO 0 and the submission of a statutory declaration that all accounts, assessments and levies in connection with the work under the contract have been paid and that no claims, liens or encumbrances exist.

7 . TRAFFIC CONTROL The Contractor shall be responsible for the control of vehicular traffic during the progress of surface treatment application as per the Ontario Traffic Manual, Book. In addition, while performing the work, the Contractor will inform the Municipality on a daily basis of the intended work plan for the day so that emergency services can be notified of work locations.. LOADING OF MOTOR VEHICLES Where a vehicle is hauling material for use on the work under the contract, in whole or in part upon a public highway, and where motor vehicle registration is required for such vehicle, the Contactor shall not cause or permit such vehicle to be loaded beyond the legal limit as specified in the Highway Traffic Motor Act whether such vehicles are registered in the name of the Contractor or otherwise.. DAMAGE BY VEHICLES AND OTHER EQUIPMENT If, at any time in the opinion of the Public Works manager, damage is being done or is likely to be done to any highway or any improvement thereon, other than such portions as are part of the work, by the Contractor s vehicles or other equipment whether licensed or unlicensed, the Contractor shall, on the direction of the Public Works Manager, and at the Contractor s own expense make changes in or substitutions for such vehicles or other equipment or shall alter loadings or shall in some other manner, remove the cause of such damage to the satisfaction of the Public Works Manager.. COMPLETION DATE All work forming part of this Tender shall be completed no later than September, 0.

T SURFACE TREATMENT APPLICATION CONTRACTOR S CERTIFICATION The undersigned has examined the specifications and the location of the work described herein and is fully informed as to the nature of the work and the conditions relating to its performance, and understands the quantities shown here are approximate only and are subject to increase or decrease by the Municipality without alteration of the Unit Price. The undersigned hereby proposes to furnish all necessary machinery, tools, labour and equipment to complete the work specified herein.
