3 Foreword The government has developed a National Forestry Plan (RKTN) , a macro indicative planning framework used as a reference for infrastructure plan, investment, and other businesses that are integrated in different geographic scales, timelines, and forestry functions. In reality, however, there is a discrepancy between what has been incorporated in the RKTN and the actual conditions. This will consequently delay the infrastructure development or business investments, of which many parties will incur losses. At the same time, this also raises concerns on the sustainability of the environment. Therefore, in developing infrastructure or other investment activities in forest area, the application for borrow-to-use forestry permit (IPPKH) and forest status alteration is crucial. Although the procedures of application submission for IPPKH and forest status alteration are clearly regulated, the investors still encounter different degrees of obstacles throughout the process. Based on the collected case studies, the required timelines to complete the process investors. This investor guideline is developed as a reference for relevant stakeholders to accelerate the process of obtaining approval for forest status alteration, by providing comprehensive information to investors regarding the procedure of forest status alteration, case studies for partial and provincial forest alteration, as well as the key lessons learned. By applying the lessons learned documented in this investor guideline, the investors can expect to apply an effective acceleration mechanism thus minimize costly missteps in the preparation stage of investment implementation. According to the Law No. 41 of 1999 on Forestry, forest status alteration falls under the jurisdiction of the Ministry of Forestry (MoFe) whilst non-forest areas fall under jurisdiction of the local district government (provincial and regency/city). 1.2 FOREST CLASSIFICATION AND FUNCTION Indonesia s forests cover 60% of the country s total land area, making it the third country to have the largest forest area in the world. Indonesia s forests are important both for local livelihoods and for the national and regional economy. 13 CHAPTER 5 Case Studies CHAPTER 6 Key Lessons Learned CHAPTER 7 Useful Contacts In Indonesia 2.1 NATIONAL FORESTRY PLAN (RENCANA KEHUTANAN TINGKAT NASIONAL, RKTN) Based on Ministerial Regulation P. 49/Menhut-II/2011, the government of Indonesia has developed a National Forestry Plan (Rencana Kehutanan Tingkat Nasional, RKTN) for the period The RKTN is a macro indicative planning framework used as a reference to construct infrastructure, investment, and business in different geographic scales, timelines, and principles of forestry areas. It is intended that the establishment of RKTN can result in a well-planned and structured institutional transformation for the sustainability of the forests. Almost all provinces are revising their spatial planning, which includes designation of production forests for other development purposes. RKTN is intended to provide direction for forest management through a sustainable and fair use of forest resources, multifunctional potential of forests for society, as well as provincial, and regional levels by This will be based on the principle of optimization and stabilization of forest areas, improvement of productivity and value of forest resources, community participation in forest management, forestry research and technology institutions, as well as optimization of the comparative advantages of Indonesian forestry. As a national indicative planning instrument, RKTN has 6 criteria for macro spatial functions:(1) conservation areas;(2) protection areas of natural forests and peat lands;(3) rehabilitation areas;(4) areas for large-scale forest management;(5) areas for small-scale forest management; and (6) non-forest areas. Table 4 provides all of the 6 criteria of macro spatial functions. Table 4. Utilization To be utilized for conservation of forest resources while considering the economic, social and environmental aspects as well as the utilization, protection and preservation aspects. 2 Protection area of natural forests and peat lands Protected forests with primary, secondary, and mangrove forest cover. Protected forests and production forests, which are peat land areas with depth of 2 meter or above and no existing forest permit holders. Utilization To be utilized for small-scale forest management (community) with various schemes (HTR, HKm, HD). In this area, community can increase their roles and accesses to the forest resources. 6 Non-forest area Convertible production forests with forest cover of primary forest and secondary forest, more than 2 meters of non-peat land area, and without forest permit holders. 15 CHAPTER 5 Case Studies CHAPTER 6 Key Lessons Learned CHAPTER 7 Useful Contacts In Indonesia Forecast Analysis of Forest Area (Utilization Plan) in 2030 The Ministry of Forestry has forecasted the forest area utilization plan in 2030 by taking into account the increased needs of forests for non-forestry sectors (transmigration, plantation, agriculture, etc.), community forests, and provision of residential land. The total forest area that is going to be converted to non-forest area is expected to reach million Ha. As a result forest area that can be managed and utilized effectively are million Ha or 85% of all existing forest areas, as illustrated in Table 6. Spatial Function Table 6. Consequently, it requires the project owner to either obtain a Borrow-to-Use Forest Permit (Izin Pinjam Pakai Kawasan Hutan, IPPKH) or approval for forest status alteration from the Ministry of Forestry. This investor guideline focuses on the second scope, which is forest status alteration. In Indonesia, the forest status alteration involves three interrelated laws: Law 26/2007 on Spatial Planning, Law 32/2009 on Environmental Protection and Management, and Law 41/1999 on Forestry. Spatial planning refers to how the government manages the distribution of population and activities in spaces of various scales including forest area. Effective spatial planning will have an impact on the economic growth and development of the country. At the same time, every activities needs to take into account environmental protection and management so as to prevent environmental damage. Therefore activities in the forest area requiring alteration of forest status must be properly managed to maintain forest sustainability. Figure 1 provides a list of laws and regulations that are related to the forest status alteration process, organized in a descending order based on their hierarchies. The contents of the laws and regulations will be elaborated in Chapter 2 and Chapter 3 respectively. 18 CHAPTER 1 Introduction CHAPTER 2 National Forestry Plan (RKTN) CHAPTER 3 Indonesian Forest Status Alteration Policies CHAPTER 4 Changing Legal Status Of Forest 3.2 LAW NO. 26/2007 ON SPATIAL PLANNING Based on Law No. 26/2007 on Spatial Planning, there are three levels of spatial plans based on administrative areas and these are prepared in the following order: national, provincial and regency/city level. All of the spatial plans have to refer to the spatial plan(s) of higher hierarchies. For example, provincial spatial plans have to refer to the national spatial plan whilst regency/city spatial plans have to refer to both national and provincial spatial plans. Spatial plans are valid for 20 years and should be reviewed every 5 years. The national spatial plan was made and enacted through Government Regulation No. 26/2008. Law No. 26/2007 Article 3-5 states that there is a need to adjust spatial planning for all provinces in Indonesia to realize a safe, comfortable, productive and sustainable national spatial plan based on archipelago and national security. One of the main functions of spatial planning by region concerning conservation areas and cultivation areas, where the conservation area includes conservation forest, peat lands and watershed area (Daerah Aliran Sungai, DAS), while the cultivation area includes production forest and community forest area. In particular, Article 78 paragraph (4) states that: : a. Government Regulation on National Spatial Planning should be adjusted not later than 1 year 6 months after this law is enforced. b. All provincial regulations on Provincial Spatial Planning should be prepared and adjusted not later than 2 years after this law is enforced. c. All regency/city regulation on Regency/City Spatial Planning should be adjusted not later than 3 years after the law is enforced. Currently, most provinces in Indonesia are in the process of adjusting spatial planning, and proposing forest status alteration that follows the procedure outlined in the Law 41/1999. Any approval on forest status alteration has to be integrated in the provincial spatial planning 3.3 LAW NO. 32/2009 ON ENVIRONMENTAL PROTECTION AND MANAGEMENT Every activity within forest area essentially has to take into account the principle of environmental protection and management so as to be in line with sustainable development. In achieving a more sustainable development, government and project owner are obligated to conduct the environmental management and protection as stipulated in the Law No. 32/2009. Among the instrument for prevention of environmental destruction are spatial planning, strategic environmental assessment (Kajian Lingkungan Hidup Strategis/KLHS), environmental permit, etc. Based on the article 19 of the Law No. 32/2009, every region s spatial planning has to based on the strategic environmental assessment or KLHS. KLHS is developed to ensure that sustainable development is used as the fundamental principle and being integrated into the region s development. Since forest status alteration is correlated with the adjustment of spatial planning, the strategic environmental assessment is key instrument in the development or evaluation of existing spatial planning. 3.4 LAW NO. 41/1999 ON FORESTRY In relation to the proposed forest alteration for the adjustment of provincial spatial planning, it should go through a process regulated in Law No. 41/1999 on Forestry. In particular, Article 19 states that: 1. The forest area can be altered for other purpose and function in order to maintain the balance of environmental, social, cultural and economic forest purpose and function shall be determined by the Government based on the assessment result of integrated and technical teams. 2. Provisions on procedures of alteration for forest purpose and function as referred in paragraph (1) and (2) are regulated by the government regulation. As the implementation of Article 19, Government Regulation No. 10/2010 has been established on Procedures for the Alteration of Forest Purpose and Function, as amended by Government Regulation No. 60/2012 on Amendment of Government Regulation No. 10/2010. According to this regulation, the forest area is an area that is stipulated by the Ministry of Forestry, whereas to ensure its legality, the regulation establishes a fourstep process that the MoFe must follow in designating forest areas. The four-step process entails designation of forest areas, boundary determination of the forest areas, mapping of the forest areas, and stipulation of the forest areas. Good communication between the project owner, local government and the Ministry of Forestry is required prior to the start of project implementation. This is required to gain a better understanding of the process of forest alteration, establish trust and maintain a good ii. iii. iv.. The applicant needs to have a strong commitment incompleting the process. This can be shown by displaying initiatives in preparing required documents and replacement area.. During the process, the applicant is obliged to bear all the costs related to providing replacement area, land boundary determination, inventory fees, and facilitation of the integrated alteration process. Therefore, the applicant particularly for applicants from local government to allocate the amount in the regional budget (APBD).. For exchange of forest mechanism, providing a replacement area is one of the obligations the applicant needs to particularly for areas within Java Island. This is due to most of the lands have already been occupied by communities, requiring the applicant to offer a compensation fee in acquiring the land. Sometimes, the land acquisition process resolution process is time-consuming and needs is recommended that applicant has obtained the in-principle agreement from the Entitled Party to proceed with the compensation arrangements. As such, when the Ministry of Forestry approves the designation of the area as the replacement area, the compensation arrangement can be quickly completed v.. The applicant needs to ensure that the documents and requirements are consuming process of revision and re-submission. It is often the case that the applicant lacks good preparation of the documents. Therefore, it is crucial that the applicant be proactive in obtaining the most updated information on the required documents from the Ministry of Forestry. vi. Uncertainty over the process continuity For example, location permit approved by the previous Regent is not recognized or extended by the new Regent for no clear reason. It is best for the applicant to ensure that there is sustainable support from the government. vii. Regulations. Sudden changes in the government regulation can potentially delay the process, such as the Presidential Instruction No.10/2011 on the Improving the Governance of Primary Natural Forest and Peat Lands. Due to the issuance of this regulation, the Ministry of Forestry was instructed to postpone all the applications on the Issuance of Primary Forests. 6.2 PROVINCIAL FOREST ALTERATION i.. The applicant needs to have a strong commitment to process completion. This solutions when the application faces a bottleneck issue. ii. iii. iv..
